How long do u think we will recive a 1st NOA,, we are married for almost 2 years and we already had a son..

Well, I'm getting all of my documents together and once I get signed papers back from my fiancee in the Philippines I'll be sending my package in to the Nebraska Service Center since I live in Washington State. Yes I will begin a timeline when I do that. I noticed there is no timeline for the I-129F when I click the processing times. Just straight timelines for I-129. I'm sure it's probably similar to the other service centers but was just curious why no timelines are posted for I-129F in Nebraska Service Center. If you know, great. If not your humble opinion would be appreciated.

All I-129F petitions go through California or Vermont--they no longer go through either Nebraska or Texas (that's why there is no timeline posted for that service center). If you read through the I-129F application, it will tell you exactly where to send your petition. Good luck!


Uh-oh I must have a dated form. I shall check that out. I had a feeling something wasn't quite right when I saw many posts regarding California/Vermont processing times. I'll download the latest forms. Thank you so much for letting me know! Best wishes and good luck.

hello there...I'd just like to ask some infos.
My husband filed an I130 petition last year Nov. 2009 and was approved Sep. 2010.
In October, he was sent the AOS invoice and paid it thru money order,and I the beneficiary was sent the Choice of agent form. After filling it up, I mailed it to my husband so mail will be much faster. My husband said he mailed both the AOS and COA at the same time. its now Dec 2010 and there's still no news whether the NVC office has received any of the two, the AOS payment and my Choice of Agent form. I e-mailed NVC's inquiry line and there's still no response from them. This is really heart breaking for me and the kids because we've been wanting to be reunited. They've been making plans already on where to go :(
Does anybody here have any suggestions on what we should do. Response to this will be highly appreciated.

I think your GC is fine as it is because the visa was issued before your hubby became USC. 

 

thanks apple21. my interview was on march 6, 2014 (visa issued the same day) and he was sworn in as a citizen on march 28, 2014. my poe was april 5, 2014. I called the uscis number. she told me to schedule an appointment with the local uscis office to inquire. Am still confused.

I got a 10 year green card under F21 category. (My marriage date is 29th December 2011 and POE is 5th April 2014). So its more than 2 years. However, my husband became a citizen after my interview and before my POE. Should my category change or should it be F21 only since we never upgraded our petition?

Our K1-visa went really fast. We got the interview, his approval, his biometrics, his combo card within one year. At that time, the processing times for the green card showed about a 4 month waiting period. We got the combo card and social security card in August of 2012. We have heard NOTHING since and the processing times for AOS I-485 show estimated 18 months' waiting. We will need to apply for an extension on the combo card and his passport will need to be renewed in 2014. Is there any reason for this big jump from a 4 month waiting period until an 18 month? Has there been an influx of applications for AOS?

Its determined by the number of years married at the time of POE (your first entry to the US).

 

If you entered the US using your F2A visa and you are already married 2 years or more, you'll get a 10-yr GC.

 

If you entered the US using your F2A visa and you are LESS than 2 years married, you'll get a 2-yr conditional GC.

 

This also applies to spouses of US citizens.

That's really intresting I have never heard about this law before. I though I'll get 10 year GC.

 

At the time of my F2A interview we were married for 26 months. So what kind of GC should I need to get ?

 

2 year conditional or 10 years without conditional

On Monday 10/18/2010 the CSC was listed as processing second K1 notices as of July 18, 201?. Today they are listed on this site as processing second K1 notices as of June 25, 2010. How can this be? It makes any realistic planning impossible.

Not sure. I hope the notice does not mean another round of biometrics notice. There is no "approval notice" since she is already approved from a GC perspective (like AOS).  I received a similar notice response from USCIS to my Congresswoman's office when my PD was current years back under EB2 and that time it was an approval notice and it was AOS as well.

 

What type of biometrics did she do the 1st time?

I had code 3 at my first appointment. By oct 16, according to IO, I should now if my appointment was done in error or if it is really required...

I did and they open a service request with NBC as even the L2 support IO couldn't tell if this was legit or done in error. According to the IO this was a request for picture only but couldn't tell much from the notice.

 

Apple21 - did you receive the notification letter yet? Is it for fingerprint + picture or just picture or smth else? 

 

I already have the letter on-hand.  It doesn't say if its for fingerprint and/or picture.  When I did my 1st biometrics, they took my fingerprint and photo.

 

The only difference I see is:

 

-  on the 1st biometrics letter (on the upper right hand part, under Notice Date) it says CODE 2

-  on the 2nd biometrics letter it says CODE 3

My congressman is up for election this Nov 4th. So if he does not win then i have to start all over again with the new person and not sure if they will all be up and running by then with respect to helping with these things.  :)

Update from Congressman's office. 

 

I have received a response from the United States Citizenship and Immigration Service regarding the inquiry I made on your behalf.

According to my liaison, "A review of our systems shows Case XXXXXXXXXX, Form I-90, A# XXXXXXXXXXX, DOB XXXXXXXX filed by Ms. XXXXXXXXXXX was received on 7/16/14. USCIS received XXXXXXXXX biometrics on 8/25/14 and her case is currently on the floor awaiting to be assigned to an officer for further review and adjudication. If Ms. XXXXXXXXXX has not received notice in 30 days please follow up with another inquiry."

 

I have no idea what this received notice means. Sending another email to the immigration contact.

 Hello,  Not sure if anyone has any info. or can help me out. I petitioned for my husband 2 years back. He was given a 2 yr gc because we were married less than 2 yrs. We reapplied to remove the conditions from his gc. Everything went good and received his 10yr card. However, his last name on the card was spelled wrong. We were told to submit an I90 with supporting documents to show that the error was NOT our fault. So we did. He received an appointment letter to redo his biometric. His appointment was on 09/18/14. We have not heard anything since. Does anyone know how long it is taking to hear back from them? How long are they taking to resend a card?

 

 

Takes about 5-6 months for them re-send the correct card.

The Immigration contact at my congressman's office just mailed me on Friday asking if everything was OK with immigration (Election time i guess :-))  and i replied back to her with the mess that USCIS had created with GC. She told me she will check with USCIS on my case and get back soon and for checking with USCIS she told me it generally takes  about 15-20 days for them to respond. 

 

Lets see how that goes.

Biometrics Codes

Normally, an ASC Biometrics Notice would contain (in the top right area), a field named ?Code.?    The ?Code? field is intended to indicate the type of biometrics processing to be performed.  The possible values are:

  • Code 1 ? fingerprinting only (10 prints);
  • Code 2 ? biometrics (photo, signature and index finger);
  • Code 3 ? fingerprints (10 prints) and biometrics (photo, signature and index finger).

USCIS has indicated that the applicable code for each biometrics appointment is determined based on the type of an application and certain relevant case factors.

Its an unnecessary delay to entire process

 

What does fingerprints (10 prints) mean? If its taking the print on all your fingers from both hands, wouldn't they have it from POE or from the consulate where the applicant went for the interview or even from the VAC center from their home country?

My wife's Biometric notice has Code 2 in it and was done on Aug 25th. What a mess!

Today went to the infopass appointment where I stamped my passport for another year. the IO mention that C21 is no where mentioned in the system and even if I didn't file to correct the problem I would never had a problem later. And the fact that C21 is not mentioned in the system makes this case an unusual one for USCIS IOs and confusing. He agreed that what I'm doing is the right thing, at least from moral perspective, but wasn't necessary. 
 
Anyway, he gave another year in my passport and hand-wrote the category as C21 but mentioned that he can't change that in the system, only the service center supervisor can. Was bizarre to him that USCIS might have lost my original GC. 
 
Also today the online status changed from Case Reopened to Request for Evidence Response Review. They received my response on Sept 30 and they only opened the envelope today...
