There's been some new word about authentication of divorce decree,

where

the USA divorce decree is authenticated by the China Embassy/Consulates in the USA,

then

the entire document set will be recognized by the province marriage bureau in her province in China.

 

I read it on the Houston China Consulate website last year, sorry, no link.

the instructions are a bit wrong.

she can pay the fee prior to interview, bring in the receipt.
She'll need to do a DS-260 online now.

Since the I-864 intake will be done at the IV Unit, there is no AOS fee, 88 bucks, for this. If you did I-864 intake at NVC, there'd be that fee for 88 bucks.

She'll need a medical exam as well, so you'll need to make sure she has something official looking with the MNL casefile # on it or the medicos will turn her away.

She'll bring in the confirmation page of the DS-260 filing AND her payment receipt AND her civil docs AND your I-864 stuff for the interview.

no such thing, after interview date.

however, the I-129F petition might get re-affirmed back at USCIS, who will in turn shift it back to the IV Unit via NVC, so if the I-129F petition is re-affirmed, then you've a shot.

That takes time, figure 8 to 14 months before the next interview. Your petitioner could file a new petition tomorrow, instead.

I am the petittioner and I plan on refiling  the K1. I was denied because the CO wasn't  100% sure we were real. I am hoping that our chances of passing the next interview go up as we will have another years evidence. I know people are suggesting i take it slow buti love her and we want to be together.

I was answering firstly, 'Could I file an appeal?' question.  There's no such thing as an appeal after the interview timetick.

you are using the label of 'appeal process' erroneously - there's no such thing.

One can submit a rebuttal to a notice of intent to deny/revoke - that's not an appeal.

2. check ceac.state.gov for visa status - when it flips to ISSUED on status - expect another week before it leaves the IV Unit .

apologies, after rereading your post, I understand you've not had the interview yet.

When you are at the interview, tell the Vice-Consul, USCitizen worker, that you need to stay in Hong Kong and wait for the visa packet, and you need to make arrangements, get a slip, to enter the IV Unit again to retrieve the visa packet, and could you please process the visa packet immediately, expedite, for same day pickup?

Current year income making and exceeding even the 125% income guidelines was not considered acceptable for the I-134 when LAST year's income was below guidelines.


The totality of the I-134 supporting documents are what is adjudicated on interview day.
You missed out on prior year tax data, and the IV unit 'dinged' you for it.

To anyone else reading this - this is normal behavior by all IV Units worldwide, given this exact situation.

This stuff can be overcome on interview day if (pick 1) the petitioner either:
1. shows adequate assets or
2. submits the co-sponser/joint-sponser paperwork.

It's nice this IV Unit decided to give you more time to submit stuff on a joint-sponser.

You'll have similar stuff when you file AOS, but a tax year will have transpired, so in 2014 you'll have income for that job in 2013, a tax return proving it, plus the current annual income in 2014 - so I'm thinking you won't need a joint sponser when filing AOS later.

No FrontLoading for you, alas. Wrong word.. Not nitpicking, but it's done at the very first step (file a petition) not the very last step (have an interview)

However - She can bring the pile with her, carefully indexed for her instantaneous retrieval (she gets almost 0 time to 'find something' in her file at the window, btw)

As for 'the list of what to bring' - it's covered here at VJ in the China forum.

i suggest major folders, with the follow breakdown:

--photos
--evolution of relationship letter (a new one, current)
--chat logs, chat copies
--collection of relationship evidence:
a. phone bills
b. postal stuff you sent to her
c. copies of travel receipts (airline, hotel, meals, amusements)
d. emails

So that'll be 4 major folders, one with just the EOR letter.
Make sure the photos are not in some photo book - there's about 1 and 1/2 inch of slot to pass anything through - most photo books are thicker than that, and do not bend easily.

there are two paths when the uscitizen is an expat, for domicile:
1. prove up existing USA domicile or
2. prove up intent to re-establish domicile

for either one, it scans like she not provide enough proof. #2 is easier than #1, for most people.

Still, she has some time to submit proof of intent to re-establish domicile. There's other posts here on doing just that, please to find them - search terms 'domicile overseas establish' in the advanced search tool, upper right corner.

NVC doesn't have your petition because it hasn't been sent out by USCIS yet. 

 

as to fees at NVC, there's none for a K-1 visa chaser - the fees are collected in that country instead. 

 

If you review the K-1 visa flowchart in the guides section here, note you've jumped a bit . 

 

Will the casefile catch up to the IV Unit by interview day?  Hard to forecast.

if he paid the fee for the I-864, then he possibly downloaded and printed the coversheet , and sent off the I-864 pack into nvc.

re: DS-230 payment (IV FEE PAYMENT) - it's available to be paid, at the online web portal, once the DS-3032 is added to the casefile. There's a coversheet here, as well, for him to download and print.

ask yer Dad to call in to NVC, and ask for casefile status, asking which things have been added to the casefile already.

usually, about 5 days after the I-864 is added to the casefile (and reviewed) a checklist letter is emailed out to your Dad, referencing the IV Set (DS-230 + civil docs). Usually. If he did not give over email addresses early on, then NVC not email him anything, relying instead on postal notifications. Postal notifications are batched up, sent out from NVC, but it's not a 'timely' thing, at all.
