Just an update as we have not had a chance to get on the internet until now. PW, Visa delivered Makati Feb 27th (7days). CFO clearance Feb 28th AM, flight to Tucson Feb 28th pm. Mira and I just arrived in our home, thanks to god. POE LAX, no problems. Going to do laundry now, hehehehehe.

Hi! This is Jinky! :D We arrived in LAX, Friday, March 2nd and made it through immigration after about 30 minutes. The immigration officer looked very strict and he asked me where is Job's father. I asked him to repeat himself and then he asked if I was married to Job's father. So I just answered him, NO. Before I left, he told me if I don't want to get married that I can always go back to the Philippines...bwahahahaha. He only looked strict but he was okay - he even said, Welcome. So, after that we got our luggage. They didn't even ask for the x-rays.

I'm with my Steven now and he took us to an asian market on Saturday where I found so many home products - kangkong, calderita mix, chicken feet, and Filipino foods. I even bought Datu Puti vinegar...hehehe.

At the back of our churches weekly announcements, I found 3 Filipino dentists in our area. The church we go to has a community of Filipino's and Vietnamese.

I'll keep you all updated to a new life here!

Thanks for all the well wishes! We are doing great here. I was laid off from my job last Thursday so it's been a mixed blessing - I'm able to spend all this time with Jinky and Job, but I'm also a bit eager to land my next job. I won't be able to post on VJ as often as before but I'll try to pop in as much as possible and definitely keep everyone updated.

To all the recent approvals - a big congratulations! :star: Just know that you'll soon be together! It's really been soooo good to be together! No more having to call on the phone and try to express in words the love you have for each other. My fiancee received instruction not to open the package when they delivered the visa? Is this correct?

When was she able to open the package?

Will the package be open during the CFO class?

How did she confirm that the information on the visa is correct?

Tell your fiancee...

DON'T OPEN THE PACKAGE...PERIOD! It's a sealed envelope that immigration takes at her POE. CFO has nothing to do with it. This is explained during the interview process at the embassy.

friends, i badly need ur help about DS-156 form , i mean my interview will be on march 12, the embassy sent me packet 4 already including the forms that i need to submit on the interview however, i tried browsing the US embassy manila site it says there that DS-156 will be filled-up online starting nov 2006, i mean what do i need to do about it? do i have to fill up DS-156 online or ill just used handwritten form? thanks alot... ur reply is a huge help for me..



My fiancee's interview was Feb. 16th and she told me that the embassy at that time was accepting the forms either way. I would highly recommend you fill it out online, though. When you do, it doesn't keep a record of it - all it does is print out a barcode at the bottom of the page. For example, Jinky had to redo her son's DS-156 about 3 times due to errors and she just threw away the old one as she made a new one with the corrections needed. If you just can't fill it out online, then I would stress about it too much.

Hello all... we were approved yesterday :)
I think lol... The consul never said "your approved" my fiancee keeps telling me to relax lol...
She said she did see him put a pink slip in her folder and was instructed to just go pay her delbros fee. I am assuming thats a yes :)
How long does delbros usally take to deliver? She lives in Zamboanga city.
I was suprised at how fast the embassy was she was out before lunch :)

Jinky had her interview on Friday (16th) and received her visa from Delbros yesterday (her Wednesday, 21st)! It was quite fast considering Monday was a holiday. She had it delivered to her in Cebu.

My husband and I are waiting for a rescheduled interview with the Santiago embassy ( haven't heard anything but we are hopeful), but infortunately I have to go back to the states. I am wondering if it is recommended that I return for his interview with the embassy.

Also, I have seen a lot of differnt posts about providing proof of relationship for the embassy, but the Santiago embassy did not mention this to me at all, nor did my lawyer. Is it recommended that my husband come prepared with this at the interview, and if so, what kind of evidence are they looking for?

You'll have to a little searching on this site, but you'll find invaluable information on everything you need to know.

With regard to proof of relationship - photos of the both of you together, hotel receipts, boarding passes, phone bills, emails, letters, etc. As to how much - you'll need to decide that for yourself. Just keep in mind you're providing proof that the relationship is valid and ongoing.

She's already had the interview and has been approved? I'd call the embassy up, get the name of the person you speak with and get them to make sure to correct the date.

:crying: Unfortunately my fiancee was not able to attend the interview. She had given her passport to the passport office in Thane for the 2nd police clearance and some dumbass put it in the mail rather than calling her to pick it up. Needless to say, it still has not arrived and with no passport you cannot enter the embassy grounds. I have spoken to my lawyer and they are emailing the embassy and requesting another interview date. It is so frustrating to be so close and now have to wait again.



Man, that's got to be frustrating! I'm sorry you've got to go through this. :(

Will it make a difference if I fill out the DS-156 form for my wife and stepson and put my info in the field where it asks if someone else prepared the form on their behalf? Would it look better if my wife filled them out instead?

Also, for #36 - Has Anyone Ever Filed an Immigrant Visa on Your Behalf - I'm confused.

Neither of them have ever had anyone file for them before. I'm the first. So should I answer 'yes' or 'no' to that question?

Hi,

I'll try to help as best I can. I don't think you would count yourself - I believe that is meant if she used an attorney or some other third party to help her.

Are you filling it out online? I would recommend having her actually fill it out and print it herself - but you can provide her with the necessary info as each question is numbered. This is how Jinky (my fiancee) did it - we relayed back and forth as to how to answer each question. The form she used for her and her son prints out with a barcode at the bottom of the page. She's had to redo her son's a couple of times because of errors she caught later on. From what I understand, the barcode contains all the info that was entered, so if for some reason she makes an error, she can go back to the site and fill out a new one, as long as the corrected form is the one she hangs on to.

I do not know if this will help anyone. It seems like we were rejected because Jenny did not have a picture of her and her ex-husband who deserted her and her child 5 years ago putting her brothers and then me in the position of supporting her and her child. Everything else was fine. I will fly over there and marry her soon. I will then come back and liquidate assets and emmigrate to the Philippines. I do not know if this is stating that presumptive death even though stated by the embassy is a valid show of singleness or not. I think we will never know the real reason for rejection. Anyway, I do not know if this helps anyone, but might be a reason to try annulment instead of presumptive death. Good luck to all of you and thanks for all the help this forum has been.

She was never married and has the CENOMAR document, but I am concerned they may ask for the biological father's written consent for his son to leave the country because his name is listed on the child's Birth Certificate.

Jinky has a sister-in-law who is a top law student - she told us we have nothing to worry about because the biological father has no legal custody of the child.

She has contact with him and we could get his written consent if needed, but Jinky was satisfied with her sister-in-law's legal advice.

After reading this topic I am once again concerned that this may cause a snag.


Not sure what to do? Jinky could possibly go to a government agency that will verify that she has full legal custody of the child. I believe that should satisfy any issues the CO might have...I hope. :unsure:

Were it me...I'd raise hell to no end. (don't know how much good it'd do). But I'd be at the embassy's door...day in and day out...contacting my congressmen in between. I wouldn't rest until I and my spouse were granted the visa you seemingly deserve.

As unfortunate as the situation was, as Kirk realized afterwards, an anullment is what was needed in his fiancee's case. The downside is the anullment process is long and difficult in the Philippines. Simply presuming the husband is deceased would not be sufficient.

If Jinky has CENOMAR then no need to worry about it. My son is illegitimate too but his bio-father has a signature at the back of my sons BC under ADMITION OF PATERNITY and listed in his BC as FATHER. The consul isn't going to ask any paternal consent. I had a paternal consent with me during the interview, we spent money to get the signature of my sons bio-father but all of it is useless. Just tell Jinky to bring photograph of her and her son when Job was still a baby. I mean like aged 2 months to 3 yrs old. Just a picture of them together. Also ask Jinky if her son was late registered or not coz then if he is late registered the pre-interviewer is going to ask for Baptismal Certificate.

According to my experience the pre-interviewer asked me for my son was his birthdate, birth place, if i live with his bio-father, pictures of my son and my fiance. So no worries about it and simply put NO to avoid any complications.you are unsure about his status anyway.



If she answers NO, that would not be truthful because his biological father lives here in the states. I'd be scared of that causing a denial should they find out that in fact he does live here. What do you think they will require if the biological father is here in the states?

Steve, if Jinky has contact with the father, what would it hurt to get his notarized consent to bring her son with her to the states? At least she would have the affidavit on her if asked.

I think the CO will ask about the father more if she says yes in question 37. If she says yes, she might want to be able to answer questions lke his citizenship status, marriage status...etc. Saying no and claiming not to know where the father is might be a lie but it might also garner less questions. This is a sticky one but if Jinkys CEMONAR says she is single and she checks no, maybe they will not ask her like they did not ask RiggerAF. JMHO, Ken

What you and RiggarAF stated makes sense, however, I would be really worried though, should Job speak up at the interview and blurt out that his father is in America - that would really be a problem if she had answered 'NO'. I think if she answers 'yes' to question 37, and states that he is here working, the CO will know from the Birth Certificate that one, his father is a Philippine National and two, that he was living in Philippines at least 5 years ago. All they can ask her is what she knows about his status in the US and she really doesn't know much more.

I'm going to investigate it further, but from what I've gathered - with Philippine law, if a woman has never married, unless the father has gone to court for custodianship, he has no legal rights to the child. On the flip side of that - in the Philippines, men frequently father children out of wedlock that they are never held financially liable for. This was pretty much how it was in the U.S. 30 years ago. Add to the mix, the fact that divorce is not permitted there.

Anyhow, I'll come back with an update once I find out more.

Vaccinations are not required for non-immigrant visas, including the K visas.

They will be required for adjustment of status, however.

OK, I just have one more question because I am rather confused. I had my medical exam 3 weeks ago. At the time, I could not get my vaccinations done because I had pneumonia. The panel physician told me to go ahead and just get the vaccinations form my regular doctor later on once the pneumonia cleared up. So, here I am, January 4th and my interview is February 2nd. The thing that confuses me is this:

I am getting vaccinations done today including the Hep B. My doctor says you need 3 Hep B vaccinations. She says there is not sufficient time to get all 3 shots between now and February 2nd. What do I do now? I am worried I will have problems because of this.

Can someone help me out? Thanks in advance!



Yodrak, could a nonimmigrant be stopped or turned away at the POE for not having any vaccinations? In other words, could this be open for interpretation by the immigration officers...

U.S. immigration law requires that ALL intending immigrants be vaccinated against certain vaccine-preventable
diseases before they can be admitted to the United States for permanent residence.

Hi Gary,

As far as the letter from your employer, I asked our HR person to type up on our company's stationary stating that I work for the company fulltime, my social sec. number, my job title and my annual salary. That's it. Pretty simple.

As for the bank statement - as indicated by many here who've gone through the Manila Embassy - your monthly statement should be sufficient. I logged onto to my account online and just printed it out. I also got a printout of my 401k and my Life Insurance Policy.


With regard to your brother as a sponsor - either you make him an official sponsor or you don't, but I'm not sure what you meant that he's only a sponsor on the I-134 form. Make sure to double check with the guidelines here on VJ for sponsorship because as you state, last year's income doesn't meet the minimum requirements which is what they will base their decision on. It sounds like you got all your bases covered (thank God for your brother), just be sure you give them all the required documentation using your bro as a sponsor otherwise your fiancee's visa will be delayed.

NBI CLEARANCE. Applicants aged 16 years and older must have a valid Record Clearance for
Travel Abroad Purposes from the National Bureau of Investigation (NBI). An official letter of
explanation from the NBI is required if an NBI Clearance has any of the following notations: “No
Criminal Record,” “No Criminal Conviction,” “No Pending Case,” or “With Derogatory Record.”



Can anybody here explain why this is required? Jinky has a clearance with notation that says, "No Derogatory Record", but the ambiguity of the above requirement is a bit daunting. I'm assuming that any of those listed notations would indicate the person has some kind of record with the NBI, and Jinky has no record, but then she told me they notated it as "No Derogatory Record" and one could logical assume that means she has some kind of record. I wish the Packet 4 instructions would offer more of an explanation.

Thank you Cel! We concluded that since her notation was NOT on the list - she wouldn't need a letter of explanation.

Thanks everyone for the tips! She did ask specifically for 'traveling abroad', and yes she had needed a clearance back when she worked as a dentist on a military base. :star:

After reading the posts about February interviews being scheduled, I decided for the 100th time, to put in our case number and check. I COULD NOT BELIEVE MY EYES. WE HAVE AN INTERVIEW SCHEDULED FOR FEBRUARY 20th. Good luck to everyone else, I can tell you the feeling is fantastic.




That's great! I just tried and it says it can't find our case number. Here's the thing. Manila Embassy received our NOA2 on Nov. 2nd...so we should be in there if they're going by order of received date. :unsure:

Yep. Jinky called the embassy on Monday. She'll them again next week. They gave her the standard, wait 120 days response...which really is meaningless given the fact that you and many others have gotten their interview dates already. I'm sure ours will be set soon. :star:

Hi guys,
well its offical....just got of the phone with the embassy and they told me Irish was approved by the counsular yesterday and they will release the visa in 3-4 days for delivery....WOO HOO..Thank You GOD,for all your blessings and answered prayers....and to the rest of you all here going through this same process,thanks for all your support and encouragement.I will have to come back to the PI in Dec. to bring Irish home..ill be here until the 23rd but i dont think Delbros will get it to her province before i leave...but its ok coz the hard part is finally over..I wish all the rest of you good luck with all my prayers that you also will be approved soon.

An I-864 cannot be requested for a K visa. I-134 is used for those applying for a K visa. Whilst there has been members that have at first stated they were told the I-864 was asked for, when it came to the interview this wasn't the case.
