You have to show that it is a legitimate relationship. Did you meet any of your relatives besides your parents? Do you have pictures taken together with the relatives. Of course the age difference is a red flag. You will have to address that at the interview.

No the tax transcripts don't need to be notorized. And the pay stubs are original so no need for a boss's signiture. However, if income is close to the poverty level, (and to be safe) you will need a letter from your company verifying your date of employment and your pay.

They look at the evidence - your airplane boarding passes, and hotel, restaurant receipts, photos of the two of you together, phone records, chat records, letters sent with envelopes. In the interview, just be sincere and honest about the courtship and you should be fine. smile.gif

No, they don't have to be the same exact ones. The ones submitted were just examples of evidence. When my wife went to her interview, she bought a photo album and placed all our photos in it along with boarding passes and receipts. Made it easy for the CO to browse through it ....a nice presentation.

US Embassy and Consulate DiscussionAsk the Embassy. Your Top Questions will be answered by an actual Consulate Officer
A Question for All Embassies Regarding the Beneficiaries' Past Drug Use:

During the medical exam, when the physician asks the beneficiary directly if they have ever used an illegal or illicit drug in their past, is an admission to the physician under confidentiality ever used against them in denying them a Visa, even if their past drug use was beyond the statute of 3 years? If so, what personal information that is shared with the physician would not be considered confidential between doctor and patient?

Thank you.

I will only stick my nose in one more time where it probably doesn't belong.....As you said, what happens to the child is a prime concern, which is another red flag for me. Giving the child to the parents of the "rapist" so that he can support the child and hopefully take care of it? Why not adoption so the child has a chance away from this "RAPIST" as he is called. I wonder what the CO would have to say about that in the interview?

Would that be a cultural norm in the Phils? For a child to be 'given' to a true rapist to be raised?

It just smells to high heaven.

Amen to that. #######?

Are you all trying to tell me that a woman from the Philippines would be too ashamed after a rape to disclose it to her American husband after it happened?

The answer to your question is "Maybe". But perhaps it'd be best to discuss via a seperate thread if you wanted to explore the cultural nuances to this, rather than subjecting the OP to this.

Neither you nor the OP need worry about what I am 'subjecting' him to. It's nothing compared to what the CO may do. My questions are designed to make you THINK about what's likely in store at the interview. It's not doing anybody any good to sit here and pat him on the head and wish him good luck. After all, he asked us what is likely to happen. We'd be doing him a disservice to be less than honest.

Consular Officers at high fraud posts are trained to look for signs of immigration fraud. That training includes questioning the visa applicant in a manner which will yield pertinent answers. If shame over a rape is a cultural norm (to the extent a woman might not tell her husband) then the CO will know this. But you can bet your bottom dollar the CO will still question the woman to see if the shame is real or not. It's their job.

If you think I'm turning up too much heat on the OP, then there's little hope for him when he really gets into the kitchen.

Well said. good.gif yes.gif

Here's a link to the current rape laws in the Philippines... the death penalty can be imposed in many instances.

IMO, because she doesn't want to report the person and is considering allowing the rapist to support the child, she's going to have an extremely difficult time convincing the CO this isn't a fraudulent marriage.

OPs main problem looks like proof of a bonifide "loving" marriage. Be nice if he had the bucks to hire one but to me it would be much more productive if he came up with a couple grand in the next few months and went back to PI for a respectable time [Like a month] and attend the interview with his wife.
Been there! Didn't do that and was denied! Different circumstances tho.
Only good things will come of doing such.
It will show more proof they are for real and help pass the interview or he'll find out a one time visit to marry and chatting and caming really wasn't enuf to get to know his lady that well.

That in itself wouldn't be a denial but I'd agree that only seeing her once in person combined with this situation and I just don't see how they'd make it through the interview successfully

Ok, I'm trying not to freak out...but

I submitted the 129F back in April, still waiting for NOA2...

I was just laid off at work, and wondering if I will need to report this change on my G325A?

Can I wait to find a new job, and let the NOA2 process normally? Then inform the Consulate of the job change at the interview.

Not sure exactly what to do.

Thanks to anyone who might have some insights.

Hey Jeff,

Sorry about your situation. I was laid off the day before my wife arrived here, so it was after her interview, but it had me worried about AOS later on. Once you receive the NOA2 and the interview date, you'll be required to produce a letter from your employer, indicating your job status and salary. I don't think it should be a problem unless you are still unemployed by the time of the interview. I was out of work for nearly 2 months, but was able to submit the letter from my new employer for the AOS. Our interview is at the end of this month, but I'm confident it will be a non-issue.

US Embassy and Consulate DiscussionBest way to send papers to Philippines?

I just recently sent a box Fedex with all my important papers. Cost me $97.00 but it got there 5 days just as they had quoted me. I also did it International Express so I'm guessings thats why it costed so much.

The USPS works with FedEx and you'll save a lot of money that way. Go to any USPS that offers international express mail. You'll get a tracking number along with a guaranteed delivery date. They contract with FedEx agents to personally deliver the package.

First of all, Big Congratulations to everyone who's gotten their interview date! :star:

I'm a little frustrated and confused because the embassy received our NOA2 on Nov. 2nd and our case number is 793xxx, yet Jinky has called the embassy twice and I ended up paying the $18 fee for the 1-888 number after reading that many of you who got your interview date said the website was not updated to reflect the date, only to be told no interview date is available yet! I even asked the person at the embassy, I mentioned that I belong to a support group and several people with higher case numbers than ours have gotten their interview date. She told me they don't go in order by the number, but it depends on a case by case basis. Okay, if it's like that what is the criteria? I thought if all things be fair - they would at least queue is based on when they received our NOA2.

Grrrrrr....I'm frustrated and Jinky is really feeling down. I've tried to lift her spirits and said we can hope and pray to know our interview date before Christmas.

God...this process really can wear down on you. :(

I really do understand how your feeling. It's frustrating dealing with people who can be so careless with something this important and who are instructed to lie to you in order to cover it up. Case by case MY A$$!

A month ago they told Mari they assign slots based on when petitions arrive at the USE, but PW’s list tells a very simple and clear story that, aside from the errors and expedited cases, the interview slots are assigned in Case Number order. And from what I’ve observed in the last two months, the Manila USE has actually been pretty good at processing the queue of petitions in their proper order (far better than CSC was!) and so there is reason to be optimistic that they will catch their error soon and get you moving.

For what it's worth, the February interviews are now posted online and you never know when they will assign a few more so it makes sense to make a daily check of the link Manila Interview Inquiry

I recommend waiting another week to see if any more interviews are assigned and, if you are still waiting, use PW's list of petitions (that clearly shows you were skipped) to communicate with your US Representative or Senator who can check on your behalf. That is how Gary and Luzy finally got their petition moving in CSC. Good luck!!

Thank you! Jinky did call last week to ask to change the mailing address and I'm wondering if that might have delayed things a bit. It was necessary though because her home is in an underdeveloped subdivision that rarely gets mail - even the mail deliverer never knows where it is - so she gave them her dental clinic address.

I'll keep my fingers crossed that we'll know before Christmas! Cheers to everyone here! It's great to know we all are in this together! I'm hoping that Jinky will get to meet some VJ'ers at St. Luke's and when she goes to the Embassy! :star:

US Embassy and Consulate DiscussionManila Embassy Interview

Our interview is Feb 13 and we're still waiting for the packet (in Cagayan de Oro). We could have a problem because we plan to do the medical the week of Jan 8 and we need the interview letter.

you can have an early medical even without the appointment letter. bring a copy of you I129-F NOA2 (showing your petition has been approved)...call ahead the local numbers @ USE and St. Lukes and to let them know you're picking up a copy of the packet since you haven't received it yet. anyway, you still have about 3 weeks to wait for the packet.

You may also print out your medical and interview schedule from the website and show that to the guard.

For contents of packet 4, you can always download all of them from uling's signature. Receiving packet 4 is not really a big deal since there are other ways to get them.

I have some general questions regarding the forms for packet 4 for anyone, especially those who've already had their interview:

1. Filling out the forms with hand writing vs. typing them - Is this a choice for all the forms? For example, DS-156 says it can filled out online and filed electronically - has anyone done it this way? For consistency, I thought it'd be best for Jinky to fill them out by hand.

2. Affidavit of Support (I-134) - the sample form provided here on VJ shows blanks for, 'amount in savings', 'total property', 'stocks', etc... and only lists annual salary. If my salary is well over the limit requirement, should I leave the other parts blank or should I have them all filled out? Is a bank statement then necessary if I leave out any list of savings?

3. Income tax returns - I have my w-2 for 2005 tax year. If it the entire tax return isn't required, I'd rather just give them my w-2 unless somebody here can tell me if the Manila Embassy looks at anything additional that I would include.

........

Additional questions...

4. Regarding Jinky's 5 year old son - has anyone here also had a child go through the medical? Because he is so young I worry about the day long process and how Jinky can tend to his needs when she is also going through examination?

5. On the embassy website, it recommends that you not make any travel plans before the interview, yet I have read where many people buy their plane tickets in advance for the cheaper airfare. Has anyone ever been asked during the interview whether they purchased airfare ahead of time and will that reflect negatively?

....

Sorry to throw so many questions out here, but I don't have internet access at home right now and it's difficult for me to find the time to read through all the posts while I'm at work. I'm at a computer lab right now typing this.

Thanks again, PW, for keeping that list and to everyone here for all the valuable information! I was so excited after Jinky got her interview date, I didn't sleep at all last night! :star:

PLEASE HELP ANYONE!

I have a specific question regarding Jinky's 5 yr. old son, Job. She was never married to his father, but the father is named on Job's Birth Certificate.

Will the Philippine Government allow Jinky to bring Job to the USA without the father's permission? (He has no legal custody of the child). The father is now living here in the states (Maryland) although he is a Filipino National and Jinky knows he'd sign a paper giving permission, but I just want to find out if his permission is required and if so, in what form?
