Wow! That was fast. I dropped the packet off at the local post office on Friday, and it is already scheduled for delivery tomorrow (Monday). We sent it Priority Mail with Confirmation and Tracking for $5.65 instead of Express Mail for $18.50. Good thing I didn't listen to the first postal worker, and checked the rates online for myself.

We received the wife's I-797C today. And, wonder of wonders, the Application Number (Case Number) actually works at the USCIS Status Updates. That is different from last year, when we went through the ROC process, and had to wait for our ASC Appointment letter to get a valid online number.

For my wife, they wrote her receipt number on the check, didn't do that for my stepdaughter, had to wait for the NOA. Least on the processing site, you have an idea when they send your application to your field office, after that, you just watch your mailbox.

We got the receipt number by email and by text. I see that form expires in May of this year. I wonder if they will continue the service beyond that day.

Wouldn't worry about that, did compare the form released in 2005 with the current one, if there is a difference, I didn't spot it. Still same old questions, how many times were you married, how long have you spent outside of the USA in the last five years when you only been here three, and were you a member of the Nazi party in 1933.

Surprised they didn't ask you if you fought for the British in 1812.

I just checked the mail after getting back from a week-long vacation. We found the ASC Appointment letter for two weeks from now. So of course, we ran down to the center and did a walk-in today at 3pm. The security guard gave us a hard time, but finally relented.

The waiting room was empty.

The wife fills out the forms and hands them back to the young man protecting our freedoms. He says, "Have a seat. We will call your number."

The waiting room was still empty.

Five seconds later, the technician comes up and says, "Number One?"

It was everything I could do to keep a straight face.

Ha, that is what it was like in our Milwaukee office, could actually park right in front to the building. The four or five guards there must have been guarding each other as we were the only ones there. They even let me go in with my wife for her prints, man she has big fingers on that computer screen. When she was done, asked for a civics study guide with the CD. That was a mistake, took the guy ten minutes to find one.

We listened to it for the first half hour with our long drive home, but ejected it, it was putting us to sleep.

That G-1145 is entirely optional, we never bothered with that. Just increases the anticipation.

But now your wife has to study those 100 civic questions and answers. We never took that seriously either, just studied those in the car with that other long drive to St. Paul so it was perfectly fresh in their minds. Don't ask me why our interviews are in St. Paul and biometrics in Milwaukee, we just do as we are told. Both answered the first six questions correctly and it was over. How is your wifes' English? Won't be long now until she receives her interview notice.

Her English is fine. She spells better than me. She was an English language transcriptionist in the Philippines. She even transcribed some meetings for the DHS and CDC while working there.

We have links to the study materials for the civics test. We are waiting for her little red book to show up.

It's not that bad, for me. The wife is a little hard to get out of bed at 4:00 am. We'll head out early, find a place to park, and get breakfast. The only bad part about that is the USCIS building (Old Customs House)is in an area with limited parking and fewer places to eat. Time to use google maps and plan ahead.

There was a post here a while ago where the application was set aside for further review, and a possible Stokes interview because she went alone, and got nervous answering a few questions. Just food for thought.

Since the case was dismissed, the fact that you were charged with DV will have no impact on a potential application for naturalization. One is innocent until proven guilty, at least in theory, and since you were not proven guilty, so you are still a person of good moral character, or at least you appear to be one, whatever that really means.

Dismissed without prejudice means the case could be brought again. It is up to the local prosecutor whether or not to charge her again.

No idea if this will affect you badly but you weren't found "not guilty", you weren't determined to be innocent it was just dismissed for whatever reason BUT they reserved the right to try you again (hence the "without prejudice") so it's not good. See a lawyer.

Most often, because the spouse withdrew the complaint.

My husband did not file complaint, in fact he was calling prosecutor's office to convince him to dropp NOC and dismiss the case (btw my husband is in martial art for about 10 years, and I am petit size, it really was an accident)
So neighbour called 911 saying that we are yelling too loud; then it is the city that pressed charges...

However it would be great to hear somebody sharing own experience being in similar situation and how it ended up.

Those are good facts to let the IO know come interview time. Perhaps a picture showing your relative sizes could be useful, although most likely the whole issue will get nothing more than an embarrassing chuckle.

If I'm not mistaken, No because you have to take an english comprehension test to become a citizen.

I think there is an exemption if the applicant is beyond a certain age.

Use the link I provided, and do the worksheet. That tells you if you are eligible. Never heard of the 4 yr 1 day rule, but I suppose if you can make the math work, that may be possible. I don't know if you actually have to be in the US when the 5 years starts if you already were an LPR on that date.

I will pass this information to my friend - who called me last night and said that some cop he knows who is his customer for a long time and know the owners personally assured him that he can go with him to the court and tell the judge that this was an 'unintentional' mistake. Thank you again.

'unintentional' mistake means negligence, but that is better than deliberately ignoring the law. He will probably get a fine and a warning if this is his first time getting caught. It is the kind of mistake that everybody gets to make once without serious consequences, but they want to make sure you don't let it happen again.

If he was never arrested, or cited, no problem. Just make sure it was a Field Interview Report he signed, and not a "Cite and Release". If he has to see a judge about the incident, then he will have to report that on the N400.

Thanks for your kind reply. I remember going through $h1t load of paperwork when I had to apply for AOS to remove conditional status. I am calling consulate now as I am absolutely sick and tired of this #######. If she has a valid so called "permanent resident card" there is no way in hell I am going to provide them same docs again and again. All they will get from me is my cert of naturalization, child's birth cert and our marriage cert. PERIOD!

It should be fine at this point. If they need more, they will send an RFE, or, ask you to bring additional documents to the interview. For this requirement, they are looking for proof that you paid your taxes for the last three years. Don't know why they can't just access the IRS information themselves, but it is good to know the IRS is protecting your privacy in regards the DHS.

Last week I went for my citizenship test, My husband decided to pass on 4h drive to Miami (since that was only TEST plus meeting 3 girls in the hotel who just went wedding dress shopping its not his favorite thing to do. ) so my girlfriend was keeping me a company. After I checked in in the registration desk I was given a number and directed to the wait room. After not even 15 min officer opened a door and called my name. On the way to her desk I was asked if I arrived with my husband (which is NOT required on any of the forms)and i stayed NO. After I swore, officer asked me to take a sit and started looking trough the file. She asked me if my marriage is in good standing and then she asked me if my husband lived in a different state it took me a while to give that answer and then she asked for how long in that minute I didn't even knew what was my own name, I replied that I do not remember. You all know how intimidating those people are. She also asked me where my husband lives - of course with me.
During that time she wasn't even looking at me just writing stuff with a RED pen all over my file. After that she moved to the Test part which as most of you already know is nothing to worry about. At the end she told me that passed the test but the decision cannot be made yet and i will recvive a letter what more information.

After 3 days I have received a letter:
Examination of your application N400 shows that additional, documents or forms are need before your application can be acted upon. You must APPEAR (bold and underlined ) on XXXXXXX for follow up interview. Second page is a attachment to form N-14 about required documents with 2 position marked:
original marriage certificate, evidence of spouse's citizenship and proof that marriage is in good standing
your spouse must be present for next interview
Failure of appear may result in denial of application.


Isn't that RIDICULOUS. I had all that document with me all the proof like they asked to bring, now they are making us come back. DID anyone experience something similar. Reading all those discussions we are expecting a separated interview with officer from the hell. We also consider getting a lawyer involved. Please let me know what you think.

I think your hesitation set a red flag. Just follow the directions in the N14 letter, and you should be fine. The lawyer is up to you, but is not necessary at this point in time. You may want to bring a couple of sworn affidavits from friends that can testify that you have lived together in the same domicile in wedded bliss for the last three years. Better yet, treat the friends to lunch and bring them with you.

The IO saw something that didn't seem right. You need to alleviate those suspicions. Once they meet your husband, and look at the original documents (your marriage certificate and his passport, naturalization papers, or birth certificate), then hopefully that would be it. Having a couple affidavits, or your friends handy, may not be needed, but you have something extra in case your husband gets stage fright as well.

If you can afford the lawyer to speak on your behalf, then why not? But if you want to save a few hundred dollars, or more, then try this first without the lawyer.

This is no longer the site it was many years ago. It is sad that a sticky on this site led you to be scammed, but I'd be lying if I said I was surprised.

That is only to be expected in a capitalist society. I am surprised there is not a question about that on the civics test.

I worked only 2 months in 2008 made around $14000, due to some misunderstanding i failed to file taxes in 2009, got a notice from IRS in 2010 and filed those taxes too .

* I became Permanent Resident in 2008

so what should i answer for the question

Since becoming lawful permanent resident, have you ever failed to file a required Federal,State of local tax return ?( i do not have any overdue )

Answer yes, and attach an explanation stating what you said here. This information will be on your transcripts, so it is not like they won't know.

If the question were "have you ever failed to file in a timely manner" you were correct. That's not being asked, however. They want to know if the foreigner owes Uncle Sam any money or if he's on good terms with the good Uncle.

Just Bob, I think if you don't pay on time it's considered a "failure to file your taxes" although she/he paid it later.

Exactly. The instructions for Part 10 say that if any part of the question applies to you, you must answer yes. Then it goes on to give an example: For instance, if you were ever detained (stopped for a traffic violation or questioned) by a police officer, you must answer "yes" to the question, "Were you ever arrested or detained by a police officer?"
