O.K. Your wife could have gotten a bigger refund if you had filed married filing jointly :). You could sent a letter saying that you weren't aware of this. You could also do a 2009 tax amendment to show the correct filing status and you would possible get extra money that would off set the fees for doing the amendment. Then you could send a letter with an explanation that you have just filed an amendment for 2009 taxes.

Wow 6,000 that is huge. I had about 50 people and the process took the whole morning from waiting in line to the oath ceremony. It occured in New Jersey.

We mailed off the N-400 application along with a check for $765.

$595 application
$ 85 wife's biometrics
$ 85 stepson's biometrics
_____
$765

We're perplexed as to why it is the incorrect amount because we had to pay for my stepson's biometrics when applying for Greencard.

I've tried to find out from USCIS's website, but cannot find any where it clarifies that a dependent (K-2) does NOT require paying additional biometrics fee.

Yeah, I just looked at the page from USCIS, Biological or Adopted Children Residing in the United States. Although it isn't clear that you don't pay for the child's biometrics, I'm going to now guess that because the child will automatically become a U.S. citizen through the parent's naturalization, there is no biometrics fee.

It also looks like once both of them become U.S. citizens, we'll have to file for a certification of citizenship for stepson and that fee will be $550.

the N400 is only for your wife, not for your stepson. he will become citizen after she does with the N600 if you want to send it,if he is under 18.


So he will not have a biometrics appointment? Ok, thanks. That sure is confusing when it was a requirement for his Greencard, but perhaps the Child Citizenship Act has thrown a monkey wrench into the process.

Its 685 bucks, yeah, we had to kick in an extra 80 bucks for each kid for the removal of conditions, they had to show up for biometrics, and would get a shiny new green card.

Would be wonderful if they did that with the N-400, so they could show up at the oath ceremony, take their green cards away and hand them a brand new US citizen certificate. But they don't do that, just tell you, your under the age of 18 kids are automatically US citizens. If you want USCIS proof of that, that's an extra 600 bucks, an extra over six month wait, and an extra short interview, take away the kids green card and then hand the kid his certificate.

You have to list all your kids, step, natural, adopted, not sure about kidnapped, on the N-400, but they are only interested in the ones that will become US citizens. Don't even know why they want to know that, don't do anything about it. At our last oath ceremony, did tell the parent with an eligible kid to apply for the N-$600.


Thanks, Nick. Yeah, I believe for my stepson, the fee for the N-600 is $550, but of course we'll have to wait until his mother's naturalized.

Does the dependent child get to be part of the ceremony at least?

I'm getting ready to submit my application to the USCIS either this week or next, and I had a question about the supplementary evidence to submit with the N-400.

As I understand it, if you're filing after 3 years you can file early on the basis of marriage but that in order to do this that you're required to provide evidence to the effect that you're in a genuine marriage and currently together - tax returns, lease agreements etc.

I'm filing after the 5th year anniversary of residency, but my wife and I are recently separated (we are not getting back together, but have not started the divorce yet). In this instance would I need to gather any evidence of the above evidence as I'm not using the 3 year privilege?

Seems to me that my situation makes the initial application simpler. Is it just a case of filing the form, the photographs, copies of the green card and the filing fee?

I moved back to CA in September so under the 3 month rule I figure I'd have to wait until February before I can apply.

Was wondering if there was anything specific that is used for determining residency. Am I right in thinking that the AR11 would be sufficient?

You might include something somewhat official mailed to you - such as a bank statement - or your DL for your new State which generally is supposed to be changed shortly after you move. Something that has an official date on it and addressed to you at your address in CA should work.


I haven't changed my DL yet as I've not had to drive out here - I have a post office change of address letter I guess that would work.

I've been resident since 04/05 (Resident Since field on I-551) and am thinking about applying for naturalization.

My wife and I are currently living apart (though not formally separated or divorced). That being the case I'm wondering if it will be possible for me to apply for citizenship under the 3 year rule for married couples (as we were living together up until the end of 2009) or if I would have to wait until April/May and the 5th year anniversary.

4/27 isn't that far away, but since I moved out and came back to CA in November I've been out of work. If the N400 is anything like the AOS, I presume that you need to demonstrate that you have an income and aren't a public charge.

if i'm reading your post correctly wouldn't you already be eligible for the 5 year citizenship?


I figure I would be under the 3 year rule (if I'd applied in 2008), but as the wife and I are now living apart I'd have to wait until April

Thanks so much for your responses.

 

After looking at the N-400 again I saw that questions 2 and 3 are about voting so I'm pretty sure now that there must have been mistakes when they scanned the application (or mixed up my wife's application with someone elses) since my wife answered No to both voting questions and No to questions 22-28 (she didn't have a drivers license at the time, so no chance she had any violations). As far as being inadvertently registered to vote I checked on the State website and it finds me but not her.

 

The question is do we try to correct this now or just handle it at the interview?

 

I suggest you make a complete copy of that letter,

and submit it WITH a complete copy of the N-400 that was submitted, clearly marked 'FILE COPY'

along with a nice coverletter explaining the discrepancies outlined here by you,

also asking:

1.  did you mis-scan my application into someone else's A-File Number?

2.  was it a new trainee that sent out this formletter ?

3.  Ask for Supervisor review

then take all of that

 

 

and walk it to your local USCIS office where the interview is to be held,

and

sweet talk the security guard into dropping it into the drop-box.

 

then wait two weeks.

i suggest to you that the clerk at the court was wrong.  It was convenient to use a telephone, but I suggest you show up in person with your wife, sometime in the next 5 days, have a different conversation.

This is disappointing, after all they've put you through....

I wasn't aware fingerprints changed after a couple of years!!

The good thing is... you've been approved....So, not long now!!!dancin5hr.gif

the rule 'seems to be' 

every 18 months.

 

 

so , if there was a biometric event 18 months or longer from an interview, biometrics will be ordered up again.

 

Since it's the local offices that manage MOST of the logistics for USCitizenship interviews, I'd be blaming the staff at the local office for any and all mismanagement .

i thought it was 3 years after first date in first green card, and i'm assuming that green card was obtained due to marriage to a usa citizen (K-1 adjustment, straight big adjustment, whichever).
