US Citizenship General DiscussionInterview details

I had the interview Yesterday and officer called my wife and asked to be in the interview, i was tested while my wife is sitting next to me, also the officer asked her questions like where we met..... The spouse can attend the Interview.

Even the officer didn't ask for any kind of evidence and when i told her that we brought all documents she said she doesn't need them, seeing your wife with you and the document you already sent are enough for me.

Spouse accompanying the applicant to the interview seems to alleviate all that need for additional questions. This is not the first time I have heard about an applicant having problems going solo.

:guides:

Once she comes here and you two get married within the 90-day window, she has to file for Adjustment of Status. If she is approved for AOS, she'll be granted a 2-year conditional Green Card (Residency Card). Within 90 days before her 2-year Green Card expiration date, she has to file for Removal of Conditions. If she is approved for Removal of Conditions, she'll be granted the 10-year Green Card. 90 days before your third wedding/marriage (the day you legally got married) anniversary, she'll be eligible for citizenship.

Wrong. Everything is based on date of first becoming an LPR, not marriage date.

3 years after getting her temp green card to apply for US citizenship, Remember file for i765 work permit and AP travel at same time, when you file your I485. Good Luck She will have 6 months to come to USA, you have 90 days to get married and file for I485, Lots of paperwork and follow VJ site instructions, for both K1 and AOS.

No deadline on filing for AOS, but the clock can't start until you do, and get approved.

thank you....I am only at the K1 Visa interview stage,(august 2) and I am trying to see what lies ahead, so much more I see, been quite the wait.

You are at the fun part. The rest gets easier, or you get better, one of the two. Good luck!

So "some Old guy"....you seem to young to be sarcastic...;-))..wink,wink...are you pulling my leg on the fun part????, thanks for your good luck wishes...those words always help. I am sure when we are finally both through all this waiting and more waiting, we will forget all that we had to endure.

It depends on the country. I imagine Canada is straight forward, but some of the high fraud countries can put up significant hurdles, and the cultural/language differences make it worse. You will be an expert on the process by the time it is over.

I have been to the town during my time at Fort Belvoir. I wonder how much the place has changed in the last 20 years. The town was rather depressing back then.

Thanks - not using Metro. Guess we'll be seraching for a parking spot :)

It looks like there are two parking garages behind the building as well. One looks like it has six floors. That is a lot more parking than they had in San Francisco near their office.

US Citizenship General DiscussionAnyone else get the same IO for both AOS and Citizenship interview?
Yesterday when we went to San Francisco for the wife's interview, they sent us to the same floor, and we sat in the same lucky seats in the waiting room as we did for the AOS. We saw our interviewer from three years ago walking down the hall. Big surprise when he comes back 30 minutes later, and calls my wife's name. "It's okay. Just you. Your husband can stay here this time. I just need his driver's license."

Whoa! Has that happened to anyone else?

I assume your wifes' interview went well, what about her oath ceremony?

After they came out of the interview, the IO asked me to join them in the hallway. He took us down one floor, and told us to wait while they prepared our oath letter. About ten minutes later someone hand delivered the oath letter to her for the July 26th ceremony in Oakland.

The IO was an elderly Filipino, and that made it easier on the wife. Both times he seemed stern at first, but warmed to us quickly. Perhaps that is why he remembers us, or maybe, he just saw his name on the AOS documents that he previewed before the interview.

US Citizenship General DiscussionHospital Bill

Hi everyone I am a green card holder and in 2 more years i will file for citizenship, I went to hospital here in USA and can not pay the bill would it effect on my citizenship when i file for it?
or they will reject my application when i file for my citizenship because i have to give money to hospital.

Here in USA hospitals charge alot of money , i been to hospital and as i make low money i can not pay the hospital bill and hospital have sent my case to collection aggencies.
I am worried.

Yeah, they will hound you and your spouse for the money until the day you die. They can attach your wages and drain your bank account, if they get a judgement against you, as well as take any property you own. You may have to see a bankruptcy lawyer.

US Citizenship General DiscussionHospital Bill

CALM DOWN.. I think The OP was talking about USCIS giving them a hard time about the hospital bill when they file for N-400. The hospital can do what ever they want by taking civil actions but that will have no bearing on the application. USCIS only care about taxes being paid and laws being followed. They care less about your credit and who you owe. Even the U.S government can't pay all it's bills.

I am calm. And, I agree this will have no direct bearing on applying for USC. However, this is a problem that will not go away on its own, and needs to be resolved quickly, before it overwhelms things.

Right now they put you in from debt collection agency. The Hospital cant do anything about your case. in the first place you didn't make an arrangement with them about your Bill.that's why they refer your case to the debt collection. what you will do is to contact with them to make a settlement and they can help you out to get back on track. it will not effect your eligibility. Think twice

Yep. Settlement is the key. I have seen hospitals forgive 50% to 70% for a cash settlement. $22,000 seems like a lot, but I have seen a four hour ER visit go over $100,000. Talk to a lawyer if things don't makes sense to you at this point. You need to protect your property and future earnings. It's hard living without credit, and having to pay for everything in advance with cash.

US Citizenship General DiscussionAmended taxes to update spouses income?

Thank you very much.. should I be able to pay any additional tax due at the same time as filing the amendment or will I need to wait until they send me a bill?

Penalties and interest are complex, so wait until they send you a bill. Expect to be audited, as most small businesses are audited in their second or third year after filing Schedule C.

ETA: It may include a lifestyle audit, so be sure to save all those credit card receipts.

If she is getting her USC through marriage to a USC, she will have to show that your taxes are current and up to date for both of you. Once you set up an installment program with the IRS, then she will be free to file for citizenship.

Yes, that is correct...They will simply re-use the fingerprint on their files. The sad part is that they don't refund you the extra $ 80 you pay for biometrics though.

That doesn't sound right. We did the bio last year, paid the fee, and still got a bio appointment. http://www.visajourn...le.php?id=53935

Alright... and here's the breaking news: and feel free to call me a complete and utter tool and I probably deserve to get called some names. I went to my bank to get a copy of my application.... and it stars: 'Are you a US citizen': 'no'. 'Are you a permanent resident alien': yes!

name change with the N400 form?

her name is changed due to marriage already......

anyone elses input is highly appreciated.

Thanks

The legal name of a resident alien is not changed until it is changed by DHS, as you probably found out trying to get a Social Security card in your new name. You are given an opportunity to change your name legally and have that reflected on the Naturalization Certificate when filing the N-400.

Didn't work that way at our local office. They wouldn't change the name on the Social Security card until after it was verified by the DHS. Once she received the EAD, then, and only then would they change the Social Security card to match her married name. After she received the green card, then they finally gave her an unrestricted card.

Liste, VJJ,
listen closely.
Part of the naturalization process is the option to be reborn as an American with any name you want, within reason. So no matter what you did or not did when getting married or afterward, none of this matters. What matters is that you can choose under what name you will be known as after becoming a US citizen. You will fill in that name on the N-400 form and that name will be on your Certificate of Naturalization and that will be the name on your passport also. No need to go gagga over this; write down the name you want and that's the end of it.

I don't always agree with Bob, but he is spot on here. Learn from experience.

Use the interview letter and the included checklist for guidance. You can bring anything that will help, but if the spouse shows up with you, that would be number one. Don't forget to bring all original documents, as well as photocopies of each.

If you were cited, you answer yes to both questions, and should ask the court for a copy of the final disposition of your case. In the remarks section, explain both yes answers.

I am too lazy to read the guides, and the instructions don't help. It appears that the form does not realize not everybody that fills the form out fits the form.

Part 7. #######? No, she didn't take any trips outside the US, but she lived somewhere outside the US during that five years, before she arrived in the US.

Part 8. G. I figured that one out, but they could have worded that question better.

I have to agree with what Kathryn said, it did seem like the naturalization process was the easiest step...and the fastest. We sent in AAm's app the first week of Janauary...so it only took 100 days or so...

Blessings! M

Thanks Brother Mark. We have had good luck up to this point. ROC was a breeze. Knock on wood, this should be no problem, and we can be finished with the immigration process. We only ran into one employee with an attitude, and that was a counter-person at the Old Customs Building in San Francisco for the AOS interview. But the rest of the staff has been courteous and helpful. Marie has had no complaints so far.
