count 3 years forward from first 'official' date of being a LPR.

Alternatively, you can set up an INFOPASS appointment and ask a worker face to face.

Ant - based on what you've written - I can only surmise that the back-end data processing stuff needs a re-write. I've read way too many 'examples' such as yours - Always an RFE raises the bloodpressure - and your 'biometrics letter' should have been referenced as such.

So, Nani had her interview today. Scheduled at 9:30. We arrived 9:15. Nani was called in right at 10:00. They called me in at 10:10 and we were done and on our way at 10:15.

The officer asked her 6 questions out of the catalog, had her read and write one sentence, checked the paperwork, talked to me for a couple of minutes and said that he was happy to recommend the application for approval. He said that they have an oath ceremony on Sept 28 to which she will likely be invited. We then told him that we'll be out of town that day and he made a note to schedule her for the next available oath ceremony in October. Should be towards the end of the month. Very nice officer. Very smooth process.

We're as good as done. biggrin.gif

Yes, she applied based on 3 years residency and marriage to a USC and that is why the officer wanted to have a quick chat with me which really was two questions I had to answer under oath: 1) Since your wife became a PR, have you ever been seperated for any amount of time for any reason? and 2) Since your wife became a PR, have you always lived together?

The evidence we sent in with the N400 was limited to joint tax records, joint bank accounts, jointly owned residence and the birth cert of our daughter. We brought itineraries of a recent trip we took and a trip we'll take soon to the interview but that wasn't even asked for.

We received the invite for the oath ceremony today - Oct 28 is the date. We would have done it 9/28 which was the first available after the interview but we were out of town and told the AO at the time of the interview. He said that he'd schedule Nani for the October ceremony instead. And today we received the official notice. Three to four months from start to finish for the N-400 isn't bad at all. They really have gotten a lot better. good.gif

We sent in our transcripts for 2005/06/07 with the N-400 (filed in June) and brought the tax form copies and email confirmations from our e-file for 2006/07/08 with us to the interview. That worked for us.

The oath ceremony was huge - over 400 people naturalized in Tampa today. And they do these oath ceremonies on a monthly basis. I thought the crowd would be much smaller given the frequency of the event but we had a very large crowd today.

It's a simple form letter from the DO that specifies the date and place of the oath ceremony and has a number of questions on the back covering some of the items you answered on the N-400 with respect to the time frame from your interview to the oath ceremony. You need to answer the questions, provide your current address, sign and date the letter (with the place and date being that of your oath ceremony). They will collect the letter, your Green Card and any other USCIS issued documents you may have and issue your naturalization certificate at the ceremony.

I can't find anything in the USCIS literature that would suggest that taking on a summer job and being temporarily outside of the US - 2.5months doesn't meet the extended absence threshold that would have an effect on either a future citizenship application (6mo) or the current PR status (12mo) - would be an issue as long as your daughter can demonstrate that she is not abandoning her PR status. Both the nature of the overseas engagement (summer job) and the fact that she'll be returning to school here would support her intent to maintain her PR status.

As a PR, she has to file US taxes even if she is (and works) temporarily outside the US. There should be an exclusion available on foreign earned income which is - if I remember correctly - calculated based on time spent outside the US and the maximum annual exclusion allowed. I know nothing about Canadian taxes.

Your daughter is a Canadian citizen, right? As such, there should be no concern as to what she tells the Canadian guys when entering Canada. The conversation shouldn't really extend beyond a "Welcome Home" from the Canadian officials. From a Canada point of view, she has every right to go to Canada to work there, no?

As for the return, again, there's nothing wrong with her accepting a summer job north of the border and then coming back to continue to live and study in the US - she is a PR. That said, I agree with the previous poster that a "don't ask, don't tell" approach is probaby the way to go.

I'm married since 2003, however I've just saw that my GC says ..resident since 3/4/2005

do they go by the date on the GC or by the years you have been married?

If they go by the date on my GC that means I will be eligible only in 3/4/2008

Your three years start once you become a (conditional) permanent resident. If you remain married to your USC spouse that is. Otherwise it would be 5 years from being accorded resident status. You may file the N-400 up to 90 days prior to reaching the 3 (or 5) year mark.

This is absolutely 100% completely true. I have copies of my 2010, 2011 and 2012 transcripts at my house with all my other documentation involving my application, so I know for a fact that once you have filed and been accepted, you can order that transcript.

For this particular case, I'd guess that 2011 should be fine, but when you file 2012, I'd order the transcript to have just in case it becomes necessary down the road. It won't hurt to order it and not need it.

Every time we filed and provided tax returns/transcripts, they always asked for the most current tax year when we were interviewed. So, send what you have now, and when the interview happens, have the most current return on hand.

thanks in n-400 form , they are asking the list of employment details

i have given the list of employment dates for 3 companies

and in beween there is a unemployment gap between job 2 and job 3

i have used an additonal sheet to list of unemployment dates , and working in other companies

i mean that employment 1, and employment 2 dates are in order , and employment 3 is not in order

there is gap between employment 2 and employment 3.  So i have used the addtional sheet and listeda all 1 to 10 employment and unemployment dates in order

actaully i suppose to write as unemployed in coloum 3  and used additional sheet ?

is that fine

 

As long as it is clear and legible, and follows the same method as the form, you should be okay. Usually, one would list the most recent events on the form first, and add any additional events needed to cover the period requested on an additional sheet of paper.

Yes few people will ever have issues if they don't declare their simple speeding tickets. Those people generally will have to just get proof of them during the interview and usually it's because they have other issues on their application other then just a speeding ticket.

The best advice is to go out and contact the USCIS directly. These free forum boards have lots of misleading facts by people who have no clue how the system actually works. Others can be just one persons experience.

This topic has always been a huge discussion and if you are worried about it, go out and do the research and contact several lawyers and get a consensus, call up the USCIS and speak to someone directly, make an Info-pass appointment etc. and find out from the source.

Doing a simple call or appointment can save you a lot of hassle tracking down unneeded proof etc. If worst comes to worst, they will ask you to just submit proof after the interview. Then you can go about trying to track things down. But seriously this topic always has had 2 sides on every forum out there. People just base it off their own experiences. As I mentioned, I based mine on talking to a lawyer, talking directly to a USCIS rep and then asking my IO about it. But that was my my experience only. Things may have changed since my experience and what I was told by 3 official sources. So it's best to go to them yourself to find out...

There is a lot of truth in that statement, and so many variables on how each case is handled. I always wondered how certain posters can offer advice when they are two or more steps behind in the process than the topic under discussion.

The wife succeeded in getting through the whole process, from K-1 to Naturalization, with one minor snag at the interview in Manila: Her fingerprints were unreadable first time through. We went lean on all the filings, offering exactly what was asked for only. And we lucked out that the same IO handled both interviews in the US, for AOS and for Naturalization. Mostly, we ignored the general consensus to be found here on Visa Journey, of panicking and overloading the filings in order to avoid any possible complication, except a few herniated disks carrying the packet to the do when I have more time pile. Of course, we didn't find out about Visa Journey until after the AOS was approved, so we avoided a lot of bad advice just by our absence.

Some things were helpful here:

1) Early biometrics which shortened our timelines for ROC and Naturalization considerably.
2) Kathryn41's help in confirming one confusing aspect of the N-400 for 3 Year filers. Pretend all the questions are for three years of data instead of five years.
