US Citizenship General Discussioni failed the us citizenship interview today

Kathryn, i submitted more evidence last Friday. yeah we do have Costco membership. the mailman definitely knew i live in the same house as my husband. same mailman since the day i arrived here. as with my son, we don't sign papers or something like that. however, we do attend together during parent teacher conference. i drop him off in the morning and he picks him up in the afternoon.

the interviewer rejected the bills since she said its so easy to say that we live in the same house. she said its so easy to make up and use the same address -those are bills! with my name on it or my husbands. so i did not submit any of those.

i'll let you all know when i receive a mail from uscis

(well, it was in the afternoon when i got interviewed. a lot of rolling eyes during the interview and no patience at all so i knew that i did not pass)


You should have brought the mailman to the interview
or
got a signed affadavit FROM the mailman.

yes, the details. i wish i let my husband do the papers. i forgot that there's visa journey and just relied on the people. when i did the AOS and ROC it had all kinds of evidences and had not a problem on those interviews. this one is all my fault for omitting the "major" evidences -mortgage and bank account. but it will not prove anything that we are living together because i don't have my name on it. but we do have our names in our car insurance. also, the health insurance. i and our son are under my health insurance and my husband has his own health insurance from his company. so that also post a red flag, probably. the bills didn't help either. she said that our son won't prove anything that we are living together. we may have a son but we might have splitted him. why don't they just visit us and interview the neighbors, the school where my son is enrolled, my co-workers who sees my husband whenever he shows up


What people did you rely on?

I'll suggest you should make a civil suit against them.

Ask yer husband, get his input?

This would be a great topic to discuss with one of the HR Staffers with the entity - Suggest a walk up , ask for one of the HR crew to talk with you for five minutes. IMO, it'd clear up much.

Walking is important, sometimes. This, IMO, is one of those times.

File that 4-pack pile of forms for the kid, with the mother (Now a USCitizen) as the petitioner.
Expect no consular processing, as this is NOT a visa packet yer helping them to prep, but
an
adjustment of status packet.

File all concurrently.

re: prior action/stuff with USCIS - Unsure what to tell you. As is, right now, the kid entered the country legally, and (by law) he won't be deported (unless he's caught) until after age 18.

after a re-read -

the i-94 isn't so necessary, if copy of all passport pages is included with the I-130 and the I-485 (2 seperate forms, need 2 seperate copy sets)

The foreign travel document is not tied to his Egyptian passport. (Well, it is, really, but the Egyptian Passport is the leading document, the foreign travel document depends on it, not the other way round)

IF his passport expires before anything else (ROC, USC application) is dead easy to apply for a renewal at the Egyptian Embassy/Consulate IN USA. He won't be dinged on anything occuring outside of Egypt - they will be happy to take his money, give him new passport.

IMO, let the foreign travel document expire, unless he has dire need to return to the country that issued it within the next 4 months.

can always call uscis, ask if any returned mail for your case and name, verify (with Tier 2 rep) the address.

IF it's the 'right address'

then it's time to get chummy with yer postal carrier, make sure they know you live there.
USUALLY a new name card taped onto the inside of the box, with a plate of brownies, works wonders.

Otherwise the postal carrier will simply return it to the sender (USCIS) as undeliverable.

I just spoke with one of my friends now. she had her N400 interview a week ago and the IO also swiped her Driving license revealing all the money she owes to credit cards. The IO said that is fine with him because it is not criminal to have credit card debt in this country...

My friend filed N-400 (March 2011). Her naturalization interview is August 1st. I have two questions.

(1) Her husband's IR-1 case has been completed at the NVC. Since she is a permanent resident, he has to wait for a visa to become available. Once her naturalization interview is complete, how can she have her husband's case expedited? In other words, her husband will be considered an immediate relative.

(2) Her daughter's 18th birthday is August 29th. As soon as she is approved, is her daughter eligible to apply for a US passport?

Any assistance would be appreciated.


1. no, if it's completed at NVC, is no more waiting because of LPR status. Was waiting, prior to NVC intake, but not now, if NVC has completed the NVC intake and paperwork processing. As is, right now, they are in 'regular queue', expect an interview within the next 2 to 3 months. The holding tank occurs during USCIS I-130 approval and NVC 'open the casefile' - so since the paperwork is COMPLETED at NVC, they've already gone through the holding tank. Sorry.


2. where is child ? how to answer the rest depends on her location. did child have IR-2 case in play, or not ?

This would be a great time to get a PO Box at a Post Office, in the city where the oath ceremony is to occur.

One of the cool things about not having any 'fixed address' is that your creditors have big problems to find you.

Another cool thing is that your bank will suspend your account after a few months of the statements being returned as undeliverable.

Save yerself a pot of hassle, go rent a PO Box at the Post Office, today.

I would give up any 'time clock' for the '3 years to citizenship' plan -
as USCIS will evaluate yer 'time out of country' when you are applying for citizenship.

coupla months outside USA each year? Not a problem.

couple weeks inside USA each year? Sorry, big problem.

Suggest you pitch that '3 year plan' and instead, concentrate on yer educational plan, then once yer back in USA with masters degree in hand, make new plan for filing for US Citizenship.

so - (echo'ing what NickD is saying)

you got that I-797-C notice, the receipt of ROC 'thing' - that has the 1 year extension in it, right?

SUBMIT A COPY OF THAT with a COPY of the expired greencard,
plus copies of the passport pages that have the additional (I assume 2 now) I-551 stamps in them,

when you submit the N400 app.

Include a cover letter covering WHY you don't have any 10 year card in yer submittal.

and that's it.

it's 3 years from the issuance date of the FIRST GREEN CARD -
so check the copy page of the FIRST GREEN CARD - go forward three years.

then back up 90 days - that's the FIRST day you could file, based on marriage to a US Citizen.
