Hi Guys, I have a question. It's really for my stepson. My wife, has been a citizen for 3 years, at the time she became citizen he was 17 years old. He has had his GC for atleast 5 years before that. Does that mean he is automatically a citizen?

Note: His father is not a U.S. Citizen or have ever even visited the US.

Take another look at CSPA, as the daughter gets special status once you have your citizenship, if under a certain age.
It's my understanding that all you have to do is apply for the passport , if she meets the criteria (and I think she does)

What may be 'the issue' is that the clerk at the post office NOT know about CSPA and how your daughter qualifies.

Do some research on that, then go back, get a supervisor, go over the CSPA stuff with that human.

you were married to a us citizen before you migrated in 2009. That means you became eligible to apply for citizenship 3 years after that if you are still married to the same person. You do not need to wait anymore. Go file the paperwork.

with this 'motor-voter' stuff enacted at the state level.

IMO, there was no 'box to tick' at the DMV - the DMV simply 'did it' and it's all a big mess, an error performed by the DMV.

I suggest you rethink the calendar and the math,
and

come up with an answer reflecting the start, the day her foot first hit the ground in the USA, coming in on a K-1 or CR-1/IR-1 visa.
but even then, that's not the right date.

IIRC, it's the first date of 'status' ... lets see. pick one, depending on visa type:
1. k-1 visa holder - day 1 starts after marriage date
2. CR-1 visa holder - day 1 starts the day after POE date.

I may be wrong if K-1 visa - it may be the first day of status with a green card - so keep digging, you.

Since yer using the 3 year 'rule', don't use the 5-year math and calendar.

I thought about that too, since the IO during the interview asked me about my religion and if my wife, her children and i practice i. I dont think he should ask about the religion, my wife said that too. What does the religion has to do with naturalization? i dont know. I have some moroccan friends who went thru the naturalization process, none asked them about their religion and if they practice it.

IF NOT,
then i think you've skipped some step for Removal of conditions.

A Removal of Conditions case is more about showing the evidence of financial co-mingling. You've raised questions on financial co-mingling, which, IMO, are best addressed when filing that ROC case.

So. please check her greencard, study the dates printed there - just in case she's out of status.

Are you in a financial position to start the co-mingling, or no ?

IMO, though - I say it's not so needed, when applying for Citizenship.
You'll need to prove up you were at the same place with yer spouse over that time period, so focus on that, for the rest of this week and the weekend, pulling out whatever receipts you can.

it will depend, really, on whether or not a deportation order is issued by an immigration judge at an immigration court.

no deportation order? you remain a LPR.
deportation order? time to leave USA.

Remember, you MUST maintain yer LPR status, irrespective of your USCitizenship casefile status until you become a USC.

unless, of course, you have a deportation order .

Kathryn, i submitted more evidence last Friday. yeah we do have Costco membership. the mailman definitely knew i live in the same house as my husband. same mailman since the day i arrived here. as with my son, we don't sign papers or something like that. however, we do attend together during parent teacher conference. i drop him off in the morning and he picks him up in the afternoon.

the interviewer rejected the bills since she said its so easy to say that we live in the same house. she said its so easy to make up and use the same address -those are bills! with my name on it or my husbands. so i did not submit any of those.

i'll let you all know when i receive a mail from uscis

(well, it was in the afternoon when i got interviewed. a lot of rolling eyes during the interview and no patience at all so i knew that i did not pass)


You should have brought the mailman to the interview
or
got a signed affadavit FROM the mailman.
