US Citizenship General DiscussionAccidental Claim to US Citizenship back in 1988
ya, the intent bit is what will make this 'not a misdemeanor' IMO.

Seriously, call into the PA HelpDesk, get it sussed out over the phone for 'what to do' on the remedy. I'm betting it's something as simple as an affadavit.

ya, forget what i wrote about some affadavit letter,
as

it's likely, probable,
that she renewed the permit many times since first receiving it,
thus claiming many times to be a USCitizen.

One time? is maybe some hope.
Many Times? I think withdraw the application, be happy with a green card.

Ladyfromfaraway

I not read of you contacting an ISO with USCIS.

Please contact an ISO, and ask them to have a deep look on what's going on
and
ask the ISO to check if any returned postal mail on you, as well.

report back after that phone call.

waiting on hold? with a telephone? COOL !

if not waiting on hold, and not using a telephone...

uhm... use a telephone, call in, ask for an ISO - to go over returned mail pieces.

US Citizenship General DiscussionTaxes and Citizenship denial!

Yes, I was issued a SS and I did receive a W2 from my employee!
I'll check it when I get home, but I'm pretty sure my earnings were less than $9,500!

Thanks!

OK - so get the 1040EZ forms on the years , each year, that you did not file.

Then file each one in one packet, altogether.

You SHOULD FILE, you know - as you'll probably get some refund on the taxes withheld by your employers.

Your wife might be able to help you - filing taxes is dead easy, if you have all of the instructions in front of you.

Since this is your first year, expect to file the paper returns, not anything electronic - but you should be able to get the refunds back via ACH bank deposit (usually... and if not - you get a nice paper check) .

I suggest you include a cover letter stating that for those filing years, you were unmarried.... Just in case, aye?

Go Get Em !

US Citizenship General DiscussionTaxes and Citizenship denial!

Shouldn't she be filing a 1040NR or 1040NR EZ for those periods? Nonresidents aren't allowed a standard deduction, but get the exemption of around $3,800. They can take itemized deductions, most likely any state income tax that you paid would be the main one.

yup! Yer Right !

is she leaving the USA on her USA passport and entering the PI on her PI passport? No Visa on the USA passport for such a long stay?

US Citizenship General Discussiontraveling on dual citzenship
she can stay outside of the USA for any length of time as a US Citizen.

There's some slippery slope for her, for which country she's a citizen of , when entering the PI - so plan accordingly.

I don't know what to tell you about it - except that she's gonna have to 'do' stuff.

If I were in your shoes, I'd start with a telephone call into USCIS, getting to a Tier 2 Human™, an ISO.
ISO - http://www.dhs.gov/f...5658440339.shtm

If an ISO isn't able to tell you current status, then it makes sense to get an infopass appointment at your local USCIS office, as they have your casefile and know a bit more.

Good Luck !

there's a local office where his interview and test occured.
inside that local office, there's an ICE officer - if it's a large enough office there's an ICE crew.

So - find out the local office, go in via an infopass appointment, and talk with the ICE officer.

Good Luck !

My Lawyer said she sent it through regular mail and therefore tracking is not available. Its been 3 weeks now and I have nothing to hold on to I will suggest to you, strongly, that you have the wrong lawyer.

You've been a member here a bit more than 4 years and you chose to use an attorney to file for yer citizenship. I think the majority of folk reading this would question that decision, to engage with an attorney.

OK - I'll bite.

Give free rent to a cousin.
Cousin checks postal mail daily.

Cousin opens all postal mail.
Cousin emails you when something important arrives, a scan of the page.

well, yer waiting on postal notifications from USCIS.
Here's the rub - if you put in a usps forwarding order - the mail from uscis is sent back to uscis, as there's a clear written statement on the outside - Postmaster - DO NOT FORWARD.

If you were going to be out of the USA for 3 months, for example, I suggest, instead, putting in a POSTAL HOLD ORDER and then signing up for the online portal over at https://egov.uscis.g...d/CaseStatus.do . Of course, without receipt numbers, yer hosed. With receipt numbers, you'll know status and dates.

sorry, it really is that simple - on what basis did you re-enter the USA from Canada?
You mention a form or two, signatures, fingerprints, blah blah blah -
so in the paperwork you might have walked away with,
or the paperwork you signed

the basis for your re-entry was listed there.

I'm asking you to review that piece of paper (or two)
and tell us...

From the paper you saw - what was the basis the USA Customs and Border Patrol allowed you to re-enter the country ?
