there's a 5 year rule, for qualifying as a us citizen , when filing for a consular report of birth abroad. 

 

 

If, at the time of filing the CRBA, you don't qualify - don't sweat too much, 

as 

 

you can file an I-130 on the child, leading to a CR-2 visa, 

but then once he hits USA dirt - it's my understanding he immediately qualifies for USCitizenship and then you can chase a USA Passport the next day, skipping the 'pay the immigrant fee for a green card' step.

i vote for tax return transcripts and tax account transcripts.  

 

Get both? all is shown - you have amended returns and that stuff doesn't show on the regular tax return transcript.

OTOH, this is considered a business, YOUR business - so if your business paperwork is in order with the county and state, you should be fine when the IO asks for your 'business papers' .

so as expected, i got the update that the oath is scheduled, but no changes to my wife's status.... what does it mean, any ideas? she is the one that got "decision cannot be made".

if the oath scheduled, run with that, ignore anything else unless a new postal mail piece arrives.

going by your time line, you came in on a K-3 visa, got a 2 year card, and got a 10 year card as well.

that 10 year card should not be expired, however, the 'first date' to compute for calendar math
is the first date on the 2 year card, which of course, has expired already.

what I find curious - and I may not have all the facts correct - i'm only going by what I have heard in the news, The family came here on political asylum, as refugees, got their citizenship 9/11/12 and then moved back to where they fled from 6 months after getting their citizenship..... so... you come here seeking asylum because its a dangerous place but then go back as soon as you are a citizen? Just wondering if the parents may have some involvement in this

there is something massively whack about who is where, who is from where, where is what, when was where.

I Filed as single because my wife is not in US yet. She is Away and Never been here, i petitioned for her and its in Process. Do i have to apply as married if she is not here and never worked here. Im trying appy for N-400 in 5 years basis. Hope it makes more clear of what i wanted to know.

I've been filing our taxes as married-filing-jointly these last 3 tax seasons, but I got an ITIN for my wife via IRS Form W-7.

You can pursue that, file a paper file to the IRS with an AMENDED TAX RETURN anytime you are ready.

Once you file the amended return, showing the 'married-filing-jointly' status, it negates what you did before.

I'm not going to bash post office people here. Some are more knowledgeable while others are less. I don't think its fair, or appropriate to write stuff that most posters have. If they are not aware of the immigration related laws it is not their fault. It is pretty said that the US post office people are not trained to know basic immigration stuff when they have the authority to accept passport applications. It is not the individual person's fault at the post office. Up until now, I had no clue how this procedure is done. And when I was 16 I worked at the post office. I was trained to stamp envelopes, to know the different packages that people can send, as well as deliver mails. No one ever told me a single word about immigration issues. It was just part of the fact that "oh yeah, and we accept passport applications". I did not even know what the hell is a green card, or what s a J1 visa, or an F1 visa, or a B2 visa. I was just a young kid who was desperate to get a job somewhere and I got that one. I feel (personally) that people tend to judge pretty fast on this board....anyway, like others said, go back and show your certificate of US citizenship and your son's green card. If it makes you feel warm and fuzzy, print out the law that states the fact. Good luck!

The OP brought the law, and the postal worker refused to acknowledge it.

I can understand your point of view about working in the postal unit - I'd never discount it, since it's your personal experience.

The one or two postal workers in each postal unit who have tasked to handle passport applications have gone to some training - they NOT have full training to handle cases such as the OP presented. But that's only part of the problem.

The second part of the problem is that MOST of the postal workers who are in the passport section have a very apathetic approach to customer service, when a human is across the counter.

And that's just how it is.

For the OP - is best to get into another type of office - I suggest an actual passport office - see http://travel.state....encies_913.html for the list. Sure, it might mean a drive, but the folk across the counter will know exactly how and why you qualify.

Yes, My husband is going to receive the 10 years GC soon but we didn't have to go through the ROC because we have been married for 4 years so its IR1 visa. So he apply right away soon as he receives it ?

No. he has to be an LPR for 3 years using the 'married' clock.

So when he comes into the USA and is issued a green card, study the first date there on the green card. That's the date that governs the start of the 3 year duration.

Can someone please explain to me why do you even need to report to SS after becoming a citizen? We did that after getting our green cards and we received new cards with no restrictions on it, looks like a normal SSN card.
Is there a difference in status (in Social Security) between permanent resident and a citizen? AFAIK there is no difference and you can live here all your lives as P.R., and you are still eligible for benefits (is you are eligible to begin with, meaning if you paid into it).

ya, the benefits for a citizen are different than that of a permanent resident.
