I think it is completely random. We took a while to get the ASC appointment, but we were approved quickly after the Bio. I guess it all depends which stack your application falls on.

Hmm... are you sure it's an RFE? The NOA#1 they send out says to send more info if it wasn't included with your application. That may seem a little misleading.

Thanks for the answers everyone. If we did some affidavits just to be safe, do they need to be notarized? I noticed the example ones had a lot of random legalese on them and had a spot for a notary to sign.

No need to be notarized. Just put a statement to be signed, that he/she makes this statement truthfully, under penalty of perjury, and would be willing to testify to such if necessary.

I mean, the top two holes made by my three-hole punch will be the same distance apart as if they had been made by a two-hole punch, right? Or not? :-(

No. Don't punch holes in the application if it is going to a Lockbox. They scan and process all the documents electronically, and things like holes, folds, fasteners, staples, post-it notes, white out, and tabs, screw up the document feeder. Make sure all the pages, including the evidence, are printed on standard weight 8-1/2 x 11 inch copy paper.

It can be more onerous than that. The mail can be delivered to the lock box, or mailbox, several times a day, and picked up after hours, for processing overnight. Meanwhile, the items requiring a signature, and sent by means other than USPS, go to a separate location, where each piece is received by a live body during business hours. If that person is not available, a notice is left, for either when a new attempt will be made, usually the next business day, or where the piece may be collected, usually back at the Post Office. For express and priority mail requiring a signature, you will often get the status, "Person not available for signature."

Meanwhile, once the piece is received, it will take months to process anyways, so whether it got there in one day, or two, and whether it was picked up on Friday evening, or on Tuesday morning, really won't affect the processing time significantly.

If you don't submit tax returns, and even if you are approved, they will be required if your case is scheduled for interview. Perhaps without returns, they may just flag your application for interview.

I refined my question below.

I would change the passport first, before doing the ROC, if possible. Some countries have naming conventions that have to be strictly adhered to. So if you happen to have a passport from one of those countries, you are sorta stuck with whatever the officials decide. If and when you naturalize, then you can change your name to whatever you want. If you want the new greencard and new passport to match, then definitely do the foreign passport first.

Speaking of Priority Mail...

Pro Tip 1: As long as you have access to a printer, go to USPS.com to pay and print your mailing label online. They automatically check the address (and correct it if necessary), you get a discount from the standard "retail" rate, and they throw in delivery confirmation for free.

Pro Tip 2: When you're shipping large documents (like, say, an ROC package), order Priority Mail Flat Rate Legal-size envelopes. They generally don't have them at the post office, but you can order them for free at the USPS website. You can fit a lot more documents in one due to the extra length.

Our ROC packet fit into a standard Priority Mail Flat Rate envelope, as did all our filings. If it don't fit, it may be too thick! :whistle:

No, you don't. We didn't. Doing so would have caused major problems with the mortgage company.


We put the utility bills in both names, and sent photocopies of our most recent bills. We also put our vehicles in both names, and included copies of the registrations, even though she didn't have a license to drive. She had medical insurance through work, so we added me to her insurance. Good deal for me, since I am self-employed, and saved about $500 a month on premiums. We opened a joint bank account, and I added her name to my existing accounts, including my business checking. Finally, we got statements from two of her friends. That, along with joint tax transcripts seemed to satisfy the USCIS, no interview.

Alas, requirements are different, when comparing AOS (your interview) to a ROC interview.

Almost like apples and oranges. For AOS, yer not expected to have the things available during a ROC interview, as there's 2 years o time you've not had , yet.

It helps to live in a community property state like California. The surviving spouse is entitled to almost everything, and anything that can be diverted to another heir, requires an affirmative election by the departing spouse, and an acknowledgement by the surviving spouse. That makes filing taxes when one spouse is self-employed, for example, so much easier!

You will have to include returns or transcripts for the N-400 if and when you/he/she decides to a become a USC, so keep that in mind. It doesn't matter if they are joint returns, or married filing separately, as long as both spouses are listed on the returns, even better if they are filing from the same address. The USCIS likes to see that you are paying your taxes.

if you are seriously considering the house, to be added as evidence, go into the county clerk's office, ask what can be done to add your spouse. Some states allow a new deed, or an addendum to the deed.

She could do a Quit Claim, but that may freak out the Mortgage Company. I was in the same situation, and it wasn't a problem with the USCIS. We submitted less evidence than she has listed, but we did file joint tax returns. That shouldn't be a problem as both spouses are listed on both returns.

Sound like you really need to talk to a lawyer. Look for one with free consultation to get you started in the right direction. Most lawyers I have met will be thorough and give you an estimate of what it will cost if you want to proceed in that first consultation.

In my layman's view, from this point forward disclose the facts as you know them on the forms as required. The only difficulty I see, other than having a ready explanation handy if it becomes as issue, is later on once your husband becomes a USC. If his children are eligible for immediate immigration as immediate relatives being unmarried and younger than the cut-off age, there may be a question why they were not disclosed early. But as far as the removing conditions and later filing for citizenship, I don't see this as a problem. Establishing paternity later, as always is the case for fathers, I do see as a problem.
