I remember seeing a post on here that Nebraska has asked for someones expired Green Card. My card expires in Oct 2007 and I would be travelling July 2008, I doubt I would have my 10 yr green card by then.

If your GC expires in Oct 07, then you'll be filing the I-751 in July 07 - 90 prior to expiration. Surely, you'll have your GC within a year of filing. If you do not have it by then, get an I-551 stamp in July 2008. That'll work for travel.

I married my wife in Peru in 2004, filed for a K-3 Visa, waited almost a year for it to be approved so she could come to the USA, and then 19 months later she got her Permanent Residency. We did everything 100% legal to get her here.

My question is this. There are two people that came to the USA from Peru on a Tourist Visa. They overstayed their Visa and have been living here in the USA illegally for about 3 years. Now they claim that because their daughter is a US Citizen, they have now received their Permanent Residency. How can that be? How can you be here illegally and get your Permanent Residency? I am thinking that they are not being truthful. What do you think?

Only if their daughter was 21 or reasonably close to that when they came here. A USC child 21 years of age or older can sponsor parents same as a USC can sponsor a spouse or unmarried child under 21. They may not even have overstayed if the child filed the I-130 prior to their I-94 expiring. The parents would then have been lawfully present pending the adjudication of the petition the child filed on their behalf. They'd even be eligible for an EAD while the process is pending.

Is it just us being so special?

Maybe you have been selected for one of the few interviews they do on those cases. That interview would go through the local office. Not sure that's what it is but it's a possibility.

At any company, the HR staff administering the I-9 filing may be inexperienced. That doesn't mean that the resident alien holding such letter is not authorized to work. There is a certain liability on a company that refuses to accept proper documentation. The EEOC loves to hear about such employers... ;)

Ultimately, the new employer did accept the extension letter (after OP contacted the Dept of Justice).

I don't doubt for a minute that one could have difficulties with employment eligibility verification using the extension letter and corresponding GC. There's enough ignorance out there regarding these items. That said, the GC along with the extension letter - which explicitly leaves said GC in unexpired status - is good enough for I-9 verification in the eyes of the law.

My husband just called me after spending 3.5 hours at the Social Security office, to get his SS card updated. It was 3 hours of waiting time and a half an hour of talking with the person that works there (I told you guys it's a HUGE hassle to go there compared to the immigration office!! Now we need to find out who we can complain to).

Anyway, they ordered the new card for him after much pleading. At first they didn't want to get him the new card because he did not bring his old one. No where on THEIR instructions from THEIR website does it say that he needed to bring it. He could have just said he lost it. They said they don't want people to have two of them. Umm, I have my old one in my maiden name. And my husband mentioned that to the lady. So she got past that issue and then she said that she didn't know how many days ahead of the expiration date on his greencard he had. She thought the number 15 sounded right to her, and some other guy in the office said 15 working days. Which would have put my husband at one day short! My husband pointed out how the website does not state that, and how he thought it was 14 days, not working days. So they looked and looked but could not find the days anywhere (neither could I) and she eventually just put it through and said she hopes she doesn't lose her job.

Why are these people so incompetent??!??? :wacko:

At least it's done with now.

The real question should be: Why do these people (gov't employees) not care?

We moved twice before filing the I-751 and once while it was pending. Our I-751 was approved in about 4 months.

Did you ever change your address with USCIS when you moved. Coz i'm moving too but i have to file for removing condition after 1 year and 9 months and i'm not sure if i need to change my address with them or i just simply have to wait and change it when i apply for 751

you should file the AR-11 and the I-864 when you move , and when you file your I-751 use your new address.....

We moved twice since Nani became a PR. I have copies of the AR-11's and receipts for the I-865's on file and intend to submit copies of those docs with the I-751 that we'll file in 7 weeks. Yep, getting ready for it.

There's something to be said about filing as soon as possible - i.e. 90 days prior to the expiration of one's GC. However, somewhere in the I-751 instructions, if I remember correctly, there's a passage about filing late. It says something to the effect that the applicant should explain why (s)he filed late so they can make a decision on whether or not to accept the late filing. I suppose including the explanation about the fee that you gave here and evidence of the earlier, timely filing should suffice. Either way, you're in a bit of a document situation until you actually receive the I-797 that formally extends your status and corresponding privileges.

Okay, so we need to file the I-751 soonest on 6/16/07 and latest on 09/13/07. Come the end of September or so, Nani needs to travel home. Obviously, the I-751 won't be adjudicated by then. So, does one travel w/ old GC and extension letter? Has anyone any actual experience to share?

We sent three years of tax transcripts (I'm self-employed), proof of health coverage, most recent utility bills, most recent bank statements, vehicle registrations, two affidavits, and about a dozen pictures printed on two pages. No interview required, and we were approved before the rest of our peer group.

Depending on the state, your wife will already be a co-owner of the business under community property laws. In other states, you would have to prove she did not materially contribute to the business to exclude her. You should talk to a tax attorney to see how best to handle the tax implications.

Having a property interest is not the same as ownership.

 

 

 

Not necessarily. The spouse has certain ownership rights under community property that supersede any operational agreement between members, especially in the case of the death of the spousal member, or divorce.

It worked for me. I just put the wife's name on all my bank accounts, including my business checking account. Since she does not participate in the business, no tax implications for her. The property I own and house we live in is still in my name, but this is a community property state. I also added her name to the utilities. That seemed to be enough in our case.

Just the most current bank statement(s) are all you need. So, one bank account, one statement is enough, or a letter from the bank establishing the account is indeed in both names.

As far as tax transcripts, show the transcripts for the years you have already filed. If you are picked for an interview, you may have to bring the transcript for 2012.

I have a question I m going to apply for ROC on middle of march but i have an issue about bank accounts that me and my wife do not have any bank account together because she did not want me to have it with her bec of her bad credit might affect my credit score.. is that going to be a problem?

we have a house both of our names , we have a car both of our names, utility bill, pics, we visited her family together and my family as well which is they are out of country, both name car insurance, i was under her insurance, taxes done married jointly ,

are these good enough to avoid from RFE?

If you send transcripts, you do not. If you don't, you do. The transcript already contains that information as reported to the IRS. If you send a return, they have to take your word that is what you sent the IRS. The w-2's are also reported separately to the IRS and are filled out by your employer, so they are just another piece of evidence supporting what is on the return you filled out and you said you sent to the IRS.

Yep. Unscrupulous people have been known to generate fake tax returns to prove income. The W-2's and 1099's are the only way they have to verify the income. The information from the W-2's and 1099's is on the tax transcripts.

hi everyone, i hope everyone is doing fine. my wife has her 2 year greencard and she still has about 6 months to go for her to roc. we are planning to go to the philippines on vacation. we had just came back from the philippine consulate in new york to have her marry name in her current passport. it will take about 6 weeks for my wife to have her new passport. we would have to send the old passport with her maiden name back for her to get the new passport with her marry name. my question is, will we have a problem going and coming from the philippines from the united states becaused in her old passport, it has the point of entry stamp in her old passport. if i understand it right, it has on one of the websites that you have to keep your old valid passport while holding a greencard. if this was true, why didn't someone tell us from the philippine consulate of new york. i hope someone can help me becaused i don't want any problems. thank you everyone.

Your wife needs a valid passport to leave the US and enter the Philippines. She needs her green card to leave the Philippines and enter the US. If the name on the two documents (and her itinerary) don't match, she needs documentation to explain the difference, not just for the Philippines, or the US, but in order to board her flight.

i know that my wife needs her passport and greencard. what i am trying to say is that the philippine consulate of new york will not send my wife her new passport with her marry name until she sends in the old valid passport. her old valid passport has her date of entry into the united states. will she have any problems with her new passport without havung a copy of her date of entry into the united states. thanks for any help.

As far as entering and leaving the US or the Philippines? No. They want the old passport so that they can invalidate it. They will return it to you.

As many times as I have dealt with mortgage companies, they are for some weird stuff just before closing escrow, and funding the loan. You have to hope the extension letter will work, with the explanation that you don't see any reason why your ROC won't be approved. However, you just never know what they may decide until the loan is funded.

My first mortgage, they cut the check with my nickname as my first name, instead of my legal one. The escrow company, my agent, and I, decided in was easier to conform all the other documents to the check and loan papers, then go back to the loan company and get another check. It was the last day of escrow, and this was after having the mortgage company try and change the loan terms within a few days of closing. It took threats of a lawsuit from two real estate companies, the escrow company, the seller and me, just to get that check. What a pain!

The USCIS will assume you have abandoned your application, and start removal proceedings. Don't miss your appointment. Some offices will take walk-ins with your appointment letter, especially in the afternoon. If you do miss your appointment, contact the ASC office right away. See the instructions that came with the appointment letter if you need to reschedule.

The receipt number shown on the NOA #1 won't work in the USCIS website. You need to wait for the ASC (Bio) Appointment Letter to get the correct number.

Yes. It depends on the ASC, but afternoons are less crowded, and they will usually take you if there is nobody waiting that has an appointment. Make sure you bring your appointment letter.

I think it is completely random. We took a while to get the ASC appointment, but we were approved quickly after the Bio. I guess it all depends which stack your application falls on.
