That stinks. I wish the service centers were consistent with each other instead of one always seeming to be faster than others or slower than others. We all pay the same fee, we should get the same service at all service centers. :yes:

I dunno, I had my biometrics a month after submitting, and that was only a couple of months or so ago. *dunno*

Our I-751 is out a month and a wekk now and we still haven't seen any bio appointment. Texas sucks big time once again. But what else is new? :wacko:

I believe so. On of the first things they do is check for eligibility. If you file more than 90 days in advance, you're not eligible and your petition should be rejected on those grounds.

My husband's card expires 10/25/07 also...Is there any reason in particular that you are not filing before the 28th. I was wondering the same thing as you and trying to make sure we don't file too soon. I'm not sure where day 1 starts (in the 90 day window). Where do we start counting from? Is July 25th day one or is July 26th day one?

Depending on what day 1 is, the date to fle would be either the 27th or the 28th seeing that both July and August have 31 days.

If you are filing this petition jointly withyour spouse, you must file it during the 90 days immediately before the second anniversary of the date you were accorded conditional resident status.


If your GC expires 10/25/07, then the second anniversary referred to in the instructions is on 10/25/07. 90 days immediately before the anniversary would then start on 07/27/07 which would be day 1 with 10/24/07 being day 90. If day 90 is supposed to be the anniversary date itself, then you'd file 07/28/07. Since from a filing fee perspective it won't make a difference, I'd chose 07/28/07 since that falls indisputably within the 90 day window.

This is what I got off of the website: "Customers who have an application and/or petition which has been filed with USCIS but has not yet been decided (also known as a 'pending' case) should notify USCIS of any change of address as soon as possible after moving. The law requires nearly all non-U.S. Citizens1 to report a change of address within 10 days of moving by completing a Form AR-11. Basically, we do not have a case 'pending' or have an 'active case' at the moment. She has status of 'Conditional Green Card for 2 years now'. Between now and the time we actually apply to lift conditions and get her 10 year Green Card do we need to let USCIS know of our address change? Our address has changed a longtime ago and will be current before the 90 days we need to apply to remove conditions. Do we just simply write down the new address when we apply to lift conditions and get the 10 year Green Card? By then she would just about be eligible for Naturalized U.S. Citizenship anyway.

How Do I Report a Change of Address to the USCIS?

Background

All non-U.S. citizens (aliens) who are required to be registered are also required to keep the USCIS informed of their current address. This is particularly important when you have filed an application or petition for a benefit under the Immigration and Nationality Act and expect notification of a decision on that application. In addition, the USCIS may need to contact you to provide other issued documents or return original copies of evidence you submitted. It is also mandatory for any alien who has been designated as a “special registrant” under 8 CFR § 264.1(f)(as amended by 67 Federal Register 52585 (August 12, 2002) to inform the USCIS whenever he or she has a change of address, employment or school. The special registrant rule is effective as of September 11, 2002. For information about special registrant go to the U.S. Immigration and Customs Enforcement website.

In the past, our predecessor, the INS, required every alien in the United States to report his or her address annually, in January. This requirement was eliminated in 1980 and annual reporting is no longer required. However, if you are not a U.S. citizen, the law still requires that you report any change of address change within 10 days of the change.
How Do I Report My Change of Address?

If you are not a U.S. citizen, changing your address for legal purposes does not change your address on any application or petition pending with USCIS and changing your address on a pending application or petition does not meet the legal requirements of informing USCIS of your change of address. You will need to do both. For most cases, you can now do both at the same time on our website using the Electronic Change of Address tool (available under "Related Links" on this page).

With the exception noted above, all non-U.S. citizens who move within the United States and its territories must submit a Form AR-11 within 10 days after completing the change of address. You can do that here on our website with the Electronic Change of Address tool. If you choose to use this online tool, you can complete an electronic Form AR-11 and notify USCIS to update your address on most pending cases.

If you choose not to complete an electronic Form AR-11, you will be required to obtain a paper Form AR-11 and mail it to the address shown on the form. This will delay the process of notifying USCIS significantly. Not filing an electronic AR-11 and choosing to mail in a paper AR-11 will not update your address on any applications or petitions pending with USCIS.

Regardless of whether or not you are a U.S. citizen, if you choose not to use the electronic change of address notification, you will need to call customer service at 1-800-375-5283 to request that the address on your pending application/petition be changed. If you are not a U.S. citizen, you will also need to complete a paper Form AR-11.

If you are not a U.S. citizen and you have a case pending with USCIS, you will need to do both – call customer service and complete the paper AR-11. Completing an AR-11 does not update your address on any pending case. Also, notifying customer service does not meet the legal requirement of completing an AR-11.

If you mail a paper Form AR-11, we recommend using certified, registered or return receipt mail. This is not currently a requirement of USCIS, however it is advisable to send the AR-11 by a method that will give you documentation that you did mail the form to USCIS, in case there should ever be a question.


Where Can I Find The Law?

The Immigration and Nationality Act (INA) is a law that governs immigration in the United States. For the part of the law concerning reporting of your address and for the penalties if you do not comply, please see INA § 265 and 266. The specific requirements for reporting your change of address are federal regulations found in 8 CFR Part 265 and at 67 Federal Register 52584, 52592 (to be codified at 8 CFR § 264.1(f)(6)(concerning designated special registrants)).

Who Must Comply?

All aliens in the United States who are required to be registered under the law (INA § 262 and 261) must keep the USCIS informed of their changes of address. The only aliens exempt from this requirement are diplomats (visa status A), official government representatives to an international organization (visa status G), and certain nonimmigrants who do not possess a visa and who are in the U.S. for fewer than 30 days (INA § 263).



What Should I Include?

For the Form AR-11: Complete the information requested on the form, including present address, last address (most recent only), alien or registration number, country of citizenship, date of birth, and your signature.

You do not need to include temporary addresses as long as you maintain your present address as your permanent residence and continue to receive mail there.

When sending us a change of address, you do not need to include numerous last addresses; only the most recent last address is needed.

Be sure to also indicate in the appropriate block on the AR-11 your current employment and school, where applicable.


Additional Information

The address reporting requirement should not be confused with renewal or replacement of lawful permanent resident cards (Form I-551) or replacement of other evidence of alien registration, such as the Form I-94, Arrival-Departure Record; I-186, Nonresident Mexican Border Crossing Card; I-688, Temporary Resident Card; or, I-766, Employment Authorization Document.


Penalties for Failure to Comply

A willful failure to give written notice to the USCIS of a change of address within 10 days of the change is a misdemeanor crime. If convicted, the alien (or parent or legal guardian of an alien under age 14 who is required to give notice) can be fined up to $200 or imprisoned up to 30 days, or both.
The alien may also be subject to removal from the United States. (INA § 266(.b.)). Compliance with the requirement to notify the USCIS of any address changes is also a condition of an alien’s stay in the United States. Failure to comply could also jeopardize the alien’s ability to obtain a future visa or other immigration benefit.

Thanks for the replies. I checked the actual for I-751 and there was a question about and changes in address since having a Green Card (where and dates). I noticed that the example letter is from/signed by the US citizen spouse. I am assuming this is because it is a joint petition as opposed to the AOS.

Has everyone pretty much followed this example and sent the I-751 with a smilar cover letter signed by the USC spouse? I guess it would solidify the petition since it would further "document" the relationship, but at the same time it is the non-USC that is asking for the removal of conditions on their green card.

Actually, if you file the I-751 as a joint petition, then it is both the USC and the non-USC spouse petitioning for the removal of the conditions. Hence, a joint petition. We put the letter on a letterhead that has both our names on it and we both signed the letter. Which makes sense since we also both signed the petition. I don't think it matters an aweful lot, though.

Here we are, almost 4 years into our marriage, well over three years of living a happy life together, three moves behind us since Nani arrived in the US and just over 9 months into parenthood blessed with our little cutie, here we are filing the I-751. Seems just so out of place having to demonstrate, yet again, to this bureaucracy that we married for all the right reasons. I can't wait to get this one done and over with and to get through the last piece of this process, filing the N-400 for Nani and say buh-bye to the USCIS for freakin' ever.

Anyway, it's all assembled and ready to go tomorrow morning. Wish us luck! :)

on the corner of sligh & 43rd. I don't know if you know of the area, but there were some townhouses built across the street from Robles Elementary about 3 years ago. That is where my house is. Riverwalk @ Waterside, plus not so good neighborhood anymore, we used to have security all the time, not anymore and someone broke into my car 2 weeks ago. all for them to steal a broken cd player.lol Anyhow I cant wait for my fiance to move here so we can move some where else.

Yes, I would say Valrico is much nicer and quiter. Less crime. I hate driving on 60 though, red light, one right after the other, at least in Brandon. I've considered moving to Brandon, though Valrico is a nice option too. The houses are cheaper there??

60 gets much easier once you're through Brandon. And there are alternate routes - I hardly ever travel on 60. Home prices in Brandon and Valrico are probably about the same. Homes are generally newer in Valrico, though. We like it. Nice family neighborhoods.

Your case officer might just be on vacation or some other leave. Or simply not be the most productive. Once you're 30 days behind, it would be time to raise some questions. Also consider that you may have been selected for an interview at the local office and they might be in the process of scheduling you for that interview. Again, unless you're a month overdue, no need to panic.

Of course. The only reason why people have problems with that is that there are too many HR clerks that don't know a first thing about the I-9 requirements. They see the extension letter as an NOA (or receipt notice) which they were drilled is no good.

What I worry about is that when my conditional GC expires, my employer will threaten to terminate me. I know it's illegal, but our HR people are so dumb that it may very well happen. I have "employment authorization expires on 1/4/2009" (GC expiration date) written all over my paperwork, and I'm not sure if these folks have dealt with conditional permanent residents before. I know they are not supposed to re-verify my employment, but they may not be aware of it...

Well, then they either have two years to get familiar with it or you can offer to have a judge spell it out to them. ;)

My new accountant recently informed me while doing this years taxes that he could ammend that year for me and I'll l end up getting money back from IRS if I do so.
I haven't really figured it out but if I do so it may drop me below the Minimum Poverty Guidlines.

How so? I'm quite certain that the poverty guidelines are based on before tax income.

Could be but I'm still not sure about what they use for self employed with writeoffs.
Hard for me to believe they will let you by if you gross 40K and you have write offs that take you below the Minimum Poverty guides down to lets say to 5k net. it's OK.

Hard to comprehend that they assume you can adequately provide for yourself and an immigrant spouse on 12K / year.

The foreign spouse needs to make sure to not exceed the time she's allowed to be out of the country in one stretch or ask for re-entry permit beforehand. I'm not sure what the timeframes are but I would think that a temporary assignment of a couple of months wouldn't be an issue. Just keep in mind that being absent for extended periods of time while in LPR status will have adverse effects on the eligibility of an LPR for US citizenship.

We were thinking about heading to Europe or maybe even Africa via my current employer for awhile but I won't even touch that until Nani has her US citizenship. Once that's complete, things will get much easier in that regard.

Why would they ask for your expired GreenCard? When you file the I-751, your GC is not expired. So, you keep it. I've actually never heard that they request the expired GreenCard to be returned.

I remember seeing a post on here that Nebraska has asked for someones expired Green Card. My card expires in Oct 2007 and I would be travelling July 2008, I doubt I would have my 10 yr green card by then.

If your GC expires in Oct 07, then you'll be filing the I-751 in July 07 - 90 prior to expiration. Surely, you'll have your GC within a year of filing. If you do not have it by then, get an I-551 stamp in July 2008. That'll work for travel.
