After a year and change, someone must have disreagred the DO NO TOUCH sign on the box that held our case file. And rather than putting it back, it seem that they just approved it.

If you sent in your I-751 in December 2006, though, your window to apply for citizenship opened up last month. Have you applied? That will force adjudication of the I-751, assuming it's still not adjudicated by the time the citizenship interview comes up.
I wonder how many of us will end up having that happen.

We're going for Nani's citizenship just as soon as we can. If for nothing else then at least for not having to deal with this pathetic excuse for a government agency any more after that. Also, it will make traveling elsewhere a lot easier seeing that Nani needs a visa for just about any country she'd want to visit. But then we have to wait until June next year to file the N-400. sad.gif

The CSR was able to confirm one thing for me. My wife's application was sent back to the Atlanta office because she is going to be called back in for a second interview prior to being approved. Looks like I will need to get the files back out and have plenty of copies ready to go!

While a pain in the butt, at least it looks like there will be action on your case.

Yep. Your employer is clearly wrong here. You should be on file as a permanent resident. You do not need to provide any additional documentation at this point and your employer cannot require you to provide it. They have no grounds to terminate your employment for your immigration status. If they decide to let you go, take them to court.

I'm just frustrated that the USCIS cannot provide consistent service across the nation. That's my beef. Just ain't right that they simply pick and choose what applications they work on on what applications get put to the side based on nothing but the location of the applicant or based on when that applicant happened to file their petition. That just ain't right.

As for all the worries with employment: I must be missing something here. I've worked for a number of companies in the US - both as an immigrant and as a naturalized citizen - and not once have I filled out the I-9 until after I was hired. Prior to being hired, I simply answered the question whether I am legally eligible for employment in the US with YES and whether I will now or in the future require sponsorship from the potential employer with NO. They cannot let you go simply because they're not familiar with the documents that you provide to verify your employment eligibility. You never show those documents to a potential employer, you present them to your employer after they hire you.

That said, any conditional resident should obtain the unrestricted SSC and a state ID and the issue of extension letters disappears for good. wink.gif

Something tells me you only read the first two sentences of the notice. If you had kept reading it should have been pretty obvious to you that what you got was a receipt notice, not an approval notice.

That said, you're not the only one to freak out when getting a notice from USCIS. Getting mail from them can be rather traumatic. That's why it's very important to read what they send you thoroughly before jumping to any conclusions.

You did. Just not thoroughly. I highlighted the piece that you must have missed. What this receipt notice does is extend your current status for one year during which the USCIS will adjudicate your joint I-751 petition. Once it is adjudicated, you either gain unconditional PR status or - in the unlikely event that USCIS hands down a negative decision - you lose your PR status altogether. That said, until that adjudication takes place, you remain a conditional permanent resident even though your actual GC is expired. Again, the notice only serves to bridge the time between the expiration of your current GC and the adjudication of your petition.

Does that explain it?

I agree with some of the comments - most notable James' - that you were a bit weak on the proof of joint residence. On top of the landlord's letter (a lease contract would certainly be better), other simple pieces of evidence - such as envelopes of letters addressed to either or both of you at said address - may strengthen that proof.

And I do believe that re-submitting the already submitted evidence along with the additional items might be a good idea as things do seem to disappear at USCIS from time to time. Make sure that you keep a copy of everything you submit and that you submit the evidence with a copy of the RFE letter and a cover letter detailing the content of your package.

Exactly. My own Lifting of Conditions way back when included an interview.
It was essentially the same as the AOS interview - a cakewalk.

This must be something new. We have the same number on the NOA1 and the biometrics notice and have been able to look at the case online right when we received the NOA1. Not that it does us any good seeing that they haven't updated the file or done squat with our petition since the day after we had the biometrics done. *shrugs*

We haven't submitted any affidavits. As I said some time back, if our baby, our jointly owned home, our joint accounts, joint insurances, trips and such ain't good enough then no affidavit will turn the tide. Generally speaking, affidavits are some of the weakest pieces of evidence that you submit. They might round out the picture but won't tip a decision on your case one way or the other, IMHO.
