There will be a few issues, there in Roma, but you should try to address:

1. 'returning immigrant' status - is some special 'permission' that the LPR can get from the USEM.
2. 'another stamp in the passport' - I-551 maybe, maybe something else.

I think you will get some 'special consideration' at USEM Roma because you are UN Employee, but you prolly want to touch base with the travel office of the UN, they normally handle 'foreigner' questions, give guidance on what to do.

There is also a DHS/USCIS office in Roma, as well - keep in mind is SEPERATE FUNCTION from the USEM staffers. I fear that USCIS will view her ROC as 'abandoned' - so be 'ware, ah?

But I don't recommend it - You might just wanna wait until there is a reported problem , back to you.

My opinion - you'll be ok.

1. get police report today or tomorrow.
2. USCIS will make several attempts to cash the check.
3. talk with your bank - tell them to honor the check (do that today ) .

Best Case Scenario - you can handle all with the bank, today.

Worst case scenario - all is returned to you in 2 months time.
Send it back to them, with affadavit (a notarized letter) explaining what happened, and include the money order.
Don't worry about deportation proceedings, at this point, or even when you get it back.

usually the ASC is not the local USCIS office - but - if anything else gets wonky - set up an INFOPASS appointment, go to the USCIS office, and talk with a staff officer, get the new appointment scheduled.

I think you'll be ok from handling it at the local ASC office, but really - if any problem - get an INFOPASS appointment.

when / if you two are ready to move back to USA, file a I-130 via DCF in Jakarta at the USEM there. You'll be granted an IR-1 (10 year card ) then.

For now, to jump back and forth with tourist visa, you should be ok - just file at Jakarta - make sure the IO knows you have strong ties to return to Indonesia.

You not need USCIS permission to get an infopass appointment. The IO at the appointment will make a decision, right then and there, if you qualify for any extension stamp in your passport.

there are two addresses for delivery - one to a po box for usps, and another for courier delivery (fedex, dhl, ups).

Usually - if you send to the PO BOX with 'signature confirmation' - it's gonna get held up for a bit, up to 10 days, whilst a USCIS employee goes to the stack of 'signature confirmation' packets that accrued ...

If you really need 'signature confirmation' then use the courier delivery address, otherwise -

a delivery confirmation without signature is best. I get ####### about tracking things online - so you being able to track it, is useful biggrin.gif

the usc spouse would have to have evidence of visa fraud, then submit the evidence to ICE, and then ICE accept it, have a hearing, then ICE decide to deport you.

The USC spouse cannot deport, but he can file claim of visa fraud. It's up to ICE to take action on his filing.

It was up to your or your spouse to keep track of the 2 year timeline from when the first greencard was issued. No Fed Agency will send you a reminder.

Sorry for this oversight, but...

You'll have to file something else, almost immediately, or he'll be scheduled for a deportation hearing.

you've got the 10 year card, so yer set for a bit.

BUT
since yer divorced, the '3 year waiting' span is gone, for you - as it's based on continuous marriage to a usc.

now, it's 5 years, since yer divorced from that miscreant.

but - it's not 5 years because he was abusive.

it's 5 years because yer divorced.

the 'start date' for time computation is the first valid date on the first green card that you had.

take that date, go forward 5 years - peg THAT date (lets call it the Blue Date, for now, yes? )

Then - 90 days prior to the Blue Date, you can file the N-400 .

3. utility bills in both names (gas, electric, cable tv, landline telephone )

Perhaps you already have those, but didn't think to include them?
These 3 'things' prove up a 'shared domicile'.

hey case is not linked to your case - so HER getting an infopass appointment to reschedule biometrics will not affect HER case in any negative way, and in fact, has no impact on your case.

her case is stalled because the biometrics interview was cancelled.

If she can't reschedule the biometrics, she'll have problems later, as she wasn't able to finish up the necessary things leading to a 10 year green card.

Not true. we've had 4 from this list approved this month, plus a bunch of others that are at VSC but not on the list. Vermont is slow right now, no doubt about it, but we've had at least 3 or 4 approvals this week alone.

That'll probably be it for awhile, though. They're exhausted at the VSC. tongue.gif

They don't do interviews at all anymore? There used to be occasional interviews on I-751's.
