We are in a quite similar situation where my husband goes to school in a different state, and I can't quit my job in this economy. We submitted the same amount of paperwork as yours and got approved quickly. I wrote in the cover letter the details of our situation explaining why we are not living together, how we communicate to keep our relationship alive, and also our concrete plan to reunite in the near future. Travel documents (air tix, boarding passes, pictures, etc.) and communication records are very helpful. I think it's a matter of trust. Just be honest, and USCIS will understand.


IMO, it's a bit different when the foreign spouse is OUT OF THE COUNTRY and the USC Spouse is in the USA, for such an extended period of time. Just saying... IMO - more scrutiny than your particular situation.

My apologies if I offended your sensibilities in any way -

I asked innocuous questions only to get you to THINK about HER situation. She's lived outside the USA for 18 months since receiving the green card. Usually, USCIS assumes the greencard is abandoned UNLESS you can prove otherwise.

My question about 'how is she returning' was a real one - Please review SB-1 and DS-117 -

Sure, I understand the situation, as you've written it here. That doesn't discount two facts:

1. you're gonna have to produce a pile of evidence of the bonafides of your marriage, to submit to USCIS NOW and
2. she is gonna have a hard time returning into the USA, much hassle at the POE, high probability of being turned back at the POE.

1. yes - not sure about any form. A letter should suffice (I THINK). You want this to be noted, a 'voluntary departure', since you have a deportation hearing scheduled.
2. yes - have yer wife file an I-130 petition via Direct Consular Filing to the US Embassy in Egypt. When you get new visa and come INTO the country again, you'll have a 10 year green card (based on marriage to us citizen longer than 2 years)
3. ME? You want me to charge you ? mmmmmmmmmmmmmmmmmmmmmmmm no, sorry, I wouldn't do that. I might ask for food pr0n photos though - you gots any fav mutton dish ??

Jan,

if someone fails to file for ROC, removal proceedings are automatically initiated. These include a hearing in front of an Immigration judge who is the only one in power to revoke the status of a LPR living within the USA.

You failed to report your change of address, you failed to file for ROC, and you already abandoned your LPR status by moving abroad. At this point, you need to formally inform USCIS and the court that -- and at what time -- you left the USA, and provide evidence to this fact.

If you try to enter the US with your GC, it will be taken away from you at the airport. If you try to enter using the VWP, you will be refused entry.

In light of a possible later move back to the US, you need to stop removal proceedings as deportation carries a 5-year ban. I would do this in writing a formal letter to USCIS and the Court and have it notarized at the US Embassy in Germany.

When the time comes to move back to the Land of the Brave and Free, file for DCF in Germany and you will be rewarded with an unrestricted, 10-year GC.

When you go to infopass again, soonish, initiate a 'service request'.

This forces USCIS to find the file, and report back to you exactly 'where it is' and in what timetick on status.

I also understand that a immigration liason staffer at a congressmen's/senator's office can ALSO instigate a service request on yer behalf.

ya, IMO, ROC is all about co-mingling of finances and co-habitation (same domicile).

Talk to the utility companies again - have them change the STATEMENTS to show both names.
REDO the lease, or have addendum made.
revisit all joint bank accounts, as well.

if any financial instruments/life insurance policies - rework the POD instructions for the foreign spouse.

re: no paper statements - each entity has a billing statement, available online to print or download. Get it, print it.

weigh it. If it's over 20 pounds, then (IMO) it's too much.

I'd suggest a month-by-month collection, from the day you got married to the day before the submittal.
Some ppl might say that's too much, but I'm really ####### about this type o collection.

No, this is 'normal' verbiage in a NOA-1 for a ROC case.
Is also 'normal' for this 1 year extension, as there is NO IDEA of exactly 'when' the 10 year card will be issued.

So, you gots some slush time - another year - which USCIS will use (we hope! ) to process the ROC case.

Sounds like yer on the right track.

At some point, you'll want to create a cover sheet for yer evidence.

I was teasing about the corporation papers on 'Pinay for Pizza'. Please understand, I was TEASING.
But - I think yer avatar is great for promoting the line o Pizza that 'Pinay for Pizza' had created. Each time I see it, I want to eat some pizza (or something) .

But - even with that said - if the corporation paperwork on 'Pinay for Pizza' has yer name and yer husband's name listed in the corporation paperwork - go ahead and submit it.

With the 'other' evidence that you have, I'd not worry about any affadavits, at least not for initial submittal.

was there any 'newspaper announcement' about the wedding / marriage ?

My problem is: I will need some sort of proof that my status is extended prior to 02/23... otherwise I will run into trouble with my employer!


If you don't have the NOA-1 by 14 Feb, make an infopass appointment, get the extension handled via infopass at the local USCIS office.

US Postal Carriers (the lads that handle the mail for you ) aren't that interested in ensure that YOU get YOUR mail - as long as it's IN the general vicinity of YOUR mailbox - all is ok with them.
