Removing Conditions on Residency General DiscussionDo i want "Tax Return Transcript" or "Tax Account Transcript"

I 've read that and it's also on the info page where you contact the IRS to order the transcript. But my question was in regard to "which one" of the two the Immigration IO officer want to see, has nohing to do with what IRS wants. I think most of you mis-understood me. I know the difference between the two. Thanks for the link anyway. I am sure it'll serve its purpose for others.

Ah - got it. Sorry for my confusion. I took 'it', wrongly, to be a Consular Official overseas, and not an IO stateside. My bad.

A Consular Officer overseas (which is not what yer asking about, btw) will want to see the 'long form' if no later amendments, then if 'later amendments', wants to see the long form and the short form.

if any amendments, that data DOES NOT SHOW UP in the long form.

The 'short form' doesn't show all data points, either, so is useless for inclusion. Some people have gotten lucky with the inclusion of the 'short form', but that was luck.

as for an IO in the USA - I've no idea, truly.

Removing Conditions on Residency General DiscussionFiling I-751 for my wife
The 'Consulate Record of Birth Abroad' from a US Embassy/Consulate - is very straightforward process - usually the request for USA Passport is done at same time (saves hassle with multiple trips to US Embassy/Consulate, as well).

the painful thing to acquire, though - is the
'EXIT VISA' stamp from Chinese Authorities - for some districts in China, this is easy thing - for other districts in China, this is painful process, must pay bribes to the proper offices.

re: too young to travel, nope - sorry, new borns travel all the time - I'll suggest you've been given bad info on that one.
---
other tidbits -
- any forms that need her signature, must be original signature, suggest BLUE INK, in case any question for 'copy or scanned' documents.
- pay attention to the 'out of country for 6 months' windows, as she might lose any status for residency in USA, might reset some clock.
- USCIS pulls her 'departure records' after the I-751 is submitted, so be cognizant about this 'record search', aye?
- for 'submitted evidence' - focus much on 'co-mingled financials'

Good Luck !

Ouch. it's more than 6 months now. Suggest you ask around a bit, about 'being out of country' this long.

Or review some topics here, with the search tool.

Removing Conditions on Residency General Discussiondivorce....calling 911
ROC ? Yes !

AOS ? No !

-----

you need to collect -
1. green card
2. passport
3. other IDs
4. a phone with a sim card
and get the f out of there.
----
the marriage certificate - can get duplicate at courthouse - don't sweat that one.
---
to file for ROC by yourself - you'll need to prove up that the marriage was entered in good faith, and show bonafide marriage evidence, and a copy of the divorce decree.

There's some timing issues, as well, as to when to file for ROC -

1. you still have time left on current greencard, not expire for some time - yer USC spouse cannot deport you, regardless of what he says. At most, he can submit a withdrawal of support for the I-864, but he would have to have substantial proof of YOUR immigration fraud.

2. you can file for ROC on your own, before the current green card expires, IF the divorce is finalized - ie - divorce decree in hand.

3. you can file for ROC on your own, AFTER filing for divorce, if any timing issues on current green card expiration - ie - say it expires on 13 DEC 2010, you filed for divorce on 12 Nov 2010 - you can file for ROC the day after you have filed for divorce. Filing and granting are two different timeticks in a divorce proceeding. USCIS will give you a RFE for the actual divorce DECREE, and thats OK - you have some time to submit the RFE back to them, the divorce decree paperwork.

4. if your state has 'fast divorce process' - ie - in/out in 90 days - you can file ROC immediately after you have divorce decree in hand. No waiting for current greencard to expire. Current greencard will remain in effect, ROC status starts after ROC is approved, but you get SOME status for 'ROC filed', if any gaps on greencard validity.

---
His family is doing this stuff? really? how very strange. Some of these things are criminal acts - ie - destroying a persons green card is a criminal act - that's a federal document, to be only surrendered to a federal entity. Destruction carries an arrest and fine, is federal offense.
---
Please do all that AlwaysWaiting has mentioned, as well.

Good Luck !

timing is an issue, reread my post here in yer topic about it ?

as for 'the waiver' - is a written letter, requesting the waiver of 'current marriage requirement'.

Also -

I suggest YOU file the divorce, instead of HIM filing the divorce.

He/She who FILES the divorce, controls the process.

which one is better i file the divorce now or let him file the divorce?

IMO, is better that YOU file it, not him.

The person that files, has more control over the divorce process.

You need to be that 'person who files'.

Seriously.

Hey ! Now that the immediate danger is past, strongly suggest you re-read all of the responses in your post, make copious notes, pen to paper, then map out your plan, dig out a calendar (or print one) and figure this stuff out.

Double Seriously !!

i made that already and will need to send a letter of request to the police department, since i move out the state..whats the next thing i can do now?

Assume that divorce is in the state where you were living with him.

For 'what's next' - IMO -
Study all of the county courthouse website - in the county you used to live in -
learn ALL about the divorce process for that county , then
YOU FILE the divorce paperwork at THAT county courthouse.

You'll have some 'county residence' issues, but those can be overcome.

At some point, if you decide that you need legal assistance, get to any Catholic Charities office, ask for legal aid.

Good Luck !

Removing Conditions on Residency General Discussiondivorce....calling 911

so i need to file a divorce now?

i didnt have my paper back coz when the day i called 911 what came into my mind is to get away from them...i

I assume you left much of your personal belongings inside the house, were not able to get them out of the house. Call the police department that handled the 911 call, and

INQUIRE WITH THEM if you can get a policeman to escort you INTO the house, stay with you whilst you retrieve yer belongings AND PAPERWORK, and escort you OUT of the house. Make that phone call, today, inquire.

Many police / sherrif offices do this, some don't; also depends on their workload. For background info - tell them:

1. your name is still on the lease and
2. you need to remove your personal belongings and legal paperwork from the domicile and
3. you are worried that your husband will physically harm you if you show up without the police.

Your husband won't be arrested when the police 'simply escort you' - but they CAN arrest him IF he attempts to physically harm you or destroy your belongings and paperwork, in front of THEM.

That police escort is for your protection. You should call, inquire if they do it - ask for the desk sargeant or 'shift supervisor', when you call in - don't assume the first person you talk to has any clue.

Good Luck !

Removing Conditions on Residency General DiscussionDivorce :(
Each California County has a web portal - where you can FILE for divorce online.

Have you researched your County Web Portal, yet?
DarnellMaleChina2010-07-19 13:37:00
Removing Conditions on Residency General DiscussionDivorce :(

Web portal ? No idea..

You should find it. Seriously.

You know the name of your county, right ? Use Some Google_Magic -
goto http://www.google.com

enter
<<county_name>> CA divorce filing in the search text box, replacing <<county_name>> with the name of the county (in CA) where you reside.

The county courthouse or county clerk's office should be on the first 2 pages of results.

A few aquaintences (sp?) of mine, this year, filed via their county web portal. Took about 20 minutes. You really should find YOURS, and review it.

Removing Conditions on Residency General DiscussionNo lease/mortgage, will that be a problem?
apartment share?
I dunno squat about that - but you really should generate some type of rental agreement or lease-holder's agreement, asap.

ROC is all about 'co-mingling of finances', among other things, and IMO, a lease document, rental document, SOMETHING that qualifies the domicile as 'our living-together address' (other than utility bills) is important.

Someone holds the lease, right ?
Someone pays rent to some agent, right ?

You really should (again IMO ) rethink this, asap.

There's another thing to try -

GO TO LOCAL IRS OFFICE, talk with Human - many Humans at the IRS OFFICE have GOD ACCESS to the computers, in REAL TIME -

that's 7 months for you, out of the country.

I'd schedule something else, during that time frame, to make sure that 'presence' will not be an issue.

Also is some issue for being out of the country > 6 months, as well.

IMO, if you 'squish in' 2 weeks of christmas break IN the USA, should resolve any 'presence' or 'duration' issues, given your current calendar.

Removing Conditions on Residency General DiscussionI did not "take my husbands name"
Alwayswaiting - no, alas - CBP is rife with personnel who only regurgitate what their bosses tell them. Apparently, their bosses came up through the ranks, from the same 'moronic-level' of uber-douchey @ss-munches that did 'front-facing' at the gate, prior. The only way to get rid of them, IMO, is via a rigorous 'knowledge test' system, and I don't see that happening anytime soon.

Now you have to accumulate 'bonafide marriage evidence'.

Check the I-130 instructions, for the 6 evidence types - they want to see that stuff.

Removing Conditions on Residency General DiscussionNotice of Action - Blue Request for Evidence
ROC must show 'co-mingling of assets'. You're lucky they are asking for it.

Here is similar, recent topic - http://www.visajourn...d-at-interview/

Suggest you study all, in that topic, as EVERYTHING ONE CAN DISCUSS ABOUT IT- is discussed there.

There is one major difference, however - in that thread - the OP was dinged at the interview, told anything generated after the interview date would NOT BE CONSIDERED.

You haven't had the interview yet, and you've not been told any 'cut off dates' for evidence 'as-of-dates' for new generation of evidence.
