Mostly, the evidence pile on a ROC case deals with financial co-mingling - such things as
--joint bank accounts
--joint tax returns
--utilities in both names
--rental agreement in both names
--house deed in both names

IMO, the affadavit portion is optional, not required.

there's 2 dates on it. Subtract one from the other, and IF the span is more than 2 years, she's not a conditional anything.

1. check the expiration date on the green card - make certain it fits in with your other plans.
2. use parent's addres or buy a po box at the post office.
3. re: residency evidence - you'll need to gather up what you have prior to leaving, generate more now, if needed - keep a copy with your parents.

re: the dates for interview - once an interview date is set - you'll have the local uscis address -
the problem is getting the interview changed to a later date -
as the ISO at the national help desk really (I mean f'ing really truely) cannot change the interview date at a local office. Many have tried (VJ members) and failed.

so - what to do ?
calling an ISO with the national office is useful regardless - it'll give you some electronic paper trail with USCIS that you tried, first, at the national office.

then prepare to send off that letter to the LOCAL OFFICE, attn (you find the title), a frickin POSTAL LETTER, for when you can come in
and finally
get an infopass appointment made, but YOUR PARENTS go and request, face to face at that local USCIS office, a rescheduled interview date. Make sure they have copies of her green card, passport, casefile, etc etc, with a limited power of attorney letter (signed by her) for your parents to act on her behalf for this one infopass meeting to reschedule the appointment

There - all bases covered - now get the heck outta here !

1. recheck your letter - it should have a paragraph in it that extends the validity date of your initial green card by one year. Keep a copy of this letter with a copy of yer initial green card, IN YER PURSE.

2. when you call INTO USCIS again, get an ISO, and REVIEW the address listed for you. If it matches - great - but ask the ISO to check if any postal mail was returned to them. IF something was returned (and the addresses are a match) ask the ISO to PUT IN A RESEND request.

3. If the addresses do not match, the ISO will tell you.

ISOs are important, don't waste time with a CSR - see http://www.dhs.gov/x...37986181.shtm#5 for a very detailed explanation.

Ya, this 'operate' seems tedious, yes?

There's been some members here who have reported much problems with address changes, specifically in conjunction with 'this notice' -
as the notice was nixed back via USPS ? USCIS goes nuts, does terrible things to yer casefile status, etc etc.

If you have some time, try to find them, using the 'advanced search' tool here -
search terms -
'address notice ROC'
then turn on 'show as posts'

one of the bits about ROC deals with 'co-mingling of finances'. Usually, that is shown via JOINT ACCOUNTS - bank, utilities, telephone, etc, where BOTH NAMES are on the 'paper that you receive each month'. Much of this 'paper' is electronic these days, but can still be printed out, in lieu of postal delivery.

Why stress and risk it?

Get a phone card or service that shows that you call your girl. Even Skype letz you do this for free and print out the logs.

This is something you should not be stressing on because there are too many options that let you document the phone logs you need.


ROC is a bit different, for these 'utility bills' proof. Phone Logs are not an issue on ROC, but evidence of financial co-mingling IS.

I think you and yer spouse should drag the 'offending family member' down to the local USCIS office during an infopass appointment, and squarely place the blame on this family member, in front of an Immigration Officer. Then ask the Immigration Officer if there is any federal charges to be filed on said family member for purposefully altering this federal document, then hand over the family member to the FBI, around the corner.

Soonish.

(I think it's the 10 year card that was damaged, from studying the timeline)

Convicted is another.

Being Brought up on Charges, IMO, should be enough for HER, to get her out of the house .

IMO, that's a good thing - as she will MOST LIKELY do the same action, again, when the replacement shows up.

is wording about 'extending your conditional status' for 1 year past the filing date of the ROC case.

I think you are fretting over way too much.

If you are returning from holiday in December (and not leaving the country again) then file in December. The '90 days' is a window of time - is not absolutely must file on 'expiration-90Days' - it's WITHIN 90 days of the expiration date. You've a span of days - 90 of them, pick one.

I think yer reading way too much into this, really.

if yer not going out of country from december-forward - you'll be OK after the expiration date, even when waiting on the receipt notice
IF
you file within 90 days of the expiration date.

I'm curious, on average from the day that an NOA letter is received to the day the biometrics appointment arrives in the mail. How long does it take? I'm thinking / hoping I can just try to do a walk-in in at the Detroit location when I do receive it.

Our travel + work schedules are so hectic now, after hubby came back from work today, we may not be able to come back in December.


Try really hard to be back in country on or before 11 Jan 2011 - as yer greencard expires then, it would be painful to try to return to USA after that date.

whatever you decide, try to mitigate the risk of being denied entry at the POE. That's really the only input, good or bad or indifferent, that I'd have for ya.

Sure - stuff in life happens. Supposedly, one is supposed to 'plan yer life' around USCIS due dates. Anyone hoping for the 'other way round', or vice versa, IMO, is shooting at windmills.

Can you tell us what yer USC Spouse thinks about all of this?

Strongly suggest you and your USC Spouse file AMENDED TAX RETURN for TY 2007, using yer new ssn.

Dig up a 1040X from the IRS web site, fill it out on Sunday - send it in to IRS, make copy of entire packet to send it as evidence.

ON ALL bank accounts that USC SPOUSE used prior to you having a SSN - were there POD (Payable upon death) instructions listing YOU as the beneficiary?

re: Joint Bank Account Stuff - get all of the monthly statements, from the first month you were added, to current date. ALL OF THEM. I assume March 2008 to current date, yes?

Utility BILLS NOT IN BOTH names is huge issue. Bad Form. Not a Major Ding, though - but still a big deal to NOT have it.

re: The Lease. Ouch. Sorry. Did you try for 'amendment to lease - covering authorized occupants', at least? No ? Ouch.

Going backwards in time, one of the major failures that I see, is that you did not apply for SSN 15 days past yer original POE
date. If you had applied between Day 15 to Day 74 from the POE date, you would have had a SSN. With a SSN, you could have gotten all that other evidence, from Day 2 of the marriage. I know it sucks, but it is what it is.

I guess in the grander scheme of things, you are WAY LUCKY that USCIS hasn't dinged you for getting married outside of the 90 day window.

does your 'green card name' match your 'passport name' ? if it's 100 percent match, then no, no other docs to carry.

if they don't match, then yes, the marriage cert and divorce cert are useful - but only at a POE when returning into USA, and then ONLY IF the CBP goon is confused. Can't predict that confusion, so it's better to be 'ready for it' than not.

2. contact immigration liason staffer at US REP / US Senator office, fill out the info release form, then have that ILS contact USCIS.

if i understand your process, the child is:

1. in usa
2. finished with adoption papers already

so what you really need is some 'recognition' followed by issuance of US Passport.

ignore any IR-3/4 visa processing for now, as it doesn't apply.

As I understand 'this', the child and the two of you will go in to a passport appointment, hand over the passport application and fees, then wait for several weeks/months for the passport to arrive.

As is, now, no need to file the ROC case on the child. The adoption was concluded prior to expiration of the Legal Permanent Resident Card (Green Card) , so, IMO, the child is golden, for now.

ya, be warned though -
is a 'wrinkle' for your child, for 'initial visa type'

MOST children come in as IR3/4 , your child did not. The CR-2 visa designation is VALID for 'prior visa type' and/or 'legal permanent resident' status, so don't let that trip you up, when you read that link - is no mention of CR-2/IR-2, but trust me, the child qualifies.

If you are completely protaginistic about this, as I would be (in the same situation),
then suggest you contact the Ombudsman's office with an official complaint.

The 'scope' here deals with 'real time data access' and 'real time data updates'
with 'updates' not being 'pushed' properly into the 'receiving' databases.

If you want some fodder on this, if you actually wish to pursue a case with the Ombudsman's office,
let me know - Happy to point out the disparate data sources that are NEVER updated properly.

For now, though, 'getting it right' via the INFOPASS appointment 'seems to be the right approach'
but even with that? I'd suggest to you that you bring 'sign-off letters' with you, each letter with a SASE (addressed back to you) - about 5 sets, and give them to the IO at the infopass appointment. Sure, he'll be confused about it - but do tell him - HEY ! Everyone that touches my address in yer system - I WANT THEM TO SIGN OFF that they did an eye-ball review, and corrected the address, and mail me a postal confirmation that they fixed it'

Sure, it's going overboard, but ya know what? It's HER casefile, so it's up to YOU to do something, yes?

I 've read that and it's also on the info page where you contact the IRS to order the transcript. But my question was in regard to "which one" of the two the Immigration IO officer want to see, has nohing to do with what IRS wants. I think most of you mis-understood me. Ah - got it. Sorry for my confusion. I took 'it', wrongly, to be a Consular Official overseas, and not an IO stateside. My bad.

A Consular Officer overseas (which is not what yer asking about, btw) will want to see the 'long form' if no later amendments, then if 'later amendments', wants to see the long form and the short form.

if any amendments, that data DOES NOT SHOW UP in the long form.

The 'short form' doesn't show all data points, either, so is useless for inclusion. Some people have gotten lucky with the inclusion of the 'short form', but that was luck.

as for an IO in the USA - I've no idea, truly.
