One of the sticky bits to successfully receive a 10 year green card, based on yer prior green card type and reason for issuance, is that you two must be domiciled at the same address.

Yer not, you sent in 2 addresses (one on you, one on her) so it hoisted a red flag at USCIS.

alas, on paper, you two as a married couple, don't exist. ROC primilary seeks to reveal your financial co-mingling - as is, you not really have proof of that.

Don't fret so much, though.

re: utilities that you do pay to the parents -
get a receipt book at the local office supply store, create 2 years of receipts with the parents, have both names put on the receipts (you and yer wife)

re: rental agreement, lack of -
explain in brief your living situation with the parents, list the duration as well.

re: joint bank account, lack of -
explain in brief why the two of you not have a joint bank account.

re: health insurance - show it.

were you ever issued a green card? if so, look at the expiration date, apply 90 days prior to the expiration date.

otherwise - wei - you've got a postal shipping problem with USCIS, they couldn't deliver yer greencard.
IF THAT'S THE CASE then call into USCIS, get a Tier 2 Human, ask about greencard shipping, review the address they have on you, try to fix.

I dunno, reschedules for the local office are problematic, at best.
Is difficult for the request to wind it's way to the scheduling officer, IMO.

IF yer in country on the initial date, bring a copy of the reschedule request letter with you, and go to the local office with the original letter, then see what's what.

whew ! it's good that it was returned.

Here's a thought, however malformed.

when travelling inside your county of residence, keep a color photocopy in the wallet, laminated.
Then, when he's picked up and asked to show his immigration status, he shows the photocopy.
If the arresting officer has issues with the photocopy, tell him 'Hey - the original is in my firesafe at home, let's swing by there on the way to the jail'.

Of course, do carry it when travelling out of the county.. Good luck with the wedding trip !

some comments:

1. the one year extension is good whether you're divorced or not, so you're ok to leave usa, plan on being back for any USCIS interview, though - the interview is important.
2. the removal of conditions case itself, must be able to show the divorce document, then is some 'self-filing' without the husband/ex-husband, but not need to show it on initial submittal - expect an RFE for it, you've got some time.
3. filing for divorce is not the same as being granted a divorce - self-filing for removal of conditions - needs the divorce decree at some point.

Hopefully others will chime in here - I pray your attorney is an immigration attorney?

at/during
an InfoPass appointment at yer local USCIS office.


With that stamp in his passport and a SSN, he can work, immediately, these 2 things satisfy the I-9 documentation requirement.

I know this was for ROC, but - ever since returning from China after the marriage, I've been successful in getting her name on everything.

Utility bills were the easiest, I must admit my lease documents are not standard (I lease farmland and ranches straight from the owners, use my own lease documents, wife signs her set, sends em on to me via DHL from China) and the house deeds were straightforward, each county clerk 'trained' me how to make the addendums.

At one point I just thought the problem for other folk was simply 'no SSN' but I'm convinced, after getting it done without her here, in country, it's all down to 'your approach' on talking with the CSRs.

In genERAL, THOUGH, there is some example affadavit for the I-130 floating around, you can use that same format, no problems.

Mostly, the evidence pile on a ROC case deals with financial co-mingling - such things as
--joint bank accounts
--joint tax returns
--utilities in both names
--rental agreement in both names
--house deed in both names

IMO, the affadavit portion is optional, not required.
