Removing Conditions on Residency General DiscussionROC coming up and getting divorced

how to get a FDNS officer, live, face to face, in person?

set up an infopass appointment, then go in , and once there, tell the clerk at the counter you need to talk with the FDNS officer on duty.

An FDNS officer is charged with investigating instances of Fraud.  If you feel you have enough evidence and the timeline on events makes sense to a FDNS officer, then

I suggest you pursue it.

Removing Conditions on Residency General DiscussionIs it too late to get life insurance now for RFE?

2 monthly statements per year? that's not enough, IMO.

Think of the bank statements on that joint account as a living journal of your comingling of finances.

Print each monthly statement from marriage date to yesterday.

So what if it stacks at 3 inches?  So What?  It's a continual journal, from marriage date to yesterday.  Get all months, submit all months.

---

IMO, evidence generated after RFE issuance date will be seen as 'scramble for more' .  So, life insurance issued after the RFE issuance date, will be seen in a bad light by the adjudicator.

---

also - you should take a look at any utility that has both names, then get monthly versions of that utility bill, from date of marriage to date of ROC submittal.

---

also - it's good you finally got the tax transcripts.  Bad form, alas, for not turning those in with the original ROC submittal. IMO (and others) that's the thing that triggered the RFE, as that collection is the 'bare minimum' when filing.

---

Removing Conditions on Residency General Discussionhow a divorce affect citizenship

my question is if getting married after i get divorced is going to affect my immigration case?

it's my understanding,

that to qualify for the 3 year rule on citizenship,

you must still be married to the human that signed the I-864.

Removing Conditions on Residency General DiscussionTravel with expired Greencard and Pending ROC without letter

so, you lost the receipt notice, that had the clear paragraph in it detailing the 1 year extension?

OK - get into a local USCIS office via INFOPASS appointment,

and ask for an I-551 stamp in yer passport.

Removing Conditions on Residency General DiscussionShould I apply for the removal of conditions for my green card or for US citizenship?

oh the wonderful marriage clock.

so - pull out your first green card. study the earliest date there.

it's 3 years from that first date (minus 90 days)

when you are still married to that human that signed the I-864

for

when to apply

based on marriage to a USA citizen.

--

it's not, repeat NOT, the amount of time being married to a USCitizen that counts, here.

it's the amount o time from first green card issuance.

Sorry.  Do the RoC, get busy..

Removing Conditions on Residency General DiscussionNeed to file I-751 / Divorce situation.

I suggest sending the letter back to USCIS, with a note that beneficiary is divorced and left no forwarding address.

And leave it at that.

DarnellMaleChina2013-08-15 05:39:00
Removing Conditions on Residency General DiscussionNeed to file I-751 / Divorce situation.

re: ex getting a 10 year card - sure, it's possible, without you, as there's a tickbox on the form covering divorce.  still on her to prove up bonafide marriage, and that's done with evidence of same - leases, bank accounts, receipts, photos, etc.

re: your support on the ex - uhm - you probably forgot , since it was all handled with that 'Korean firm' but you did, in fact, sign an I-864.  Bear that in mind when you are doing NVC doc intake on your current wife - you'll need to list the ex in the I-864 for your current wife.

re: what else to send back to USCIS - I suggest putting all in a larger envelope, containing:

1.  photocopy of divorce decree

2.  cover letter explaining the rush job with the korean agency, listing them by name and address, as well as the 'overview' you've given here, noting the divorce date.   Also include a small paragraph about why you opened the letter.

3.  the uscis mailer that you received.

your feelings, wants, needs and desires about the ex's 'wellness' and 'ability' to remain in the USA should not be your focus or concern, at this juncture.  IMO, you were played all along the way.  Your ex hooked the wrong fish, IMO (apologies to say that, it sounds really bad) and you should protect yourself on many levels.

That's all I'm gonna write, for the moment.  Go Get Em, and Good Luck !

Removing Conditions on Residency General Discussion10 year green card tracking number: how to find out?

uscis has an online status portal - so if you sign in to it,

Tracking # is issued after the 'card production ordered' status.

no tracking notification? EEEK !

Well, I suppose you could take the tracking # off of the envelope (now) and look it up, see what's what.

That's a shame, really, there was no tracking # issued to you in 'the normal manner'.

Although she'll get a biometrics appointment date and she's busy with school -

it's quite  possible for her to simply walk in before the date, and get it done when she's not so busy with school. (bring the appointment letter)

Surely she's a light day in the week, yes?

yup, anytime.

however - I suggest a modicum of 'worst case scenario' with the shipping company you chose, and plan to drop it to a shipping company no later than 1 week prior to the end of that 90 days.

Removing Conditions on Residency General DiscussionThe A number in the affidavit letter

I'll throw one more thing into the mix.

The A# for a K-1 visa chaser is assigned at USCIS.  It's noted in the approval notice on the I-129F.

So, if a petitioner (USCitizen) is filling out an I-134 whilst chasing a K-1 visa - it's the A# on the foreign fiance.

---

I am confused with the question, though, based on yer timeline and the forum you are posting in.  Which 'affadavit letter' are you referring to, and it's being filed in conjuntion with WHAT?  Assuming a ROC casefile, then it's the A# of the person filing for the removal of conditions...
