Hi there,
 
Found out good news today. Got a letter saying the removal of conditions for my wife has been approved. We are very happy. Only thing though, we want to take a trip back to see her family and it says the card will take up to 60 days to come. We were hoping to take the trip next month for the Asian New Year observed in many countries. Is it possible to go with the passport (of the origin country), expired green card, and letter that states that her green card is approved? Will this be okay or will we need to wait for the card to come? Her family was hoping to see her for the new year.

all this stuff will get her on the plane in the Asia Country, and through a POE in the USA.

provided, of course, the issue date on the letter isn't 1 year + 1 day before the POE date.

Yup. Absolutely. Not have it? Suggest submitting letters of attestation covering exactly where the money went, each month, by month.

I received a few "advises" saying that I should send everything claiming abuse and I would get my documents faster That doesn't apply to ROC casefiles, so I'll posit you've gotten the wrong advises.

If the base of the annulment was Fraud then you are screwed, not even a  great lawyer will be able to help you.

 

With all respect you signed a bunch of papers because she said "if you love me you should sign", and you signed the papers, are you serious?

 

My 2 cents:

1.  annulment was signed - this nullifies the marriage.  He got his first green card based on a bonafide marriage, or by showing evidence thereof.

2.  in the wording of the annulment, the respondent abandoned the marriage 3 months prior to him signing the annulment paperwork.

 

These 2 things would be enough to overcome most bonafide marriage evidence presented.  Since he didn't present bonafide marriage evidence at the interview, the Immigration Officer either has to ask for more evidence or weigh the casefile based on regular adjudication rules. 

 

His chances to 'stay in the USA' ?  Slim to none, at the moment.  This might change, if he is able to get offered a deportation hearing AND shows other evidence that clearly outlines what he's posted here about what happened. 

 

I tell folk who are fighting visa scammers to file for annulment and list the reasons why the annulment was to occur, I have to think that the OP's wife got some great advice and wanted to be certain this fella have no further inroads to stay in the USA.

In addition to what they are asking for,
you should present a pile of evidence
showing financial co-mingling,
from the date you married to yesterday.

Is best to show this as a monthly occurence - assuming 29 months since married, show 29 months of a monthly financial picture, both names on everything: bank statements, utility bills/statements, car insurance, life insurance.

I cannot stress enough just how important a monthly journal is. You did not submit it with the original ROC submittal, now you have ONE chance to compile all.

Your living arrangements are different than 99 percent of the filers, so practice writing letters of attestation about your living arrangements and your travel calendar.

Sure, a piece of that would be the monthly bank statements. Then there's utility bills, shown for each month (well, that's what a monthly journal would contain, stuff for each month).

first, there's residency requirements. If she's out of the USA for more than 6 months, she may have some problem returning to the USA, some flack at a POE.

second, there's the ROC receipt notice. If she carried that on her travel back, she's good for another year of USA Legal Permanent Resident status. If she left before getting this notice, and you moved after filing it, I suggest you chase down this notice with an ISO at the USCIS National Call Center, asking about returned mail pieces (don't waste time with a CSR, they are useless)

third, there's the evidence submitted. RoC , best done, shows a monthly journal of financial co-mingling. Not show that, then expect an RFE. USCIS is lagged, so it could be 5 to 11 months before the RFE is issued, or even longer.

fourth, there's the concept of having an interview. Since USCIS is lagged, don't expect an interview notice anywhere from 6 months to 13 months after filing. Once the interview notice hits yer postal box, she'll have 20 to 45 days before the interview actually occurs.

So, you've got issues with time, timing, change of address, possible RFE, and her being out of the USA for more than 6 months.

Uncle Darnell's Tried and True Method of Getting a Human™ at USCIS:

1. call the USCIS number. punch no buttons after it rings.
2. wait 2 to 4 minutes. A spanish speaking CSR will come on the line, and start talking.
3. If spanish is yer thing - GREAT ! just say 'Hey ! I need an ISO, I think there's returned mail pieces on me' or
3. Let them wind down to silence, then say 'English Please ! ' then let them wind down to silence again, and say 'Hey ! I need an ISO, I think there's returned mail pieces on me'.

Then once you get an ISO, just ask them if they have returned mail pieces on you, and ask what they are.

IMO, though, it's better to have them SEND IT ON, as you'll need some evidence to file with that Motion to Re-Open, to get the FEE waived, from 'non-delivery'. IMO, that's a valid reason to waive the fee.

i say start over.   here's the bits that are troublesome to me, with my explanation:

 

 

joint ownership of assets -> monthly bank statements. tax bills on house, if you have house.

joint responsibility for liabilities - monthly utility bills showing both names. life insurance showing each other as beneficiary.

and an active commingling of finances for the duration of your marriage -> monthly credit card statements

when I write 'monthly' here, I mean from the time you married to yesterday. Whatever that span is, must to show each month.

MONTHLY stuff.  

 

duration is a big thing, you've been dinged for it already already, so showing MONTHLY (IMO) is gonna be the thing that saves you. 

 

Think of it as a journal, starting from date of marriage, to yesterday.  Must to show each month of 'what occured' in the sections I wrote about previously. 

 

There's no harm in refactoring - none what so ever.  Done properly?  You will have success.

ok - coupla paths here:

 

A.  USCIS

1.  call into USCIS national call center.  Touch no buttons after dialing.  Wait till a spanish speaker comes online, then say 'English Please'.  Wait again.  Then when the CSR stops talking, say 'I have a problem with returned mail pieces - please transfer me to a ISO'.

2.  Stay on hold till an ISO picks up.

3.  When you get the ISO on the phone, ask - do you have any returned mail pieces on me?  If yes, go over the address again, and ask that the returned mail pieces be sent to your proper address.

 

B.  USPS

1.  Go to the station that handles delivery of your mail, tracking number in hand.

2.  ask for the site shift supervisor.

3.  wait a bit, until you get the site shift supervisor.

4.  give over the tracking number, ask the shift supervisor who delivered the mail (which human) that day.

5.  ask for a 'local mailbox  resort' if you live at an apartment and have a multi-box with the other tenants.  it's possible it was mis-delivered to an unoccupied apartment.

 

That's it, for the moment.  I pray you got lucky, and the letter was returned to USCIS.  If that's the case, well, you have a path to have it resent.   Dealing with USPS f'ups is a PITA.

so, OP cannot file for divorce, as 1] the wife did and 2] it's final already.

 

now the OP is understandably concerned about his ROC case.

 

It's very straightforward, file ROC alone, without the wife's involvement, ticking the divorce box on the ROC form.
