since yer in the USA on a greencard - with spousal support somewhere (visa or AOS) 

then yer path to USA Citizenship is very basic [unless you divorce or are out of the USA for extended periods of time] 

 

so - all of this stuff about who/what/where/when - 

does not apply - 

and stops applying 

after you've green card in hand.   

 

It's a new clock as well, to become a USCitizen after green-card in hand and 

we've a guide for that here !!

Some people in your exact situation do file the RoC

and come back to USA every 3 or 4 months to maintain their residency status.

 

Sure, there can be pitfalls in doing this, and requires some effort and logistics, but

 

if you want to maintain residency, there's a way to do that.

I guess it depends if'n you want to breeze through the RoC stage or no.

 

IMO, make a 'book' that resembles a monthly journal, and then everything that you have monthly 'joint' stuff on, such as:

--utility bills

--cell phone bills

--monthly receipts for domicile

--bank statements

--medical insurance statements

--car insurance statements

 

from day 1 of marriage to yesterday, all seperated by month.   yes, that's 24 months.

 

then other stuff that isn't monthly, put in another section, such as:

--joint tax returns or transcripts

--property tax payments

--lease, deed or mortgage paperwork

--copies of drivers licenses.

--POD instructions on back accounts

--life insurance documents

--car titles

--car insurance initiation paperwork

 

some folk will say it's not all required, and I agree, wholeheartedly - but to 'breeze through' without any RFE should be your goal here....

yup yup - what's going on there, and were you successful in getting the spouse's name added in to all of the utility bills? 

 

great evidence fodder, show all months from marriage date till yesterday.

 

ok - after a reread - I am stumped,

as

you could have done something else, like put a cable bill or satellite bill on yer parent's house in both of yer names.

and make a joint bank account that you two actually used - heck writing a monthly check to the parents on a joint account would have been great evidence fodder, (showing shared domicile between you and your spouse and payment of same) but you chose to do something else.

 

 

re: insurance - medical/life or hangnail - hey !  although you ain't got anything NOW - what did you have prior? Produce what you had prior, as it counts.

re: bank accounts - on a single payer bank account, you can create 'payable upon death' instructions on each account, and include those instructions with the evidence.  plan a trip into the bank(s ) and get it done.

 

 

re: partial tax returns.  no, no no and no.  USCIS wants to see COMPLETE returns.  Don't have it, you say?  Get the tax transcripts from the IRS.

ya, maybe I'm having a language problem.

 

I take another try...

 

 

 

When you are putting together your evidence for the ROC case,

present the evidence in a monthly journal format, having a section for each month,

and showing the evidence accumulated for that month,

for each and every month that's transpired between marriage and yesterday.

 

What goes in that monthly journal, in a month's section, you ask?

1.  monthly statements from bank

2.  monthly utility bills

3.  monthly 'other' bills

4.  monthly car insurance statements

5.  Anything else you two paid monthly.

 

Then if you want, for other evidence, of a general (not time specific) nature, such as:

1.  medical bills

2.  tax returns

3.  photos

4.  affadavits

5.  letters of attestation

6.  insurance documents

7.  POD documents

put into another section....   it's not monthly in nature, but accumulative. 

 

I hope that made more sense?  I'm quadlingual and forget english grammar rules sometimes ...

Why? If'n you present yer stuff in a monthly journal fashion, USCIS adjudicators won't ding you on anything.

Give up Conditional Residency,

get back to Canada,

then file I-130, chasing an IR-1,

this time keeping monthly records of the co-mingling,

co-mingling that you are starting this week.

 

Why?

 

USCIS wants to see 2 years worth of stuff prior,

and

you not have it. You did not do co-mingling of finances, so there is to evidence to produce.

 

I say go back, start over, try it again,

and this time - read the instructions, map out the plan based on what you read.

 

IR-1 is superior, as

once granted, you have 10 years to be a slacker. Sure, it does mean you have to NOT be a slacker up until the new visa is granted, but - HEY ! live and learn, right?

It is perfectly fine to file late  - if the feds owe him money, is no penalty and will get an extra interest payment.

 

So, without earning income anywhere on the planet, go ahead and WORK ON THE PAPERWORK for 2012,

you work on it - see what's what, see the scenario at 'married filing jointly' .   I not say to file it, yet - I said for YOU to work on the paperwork,

 

with the hope that you'd report back what's what when yer done, finding fun IRS tax thingies that has the feds giving you and your husband monies.

 

At least, that was my hope.  Tax forms and tax code can be fun, if you take the right approach of 'wow - they will give us money if I know what to do on this form !'

First, I never proposed lying to an immigration officer.  The question regarding the divorce settlement pertained to not withdrawing the I-751.  It is not certain there would even be an interview.

I-751 ? removal of conditions?

 

Basically, if you two signed it, then it's considered a joint petition.  There is no support to withdraw, as you signed the I-864 ages past and that document remains in effect ..

 

However, there is a tickbox for 'divorced' on the same form.  Since neither of you are divorced, then it made sense for (then) to not tick it.

 

She can apply for, and get, the ROC stuff without you, if'n you two are divorced. 

 

However, it was filed AS IF you two were married.   So, if there is an interview for the 10 year green card, marital status might come up.  

 

Lots of mud, nothing clear - so really the best thing for her is to show up at the interview without you, with a divorce decree in hand and a new I-751 document without your signature, if'n she wants to present a lawful case to remove the conditions.

 

 

That's it, really.

time and timing matters,so if the office is super busy, come back an hour later.

 

IMO, it's worth it to try.

 

missing an ASC appointment can be painful, but a day later with biometrics taken seems ok .

actually,

you can talk with an ISO at USCIS via telephone,

and THEY can chase down the RFE packet that you submitted,

and THEY can request it be forwarded off to the Adjudicator that wrongly denied the ROC case.

 

It takes some phone time, during the day - suggest you talk with your foreign spouse to make the time to talk with that ISO, if'n your duty time conflicts during the day.

Photos would be secondary evidence.

A monthly journal for 24 months showing all of the utility bills in both names, bank account monthly transcripts showing both names, carry more weight that the photos.
