It is not as confusing as you think,

The note in the receipt notice completely says,
"Conditional resident applicants, including conditional resident dependents, residing overseas pursuant to military or government orders WILL NOT RECEIVE an ASC appointment notice. To complete biometric processing, these applicants must submit the required items listed on the I-751 form instructions."

If you do not reside overseas on military/gorvernment orders this does not apply to you. Expect to receive the ASC appointment notice for your biometrics and you need the notice to enter the ASC or do a walk-in.

It would have been clearer for the notice to say, "All conditional resident applicants will receive an appointment, except the following..."

Just curious how long it usually takes - and also if they deliver it Fedex/UPS or regular mail.

I called the USCIS customer service people to change my address. As I hadn't received my NOA for the 751, they were able to provide my receipt number and directed me to update my residence address via the online AR-11 process.

The guy I spoke to was fairly helpful, but rattled off a bunch of jargon that I didn't really understand.

If I filed the AR-11 online, then I don't need to do anything else right - as it takes care of any pending petitions that I have in the works?

Have they changed the policy that if there's a mistake on your GC (i.e. wrong/mispelled name etc.) when you receive the card that they make you pay for the biometrics all over again?

I never bothered having my original GC changed after they mispelt my christian name (missed out an 'n'). It never affected me getting a driver's license/SSN or work so I never bothered to have it fixed. We didn't have the $70 to spare at the time...

I know you can waive the fee on the GC replacement form, but the biometrics are separate I think.

1) Is it usual for the USCIS to send the receipt notice to your residence address as opposed to the mailing address that I provided? We're moving in a few weeks, so as I will be submitting an AR-11 anyway (and will file a change of address form with the post office) so it probably doesn't matter. But just curious - we have a PO box address, and it seemed logical to include that as a mailing address rather than our soon-to-be "ex" apartment.

2) What's a good estimate on the wait time for NOA1 from VSC?

Thanks all - the moving thing is a little stressful especially with the immigration thing hanging over it as well.

Just a little concerned about the NOA. We're not moving for a couple of weeks - as the new apartment isn't ready yet, so I can't do a change of address just yet. Once we move I'll file the AR11 and a change of address at the local USPS office.

Also - another silly question perhaps. Am I right in thinking that the biometrics appointment is scheduled in a separate notice than the NOA1? I seem to remember that being the case with the original AOS application (though it was so long ago now I'm having trouble remembering).

Is there a contingency in case the NOA/Biometrics appointment goes to the wrong address? Would I be able to do an Infopass Appointment down at the local district office?

Just wondering if anyone send their i-751 package to VSC via Fedex. I saw that the other Service Centers had a PO Box address (which would make that a no-no), but VSC doesn't. So was wondering if anyone has had any problems (specifically with VSC).

That’s good to know. I mailed mine on Saturday – and saw from the tracking info that it went to some facility in Williston instead of St Albans. I got paranoid for a moment that it had gone awry somehow. I was going to send via USPS, but our Post Office closes on Saturday at the obscenely early (and unhelpful) time of 2pm.

Apparently due to 9/11 Fedex packages to Federal Buildings are automatically re-routed to a Fedex location for pickup. I was able to find out that my package (along with 1300 other items) was picked up on Monday, so fingers crossed I should get an NOA in the next few weeks.

The only reason I sent it that way was because my district USPS office closed at 2 on a saturday, and where I work in NYC the only Post Office location is in the Empire State Building, which due to 9/11 doesn't accept mail larger than a christmas card. Otherwise I'd have ended up waiting till the following weekend.

I've just made it through the instructions of the I751 form and it states there that written affidavits may be presented as proof of a valid marriage. :blink:
I find this a bit strange and would prefer to not having to ask any of our friends to prepare something like this.
Do you think this will be one of the more important evidence documents?

We don't have children so we can't present birthcertificates or the like, but we have a few things shared like bank account, insurances and property. We also don't have bills in both of our names (the companies we work with won't issue in both names).

Do you think we should include affidavits?

It's a good idea to include as much as physically possible - the guides suggest that the affidavits are considered major evidence as they provide specific testimony from identifiable people who can attest to the authenticity of your marriage.

The form doesn't say that they are compulsory, but better to be safe than sorry.

• Complete Form I-751 - Petition to Remove Conditions on Residence
• Filing Fee of $275 (via personal check) payable to U.S. Department of Homeland Security.
• Photocopy of Permanent Resident Card (showing both front and back)

Evidence

• A copy of the lease agreement for our current residential address in New Jersey, containing both of our signatures.
• A copy of a bank statement for our current checking account, showing both of our names.
• A printout of the confirmation page from the website for my 401K, showing my wife as the primary beneficiary.
• A copy of my current medical card from United Healthcare, showing both of our names.
• A copy of the payment agreement for our car, signed by my wife and I.
• A copy of our 2005 Joint Income Tax Returns.
• Copies of airplane travel itineraries for a trip to Los Angeles between in October 2006, with myself and my wife listed as passengers.
• A selection of printed and digital photographs taken between October 31st, 2004 and February 1st, 2007.
• Signed letters from friends and family members testifying to the authenticity of our marriage.

I can't remember offhand what the instructions said for forms of payment - except to (obviously) not mail cash. Personally I would (and did) send a check. At least that way in the extremely rare instance that the package gets lost or the payment somehow detached from the rest of the papers you can cancel it relatively easily and send a replacement. With the money order your money is already spent, and it's a hassle (to say the least) to cancel and reverse it.

That's the problem we have with our current landlady - she insists on being paid by MO, which is expensive and inconvenient.

We included pictures - we have several gigs of digital photos on an external hard-drive. I just picked a selection taken from different times and situations - they're not time stamped or anything, but they show us together in a number of situations (with different hair and clothes), and with various different people (including those who wrote our affidavit letters).

Included a dozen prints and the rest on a CD-ROM.

I've noticed on some peoples' lists of what they've included, they've mentioned a copy of their drivers license and/or passport.
Is this what most people are doing? It does not include these on the instructions list.


I didn't include the driver's licence but I did slip in a copy of my passport pages containing the K-1 Visa and the I-551 stamp.
