Submitting the I-130 Petition to put you on the track towards an IR-1/CR-1 visa (spousal) minus the added paperwork of submitting an I-129F for a K-3 which would administratively get closed anyway -- would mean one less document to fill out.  K-3s were done at a time when IR-1s were taking more than a year to complete -- that's no longer the case, especially for an applicant in the Philippines.

 

The advantage to getting married (IR-1 visa) is you'd get your Green Card shortly after arrival vs having to wait months in the case of a Fiance(e) visa.

 

Whichever way you decide -- good luck!

 My wife is Filipina.  We have a 5 month old son and we started our K-3 process a few months ago. 

 

I am stuck in the U.S. working, due to this long confusing process we have been away from each other for almost 2 years.

 

If anyone is available to help us through the process it would be much appreciated.

 

I was going to ask why K-3 instead of an I-130 Petition?  Reading the bold type answered my question.

 

The I-129FPetition will be administratively closed and the I-130 Petition will be processed so your wife and son can apply for IR-1/CR-1 visas.

If there is an MSC number it likely means that the I-129F was married up with the I-130 according to USCIS policy.  So trying to find the processing time for this on the USCIS website will be moot.  If you are very curious then the USC petitioner can call the USCIS, speak to a tier 2, and request the information on where both petitions are.

Hello we are December fillers and I contacted my congressman. They looked into the matter and I just got an answer today saying "USCIS has responded to this inquiry stating that your I-129F petition and is still pending at this time and that regrettably it is not possible to predict when this processing will be completed"

What do I do now?

 

If you filed in December you are still in the 5 month time frame for I-130 petitions (the I-130 and I-129F are joined at the service center most often and are adjudicated together.  Do not expect your I-129F to be adjudicated faster or separately as the USCIS has stated they do not do this.)  Contacting anyone at this point is useless.  Try in a month and call vs email.

Start calling the NVC in a few weeks to find out case numbers for either the I-130 or the I-129F.  NVC can still close the I-129F and put you on the CR1 path.

According to the paperwork I received the national visa center should take no more than 30 days. If it does you should call them.

What kind of message would I send to my loving wife if I took my son back with me to the US without her?

 

You misunderstand.  Your son will need his CRBA to get his citizenship.  He stays with his mother until she moves.  Just because he would be a USC doesn't mean he MUST live in the USA.  But without that citizenship taken care of beforehand (or if you don't qualify to do the CRBA) your son will need his OWN I-130 and then subsequent visa path.  If the K3 route is closed at the NVC, like 99% of them are, the K4 route is closed and your son will NOT be able to immigrate with his mother.

Just be aware that you most likely will end up on the IR1/CR1 path and should look at the NVC Process wiki on VJ and familiarize yourself with it.

 

Processing time is normally 6-8 months from NOA1.   Sometimes the change of A# means someone is working on your case, sometimes it doesn't.

I believe they're working on May or June right now. So if you filed later than that you have a good 4-6 months to wait.

Plus they're trying to clear backlog from 2012 to early 2013 still too.

VSC and CSC both process i-129F.  But EVERY service center processes I-129F when they are joined with an I-130 because are chasing a K3 visa.

Because you are trying for the K3 visa, both your I-130 and your I-129F will be joined up at the service center for the I-130, whether they normally process I-129Fs or not.  So they will be adjudicated at the same time.

Has he tried his congressman.  Sometimes they seem to be more effective in this than a senator. 


I would go for a visit anyhow.  I know when I was in the process (and before we started) going longer than 3 months without being able to touch my husband was about at the limit for both of us.  Sometimes, you just need a friggin hug!

each person needs their own I-130.  So if your daughter is not a US citizen, she needs her own petition, documents and fees. 


Also your husband needs to call his congressman and ask for help because this is WAY over the processing times.

Not sure where you're getting this idea the OP is actually on a path that will lead to a K3.  I get that it was there intention but what are the chances, really?  When did you last see two petitions approved on the same day, with the I-129F not being dead on arrival at NVC?  IMO, you are leading the OP down a path of disappointment by providing such false hope.
 

 

There's been quite a few going through.  Even a couple from Canada.  It's REALLY odd and I honestly think the USCIS is sending the I-129F before they send the I-130 and the NVC are opening the I-129F sooner than the I-130 packages.  

 

They have both petitions approved, which means they're still on the K3 path, until such a time as the NVC closes the I-129F they have that opportunity, albeit how unlikely and infinitesimal that opportunity is.   The thread simply belongs in this sub forum until such a time as they are specifically on the other path, either by force or choice.

No one can tell you how long a security check takes. Whats does your status say on the USCIS.gov for your case?

Good day to the staff on this site. I just want to ask regarding my petition. My Husband have received the letter coming from USCIS that his petition has been approved last April 2014, then the visa will be coming out after 30 days, so my question goes this way. Until now we did not receive any update from the NVC regarding my visa, since the NVS said that it takes 30 day before the approval of the said visa. It's been almost 2 months, so how long it takes before the visa will release or coming out. Thanks hope you will answer my query!

 

Okay we need to clear some things up because I think you are confused on some things.

 

You submitted a I-130 and a I-129F (to get a K3) correct? What got approved?

 

Once your petition (I assume I-130) is approved by USCIS you get sent to NVC.

 

Please read the NVC process Wiki  http://www.visajourn...php/NVC_Process you have much to understand.

 

When you say the Visa will be coming in 30 days, no that is way wrong you have yet to apply for a Visa. You still have to get through NVC, have interview in your country and get approved.

 

Now have your husband call NVC tomorrow they are open 7am to midnight eastern time to find out if they have even received his case.

 

Report back what they say. And both of you please read that link I gave.

all know that my wife here with me we live together .... she get sick and i take here to clink they fond she have cancer tumor stage 3 .... like to many friends here advice me to apply B1-B2 visa because doctor say she need to go back to usa soon as possible .... i do i take her and we go to consulate .... but they dont give me visa because they told me i cant have non immigrate visa and im waiting my papers I130 to get done .... my wife meet consul and she was showing him all her medical papers and she show him all certificate from professor ....and they get worried ... they told her to go back but she say is ur fault because you think bad on this married and denied my husband .. and know i die here and i dont go without him ......etc   one officer told her to call our lawyer and ask  expedite

Your lawyer or wife calls USCIS and request an expedite and they will tell them the necessary papers to submit to be considered. Once approved at USCIS you have to do the same thing at NVC request and submit evidence why you need an expedite.

 

So tell your lawyer to call uscis tomorrow and get on it.
