I applied for my wife back in Aug 2013 for K3 Visa. During that time, she was staying in Bangalore, India. She received her new passport also there in November 2013.

Now she has moved to Delhi, India. 

 

I recently got an update from USCIS that our case has been transferred to TX Service Center for faster processing. 

 

Please guide me what should be my next step to change her address and what address proof is required for this purpose.

It got transferred, certainly. 

 

suggest you find and read in a monthly I-130 filers thread, soonish.   And study the prior month topics as well.

I am four months pregnant. We sent off out 1-130 in November, and 1-129f in December. I am wondering how I can get back for the birth of my child. My husband is in the U.S and I am in Australia. Can anyone offer any advise?

Desperate here, as within a few more months I won't be able to fly.

 

 

you will wait an additional 4 to 9 weeks , as filing an I-129F to chase a K-3 visa,

usually means the I-130 is pulled out of it's place in queue,

and joined up with the I-129F,

both placed at the end of the queue.

I am in the same situation as the thread starter. I received 2 NOA2 for my I-29F and I-30. Both were dated December 30, 2013 and were sent to me on December 31, 2013. However, on my I-29F, it says there that Approval Notice Valid from 12/27/2013 to 03/26/2014. What does that mean? I also have an A### ### ### assigned to me as well as my wife. Also, when I checked with the USCIS website, it says on my I-29F petition that "your Alien Registration Number was changed relating to your I29F PETITION FOR FIANCE(E). Why is that?

 

This has probably the best Christmas gift I have ever received. My hands were trembling and my heart was pounding as I was opening the envelopes. My knees almost buckled after reading what was written in it.

Darnell, I need a guidance, I have not yet called  the NVC for the  case number and inn. Just wanted to ask whether the beneficiary can call the NVC and ask for the case number or it is just The US citizen the petitioner that has to call the NVC?

Both were approved on same day and are packaged together and sent out to NVC, together.

Since there's no further basis to pursue a K-3 visa, an unapproved I-130, expect NVC to administratively close the I-129F.

But hey - keep us informed with what actually transpires on the I-129F, aye?

There was one I saw approved a couple of months ago here on VJ, but they are extremely rare.  As mentioned by the others, you have to file for both and take your chances, but it is extremely unlikely you'll be able to go through with the K3 even if you want to.

No quite the opposite.  The I-130 alone leads to the CR-1, which is superior as you get a greencard upon entry to the USA and can work and travel right away.  Don't bother filing the I-129/ filing for the K3, it usually gets administratively closed at NVC stage and if you are one of the very few that get it, means more expense and paperwork once in the USA.

Wouldn't be the first time.  In mid-2011, some members reported having both petitions approved at the same time only to have the I-129F make to the NVC first while the I-130 was held back, no one could explain why that was the case and such reports tailed off shortly thereafter.

Is the NVC not closing the I-129F anymore?!? This is the 3rd person I've seen with the letter saying the I-129F is going to the embassy. 

The policy of administrative closure of the I-129F is still in effect only if an approved I-130 is on-station. If the NVC is sending the K3 off, then it it one of those instances where the I-129F made it to the NVC first. Chances are it will be closed as soon as the Embassy gets word of an approved I-130 being on-station at the NVC.

OP, if pursuing the K3 is too much of a hassle, then chase after a case number for the I-130 at the NVC. Once that's out, the K3 can be administratively closed.

It has been almost 8 months since my husband apply for the i130 and i129f petitions and my case was transferred on Jan 22nd, 2014 to CSC, so how long should i wait before i receive a decision?

Look at emilys. She was a Canadian last year also trying for a K3. Im not even sure a K3 would go through Vancouver but it may.

If you live very near Vancouver you can do your medical there and then do an overnight trip to Montreal. The most expensive part of Montreal for me was staying 7 days. It would have been cheaper to fly there and back twice actually.

What crappy insurance plan do you have so I know to never take a job with that coverage? For 20 years I've known this as the standard. No changes for life events? 



Okay it seemed like you were going on about insurance when the point is moot because she wont be here for the birth anyhow most likely. Health insurance in Australia works similar to that in the UK and Canada (and the rest of planet earth as well.) In fact the USA is the ONLY 1st world country that doesn't have some sort of socialized health care system.

We have good insurance because my husband works for the government thanks for asking. It is quite possible he didn't inquire well enough about immigration being a life changing event, he didnt have the job when we were married and I'm Canadian so I didnt NEED insurance when he started, but he was told it wasn't one and we'd have to wait until the next open period. Since he was in the USAF for 8 years he doesn't tend to challenge authority as much but hey, he volunteered for tours in Iraq and Africa so if thats the end result I'll take it.

Todd&Hanh I think youre misunderstanding thay the OP isnt concerned about the cost of health care in Australia, which would be nil, but wants to have the baby in the USA so the father can be present.

Not everyone can be put on medical coverage before they move to the USA or even before the open period for changing benefits.

I highly suggest you stay in Australia for the birth of your child due to several reasons.  Your visa is HIGHLY unlikely to be ready before you have to stop flying.  There is no expedite for pregnant mothers.  Medical care in the USA is very expensive.  If there are complications you end up paying even more.  A cash birth in the USA can run around $10,000.  If a c-section or any post natal care is needed, that figure jumps dramatically.  Not all medical providers consider immigration as being a life changing event (even though to us it is for sure.)  So they may make you wait until the next "open period" when changes can be made to the coverage.  I had to do with with my husband so I haven't had medical coverage from June, when I moved from Canada, until it finally started Jan 1st. (Open period was in November.)  

 

It is relatively easy and painless to obtain a CRBA for the baby after they are born.  This means the child is a USC and can move to the USA.  

 

I know it's really expensive to fly to Oz, but in the end I'm afraid it'll be your only option.  I highly suggest your husband earn up as much leave as possible so he can spend both the time with you for the birth and also to help you move when you do finally get the visa. 

 

Best of luck to you and your husband.  I hope he's able to be there for all the important bits and that your visa journey is short and swift.

According to the OP, their I-130 and I-129F were approved same day.  So unless the USCIS is taking longer, on purpose, to send the I-130 they should have arrived at the NVC the same day.  Twice I've seen the embassy send word back to the K3 visa chaser to start filling out the DS-160 in preparation for the K3 vs closing their I-129F.  In one the poster had informed the embassy that they had an NVC number for their I-130 and the embassy informed them that they could choose a path at that point.   So... It's getting rather odd that the I-129F is going through the NVC so quickly and that it's not being closed when the there is an approved I-130 the same day.

Once the case reaches the NVC you have a year between each contact with them to do anything you need to do.  So realistically you can pay the AOS bill, send the info, then wait a year to pay the IV bill and send the info.  So about 2 years you can wait.  The NVC is nice because you can do everything right away as fast as possible or wait and slow it down because you're in control of when you pay bills and send the packages.
