Your application is processing. It will be sent to NVC when it is finished the initial processing. At that point some fees will have to be paid and the affidavit of support sent/emailed in. Has your wife gotten a joint sponsor yet?

However long it takes for the approved petition to reach NVC. Then however long it takes you to finish the affidavit of support and send in all the documentation. Then however long it takes to review the material. After the NVC stage it will be sent to the embassy. So I am guessing about 3 months or so depending on how backlogged the embassy is with interviews and how long it takes YOU to complete the NVC stage.

The next step will be with NVC. It will involve the affidavit of support and proving you make 125% of the poverty levels for your household size or you have a sponsor who does. I have asked several times if you have taken care of this and you have not responded.

Come to the US and receive treatment. The process could take years if they are doing background checks.

If you pass away from cancer (or anything else) while waiting for the petition/visa to be approved the entire process stops.

Take care of yourself first. I can't imagine any man I would die for rather than spending some time apart.

Actually. I just read this from travel.state.gov - If the NVC receives the approved I-129F petition before it receives the I-130 petition, the NVC will process the I-129F petition.

You are almost there soon you will have a message saying the I-129F has been canncelled and I-130 will be approved then off to NVC just hang in there its worth it in the end

Okay, im going to call tomorrow and see what they have to say. Do i have to wait the 60 days for the k3 visa packet to be sent to the consulate in mexico?

are you talking about the I864? and the papers that go with that? If so, those papers will be sent to NVC after you have paid the fees online for them. (you need your case number and an invoice number to do this) Once completed with the NVC the approved papers will then be sent to the consulate by NVC.

Like NLR says..2 weeks up to 8 weeks..

If you want to call to see if they received your package, you can, they may not have your case number ready yet, but they can verify they received your packet.

I would call each week until you get a case number.  For me, I got a letter stating about my I129f was being closed after my I130 was sent to NVC.

Since both were approved, they will close the I129f and continue with the I130. NVC is backlogged now and are telling people the time may be longer than 30 days to get your case number.  The normal processing time at NVC right now is 60 days.

You might have longer to wait now. As long as the 129F / K1 visa is, it is significantly longer for married couples doing the K3. I would cancel the I-129F as it would  be fraud to continue to get a non immigrant Visa because you are already married.

We have been waiting a year for the K1 due to needing a waiver.  Will be a year exactly this week.

 

However, Im pretty sure its about to be issued.....I think this week.

 

You can do it.  Try to visit as much as possible.... it helps.....it gets easier for some and harder for others but you CAN do it.

My i129F was approved first. As far as CR1 being a better choice, i believe that would apply for most people, however, the cost of going to visit my wife every few months is by far more expensive than the extra $1000 I will pay for going the K3 route.

For those who are contemplating or have filed the k3 visa it DOES exist. My wife just interviewed at the consulate today and I am thrilled to say it has been approved! I have been stuck at NVC with the I-130 since June and I was preparing myself for the bad news that the consulate would tell her at the interview that the K-3 was no longer valid, however, they went ahead and approved it today.

Do not give up hope and don't believe when people say it doe not exist. It doesn't hurt to pursue it and in some cases like mine it actually works.

Update on my case. We followed the K3 path. My wife just had her interview last Thursday but we hit a snag, I guess. During the interview, the CO asked for a copy of our CENOMAR but she doesn't have one. Now, I read in another thread that the same thing happened to them also and he said that they waited for another 44 days before they got their visa. So hopefully, that will also be our case. They did take her passport though and she was told at the releasing section to just wait for her papers to be delivered to our place. Will update as soon as we hear from them.

Good morning. I believe I am also in the same boat as the starter of this thread. Both of our applications (I-129F and I-130) were approved December 2013. I received both Notices first week of January. We have not received any letter or notice from anybody, US Embassy in Manila, NVC or USCIS saying that our I-129F has been cancelled or what. I checked the status of our applications with ceac.state.gov a couple of weeks ago and is said, I-130 is at NVC while I-129F says "call the consulate where we think our application is being process" (US Embassy in Manila). I called the embassy hotline in Manila and they said that our I-129F is still active and valid. So, we scheduled for an interview (Sept. 5).

 

My wife just got back from Dubai, where she was working since May of last year, that is why she was only able to start processing her paperworks now. Last notice we received from NVC was telling us to send support documents (Marriage cert, police and NBI clearances, affidavit of support, etc.) I don't care if we have to spend more to adjust her status here. I just want to have her here as soon as possible.

Incorrect. The I-129F is the proper form to use for the K-3 petition. It's just unlikely to be approved. (Some people, however, do still get them, through vagaries of NVC/chance.)

IR1/CR1s seem to be running at a little over a year. 

 

If they hadn't had the massive system crash recently, which seems to have set NVC back a month, it seems like you probably would have been contacted by now. If you look at your timeline, it estimates you should have heard by the end of July. I'd give til the end of August, and then contact the appropriate folks to see what's going on. But based on what people report here, you're probably looking at another few months, but nothing like the wait you've already had.

It looks like you filed for the K-3 after filing the IR1/CR1. Chances are they're just going to be merged together,... as other people will undoubtedly tell you, K-3 is largely obsolete.

 

The good news is, by your timeline, it looks like you're a good chunk of the way through the wait.

Did you apply for K3? Since your I130 was approved at the same time as the I129F, the I129F will be cancelled and the I130 will go to NVC for normal processing...seems to be around 3 - 4 months - then it will be forwarded to the Embassy in India. 

 

You don't have a time line...so, we don't know what you're doing...please fill out your timeline.

to 'get a visa' -

one has to apply for a visa...

 

For a K-3 - that's done at Manila IV - filling out forms and paying a Visa Application Fee.

 

For a CR-1/IR-1 - that's done at the NVC - filling out forms and paying Visa Application Fee and Adjustment of Status Consular Evaluation Fee .

 

Both require an interview at Manila IV after the Visa Application is accepted.

 

 

 

To be allowed to apply for a visa -

One has to have an approved petition (I-130 or I-130 + I-129F) ... 

 

 

I am so uncertain (back at post #1) by what you wrote - I've never heard of this visa thing coming in in 30 days after the I-129F petition was approved.   Not saying it couldn't happen - it's just that I've never heard of it.

 

Can help clarify?? I ask - Cause I dislike confusion...

hello my best friend here in this nice website :

all know that my wife here with me we live together .... she get sick and i take here to clink they fond she have cancer tumor stage 3 .... like to many friends here advice me to apply B1-B2 visa because doctor say she need to go back to usa soon as possible .... i do i take her and we go to consulate .... but they dont give me visa because they told me i cant have non immigrate visa and im waiting my papers I130 to get done .... my wife meet consul and she was showing him all her medical papers and she show him all certificate from professor ....and they get worried ... they told her to go back but she say is ur fault because you think bad on this married and denied my husband .. and know i die here and i dont go without him ......etc   one officer told her to call our lawyer and ask  expedite 

   1- Can we expedite our process?

- 2 - Can you give me Advice ? I really like to talk my problem with all of you because i love all peoples here

What I've seen done successfully in a case like this, was to get a US Senator or Congressman involved in the B1/B2 process, with the USC's medical hardship as the justification.  You'll still have to wait out the immigrant visa process, go back and get the visa later, but it CAN work.

 

The situation I'm familiar with, was a US Citizen who had complications of diabetes while visiting his foreign spouse.  He was medically evacuated to have his leg amputated and his wife came to take care of him for a few months, then went back to interview for the CR1 or IR1 visa when the time came.  It's worth a try, but the US citizen or close family member would need to start by contacting the Congressman or Senator's local office near them.

There's been quite a few going through.  Even a couple from Canada.  It's REALLY odd and I honestly think the USCIS is sending the I-129F before they send the I-130 and the NVC are opening the I-129F sooner than the I-130 packages.  

 

They have both petitions approved, which means they're still on the K3 path, until such a time as the NVC closes the I-129F they have that opportunity, albeit how unlikely and infinitesimal that opportunity is.   The thread simply belongs in this sub forum until such a time as they are specifically on the other path, either by force or choice. 

 

I see.  Obviously, I don't agree (which doesn't matter) that it belongs here, because what they really need to be doing is getting up to speed on the immigrant visa process they'll be using to get through NVC and on to the Consulate, or at least getting up to speed enough to make a decision what they really want. 

 

On the off chance the I-129F survives, AND they want to proceed with it, there's nothing much they'll need to be doing about that anytime soon, except maybe take a look at an I-134 and DS160 examples.

 

In any event, it's time to obtain any needed police report(s).
