K3 is pretty much dead. The I-129F is a fiancee visa. You are married so this does not apply to you. You are looking at the CR-1 visa for married folks. As an FYi, reviews do not take minutes. They must research multiple databases, often asking other agencies to respond and they have their hands full as well. Heck, prolly took several hours just to read you 27 page document. It's only been a few months.Stop being antsy. It's just the way things work sometimes.

I just got of the phone with a tier 2.

I had a question about a typographical error in my A number (I am a USC) on the NOA1.

He said that it does not matter since I am a US citizen.

I also asked him about the I-129F i filed for a K3.

He said: " I'll be honest with you, they are not going to honor that"

he also added: "if you don't hear anything by Dec 26 (6 months after I filed the I-129F), call us again"

 

So, I guess K3 is dead, but I'll still call themthe first week of January to check on that.

Usually it is the people that have been through the same case are the people that can give good advice. Please, if you have never been thru it don't argue much.
My wife recently joined me on a K3 visa and our green card interview is next week September 2013, K3 visa applies to those who are already married and wants to speed up the process to be together. The USCIS won't lead you to the wrong thing nor lie to you, yes it a little more expensive but a faster way to bring your spouse.
Some of the members think that K3 visa is obsolete. They are wrong, I have been through the process and my wife is here now, the type of visa on her passport says K3.

  Your U.S citizen spouse should easily be able to answer this question for you by contacting your lawyer and asking for clarification.  The U.S. spouse is the one petitioning for you and should be able to get the answer directly from him/her.   Did you try asking your spouse ?

And I wanna keep this journal from start to finish for you guys. First of all I am looking to getting the K-3 Visa for my soon to be spouse. We are not yet married. We plan on getting married in her country, the Philippines, in June. There seems to be some experienced members here so my first big question is if I can start the FORM I-130 ahead of time without being married yet? I wanna know if I can jumpstart this process. With my last visit my fiance receieved the Affidavit from the Embassy (legal contract to marriage) and thats it we haven't even gotten the Marriage liscense yet.

 

I am really confused actually and looking for guidance...if I'm not mistaken the process goes something like this (very simplified)...

 

1. Form I-130
2. Then Form I-797
3. Form I-129

The receipt for which application? I see you are K-3.... First the I-130 is sent (the spouse petition) and when the receipt is received, then the I-129f is sent in with a copy of the I-130 receipt to apply for the K-3. Sooooo..... It depends on which receipt the lawyer is referring to. We received our I-130 receipt about 1 week after USCIS received it. We did not file for K-3 and did not use a lawyer. Sounds like your I-130 papers were just sent or your lawyer is taking thier time... Good luck

I posted this on another thread but felt perhaps it might be helpful here as well.

 

We filed our I-130 end of June.  Studied timelines and USCIS processing times and realized they were starting to drag.   Called the USCIS to see if they could tell me if my petition was still really at the NBC, which they confirmed.  In the same breath, the CS person referred me to the K3 telling me that was of course an option to pursue.   Sounded more promising, so that's what we did (I had already resigned myself to knowing it was going to cost us a whole lot more to have to adjust status from the US, take more time to get work and driving permits, etc, but I was ready to deal with that if I could get him here sooner.  Thus we filed the 129F/K3 application in August.

 

Since then, while I was already reading on VJ that K3's were no longer really being processed and 130's and 129's being joined, I've continued to check on both of my applications hoping VJ folks were wrong.

 

Several weeks ago I decided to follow other VJ advice and asked my congresspersons for assistance, moreso just to get someone to tell them where our documents are (this was when the news started coming out about petitions/applications being transferred out to the other VPC's).

 

Response back from my congressperson was pretty quick, probably about a week  or so.   USCIS responded that "our I-130 & I-129f had been joined together and would be adjudicated together IN MAY!   A couple of points I got out of this response were:  1) K3's really aren't moving on their own so that is pretty much a waste of time and energy and 2) IF we are really adjudicated in May, that will put us at exactly 11mths, altho I'm going to guess that that's an estimate and could change tomorrow.....most likely they counted out 11mths based on what the processing trend appears to be today and said MAY, not like they actually KNOW it will be done in May.   Kind of had to resign myself to the reverse explaination as being the real one.

 

This however was good enough for me!   Oh no, I had to go back in for one more inquiry!   I asked my congressperson if they would please (re)-inquire about the 129F/K3 application and if/why it's not being processed seperately as was the intention when the darn thing was put in to law!    Heard back just this morning from my congressperson regarding the status of our 129F/K3 application:

 

"The processing time frame for I-130 and I-129F are the same.  If the petitioner files the I-129F it is matched with the I-130 petition and are adjudicated together.  

The NBC will expedite the I-130/I-129F if it meets the expedite criteria.  Due to the extremely high volume of expedite requests for this case type, we are strictly enforcing the criteria that has been set for these expedite requests. 

Based on the information provided, we are unable to expedite the processing of this case. All expedite requests must be accompanied by supporting documents that demonstrate that one or more of the expedite criteria have been met."

 

So there it is.....clearly nothing else will be done with our K3; ain't gonna happen.   We're gonna sit here with all you other fine folks and wait.

Hang in there the K3 application was good for me got my case out of the local office and back to Kansas City they did cancel the K3 but approved the I-130 but was 256 days from NOA1 to NOA2

 
The USCIS told us, 15 days for a decision, NOT a few months. 
Sorry, its really hard to tell someone who is sick not to be antsy.
My son helps me when he can, but he is not always available.

No recommendation is needed - it's a CHOICE that is available to anyone who files an I-130 for a CR-1/IR-1 visa.

 

(VJ is) also reporting that 12 K-3 visas were awarded this year (for the last 360 days) under the heading K Visa Timelines Statistics. 186 days to interview for the K-3's, while the IR-1/CR-1 statistics report 321 days. 12 I-129F petitions that apparently made it through the NVC before the I-130's showed up.

Sorry Randy - NVC policy in effect more than 3 years now, when the I-129F arrives with the I-130 from USCIS to NVC, NVC will administratively close the I-129F. There's a blurb here in the NEWS section on it, might be useful for you to dig and read it.

At the moment, and over the last 7 to 9 months, filing the I-129F made sense because of where the I-130 went - usually gone into a local office to sit in some stupid queue. Once the I-129F was filed and then arrived at a different office for adjudication, the I-130 at a local office was pulled, and sent to that other adjudication office. The only benefit this year, really, was faster adjudication times (5 months instead of 7 to 11) .

The Limitations of the K-3/K-4 Nonimmigrant Visa

 

When the K-3?s I-130 reaches the Department of State, an immigrant visa is immediately available to him or her such that the he or she and his or her children are no longer eligible for K-3/K-4 nonimmigrant status, but rather must immigrate as lawful permanent residents.

 

 

Basically, that the K-3/K-4 are NO LONGER AVAILABLE once the "K-3?s I-130 reaches the Department of State". It's not clear that that is based on an actual law, or if it's simply another USCIS policy that is ripe for a lawsuit, like the over-21 K-2 policy was, but that's what you're up against with the I-130/I-129F horse race these days.

I'm seeing some I-129F for K-3 processing times on VJ for THIS YEAR - we'd be doing a disservice by telling people (or implying that) they're NOT AVAILABLE or OBSOLETE.

This chart says a lot - over 400 days processing at CSC, closer to 200 to 300 days at the other service centers. This is the time from NOA1 to NOA2 for I-130's

I spoke to an advocate yesterday in PA. She specifically told me that K-3s are now taking LONGER than I-130 petitions to process.  The normal processing times are now 9-12 months for an I-130. 

Sorry,  I'm not sure what an Advocate is?  Also in PA?  How does that relate to the K3 proces time at the NBC. Would it be the truth or like talking to a tier 2?

 

For the most part I'm all in and have filed the I-129f June 24th before I knew about this Site. 

 

This whole K3, I should or should not is very upsetting to alot of people here. It makes a person feel like either they did not do enough or did too much.  So I'm not bringing it up anymore as I've asked my questions already.  I've come to understand that the overall opinon on VJ is about 50-50 for the need to file a I-129f if your in a hurry.  Crazy to reason out why it could be that filing for it could slow your Procces Time for the I-130 too, but that is what is being said by some.  

I see a big bust in the charts On VJ.  The stats and trends do not match up the last few days.  Off by about 50 days I think.  No information on the NBC any where that a person can use.

We filed K3 in 2007.  We were already married.  It does apply to their case. 

 

In 2007 our I130 and I129F were approved on the same day.  We got a K3 visa because we asked for a K3 visa and it saved about (60) days of processing for us(based on timelines anyway).  So our case from start to US entry was 7 months vs. the (very shortest timelines) of 9 months for an immigrant visa.  That was the purpose of K3. 

 

They don't do that anymore.  Now they link the two petitions and if the I130 / I129F gets approved together the I130 gets sent on for CR1/IR1 processing and the I129F gets tabled.  The processing time is much faster post-approval than it used to be so at the most the NVC steps take an extra month or so. 

 

Since the purpose of K3 was to expedite bringing families together and IR1/CR1 processing times have caught up with K3 processing times the K3 process is essentially obsolete. 

 

It is, however, incorrect to say that "the I129F is a fiancé visa" and "does not apply to married applicants"

 

@OP:  It is hard to get a case expedited.  Sounds like you are on the normal path so it will be another couple months.

 

The charts are showing that there is a big slow down with the I-130 now.  looks like 100 days more time added since 2-20-2013  So my question is then why would a K3 not be a good Idea at this time.  It is unclear to me how the two (I-130 and I-129f) are linked at USCIS.  On the surface getting the wife here earlier with a K3 is the best way for me.  The extra cost is well worth it.  So I wonder if your information is dated and things have changed back to a situation where we need the K3?  USCIS website says I-129f for already married is 5 months,  the I-130 are taking 9-10 months?  Plus as you have said a lot of time saved in the next step too.

the whole thing is fluid

with the timelines of approval varying differently, there is no way to tell which of the petitions will go through first

yes many members say the k-3 is dead, but that is not true, it is still a viable petition process regardless of what someone here tells you.

with all the shuffling of the petitions and where they will get approved these days it would not surprise me to see your 129 go through first.

with the expedite, give it another try with uscis, make sure you speak with an IO if you call.

you will need to complete another expedite request at nvc

I too, filed both I-130 and 129F (K3) back in early April. I too, spoke to a Tier 2 and got our congressman involved.  Same reply -- both at NBC and BOTH will be adjudicated together (whenever that will be). By the way each time I pass through the US land border (go once a week to shop) they also suggest I file for a K3 -- but then they are Customs and Border Patrol and NOT Immigration Officers!

Dreamers - once you have that privacy release form in place, 

I got a lot of 'action' with my ILS about my expedite.  I think she got tired of me, taking up her phone time, emailing in to her, and faxing her for status updates.  But - I do remember - I talked with her a LOT about that expedite- and she worked hard on it, a month's span for the duration.  Ya, i know, in the end, it didn't matter, but she was talking to them (the local USCIS office congressional liason human ) 

 

So, if you just started convo with your ILS human, KEEP AT IT ! (IMO).

May 28, 2013 Finally sent I-130 off to Chicago Lock-box via express mail and all required paperwork, photos etc. Notarized affidavits from 3 people to show we were "really in love" (one was from my 22 year old son who has a traumatic brain injury) Photos, convos and anything i could find that tied us together. Of course all Tunisian documents were translated into English.

 

May 30, 2013 1-797C received from I-130: Noted this came from NBC-Overland Park Kansas

 

June 17, 2013 Filed the I-129f and corresponding paperwork to Lewisville, Texas Lock-box via express mail.

June 19, 2013 I-797C recieved from I-129f: Noted this came from NBC-Lee's Summit, Missouri

 

June 28, 2013 Called to expedite the I-129f (We qualified for 2 of the criteria for expedite services.)

 

July 2013 (not sure when) USCIS sent our 1-130 to Lee's Summit, Missouri so both our I-129f and I-130 were together @ Lee's Summit

 

July 19, 2013 Letter received referring to the 129f from expedite team requesting more documents.

July 29, 2013 Faxed 27 pages to the expedite team (Note: 2 explanatory pages with 25 supporting documents) to Lee's Summit, Mo.
 


August 16, 2013 Called to expedite the I-130 (NOTE: The USCIS customer service person said, they don't necessarily expedite the 130 so she entered under TYPE OF SERVICE REQUESTED: OTHER TIER 1 - on our 129f it said under TYPE OF SERVICE REQUESTED: Expedite)

September 2013 No movement or word about expedite.

October 10, 2013 Contacted our Sen. ####### Durbin, Sen. Mark Kirk and Congressman John Shimkus offices filled out releases to have them contact USCIS about our cases.

October 16, 2013 USCIS terminated our 129f and approved our 130

 







A BIG THANK YOU TO KATIE at Sen. Mark Kirk's office, I believe she gave them a nice but firm push for them do so something before we lost our home. We can never Thank her enough. star_smile.gif

I had this conversation with my immigration attorney the other day. I'd post it but last night I was told to "calm down" by someone on VJ because they see my posts all over...  So a BIG F U to that member....  

 

It does suck being a USC and being treated as if you don't "count"

 

lol, that's great, i like you! Honestly, idk if they "see" what i post about their lameness,
They are the ones who set up their own "get up set up" !!! I think their system needs a re-vampin'

because the one they have now is not working very well. I don't see how some people who aren't married

yet are being approved and some of the ones who are married must wait. Arent'  married people suposed

to have presidence over those kind of cases? (If one spouse is a U.S. Citizen i am meaning) I thought

there was special law for this...anyone?

after reading the expedite reason, I'm just thinking it wasn't approved because it was a pre-existing condition. 
 

There is only one reason needed to ask for expediting a case. We just happen to have two reasons. Yes, i have a "pre-existing"

conditon, but i wanted to show the reasons i do not go out and get a second or third job to keep things together until he can arrive. 

 

I am so upset that my husband is not being allowed to join me. Not just to help me pay the mortgage, but fix our home up as winter is approaching fast.

At the rate that this big top adventure is going, i will be homeless anyway. So all the hard work i have done to save our home seems to be in vain.

And believe you me, the USCIS people do not care one iota if this were to happen, BECAUSE IT DOES NOT EFFECT THEM PERSONALLY! 

If it appears to you readers out there that i am bitter, oh yes.... i truly am, especially from the news i recieved today. Get this:

I contacted our Illinois Senator Mark Kirk last week in despiration. His office called me today and told me that the USCIS office personnel stated to her



that "their 129f is NOT even in expedite status!" when I have the reciept right in front of me stating it is! And so did she, but she justified their incompentence of the right hand not knowing what the left hand is doing. Now i am not saying that i am ungrateful for their help, but in all honesty...it was no help.

These USCIS and State dept. people are controlling our lives, and that is what really upsets me. Who do they think they are? They have had 3 full  months to mull
over our papers in "expedite" status. And not even one incling of courtsey to respond or give a time frame on the expedite process. QUOTE UNQUOTE: " YOU WILL RECIEVE A DECISION OR NOTICE OF FURTHER ACTION SHORTLY."


 

I guess Chanel 4 in St. Louis is my only hope. I find the more you expose unjust treatment, things will start to change. Hey look what whistleblowers

have done here in Illinois: OUR LAST 4 of 7 GOVERNORS WENT TO PRISON because they were all called out! hhahahaha there's one to put in your trivia hat. rofl.gif

 

...AND while i'm still ranting....I LOATHE BEING CALLED A CUSTOMER! i am NOT a customer, i am a U.S.born citizen who abides the law. My husband is a good man too, who abides all laws especially God's. If i ever treated a customer like i have been treated, unemployment would be the line i'd be standing in.

Pffffffff, i love my tax dollars so hard at work, it gives me that warm fuzzy feeling.

I, too, filed an expedite request with the I-130.  It was never 'answered'.  I was exceptionally ####### about chasing the expedite..

wow.gif you have been thru so much, i about cried when i read your stuff.

 

Honestly, I can not believe that MY GOVERNMENT IS KEEPING MY HUSBAND FROM ME! I can not help but to feel this way.

It seems to me, the USCIS folks are playing GOD and they like it! They are suposed to work for us.

I totally am so ashamed of the United States for treating people in such a manner. helpsmilie.gif

Well, USCIS thinks it's still a viable path.

 

NVC, on the other hand, will administratively close the I-129F IF it arrives with an approved I-130.

 

USCIS will always say 'Sure - go ahead ! File the I-129F - it's perfectly fine ! '

 

been this way since 2010 or so, NVC changed their flow that year, administratively closing the I-129F when it arrives with an approved I-130.

 

As to 'why' ? I attritubute it to a level of stupidity from a branch of the US Government.

I spoke with a Tier 2 today about the expedition on our case. She told me both our 130 and 129f K3 is at the National Benefits Center, and that is good they are together.
She filed a "129f Service request" because we should have heard something by now. She said give this 5-10 days for a email response or a letter from Lee's Summit on the

status of our requests. I guess you have to be the squeeky wheel to get anywhere. Its such a small step, but its progress, nonetheless....dancin5hr.gif
