Well, USCIS thinks it's still a viable path.

 

NVC, on the other hand, will administratively close the I-129F IF it arrives with an approved I-130.

 

USCIS will always say 'Sure - go ahead ! File the I-129F - it's perfectly fine ! '

 

been this way since 2010 or so, NVC changed their flow that year, administratively closing the I-129F when it arrives with an approved I-130.

 

As to 'why' ? I attritubute it to a level of stupidity from a branch of the US Government.

If it's been 6 weeks since you requested expedite, it looks like you didn;t get it. If you expedited on medical grounds, you;d need several doctors letter stating the nature and severity of the USC's illness.  It needs to either be terminal or so debilitating that he needs you there to care for him- something like helping by driving him to doctors appointments is not enough, because they will argue he can get a local friend/ family or a taxi service.

My 129F for K3 was approved and sent to NVC at the same time as approved I130. All communication I received from NVC was about I130 process which is now in Case Complete status. There was no communication from NVC about I129F. When I called NVC a few weeks ago, I was told I129F was administratively closed by NVC. But I still wonder why they did not send any communication about administrative closing of I129F.

K3 is a spousal visa.  

 

How the K3 is supposed to work:

 

the I-129F is approved before the I-130

the spousal interview (K3) takes place where the foreign spouse resides before the I-130 is approved

foreign spouse arrives in USA

adjustment of status after the I-130 is approved.

If you look at the bottom of the graph it is a VJ graph which is only representative of people on VJ and those who actually upkeep their timeline. 


 

CSC has been adjudicating I-130s since the recent workload shift announcement (10/21). Also TSC.

There have been quite a few approvals already, too smile.png

 

Ah that's very recent then... but it doesn't mean they're adjudicating files that are as old as the OP is claiming, however they could be, as I don't work there nor look over their shoulders.

You keep mentioning CSC but they haven't adjudicated I-130 petitions for USC spouses since Aug 2012.  Neither has VSC.  

 

The only places I-130 for USC spouses are going right now is NBC (either staying or being forwarded on) or Nebraska (which is very recent.)

LOL exactly 6 months for the I-130!!!  My entire process took 8 months.  I-130 was exactly 4 months.  It was just under 4 months until my interview.  I received my green card exactly 9 months from putting the I-130 in the mail.

As a technicality, the K3 visa is a spousal visa.  It takes just as long, normally, as the CR1/IR1 and the latter is the superior visa by far.

Honestly, I can not believe that MY GOVERNMENT IS KEEPING MY HUSBAND FROM ME! I can not help but to feel this way.

It seems to me, the USCIS folks are playing GOD and they like it! They are suposed to work for us.

I talked to one person who had a k3 granted in the last year from VJ.  I asked a bunch of questions they didn't bother responding to.   I just wanted to get more info and after saying yes they got the K3 not the IR1/CR1 they said, it's in my timeline and never answered again.  Super helpful! :rolleyes:

The USCIS can send you on the path for the visa, but the NVC is the government body to which you make the visa application.  The consulate or embassy is the one who grants and issues the eventual visa.  Then the USCIS logs you as a resident alien when you POE and sends you the green card.  Everything is then done through the USCIS (removal of conditions and citizenship.) 

 

K3 is impossible if you do not send the correct petitions to the USCIS, but the National Visa Center obviously doesn't need more work (they have enough trouble with the work they have) so like any business, made rules to give themselves less work vs more.  The USCIS would love for more K3 visas because that means more adjustment of status and more money.   It's an extra $1070 for them instead of the $165 new immigrant fee (for the green card production.) 


Once you get the green card with the electronic strip on the back, you'll see why they started charging people for it!

less than .33% of spousal visas in 2012 were K3. 290 were approved out of almost 89000 spousal visas world wide. You can try for the K3, but remember, until the approved petitions make it to the NVC, they are just petitions and are not a visa.  If it makes it easier we can call it a spousal visa path until you know what direction you're headed.

 

It would be 15 days for them to make a decision on your expedite.  If it was denied, you likely would not hear anything, they'd simply keep processing the petition(s) as normal.  Expedites are very rare unless a spouse is terminally ill, in a high degree of danger, or the USC is being deployed (often it has to be to an active military zone like Afghanistan.)

K3 is pretty much dead. The I-129F is a fiancee visa. You are married so this does not apply to you. You are looking at the CR-1 visa for married folks. As an FYi, reviews do not take minutes. They must research multiple databases, often asking other agencies to respond and they have their hands full as well. Heck, prolly took several hours just to read you 27 page document. It's only been a few months.Stop being antsy. It's just the way things work sometimes.

 

The I129F is not a visa, it is a petition.  When filed solo, it puts the petitioner and beneficiary on the K-1 route for non married people.  When filed with the I130 receipt, it puts the couple on the K-3 spousal visa route.

 

The I129F applies to the OP, it probably will not result in a K-3 visa however.

Well, you could tell us the reasons for your expedite to see what we think.

 

In all honesty, The K-3 (to me) is useless.  It saves little (if any) time and is more expensive. 

 

I hope your had supporting documentation and not 27 pages of your reasons

I-130 takes exactly 11months to process. I-129F takes exactly 6 months. I applied April 30th for I-130 and May 7th for I-129F. We got approved this month. Obviously it not obsolete since I-130 is slow and not catching up with I-130. We still need to wait 4 to 5 months for the I-130 to approve! You still have two mnths, and it will take EXACTLY 2 months to get a response.......All the best to you!!

 I've been waiting 7 months so far for my I-130 and only a month for my K-3.  April files have started to transfer to service centers.. Hopefully mine will be transferred next week and I won't be waiting 11 months.  yes.gif

because the one they have now is not working very well. I don't see how some people who aren't married

yet are being approved and some of the ones who are married must wait. Arent'  married people suposed

There is only one reason needed to ask for expediting a case. We just happen to have two reasons. Yes, i have a "pre-existing"

conditon, but i wanted to show the reasons i do not go out and get a second or third job to keep things together until he can arrive. 

 

I am so upset that my husband is not being allowed to join me. Not just to help me pay the mortgage, but fix our home up as winter is approaching fast.

At the rate that this big top adventure is going, i will be homeless anyway. So all the hard work i have done to save our home seems to be in vain.

And believe you me, the USCIS people do not care one iota if this were to happen, BECAUSE IT DOES NOT EFFECT THEM PERSONALLY! 

If it appears to you readers out there that i am bitter, oh yes.... i truly am, especially from the news i recieved today. Get this:

I contacted our Illinois Senator Mark Kirk last week in despiration. His office called me today and told me that the USCIS office personnel stated to her



that "their 129f is NOT even in expedite status!" when I have the reciept right in front of me stating it is! And so did she, but she justified their incompentence of the right hand not knowing what the left hand is doing. Now i am not saying that i am ungrateful for their help, but in all honesty...it was no help.

These USCIS and State dept. people are controlling our lives, and that is what really upsets me. Who do they think they are? They have had 3 full  months to mull
over our papers in "expedite" status. And not even one incling of courtsey to respond or give a time frame on the expedite process. QUOTE UNQUOTE: " YOU WILL RECIEVE A DECISION OR NOTICE OF FURTHER ACTION SHORTLY."


 

I guess Chanel 4 in St. Louis is my only hope. I find the more you expose unjust treatment, things will start to change. Hey look what whistleblowers

have done here in Illinois: OUR LAST 4 of 7 GOVERNORS WENT TO PRISON because they were all called out! hhahahaha there's one to put in your trivia hat. rofl.gif

 

...AND while i'm still ranting....I LOATHE BEING CALLED A CUSTOMER! i am NOT a customer, i am a U.S.born citizen who abides the law. I had this conversation with my immigration attorney the other day. I'd post it but last night I was told to "calm down" by someone on VJ because they see my posts all over...  So a BIG F U to that member....

after reading the expedite reason, I'm just thinking it wasn't approved because it was a pre-existing condition.  They are really strict on expedites.  When the government gets their sh!t together and goes back to work, I suggest contacting the senator's office and making a big deal about it.  Or getting them to submit the same expedite.  Be a monkey on their backs.

 

I heard  through my attorney that the K-3 is going to be processed again, so maybe there is hope.....  I am going to file a K-3 today. My I-130 PD is April 12th. which ever comes first is where I'll be.  I wish I could live with my husband while this is being processed. It just isn't possible.  cray5ol.gif

The charts are showing that there is a big slow down with the I-130 now.  looks like 100 days more time added since 2-20-2013  So my question is then why would a K3 not be a good Idea at this time.  It is unclear to me how the two (I-130 and I-129f) are linked at USCIS.  On the surface getting the wife here earlier with a K3 is the best way for me.  The extra cost is well worth it.  So I wonder if your information is dated and things have changed back to a situation where we need the K3?  USCIS website says I-129f for already married is 5 months,  the I-130 are taking 9-10 months?  Plus as you have said a lot of time saved in the next step too. 

I spoke to an advocate yesterday in PA. She specifically told me that K-3s are now taking LONGER than I-130 petitions to process.  The normal processing times are now 9-12 months for an I-130.

the whole thing is fluid

with the timelines of approval varying differently, there is no way to tell which of the petitions will go through first

yes many members say the k-3 is dead, but that is not true, it is still a viable petition process regardless of what someone here tells you.

with all the shuffling of the petitions and where they will get approved these days it would not surprise me to see your 129 go through first.

with the expedite, give it another try with uscis, make sure you speak with an IO if you call.

you will need to complete another expedite request at nvc

good luck, yip sometimes a little confusing :( but there is a lot of useful information here as well as knowledgeable members, just gotta know who to listen to :)
