hello everyone ...can someone tell me for how many months the medical report is valid after the k-1 visa is approved ??

i had my mediacal on 16-6-14 and was approved the k-1 visa in july and my visa is valid for january 2015..so i have this anxiety about the expiration of my medical examination report?

Applicants must also submit Form I-693 to USCIS within one year of the immigration medical examination. USCIS will also provide additional ways to submit Form I-693. As outlined in policy alert PA-2014-005, this updated policy applies to any Form I-693 supporting a benefit application that USCIS adjudicates on or after June 1, 2014.

Lynn n Sam, it is ridiculous. I see you have been through a K1 rejection like me. I have been ready to pack my bags and leave for good. A k1 rejections followed by another year and a half wait for IR1 has killed my spirit. Its a wonder that I am still functional. 

 

Is the beneficiary a divorcee in your case?  Since packet 4 is meant for the beneficiary, my wife needs the marriage papers. I will let you know what comes out of this. I just want this to end. 

 

Yep, been on that merry-go-round before.  And although it didn't quite fall in our favor,  it at least gave us an opportunity to file another petition for a visa.  Let's hope round 2 is more successful for the both of us!  And I hear that about leaving.... have pondered that many, many times before.  This wait is super frustrating on top of the long time we waited to hear back from USCIS to render a final decision on our K1.  And now this added frustration.... we're still waiting on our NOA2.

 

DirtyHarry, I found this on the Mumbai Consulate website (even though we're both going through New Delhi Embassy, it might still apply).  Enclosed here it sounds as if both parties need to provide.  So I'm unsure about this.  I was able to find out that I can get copies of previous marriage licenses through my county courthouse (I live in Pennsylvania).  You may want to look into this as well, just in case.  I'm just not sure if I should obtain the triple seal or the Apostille for the certificate (they cost $10 for each)  Best of luck to you and your wife moving forward!

IV Marriage Certificate

Any Applicant who has ever been married must provide an original and a clear photocopy of the marriage certificate(s) for all marriages of the petitioner and of the visa applicant.  Persons who married before 1955 must attempt to register their marriage.  Failing this, they must submit affidavits on appropriate stamp paper sworn before a First Class Magistrate giving the names, dates and places of birth of the bride and groom, and the date and place of marriage, as well as the names of the parents of both parties are acceptable.  The affidavits must be executed by one of the parents of each party, or if the parents are deceased, by the nearest relative of each party who was present at the wedding. Persons married in 1955 and later must submit a marriage registration certificate.  Certificates issued by the appropriate authorities or recognized religious organizations are acceptable if they are legally valid in India.  If any of these documents were issued in a regional language, a notarized English translation is required in addition to the original.  If you and your spouse are applying for visas, you should submit an original and two clear photocopies of each certificate.

This sounds like something new for Packet 4??  I've been married previously as well and I would have no clue how I go about getting these!  That's a strange thing to request given that you must submit divorce decrees.... I mean, if you have a divorce decree, doesn't it already prove that you were married to the person named on the decree?  Such ridiculous rules!  If you figure it out, please post and let everyone know.... I'm in the same position :(

Ah yes, correct.  Seeing as you are a green card holder and don't hold a US passport you're not eligible for the PIO unless you become a US citizen and then able to obtain a US passport.  Sorry for the confusion.  If your wife is a US citizen and holds a US passport, she can obtain a PIO card because she's married to an Indian citizen/passport holder.  Otherwise she could probably apply for an Indian tourist visa.  She can apply for certain time periods (like a 5 yr visa or a 10 yr visa, etc) but there's no guarantee as to what they'll issue.  They decide once they receive the application.  For example, if she submits fee for and applies for a 10 year visa, they may decide to only issue a 5 year and you do not receive a refund for the lesser time period that is issued (or they can deny altogether).  Hope this helps.  Good Luck

Coming back to this valued forum after a long time. I am a 10 yr green card holder here in us through marriage to my us wife. We are planning to go to india for a visit. I have a few queries as below :

 

a) my recently renewed passport does not have my wife`s name. Can it be added ?

 

b) We are about to make my wife`s US passport. Can my name be added there ?

 

c) What kind of indian visa should we apply for my wife ?

 

d) should we carry our marriage certificate while we travel ?

My husband inquired about getting my name added to his passport, but was told he would have to get a new passport with my name included and it was going to take quite a bit of time.  I don't know if this is the same rule all over India (as you well know you can get different answers from different officials in India  :rolleyes:)  You might want to go the PIO (Person of Indian Origin) route for the two of you, and that way a visa is unnecessary. You just carry the PIO card along with your US passport and travel to and from India freely. As for your wife's US passport, a spouse's name isn't added to US passports.

 

Your wife should carry your marriage certificate while traveling with her passport so there isn't an issue going through customs or security checks.

I have been reading a lot about PCC on this forum, so thought of sharing my personal experience here, which might help many.  Because the procedure has to be same all over India.  

 

Procedure for applying PCC - (My personal experience)

 

  • Log into site http://www.passportindia.gov.in
  • Register through the Passport Seva Portal. (Click on "Register" link under the Online Application Filling section on the Home Page).
  • Login to the Passport Seva Portal with the User ID created as above
  • Click "Apply for Police Clearance Certificate" link.
  • Fill in the required details in the form and submit.
  • Choose Alternative 1
  • After filling in all the details, VALIDATE & SAVE it on your DESKTOP (its easier to upload later on)
  • Go to Alternative 1 again & select "Click here to upload the form" & upload the file you have saved on your desktop
  • Then go to Applicant Home page. Select "View Saved/Submitted Applications"
  • Select the saved application & take a printout of Application Receipt

Now with this printout you just have to walk into your nearest Passport office or Passport Seva Kendra during 9am to 11am ONLY. Take the token number & just follow the instructions. I was amazed to see the smooth process without any confusion at the Passport Seva Kendra. My nearest point was Hubli, Karnataka.  

 

Documents you need to carry is just a photocopy of your passport with your signature & your original Passport.  The fee is Rs. 500 & has to be paid at the passport office only. Just walk in with this preparation, rest they will take care of.  I had taken a copy of my NOA2 letter, but they didn't even bother to see that. I hope it helps.

I also think you should go with out them and see how it goes. Divorce papers are important,i think you will not find any problem.Good Luck.

In my case, in my previous marriage in India  i  just had a paper issued from Gurudwara in Punjabi but Embassy didn't ask me to submit the previous marriage certificate just asked for divorce judgment sheet with decree of termination of previous marriage  and  the  current marriage certificate with marriage registration certificate.

If you don't mind may i know what had you submitted in the court to proof you people were married to get divorce? if it was strong evidence related with your previous marriage  then  you two can get certified copy  of that evidence from the court .

you have to let NVC know that PCC will be given at interview in mumbai india when you send your DS 230 package and also by calling just to confirm after you get the false checklist for PCC. My husband didn't submit PCC with his DS 230 package, my case just got complete this monday aug 13th.

Hello,

         I filed an IR1/CR1 visa for my wife and daughter. I will be scheduling an interview for my wife and step daughter on the ustraveldocs site. When I log into the ustraveldocs site with my wife's account, I see our daughter as a family member on her account. 

 

My question is:

 

If I schedule an interview for my wife, will that automatically cover my daughter? Or do I have to login to the ustraveldocs site with my wife's id to schedule and interview and login with my daughter's id to schedule a seperate interview for my daughter? My wife and daughter are in India and they do not have internet access.

My wife got divorced in India. They did not have to submit any papers to prove that they were married. Her prior marriage was solemnized in a Gurudwara and she filed for divorce in a court in India. As you seem aware, marriages in India are usually performed in religious places. So we only have divorce papers.

Packet 4 requires you to bring marriage certificates for all your past marriages. My wife and I have been married previously. We have copies of our divorce decrees but we do not have copies of our past marriage certificates. 

 

Has this been a problem for any one? Circumstances are such that we cannot get copies of marriage certificates.

Hello,

             I need advise. This long journey has devastated me mentally. My wife and step daughter are in India. I had initially filed a fiance visa in June 2012 that was rejected in March 2013. Following that we got married in June 2013. I filed an IR1/CR1 for my wife and step daughter in August 2013. I received an RFE in April related to my relationship which I successfully answered. I am going through the check list of documents needed for the interview. One of the items in the checklist is for Marriage Certificate. I have my marriage certificate for my marriage to my wife. However, I read the checklist item in detail now. The check list item states that I need a marriage certificate for all prior marriages. Both me and my wife were married before. I do not have the marriage certificate for my previous marriage and neither does my wife. We both do have divorce certificates for our past marriages indicating that we have legally ended our earlier marriages. 

 

What should I do? Is this a deal breaker? Aren't the divorce decrees sufficient ? I am planning on going to the interview with the documents I have because I am at the end of my wits. I cannot stay stuck in this limbo of paperwork and bureaucracy forever. 

 

Has any one encountered this situation before.

My fiancee's K1 visa was rejected. We were not even interracial. Same religion, same ethnicity. I was older to her by 5 years but that is normal per Indian tradition for the guy to be older. The CO treated her like a piece of garbage. We got married and filed an CR1. Come hell or high water, I am going to the interview to be with her. 

 

The emotional and financial turmoil that you will go through after a K1 rejection is unimaginable.  You will spend money on lawyers. You will also spend money on at least 3 trips by the time your C1 comes through. The NVC is currently taking 60 days to touch a document.  You could potentially be looking at a 2 year wait from this point if your K1 gets denied. Do you want to take that risk? 


I re read your case. Your fiance is a Sikh. I am also a Sikh. There is a high amount of fraud that goes on in Punjab. I think they treat everyone from Punjab as a fraud case and work their way backwards to an approval.

So I am completely freaking out VJ'ers and I am requesting for someone to please respond to this post. I attended my fiance's interview in Delhi on Sept 19 and the visa was approved immediately. I have been checking online since for a status update... the CEAC website now says that the case is under ADMINISTRATIVE PROCESSING. I then called the Visa line and the man on the phone asked me if my fiance received any paperwork requesting to submit additional documents and i said no. He then said it is under administrative processing (same thing as the website). I am really concerned because they say it can take up to 60 days under AP. Has anyone else experienced this? It's been over 2 weeks since the interview and now all of a sudden it's under AP. Please advise guys - I am losing my mind here  :crying:  :crying:  :crying:

Your devorce decrees will suffice. Make sure to have your birth certificates, proof of marriage and continuing relationship (photos, chat and email logs, phone bills, skype conversation etc), medical and PCC. These things and if they asked for anything specific in the letter should be enough. If they ask for the marriage certificate for previous marriages, tell them you don't have it and can't get it and they will give you a 221(g) with a checklist of what they can accept. Dude all u have to do is that register on passportindia.gov.in, then fill online form for PCC or offline e form for PCC which ever u find convenient..make sure u have adobe 10.5.1 version otherwise u wont be able to get the form open ...
After that u submit the online application using apply link...u will get an Application Reference Number (ARN) .
after that u need to take appointment which will be either in next 30 days or next month...but u need to take appointment as soon as possible as appointments r not available on date which we desire...we have to book before 15 days to 30 days in advance....and appointment is only available for 15 mins per applicant...
It depends on which area u live..if u stay at Vadodara, Anand, Nadiad, Kheda area u r supposed to go to PSK Vadodara or else Ahmedabad PSK depending upon the area....
I live at Vadodara but i haven't obtained PCC but i have read all these stuff thru their website...n i will be applying within 2-3 months...
For passport PCC, u will definitely need original passport, local pcc , 1-2 residence proof...and 500 Rs/- fee...
U can take one or 2 Photo ID of yours if they need that...

At least four working prior to your interview, you're supposed to submit your medical report as well as photocopies of all the documents you sent to NVC along with another set of original ds230, current dated, to VFS. Also pl make note of the fact that your x-ray is not required at the interview. It's to be hand carried with you to the US, where at your port of entry you'll hand it over to the immigration officer.



Can you also share your experience to get PCC from India(Ahmedabad-Vadodara area). I've hard time to schedule appt. or understand their procedure to get PCC.

PSK office in Ahmedabad has their own rules. They strictly ask an evidence which states that PCC is required by an immigration office or provide an interview letter issued by Mumbai Consulate to apply for PCC certificate. So We are going to provide PCC issued by local DSP police office which requires only NOA2 to issue PCC for NVC application.

I'm surprised they wouldn't accept a Packet 3 or 4 letter along with a print out of the appropriate "Instruction package" as all of these ones clearly state the requirement: (Package 3 - K1, Package 3 - K3, Package 4 - K1, Package 4 - K3 ).

My spouse lives in Ahmedabad. PSK in Ahmedabad said that they need an interview letter or a letter from immigration office to indicate they have officially requested PCC for immigration process.

This thread was just posted this morning saying NVC will waive PCC requirement if your file will be sent to Mumbai consulate.

I will ask NVC once my file has reached into their system. If you have already got your NVC case number, then I would definitely suggest to call them and verify this information and see all operators are giving the same information. Also share your findings on these thread so others will benefit from your query :)


Not sure about Ahmedabad PSK, but Bangalore PSK didn't require any proof that it was for immigration purposes. You just had to apply / schedule from the Passport Seva Project site. If you had already had police clearance done when your passport was issued, and it was issued by the same regional passport office (RPO) they may be able to finish things the same day as your PCC appointment; Otherwise the may ask you to come back after the police have completed a check.

Since my fiance's passport was from another RPO they had to do the full check. This involved the PSK forwarding the request to the police station near where we live (took 2 days for station to receive). They contacted my fiance and asked for a couple local references. After the local police station was done they forwarded it to the Bangalore police commissioners office who did some final check before forwarding the clearance on to the PSK. For us it took 2 weeks to get the PCC after the original appointment at the PSK.

Yes it is important to send in your police clearance certificate along with the ds230 packet. If not, you'll just be delaying your process at NVC.

I'm not sure where you got this information from.

This isn't really a question but rather I wanted to clear up the issue of whether someone sending DS-230 need PCC to be in the packet. According to 2 phone calls I made they told me that PCC is consulate specific and that for mumbai consulate you're not required. :yes: Hope this info is helpful!! :D

So, My wife now has a Green Card after the AOS from K-1.  Now do we have to change name on the passport? Passport currently is in the Maiden name. If I travel to India would they let me back in if the Passport has different last-name and Ticket has different last-name?

It takes 7-10 days. You should get it in the next 3-5 days. Also, don't forget to pick up the yellow sealed envelope when you go collect your passport with the visa, you need to show the sealed yellow envelope at the point of entry in US. The yellow sealed envelope will have a little cut on the side. It's normal for the packet to have a little cut, so don't panic. In my case they forgot to give me the envelope and guys didn't know that there was an envelope to be given with K-1 visas. they said it's only given for immigrant visas. So i argued and asked them to return my passport and return it back to me when the envelope is ready to pickup. It took another 3 days for them to return with passport with K-1 visa and the yellow sealed envelope. Best of Luck !!
