Does this mean they transfered this to Vermont Service Center - the long wait one?

I know this is an old topic but I wanted to put some encouragement in here in case anyone ever searches this topic. Our appeal was sent off in July of 2012 (we were denied due to lack of co-sponsor) and we hired a lawyer, we send our appeal off and early October we received an Approval on our appeal and was issued an EAD card just a few days later. So about 3 months of waiting for the appeal.
I hope this encourages others...I know I was scared it would take YEARS to get our appeal...even our lawyer suggested we just re-file but we chose to appeal and if nothing heard withing 6 mo we would refile...Im glad we chose to appeal!

I am at 2.5 years now that is 12 months then they open the file

Is 18 months long enough?


My husband's 1st petition was pending for almost 2 years before they denied us. His 2nd petition was pending for 3 years and they denied us again in Dec 2011. Now we didn't have a choice but appeal... And looks like it will be about a year untill we hear anything from BIA.
That is more than 5 years of waiting only to hear that it is not safe enough for me to live with him and after almost 6 YEARS of marriage and heaving 2 kids together, I need to go back home. That is what I call nutts...
I wonder if anybody had won an appeal yet?

My lawyer said that it is about 6 to 12 months wait with BIA before someone even opens a file, because they are behind.
We appealed in Jan 2012.

Filed in Feb 2008, denied in December 2011 - 3 months short of 4 years. My case had been denied for 8 month now, and the web site still shows "initial review", just like it had been showing for all 4 years.

My lawyer says that if you are denied then you can sue the government and there were cases when it worked. But good luck on your current point of the journey. Hopefully all will go smooth and without delays.

Congratulations for everybody who got approved!

reading through this story, I saw a few people wrote that they submitted proff that they are not risk to a beneficiary. A lot of people (new petitioners) know the necessity of this step and send it all with petition. I wonder, those who sent it separately from petition, did you have to wait for NOD and RFE or you did it by yourself?
how long did it take for any USCIS respond on proff you sent?

There is a memorandum posted on USCIS.gov regarding what types of evidence USCIS **might** consider proof that the petitioner poses no risk to the beneficiary:

includes but no limited to certified court records, police reports, sentencing reports, psychological therapy during prison time and after prison time, psychological assessment/report recently, community services, letters from friends and families...I would also suggest a statement from the petitioner and the beneficiary. But it really depends on how they interpret your evidences. I wrote a 7 page affidavit to show them my understanding of my husband's conviction. But USCIS's denial letter says that my statement shows insufficient understanding of my husband's crime. We submitted the psychological assessment done by a licensed psychologist but USCIS says that just one-hour assessment is not enough...and my husband was not ordered to take therapy programs after discharged but USCIS says he submitted no documentary evidence that he attended programs after discharge. Discharge is DISCHARGE, right?

Talk to a lawyer my friend...That way the attorney can navigate the nitty gritty of the process for you both. The attorney also has the requisite expertise to deal with your situation. More importantly, the attorney can best explain the process and s/he can naviagte and counter appropriately to the delicate issue of the charges.

Your question about which process is "harder"; I-130 or I-129F... I honestly believe you will be better off pursueing the I-130 route. My experience tells me the I-130 is somewhat a simpler/easier path if you take the time to gather the right documentation. Ofcourse every case is unique and different and depends on it's own circumstances that's why you both need to go consult with an attorney right away.

He absolutely should seek out an immigration lawyer. Domestic violence is a huge deal when applying for a K-1 visa, regardless of whether or not it is "just a misdemeanor". IMBRA is in regards to domestic violence and sexual assault charges and is a specific part of the application, which he will have to familiarize himself with. I can't understand why he wouldn't want to read it or understand what he's going to me up against.

This type of charge IS a big deal whether he believes it or not. Again, echoing the advice of others who have replied to you, seek out an attorney.


he said this is simple. He said it isnt hard because his case in the past didnt huge, the drug case was a big case.

He needs to come on here and read the IMBRA forum.

If you love this man and you really want to overlook his past, I highly suggest that you pursue a CR1 instead of a K1. This way if something goes wrong when you get here, you are a permanent resident right away and can leave if things are not as they seem long distance. I'm not saying your fiancé is abusive so don't get me wrong, but I don't want to see him withholding the adjustment of status from you and then you having to deal with that. I think it would be best to really protect yourself just in case his account of his domestic violence charge isn't exactly what he's told you it is.

Your fiance should take the advice of the posters in here to consult an immigration attorney. K-1 Visa process takes 2 different Departments approvals. Your petition may get approve by USCIS but it may also get denied by the Department of States based on those criminal record. You should read IMBRA forum section to see if there are others in similar situations like yours.
