Hi Kazuava,

Thank you so much for the information that you shared. I am new to VJ and mostly reading threads. My husband is an AWA petitioner and he went on to have biometrics last week. We also went to have infopass appointment a few days after the biometrics for us to know what really happened to our case coz the lawyer that I've asked said that it is unusual that the petitioner have to go biometrics, she thinks it's an error. When we went for the INFOPASS appointment, even the person we talk to there was also shock about it. He said, he never had an experience about it. The guy in the appointment look at his computer and told us that USCIS sent us Notice of intent to deny and we are still waiting in the mail. Do you think, it is their new policy? If it is, why they only do that to AWA petitioners and not to other felons like for example murderers?
Please if you have more informations about AWA petitioners petition, I will be grateful and thankful for you sharing it.

My son is almost 15 months and we do have plans to have another child, how far are you along with your 2nd?

Our deadline is fast approaching and I am getting anxious that we are not going to be able to provide enough proof. The therapist that I spoke with said that to me as well, that he does not see the connection between my husband's conviction to me since I am an adult. Of course the government is just taking a sex offender's rights away by not being able to petition, and it just adds to the prejudice that they have to face their entire lives no matter what the circumstances were behind their offense. The therapist also said it would be hard to do an evaluation for my husband that he has shown rehabilitation when he was not required to get treatment, there is no basis to do the evaluation on. They're just making it very difficult.

In case of a denial, I do plan to fight and make an appeal no matter how many times it may take to do so. The only problem with applying over and over again is that you have to pay the filing costs too. I just hope that through the appeal they will still let me renew my work authorization.

Hi everyone. We fall under the AWA as well and we just received our NOID last week, so right now we are trying to gather enough proof that my husband is no risk to me. We were given 87 days as well. We filed our petition 2yrs ago, April 2008, we were married in March 2008. My husband was not required by the parole board to get any sex offender treatments so now we have to find a psychologist that will do his assessment, they said it would cost around $2000 for everything. I am just wondering, what will happen if our petition gets denied? Will they deport me? Are they really going to separate a mother from her husband and child? I can't get any sleep because of this as I am scared as to what will happen. I know my child who was born here can petition me but that in not until he is an adult.

kazuava,sorry for the very late reply, i just called our lawyer a week ago and he said my case would take a while, i mean a very long while...he did not suggest us to submit any polygraph test and he said my husband's counseling from a counselor after he went to jail is already enough that's why we did not submit any psychological evaluation from a psychologist..i got all the letters submitted like a letter from me, awareness of his conviction, his remorse, his friends' letters that he pose no risk or harm on me, a letter from the church, a letter from the pastor who married us, a letter from his parents and my parents back home too..after all the interviews i had to get through as a registered nurse, they're trying to question my stay coz my work permit would expire on may 11 this year that's why nobody wants to hire me this moment, no matter how hard i would explain,they just won't hire me..now, what i did, i already submitted my work permit renewal to the immigration and hopefully it wont be delayed on the mail..until now, i am still nervous and still suffer, worried to death if there is still a hope for my green card after all we did and submitted, i can't concentrate, i mean how long will it be???i am so worried...would it still be approved???why it takes forever???

kazuava, im on a tourist visa too, last march 24, 2009 we filed for an adjustment status and submitted all papers needed. yes, i was able to have a decent interview with an immigration officer.the interview went pretty good, no doubt of a bonafide marriage, and he even disclosed to me that my husband was guilty of stalking, violation of protective order and indecent exposure. i know everything right from the start before we got married anyway. sadly, that officer didn't even approve us. 3 weeks after, he called me up and sent me a letter stating that "he wants all my husband's court despositions,hearings, arrests and police records within 30 days, certified. my husband ran around the county trying to sacrifice his job to get all the papers and running after time. luckily, we were able to beat the deadline. after a month and 15 days, we received a letter from the uscis stating that my husband's convictions falls under AWA. luckily, we were able to beat the deadline again. right now, i have my ssn and my work permit. i struggled a long way thinking bout my green card everyday and even suffered when i was reviewing my nursing test and luckily passed it, i am now a registered nurse with bunch of interviews this month. i can't even concentrate sometimes. i am just asking God to grant my green card. we did not submit a polygraph test, it costs too much, would i still get a chance to be approved????

my husband was convicted of stalking and indecent exposure..would i still get a chance of being approved after the things we submitted like counseling, community service in the dump site for 40 hours, community service in the church and a letter from me and his friends and pastor stating that he pose no harm or risk on me, on january 18 it will be a month old since we submitted every paper work that they need and the good thing about it, we were able to beat the deadline.. i suffered sleepless nights thinking about my greencard..pls help me..

I have been in the same situation since I had a prior fiancee and petitioned her.
However, the relationship did not work out. Fiancee # 2 came along and I filed
a K-1 petition for her. Five months after filing, I received an RFE to submit a waiver
for the first petition.

In my situation, I maintained an amicable relationship with my ex-fiancee

First, Congrats you two. Finally the process will start for you. For you two I am happy.


I must point out that you didn't "beat" the AW regulations, you merely provided enough evidence to support that you are not now a potential threat to your SO and/or your future children.

AW is there to protect the SOs and any potential future children. The folks who fall under AW did something wrong in their past (according to the laws of the state where you resided) and you must provide evidence that proves that you no longer are a threat. I am sorry that some folks did something very stupid when they were young and they get lumped into a broader category with others who truly are threats but we all make choices in our lives, even when young and foolish.

So Shane show that with a lot of hard work and time, if you truly are not a threat, you can do this. If you can not provide the evidence, then too bad for you and AW is working as it should.

A polygraph will never be able to show "No risk"... What it should demonstrate is a positive result that your husband has truthfully indicated that he:

1) Has not committed another sex offense since his conviction.

2) Has complied with all of the conditions of his sentence.

3) Recognizes that he did wrong (accepts responsibility) and is remorseful of his actions.

Likewise a counselor can give a report or letter stating only what they know to be factual such as "He has continued to attend counseling session and/or actively participates in offender groups therapy" and things of that nature which demonstrate a desire on his part to not re-offend.

The fact is that USCIS is just beginning to be reasonable in reviewing AWA filers. Instead of routinely blocking them, USCIS is experimenting with guidelines to open the doors for selected petitioners. In a year's time, maybe it would be possible to determine a pattern of why some were approved, others not.

Being present for the interview helps the CO resolve any doubts about the validity of the relationship. I was within earshot of the interview, and in fact was asked a sarcastic question from a distance because of age difference. The CO didn't really want an answer, of course.

Another update.
Today we had Master Hearing again. Yes, my pending case was sent to Court, just a procedure, in case, prosecutor wants to review it. After Court it is going to be send backk to USCIS. SO, hopefully, somebody will start working on it. THe good news for me was that prosecutor proved that they received our reply for NOID.
Judge was not happy with all this tossing a pending case from USCIS to Court and back, since she doesn't see a reason for it. I agree. What for? Just to loose another 2 months, while somebody could be working on it and making a decision?

In 30-40 days I will make another Infopass appointment, to see, if there are any updates...

THe Master hearing was reset for another 6 months to see if there going to be any decision on my 2nd case then.

Yes I am, But I've learned to stay quiet on these forums as 80% of the people that are not IMBRA filers are not here to help you, but instead, they want you, or us to fail , by saying its not possible, or giving misinformation.

I have yet to release any detials of my case, unless its by PM only to other IMBRA filers. What I'm trying to do, Is complie a list of who gets approved vs who doesn't and what the cases were and what was submitted or not submitted. So at least future filers can have an idea of what chance they stand. Instead of being in this "grey area" of who is approved or not approved.

WOW...your story sound sooo much like ours. We are almost 4 years deep in the process and still stuck in Vermont...Thank you for sharing your story. Some days are so much harder than others, but your story showed there is a light. Fingers crossed. we have been together for 16 years and married for 4 of those.


My case was denied but still in Appeals , i hope it will be remanded back to USCIS *fingers crossed*

You know kazuava, I really feel like its discrimination. Here is why, your husband could have married an American citizen no questions asked. Sex offender or not, nothing would have been asked, or checked, if he had married a usa citizen. But, because he is married to someone from abroad, they put you guys through all these questions and accusations of proving to not be a "threat" .

So whats the difference? I see no difference, If he had married an American, nothing would be asked at all, or proven, so why does it need to be for you? Just because you aren't American? If thats why, then its discrimination

The Adam Walsh petition will come to rest this week. Our expedite request was approved. Bogota received it today and scheduled and interview for September, 8. That was quick... WOW amazing how things all moved fast after a expedite process.

Please pray for us our interview goes well. This has been a tough road.

Read the part where they look at your behavior from the time of completing your probation or sentence. There must be a significant passage of time of good behavior between the time of completing your probation and sentence prior to petitioning your spouse. This is put in a better wording.

My advice my friend is find a good Polygraph and get a great polygraph score and result you have not committed any other sexual convictions. Get a certificate of completion of treatment alone with a great review from your therapist you are not a person to be suspected to commit any sexual violence with your significant other or partner. A letter from your wife or partner she is aware of your offence. Get involved with a community volunteer program quickly. This is all about you can do at this point. You have one major weakness my friend. The time presents of your crime, and being on probation still.

I do not mean to discourage you but only give you great advice. You and your partner are in my prayers. Do not let this Adam Walsh act scare you. Because you seen now it has been beat. Anything is possible, but take my advice. (I have spent many nights studing the system and finding the weakness to beat this law and over come the ACT of ADAM WALSH.

Yes the interview will be my #### tearing if anything about my past. That is why it will be very important I'm present in the interview with my wife. But then again they know my wife knows. We have a plan for this already set up in case they do try this route to scare my wife away. We are prepared for the scared tactics they will play in the interview.


That will most likely be avoided if possiable.

As for the responces I have recievedd back thank you for those kind blessing. I do have the next step of this process to continie the National Visa Center. I hope they are kind with my past! what was advised to me is that maybe in the interview they feel they can try scareing my wife in the interview. or maybe not My wife knows and they also know she knows.

Now another whole battel begins with this process. Does anyone know how long this next stage will be? we are just a normal I-130 petiton at this point.

Thank you for those who have supported me threw this process. First of all, those posting out there about beating Adam walsh. I did not beat the law, I did prove my self by a reasonable doubt I pose no threat. For some this may be easy or difficult.

I went through many professional channels and legal advise. But I did really everything on my own. God takes the credit yesterday for this mircle that happened with the final approval. Here is a break down of evidence I sent for my request for evidence.

1)A letter from the Paster that married me and my wife in Colombia
2) One etter showing my remorce from my conviction in 1997.
3) A confecsion letter to my wife of my prior conviction before marriage.
4) A letter from my wife she is aware of my conviction. (Translated)
5) One family member letter showing and proving our marriage is bonifide and my charector. A IMMIDATE family mother, father, etc. (Translated)
6) A certified polygraph updated there has been no other convictions since relaese from probation.
7) A state police letter I do not register as a Preditory offender. THIS IS A IMPORTANT DOCUMENT

8) No other convictions since 1997. A state police background check, Certified.
9) Definition of a Christian marriage, etc or what ever religion you believe.
10) Communitty activity, voting card, ballet pickup receipt is what i used.
