I just received an email of Denial.  They said the Notice would explain if we had an options.  I came here on a Visitor's Visa and also filed the I485. You cant do that illegal  Is there an Appeal process? No Or is this where we need to file a Motion to Re-Open? It will not help you cant adjust your status off of a tourist visa they will say that was your intent to come and marry to stay here.  You was suppose to file the I-130 alone and then go back to your country to wait for an approval.

I did not come here to get married.  Met, stayed my six months allowed.  Married and filed.  However, the problem is I will have to repost later as this also falls under AWA.  So I'm not sure if this denial is due to the fact that USCIS believes that we do not have a real marriage or if it is denied due to the reply to NOID.

 

I will let everyone know what the denial says then we can all learn a little more.

AWA Petitioners are scheduled (paid by US Government) for biometrics. Just their way of updating their
records with FBI and other organizations that need the fingerprint information for their records. It is their
SOP (Standard Operating Procedure) now.

You dont need a lawyer, just go with CR-1 and you will be fine as long as you are not a sex offender. With k-1 you will still be fine, but you will have to get all the court and police records and send them with your petition. So maybe CR-1 is just more simple, but your petition will not be denied(K1, CR1) as long as you are not AWA . Look up Adam Walsh act... Good luck

I used Elena's Models to meet my Fiancee and was also worried about IMBRA. I emailed EM and asked them if they were IMBRA. I received an email back that stated they are not IMBRA and they have nothing to provide me in terms of a release of records form.

 

I printed this email out and put it in my petition and then answered no to the questions on the I-129F about IMBRA. If anything comes up I will just tell them exactly the truth. We met on EM and they told me they were not IMBRA. So far our petition has been NOA1 and A# assigned.

 

Bottom line, if you are not sure just email the website and if it is IMBRA then I think all you need to do is gather the forms that allowed them to do background checks.

IMHO, I would appeal, because after reopening the case, USCIS is likely to sit on it another 2 years, and there is no guaranty that they would approve. Based on what you wrote that you have submitted, it sounds like a pretty good package, and indeed what else can you do? The only thing I can suggest is community service, volunteering (the agent asked for it during our interview, but by the way, we were also denied and are appealing), but I believe this additional piece of evidence can be also added to the brief when you appeal, if you decide to. If not the ridiculous time they take for any action on AWA cases, I would suggest try to reopen, but again, they will not arrive to a decision soon.

 

 Try to enjoy your life the way you can for now, and if you are speaking kids, they sure will distract you from evolving in frustration associated with what you are going through.

Music678, my husband went to the biometrics appointment on 4th Jan. They took his fingerprints but did not take pictures of him. When I did my biometrics, they took 1 picture of me. We did not schedule info pass because our lawyer said he already talked to customer service on the phone and that the cancellation notice is valid.

You had an inetrview date on december 17 and mine too. You received a cancellation letter and then I-130 biometrics and same here. You said your husband's biometrics was january 4 which is yesterday, how was it? what did they do? did they ask them something or anything? My husband will have his biometrics on january 8 and the lawyer that I asked said that it may be an error so she recommend to get an infopass appoinment which I think I won't do coz of the very tight schedule. My husband is also an AWA petitioner. Please let me know. Thanks.

Hi all thanks for your feedback and sharing. I now feel better that it's a procedure for AWA petitioners...My husband would go to the appointment on 4th Jan then. For me I already did mine on 23rd Oct and received EAD and SSN in November. My timeline is so long that it won't fit into the space provided by the Signature. Therefore I put it in the profile section. Apologies for the confusion.

The sudden cancellation of the interview and the biometrics notice for my husband just scared me a lot. We submitted paperwork I-485, I-130, I-765 in September and it's not until after 3 months that they finally arrange for my husband's (petitioner) biometrics to be done. It's gonna be a long AOS journey for me!

We left a voice message to his phone immediately after we read the notice. I thought of calling the national hotline, but those customer service people usually don't know much what is going on and their standard answers are some scripts they read out from the screen. My husband decided to go to appointment on Jan 4th anyway.

2 weeks ago we received a cancellation notice from USCIS for my AOS interview on 17th Dec. Today we received an I797C biometrics appointment notice in the mail addressed to my husband, who is the petitioner and US citizen. According to my understanding, biometrics of the beneficiary (me) is required for AOS applications because $80 biometrics fee is included in the filing fee. But I have not heard that the US citizen petitioner has to do biometrics as well. But my husband is an AWA peititioner therefore I am not sure if this has something to do with it. We submitted all paperwork through our immigration lawyer and the paperwork includes everything USCIS needs for AWA cases. So far we have not received any RFE. If any of you have had experience of petitioner doing biometrics, please share your thoughts on this? Thank you .. I am worried..

Practical Tip: A business that does not charge comparable rates OR does not offer comparable services for its male and female clients falls under the definition of an IMB and is regulated by IMBRA

If the website charges comparable rates regardless of gender, then it is exempt. Or if its a free service such as Badoo.

It's funny how women who pay for services aren't considered at risk or who meet for free. This law is clearly temporary and unconstitutional. It's just gonna be around until someone takes it to the supreme court to get it overturned.

As far as the written consent from the beneficiary that she received a disclosure from that website that you provided her with your background check is beyond me or even the jokers who wrote the law.

I don't think visa officers take this section seriously because there more concerned with fraud rather than if you complied to some unconstitutional formality.

If you have the money call a lawyer. I don't even think the makers of this law have any clear answers to how to proceed if the website didn't comply with the law.

I think the disclaimer you posted is afrointroductions attempt to cover themselves from prosecution by suggesting you may have visa issues down the road if you don't complete the IMBRA section.

From a legal standpoint this topic is fascinating to me. We are seeing our rights being increasingly eroded by our ever evolving surveillance state. The founding fathers would be livid with this law.

I support providing all beneficiaries with background checks of petitioners prior to granting visas along with informing them of their rights against abuse and hot lines to call. However, demanding the petitioner submits a background check before even saying hello is unconstitutional. Because you would have to apply the same standard to both gender at sites like match.com & Badoo as well.

If you are clean of any criminal history & have never filed, I can't see how a VO would take issue with the fact you obtained a written consent from beneficiary that she reviewed your BC after you met.

How you initially met will be addressed at interview. If it's a country in Africa, you will need to submit proof of bonafide relationship such as chat logs & emails. It is my sole paranoid opinion that someone in DHS will open up you skype, google, whatsapp or whatever and search key words pertaining to anything fraudulent or incriminating if it goes to administrative processing so be honest. Snowden revelations made it clear that all of us on VJ are persons of interest because of our foreign correspondence. I also believe that unexplained denials are a result of discrepancies between what was provided by the petitioner and what was read in the actual chats and emails when the account was opened by DHS. So it's best to be honest and error on the side of caution because if they log into your account and read about you discussing imbra or anything visa related they will check to see if it lines up with your actual petition. So just check yes and go with it. If your clean the worst thing that could happen is that it gets tied up in Administrative Review or sent back to the US to be vetted by DHS. Eventually you will get approved.

Or you could keep question 34a simple & say you met online, provide the dates in 2-3 sentences & check no for 35. When its addressed at the interview you could just state you were unsure about the law so you checked no to avoid complicating matters. I don't know what happens from there. The prior links submitted by Ebonuowula clearly indicate that the site you met on is IMBRA.

I personally think you should just check yes. This is to big a decision to gamble with. I don't think the visa officer will automatically view you in a negative light because of where you met. Most important thing is to be 100% truthful throughout the entire process.

Allow me to educate you with some questions

 

The 2 children at 7 years old caught touching each other: di you consider them sexual predators?

 

The new 19 year old who's GF   was 16; is that person a  sexual predator?

 

Is the drunk college student arrested for public urinating at 2am a sexual predator?

 

The person arrested for selling drugs a sexual predator?

 

The person arrested for assaulting no sexually his ex-wife is he a sexual predator?

 

I can go on but I know you get the drift of how wrong your remark was.

 

Now the AWA which was created to protect is harming Millions of people or putting them in danger because the real predators hide among the 750K on the registries if they are even registered

 

Immigration wise the USCIS can only apply what they were given which was no to clearly differintiate the dangerous from the safe petitioners which has caused the hardship of these families...mark my words these type of laws come back and bite the tax payers in the Azz just so the lazy few and the fear mongers can have a false sense of security.

 

Thousands of legitimate families suffer from this bogus law.

I have a criminal record also. It is simple assault and tamper with property which I plead guilty to. Will this effect my petition. Do I have to check yes on the criminal line even though these crimes are not in their list. And if I mark no, do I still have to send police reports and court records. Please comment.

My fiance and I met on Afro introduction, we were puzzled with this question whether or not the site operates as IMBRA. We we told no, a friend who also met her fiance on a similar site had no and they have been approve and waiting for the case to be transfer to the local embassy.

 

Based on what we were told, for IMBRA they do background research on individuals to check for criminal offends ect. Afro introduction did not do any research on either of us... try not to worry yourself too much... based on what I have seen from NJ members, some have yes, some have no but it doesn't affect their process unless there is a questionable background....

Thank you everyone, It's really hard to believe it happened this quickly, seriously NOA1 on 9/23 and NOA2 on 10/17?!?! The only thing I can think of is that I was very meticulous about the I-129F petition, I put labels on every piece of evidence and a summary of how me met which referenced the evidence. I will have to post it on VJ.com for others to see and work off of. 

 

So happy!!! The Faience doesn't even know yet :P

Hi I was arrested long time ago cause I got in a fight with my ex husband I press charges against him and he turned around and press charges against me but it was a misdemeanor so charges was dropped, my question should I get the court order saying charges was dropped or just let them know nothing happen with the case..thanks for your help..
