It definitely is. But apart from the N-400 part (to become a US citizen), it's not optional. If you want to live and work in the US you will need to apply for AOS to get the green card, and then in 2 years you will need to apply for ROC. Getting the K-1 visa is just the first step.

Once you have the K-1 visa and enter the US, you have 90 days to get married. Then you apply for adjustment of status (AOS) by filing forms I-485, I-131 and I-765. AOS costs $1070. Within 90 days you will get an employment authorization document (EAD) with an I-551 annotation that allows you to work in the US and travel outside the US. Within a year of applying for AOS you will receive your conditional green card, which replaces the EAD. The conditional green card is valid for 2 years. Within 90 days of the conditional green card expiring, you apply for removal of conditions (ROC) by filing form I-751. That costs $590. Once ROC is approved you receive your 10-year green card. 

 

The date your conditional green card is approved is your "resident since" date. It will appear on your conditional green card and the same date will be on your 10-year green card. Three years from that date (minus 90 days), and provided you are still married, you are eligible to apply for US citizenship by filing form N-400. You don't have to, you can remain a green card holder for the rest of your life by renewing your green card every 10 years (with form I-90).

Yes, you will still be an Australian citizen. The law was changed in 2002 to allow Australians to hold dual citizenship. Prior to that if an Australian became a citizen of another country they automatically lost their Australian citizenship.  

 

However you don't automatically become a US citizen when you marry your US fiance. There is a long, multi-step process. First you apply for a green card.

Question: Did you submit just your original police certificate, original + photocopy, or just photocopy? The NVC site says submit photocopy, the rep on phone last night says just send original. Confused again!

PS: the whole process seems to be flowing rather nicely.

 

Because my spouse is from QLD, no Police Certificate was submitted to NVC.  The Embassy received the original directly from the Queensland Police.

 

Please be aware that the US Consulate/Embassy websites are not always up-to-date.  And neither is the Adjudicator's Manual from NVC.

 

BigO - if it were me, I would submit the original AND a photocopy of your police cert to NVC, and keep a photocopy (or three) for yourself.

ok so we did our police check at our local station here in Queensland. The address I added on the form was ours. Was I supposed to add in the embassy address? How will it be directly sent to them? 

 

This part confuses me....

 

Any thoughts? 

 

Olives24, you were supposed to put the Sydney Consulate's address on the form.  If you get the results directly (and you might not), then be sure to send the results to NVC, who are really clueless about the whole process anyway.

 

But if you have not received the police report in 4 weeks, you need to call the Queensland Police to see where it is in process.

Good luck to those of you who have gotten a name check instead of a fingerprint check. 

 

As I know, oh, too well, the folks at NVC follow a manual that is outdated - and they will not budge for love nor money.  Too bad the Sydney Consulate doesn't seem to communicate with NVC about what actually is required.  My partner has had three names - maiden, first marriage, second marriage - so I'm guessing the Consulate would have told us to get a fingerprint check, anyway.

 

I've written the Consulate about my attending the interview with my spouse.  This is the 3rd business day - and no answer yet.

Which says that a police certificate from NSW is all that is required.

 

Sweetswinks, all you need is a PCC that you obtain from your home state.  If you live in NSW, then you need to get your PCC through the NSW police.

my question....... Understand the check is only valid for 6 months, which ours was done 7 nov, as we have now been shipped to the NVC, would that mean we have to pay $120 to have both done again, or just the name check one?

Raz - if the NVC is not happy with your PCC, they will tell you what you need to do.  I believe the PCC has to be current (or you must produce an updated one) at the time of the interview - but I cannot put my hands on any website that says that for sure.

 

I also think you may get instructions from the Consulate regarding this if your report is out of date.

Thanks for this info! I am in total confusion over this PCC in Australia. I had my NSW police cert sent to me and I have it now, so I am waiting for case complete at NVC and then I will inform Sydney that I have it and hope that they will allow me to bring for interview. So just to clarify we do need fingerprints for the interview??

 

According to the checklist I got from NVC on May 7, a fingerprint check (as opposed to a name check) is required for all states.  But it seems the rules keep changing.  A person from the Netherlands, who lived in Australia for a year and is currently on the same timeframe as I am, was told by the US Consulate in Amsterdam that a name check was sufficient.  Supposedly the Consulate in Amsterdam consulted with the Consulate in Sydney for that answer.

 

NVC checklisted the guy though - for not having a fingerprint clearance.

 

It is so frustrating that the check 1) is not centralized and 2) that the NVC, DoS, and US Consulate in Sydney all have conflicting information on their websites!!!

 

In my opinion, to be safe, order a fingerprint check.

I know - you are correct about the prices.  NVC says a fingerprint police report for QLD is $131.80.  And the QLD Police website says it is $181.00

 

I've been so frustrated, because QLD Police says one thing, Department of State says another, and US Embassy - Canberra site says yet another.

 

I wrote to Canberra 4 weeks ago trying to get the correct info (I wanted to front-load our PCC), but they did not deign to answer my email.

If you open an account with a bank that has branches both in the U.S. and in Australia, can you move money between the two countries without an exchange fee?

 

For example, Citibank has branches in Australia.  But I don't know if they will let you deposit money in AUD and withdraw it in USD without fees.

Bill, you're a legend. I bank with St. George, and haven't been quite bothered to close my account. Perhaps I can negotiate with relatives and do an IOU if they can deposit the amount into my account and pay them back when they;re next out here (in four weeks). Of course, I'm speaking out loud. St George charges a $20 fee. Considerably less than $200.

Despite the checklist stating a fingerprint check is required, I emailed the Sydney consulate recently and they responded to say a name check is sufficient. They noted that a fingerprint check is only required if they have reason to believe that you have gone by another name and that the name check provided is not a full picture of your history. It also noted that if they have any doubt they will request the fingerprint check when you are interviewed, but that it it is unlikely.

So in short, I think like everything else in this process, the need for fingerprints is completely discretionary and comes down to what the CO feels like on the day. Can't hurt to go the extra mile and save yourself the stress of wondering.

We think this may have scared bio-mom enough to where she will stop allowing the visits, but we are now installing apps to record all Skype calls. We have always known that his brother is violent. The brother is severely autistic and just had a tumor in his brain removed that was making him more aggressive. The stepfather banned my husbands mother from getting the brother the help he needs and he's roughly iq wise around age 9-10 in a 29yr old body. He has hurt my stepdaughter before and we have witnesses who overheard him cursing her out one day when my husband left vent on to run to check the mail and the brother came in and was yelling at her. I'm still pushing for a Cps call or at least the lawyer, but he wants bio-mom to step up and be the mother she demanded she could be.

My husband came to the US and we agreed with his daughter's mother about that she would care for their child until she could not anymore (roughly 4yrs) and we would get settled here and be in the best possible shape with both working jobs and a house when she came. I'm concerned bc the mother is violating the parenting contract and the child is reporting being possibly harmed on visits to the grandparents. Would Aussie CHild Protective services pay attention if we call since we aren't there and can't get there. He JUST today got the Noa1 for the 485 and his job app. Ideas?i know it's not the usual but I'm worried.

My fiance emailed Sydney as well with the same type of question:  basic name check or fingerprint one?   they replied, pretty timely actually, that they accept either one.  So based on that as well as others on here who have just used the name check, that's what he will go with in order to save some money.

 

Ditto! I emailed them last week and got the reply Name check is sufficient unless another alias has been used previously, then the CO will need a fingerprint check. Bonus is saves money and time!

I just wanted to see if any of you who lived overseas in the UK briefly (over a year) needed to get a UK PC. My husband lived in the UK in 2001-2003 and was just wondering if any others who lived abroad got two police checks (one from OZ or NZ and another from UK).

ok so we did our police check at our local station here in Queensland. The address I added on the form was ours. Was I supposed to add in the embassy address? How will it be directly sent to them? 

 

This part confuses me....

 

Any thoughts?

Thanks for this info! I am in total confusion over this PCC in Australia. I had my NSW police cert sent to me and I have it now, so I am waiting for case complete at NVC and then I will inform Sydney that I have it and hope that they will allow me to bring for interview. So just to clarify we do need fingerprints for the interview??

Took about a week for the Consulate to both receive and reach out, from the looks of it.

I can't edit my post since I'm posting this from my phone. I'd just like to add that I am from NSW. I had my certificate sent back to me. I hope that there will be one way for doing this in the near future to cut down on the confusion. :)
