we have an urgent medical expedite due to mum having stage IV cancer in usa, we only got an email from nvc with case number and that it was sent (we are guessing it goes electronically)

I came across a post before about someone that lives in a country for 10-15 years but never had a permanent resident card, not sure where he was but I couldn't find it anymore or following the post. I know someone said that he never had an Australian citizenship and could not sponsor his spouse, is there a way for this even though i thought if you stay in a country for so long, you can file a petition for naturalization? I know this is in a wrong forum and probably get it moved but hopefully I can get an answer in either way. thanks in advance.

I think when it says "Ready," that means it has arrived at the U.S. Consulate in Sydney.

 

 

Crymwest >>  As VicAus said, the instructions say to not have the documents in folders / envelopes, so I would advise against putting it in a 3-ring binder.  Perhaps you use post-it notes for tabs?  That's what I'm doing.  (Our interview is this coming Tuesday.)  It's a lot of paperwork, especially the evidence the for the I-134, and I want to make it as easy to read as possible.

 

That's a good idea as well. I have plenty of post it notes and those tabs from labeling books in grad school

 

Razspaz, ditto above^ ours says ready and then some stuff about the interview process. I just got in the mail the letter from NVC about having my fiance fill out the DS-160

Thank you for the feedback. Ours got there crazy fast unless they missed something at NVC updating. It said it was still at the NVC on Friday and was sent on Monday to Sydney. It's showing it's at the consulate now. I'm watching my email I guess for the next few days

Sorry for the slow response.  Ditto what VicAus said.  No need to send anything to the Consulate pre-interview.  The Packet 3 letter that I received asked for everything that VicAus listed, and it says to bring all that stuff to the interview.

 

What do you think about arranging it all in a 3ring binder for my fiance with indexes and the papers 3hole punched? I've seen other people talk about doing that but then I balked at well ###### what if they get pissy about this being 3hole punched. I think it would be easy to present.

What all was required in your packet doing it the new way? Ours just got posted from NVC today and I'm unfortunately still waiting on my HR letter from work so I'll be a few days behind on sending my packet to him. I'm just wanting to make sure I have everything on my end covered to send which is the I-134 (including bank letters, work letter, paycheck stub, and recent '13 taxes) and then ongoing proof of the relationship (print outs of phonecalls and fb messages). Does anyone know how I get my case number so I can check the process online? We got our NOA2, 2 weeks ago. I have the wcs number but not case number... im going through an attorney and they take their sweet time responding to me!

 

I thought you called the NVC on 603-334-0700  to get the case number which you can use now to get your medical and police check done?

Might have to ask user darin&josh, they seem to know everything and are super helpful!  :)

I am wondering why when I check online it says that the nvc provided me with an interview date for Sydney and they didn't..... and my case was sent to the Sydney consulate and I believe received at this stage a week plus ago and I have received nothing from them at all.....

I would probably have it sent to you rather than the Consulate, as I don't think there is a field to put a case or reference number in order for it to be matched with your file when it arrives at the Consulate. Also, I am guessing that you would probably feel more comfortable having it in your hand so you can be confident you have everything in order prior to your interview.

 

If you are choosing to have a name and fingerprint check, you may find it easier (and perhaps slightly cheaper) to do the check through your state police rather than sending it off to the AFP (unless of course you are in the ACT or WA, or are overseas at the moment).

I've read of a few people from NSW that have had their police certificate sent directly to them rather than the Consulate. I wouldn't worry about it being sent to you, as it won't be a problem for the Consulate so long as it is an official police certificate. You can open it and include it with your DSL-1076 checklist and required documents that you will take to the interview, just as someone from another jurisdiction would do.

The petitioner will receive correspondence from NVC once they have assigned a case number and forwarded it to the US Consulate in Sydney. You don't need to call, but you can if you find it is taking longer than expected to be processed by NVC. (NVC had our petition for less than a week). 

 

I believe only NSW and QLD will require your case number allocated by NVC, as they are the only states that will send the certificate directly to the consulate (so the case number is necessary to match it up with your file). If you are applying through another state, then you can apply for your police certificate at any time. 

 

When you apply for the police check, you will want either a 'name check' or 'name and finger print check'. If you chose the later, you will be required to go to a police station to have your finger prints taken (some do ink, some will scan. If you go through the AFP they will require ink). The police service in your state will then do a check against national databases based on your name (and finger prints if you have that done). They will then send the police certificate you, or the consulate if you are in NSW or QLD. You will not receive a copy of your finger prints. 

 

There is also a service for 'name check and finger prints' which is something different. This means they will provide a certificate based on a name check, and then take your prints and provide you with a copy but not actually do a check on them. This is for those people who also need to apply for a police certificate in other countries and have to supply finger prints taken by an authorised law enforcement agency. 

 

Conducting the actual police check doesn't take very long, but the processing time will vary depending on the workload of the state in which you are applying. So it could be turned around in a week, or it could take up to a month. In our case, it took two months.

The US Embassy website provides information on police certificates in several sections. It's FAQ also covers this particular question: 

 

"What type of Australian police check is required?   

Depending on which Australian state or territory in which you reside will depend on how to apply for the Australian police certificate.

You only need to apply for 1 Australian police certificate and it can be based on a name or fingerprint check.

A police check based on name check only must contain all aliases previously and presently used."

Sorry if I am hijacking but once NOA2 is received (i'm still waiting) and I wanna make sure I have my next steps right seeing as Sydney consulate changed their way of doing packet 3 and interview.

 

So when my NOA2 comes

 

1. The petition goes to NVC, we can call up for a case number,

2. I can then apply online for my AFP police + fingerprint check with that number and before I hear from the Sydney consulate, and this is where i get confused

 

Did you print out a receipt and go to the police station and ask them to mail both the fingerprints and the certificate to the consulate?! or are we expected to receive one/and they receive the other? 

 

And the police check can take up to a month, right?

I wanna make sure i am sending my prints to the correct place when that time comes!

It's all confusing me, I did a search on this but nothing was clear

Hello!

 

So I just did this, I went to my GP with a print out of the vaccinations required for U.S. visa (MMR, Varicella, tDap, Hep A & Hep B)

He gave me a referal for a blood test which I took to a pathology office and it cost nothing. I am actually going to get my results tonight so I can post back later. basically if i am missing anything he can give me the vaccination (might cost a little but not as much as it would at the K! visa medical)

I was able to change my name through the Victorian BD&M from within the US, and also got a new passport from within the US. The process was a little tedious but it kept me occupied while waiting for my green card. I have been meaning to write about the process but keep forgetting. What state were you born in? I don't think it will be an issue in Australia.

 

 

If you could write the process for us that would be SO GREAT!! I am totally confused how I'll go about applying for a new passport from within USA and what stuff we need for it.

Cheers!  I have read through some of those, and although overwhelming, it has given me an idea of what to expect.  Right now, the waiting on NOA2 is nerve-racking.

 

There is a lot of information to take in at each step in the process, and it is very overwhelming with all the unique terminology and abbreviations. Our approach was just to focus on the stage at hand and read the guides and the forums. and once that was done, to look ahead to the next step and start preparing for that. It is a lot less daunting that way, and more manageable. The wait for the NOA2 is the hardest part. Once that is done, the next steps move a lot faster and you have a little bit more control over the process.

I just wrote a reply but it didnt work so sorry if this posts twice! What are the 1-134 docs? Att said he will advise next step when needed... nothing yet. I have police check interview tomorrow and Medical can be booked with in 1 day so thats sorted. We are in melbourne. We are using my partners mom as a co sponsor ad my fiance has been living in Aus with me for the last 5 years. Im bummed out that I used an att as I feel like I have no control over what happening and no real knowledge of the process unless I get info here!

 

That's great that you are on top of organising the police certificate and medical.

 

Both the sponsor (US citizen petitioner) and co-sponsor (US citizen's mom) will each complete the I-134 form and attach evidence of their income and/or assets. Your partner's mom should be able to provide her 2013 W-2 and approximately 3 recent pay stubs as proof of her income, and evidence of assets (such as bank statements that show her savings, shares etc). The forms will need to be originals, while the supporting evidence can be copies. Hopefully it won't take long to get the evidence together and posted to you. Is your attorney assisting with this?

 

Also, do you know if your US partner has been filing US tax returns while they have been in Australia? While it won't be needed for the I-134 or the Consulate, it would be good to try and have it up to date when you file for your Adjustment of Status (AOS) (after you have married in the US), as the most recent tax transcript needs to be attached to the I-864 form (which you submit as part of your AOS paperwork).

That is just the standard message that is displayed on the ceac.state.gov site. The Consulate will set the date and advise in their email (which hopefully you will receive very soon).

Was the email sent back an automated reply? The Consulate usually takes 3-4 days to respond to emails, so if the email you received was automated, they should respond with a specific answer by Thursday or Friday.

I'm so excited to know when my interview will be! I dont even care if its in 3 months, I just want to know my timeline so I can start getting ready to leave!! 

 

Normally I'd say just wait for the letter from the NVC since calling will not make the process go any faster, but if your attorney is not prompt in passing along updates on your case then it may be worth the petitioner contacting NVC to get the case number. That way you can make arrangements for the medical and police certificate (if the case number is needed in your state) without loosing time between the 'packet 3' email and your Consulate interview date. It looks like it has only been 2 weeks since your NOA2, so your petition may not have reached NVC yet, or if it has, a case number may not have been created, so try again a few days if either is the case.

 

Have you got your I-134 documents together yet, or confident you will in the next few weeks?

Once you have submitted your request, they will send the police certificate to the address supplied (it looks as though on the NSW site you can opt to have it sent to the applicants address and not the requesting organisation). If you opt for a fingerprint check it will just be used to look for any matches on the various state databases. They won't send the fingerprints anywhere, and the Consulate won't need them.

 

What you will receive is a single sheet (assuming you have no convictions or matters before a court) that looks like this sample and it will include your name, date of birth, and including wording to the effect that:

 

"A nationwide name check (or name and fingerprint check) has been conducted for the person listed below, for the stated purpose of Visa to the United States of America.  This is to certify that at the date of issue, there are No Disclosable Court Outcomes or outstanding matters recorded within the records of police jurisdictions in Australia."

 

On the NSW Police website you are able to apply for the police check through their site, or if you fit into certain categories, they direct you to the AFP. Do you plan to apply for your national police certificate through NSW Police? An information sheet on using their site is available, which is fairly helpful. It also includes instructions on contacting your local police station if you need to have fingerprints taken and how to have your identification confirmed.

 

(If you've lived in a country other than Australia or the US, you may need fingerprints to send to a law enforcement agency in that country in order for them to provide a police certificate to cover your time there. However, obtaining fingerprints for that purpose would be a separate request from the application for an Australian national police certificate).

Darin&josh, you seem to know a lot on the topic of police checks.  I have a question for you...

 

We live in NSW.  My fiance (the beneficiary) did the NSW National Police Check (this one: https://npcoapr.poli...troduction.aspx) and opted for the fingerprint check.  In the section where it asks the purpose of the check, he wrote something like Overseas Visa, USA K-1.  (There wasn't any space to put the details of exactly who to send it to.  It only asked for our personal address.)  Then he went and got his fingerprints taken at a local police station.  They sent it off to the NSW Criminal Records Section.  We thought that because it's NSW, the certificate should go directly to the U.S. Consulate, but yesterday, we received it at our home address.  Is this a problem?  Did we do something wrong?  Will the U.S. Consulate still accept it if we bring it in at the interview?  Can we open it?  Or should we it in the sealed envelope?

 

And has anyone else living in NSW been in this situation?  If so, how did you go?  Did the U.S. Consulate accept your police check (even though it wasn't sent directly from the NSW Criminal Records Section)?

 

Any advice would be helpful.  Thanks!

The embassy website had not been particularly clear on this point. So some people have got the name check with finger prints and some people just the name check. This updated page provides advice on a state by state basis: http://canberra.usem...olice_cert.html

 

While some are still not as clear as they could be, it indicates that they only require the name check (and not the finger print check).

Nothing happened, no problems with our case.. Just unlucky? If I'm honest, the envy I feel seeing K1s move so fast makes me tear up.. but that's how life goes!

 

The silver lining at least is that you will have permanent residency status upon arrival, and since you've been married for longer than 2 years you won't have to have a 2 year provisional green card.

I went through the new process where my consulate interview was scheduled upfront, and I was still able to use the site to pay the MRV and complete the DS-160. The website still has instructions on scheduling the interview as one of the last steps, however, when I got to that point it was skipped. I assume the website system has been adjusted to skip that step for K-1 visa applicants.

Is this something he needs to set up when he pays through the Australian Post prior to his interview or is it taken care of at the consulate and he will pay for it there? He's just trying to sort out his side of things and I'm the one that's been handling the paperwork thus far so it's got him nervous.

 

Instead of going to Australia Post, your fiance can pay for the visa application (MRV fee) through ustraveldocs.com, which will include the Toll courier cost.
