Hello everyone!

 

Anybody had any further questions regarding previous trips to usa prior to meeting your spouse?

 

I ask because my intervie at the Sydney U.S. consulate is in 12 days and I have visited the U.S. when I was 18 - 23 years old, 5 times over a 5 year period prior to meeting my fiancé because i was visiting friends there.

 

 

Any advice or feedback?

Is he in Melbourne? The main things he seemed to be focused on were mental health, drug use and TB. The rest he didnt seem to care about!

I had my medical on Monday (2 days ago) and the doctor told me they have to ask about my tattoo's for purposes of identifying me  :)

I took all of our original evidence that we sent in with our packet.  The scariest thing is the interviewer literally stared me in the eyes the whole time! So I felt so awkward and was thrown off answering some of the questions!  But the best part was at the end is when the interviewer handed me my approved and said congratulations on it!  Good luck!:)

Ok you guys, since you're way ahead of me (just got I-130 approved today) maybe you can answer me a very confusing question: at NVC stage they ask for docs you guys mentioned like police Certs etc. I'm planning on sending all originals of everything (and more) to NVC. What is the stuff we have to bring to sydney then? If they'll already have all of our original police Certs, birth and marriage Certs etc?

I thought it was only extra evidence (and copies of everything already sent just in case) and the medical. And there's the "I'm ready for interview" form too... Right?

I'm a little hazy on this cuz it seems a but different for sydney than other places... No?

Please help!!





 

Hi Bradrean - the process at the Consulate will be slightly different for spouse visa applicants (IR-1/CR-1) compared to fiance visa applicants (K-1 visa). Because a spouse will have an effective green card upon admission to the US, a lot of the checks are conducted upfront, whereas for fiance visas some of that takes place after admission (and they have longer to wait for a residency status, employment authorisation etc). 

 

Spouse visa applicants will follow the instructions on the DS-2001 (it does request of a lot of the same documents as the K-1 visa process, but there are differences and some of it will include items already requested and/or supplied to the NVC). However, I've only gone through the K-1 process so I can't offer much help with the specifics of the spouse visa requirements.

It would be cutting it very close. Assuming he had everything in order for his interview (I-134 and evidence, police certificate, medical, birth certificate etc), and also assuming they approved him on the day, it's likely it will take 4-5 working days to get the passport and packet back to him which would be the 1st or 2nd July (though some people have got it back in less time).

 

If you are considering when to book, an option could be to buy the ticket now and if it needs to be changed pay the fee to do so, or you could wait until after his interview (or even when he has his passport and visa in hand).

 

Some things to consider would be:

 

1) Do you have all the documents required for the interview yet?

2) Would the 3rd or 4th be realistic for your fiance? For instance, does he need to do anything before he leaves that would be dependent on having a confirmed visa, such as giving notice at work, change his mailing address etc?

3) How big a factor is the cost of the airline ticket and/or which airline he travels with?

 

Also, if your boss is flexible enough, do you think they could give you the 7th off instead of the 3rd? That way you would have a little more breathing room to look at booking a flight for the 4th (or even 5th) and still get to have a long weekend together. And I am guessing a flight on the 4th would still get in early enough to see the fireworks :)

If the your petition reached the Consulate on Friday, then you should expect to receive the packet 3 email very soon. In our case, the Consulate received the petition on 10 March, and sent the packet 3 email on 11 March, with an interview set for 8 April.

When I went for my interview in Sydney, I took photographs, copies of all my bookings and my partners when we visited each other, cards that I had received etc.  I did not need any of it but I took it, better to be safe than sorry.

This is a common erroneous message perpetuated by USCIS personnel. They work for the Department of Homeland Security (DHS), not the Department of State (DOS). Both of which are huge government bureaucracies, each with their own duties and responsibilities to enforce their particular portion of the INA. I would be very surprised if a DHS employee knew the correct procedures at DOS.

Yes, only Sydney does immigrant and K-1 visa interviews. He can do his medical in Melbourne though. 

Yes, you can visit Australia. Your fiance can also visit the US. 

The NOA2 goes to the petitioner (you).

Assuming a visa is approved, how is the visa delivered to the successful applicant?

Would someone need to be available to sign for the package? Or can it be sent to a local immigration office for pickup?

Any information would be greatly appreciated.







It used to be Australia Post express post (or whatever kind of envelope you chose to give them to send your passport and paperwork in).

Now I think they use Toll.

Its true. the system is ridiculous. How can people that are married and committed wait longer than people who are dating? AND in most cases (from what I've seen on here, have only met once or twice) 

 

We planned to get married and do it that way but our attorney said this would be half the time for a K1 

 

We are in a bit of a different situation than most. My partner has lived with me for 5 years in Australia and has PR. We could not move to the USA due to DOMA (same sex couple) but we would have been married and doing our thing years ago if we could have. 

 

We never thought we would be able to live in the USA so we just settled here. Thank goodness the law changed last year, i don't think she could take being away from her family for much longer. 

 

I really hope you get your interview soon. The waiting sucks. it even sucks for me and I haven't had to wait at all. (Im a bit of a control freak and HAVE to know whats going on though so its doing my head in!!!) 

 

Yeah we lived together after we got married overseas until April 2013 when I came back to Australia for a 'quick' stay until this visa thing was over. Now still waiting! Ugh I'd better win the lottery to even out my terrible luck for no reason.

Nothing happened, no problems with our case.. Just unlucky? If I'm honest, the envy I feel seeing K1s move so fast makes me tear up.. but that's how life goes!

I had the name and fingerprint check done in January last year (I got a little ahead of myself with getting things done) and I'm only just getting to the interview stage now so I contacted the NVC to see if I needed to get a current name and fingerprint check or if I only needed a name check. The gentleman I spoke with at the NVC said that all I needed was the name check. 

 

Call the NVC and get their opinion if you're not sure.

So my interview was today. As expected there was a wait. First I saw the person I had been dealing with via email and she sorted through all my paperwork. She then asked for my bank statement and resume, I handed this to her. Then she asked for my old passport as this had the dates that I was in America last year. This was handed to her as well.

I took a seat, the CO eventually called me up. I took an oath and then asked two questions,

Why do you want to travel to America? "To be with my husband"
Are you sure you want to move to America? "Uhhh yes"
Just asking, I get different answers everyday.

All my originals were handed back to me, he kept my passport and the self addressed prepaid envelope and said I was free to leave. I really don't know if this is normal for the Auckland consulate but I had prepared so much to take in and walked out feeling quite disappointed. My interview was literally 1 minute. At least it's over

I am wondering why when I check online it says that the nvc provided me with an interview date for Sydney and they didn't..... and my case was sent to the Sydney consulate and I believe received at this stage a week plus ago and I have received nothing from them at all.....

one thing we didn't know, not all aussie police stations/locations do the fingerprinting

we just got a certificate posted to us that said name and fingerprint all good blah blah, it has watermarks and other security features

yes have been told the check can take up to 4 weeks, ours took 2 1/2.......

 

how did the way of doing things at Sydney change?

just curious.....

kristy the answer seems to vary widely, we did the fingerprint just to make sure.

I can't seem to get an answer if there is a time expiration for the check, some say 6 months, some say 1 yr, some say none. the consulate gives one answer, immigration another, and aussie police another LOL :rofl:

think we did the same as maree getting ahead LOL, when you rang what did they say?

have been married 14 yrs and got a so called "expedite" at nvc and still no interview date for Sydney, mail from my family usa way moves faster than a file LOL!!!

 

congrats to you salt, there is no rhyme or reason to it, I hope we make it back to the states before my immediate family member has any more issues with their stage IV cancer.

 

we are now at the 7 month stage of all this, and when we get all done stateside............ whoa am I ever going to get soooooooooo loud! I hope my other half is able to treated like the "special immigrant he is", you know tick the box for not born in usa, tick the box for special this and that, LOL

being that the property market is more buyers now then sellers and some only want 30 or 60 day contracts, when would you put house on market?

 

our qld home took 7 months to sell, it is so unpredictable, we are thinking 1 July end of tax year......

there seems to be no new process for the packet three for IR-1.......

yep all organised and done, had hoped it would be "please bring all your paperwork to interview", but not the case

was all sent express post and waiting for interview date.......

yep, don't think "only on a tues" will do for an expedite and the next lot of school holidays are approaching

we have to do our medical in Sydney as our state doesn't offer any place so rather than do two flights, we are patiently waiting for interview date to book in medical so we don't have to pay for two lots of flights to Sydney and have been told the medical is only valid for 6 months too

 

any new things with interview process?

I finally got an email reply, Sydney consulate has not received our info from nvc, and to get packet 3 ready..........

um we are supposedly getting an urgent medical expedite, should they not give us an interview date and have us bring all the forms then???

we have an urgent medical expedite due to mum having stage IV cancer in usa, we only got an email from nvc with case number and that it was sent (we are guessing it goes electronically)
