This is very regional and there is a lot of variety. Best to have your US fiance research either their work plan, or temporary individual plans in their area.

Sometimes you can get it under your US fiance's health plan from work without being married, but usually you will have to be married. You could gamble and not have insurance until you are married (this might work if you plan to marry within days of arriving). I don't recommend going more than an extremely short time without medical coverage in the US.

In Oregon, for example, Blue Cross Blue Shield offer temporary plans for up to 6 months. They are mainly for people between jobs, etc. You have to research these too though, because sometimes there are residency requirements.

It's so nice to know that there are many kiwis out there who's experiencing a rough time immigrating to the US for their loved ones! US CBP officers in Vancouver coerced me and Ed into applying for a K-1 Fiancee Visa last October, so I had to come back to Auckland to wait for the visa while Ed works in the US wacko.gif . It'll be nearly 5 months since Ed submitted the petition for K-1 visa. I really hope the US Consulate General will contact me soon!

Just wondering, does anyone know of any way of finding out the status of visa application idea9dv.gif ?

SFO is a much smaller airport than LAX. To get to immigration simply turn right once you get out of the plane lounge and walk till you see the tapes and lines. Signs for citizens point to the left, for others to the right. The new immigrants line is on the left hand side past the citizen lines, with the line for aircrew on the other side of it. There will be a sign there, just go up, stand behind the yellow line and hold your MBE in front of you. If you ask one of the people messing around with the tape they'll tell you where to go, but you definitely do not line up with all the other NZ visitors.

If you're lucky and beat all the wheelchairs (the send them to the same area) processing takes all of 10 minutes.

Well after all the investigating I did on here before I put mine in, I read that another applicant said the woman at her interview corrected her form to read the red number on your K-1 visa. It's on the right hand side just above all the guff at the bottom. smile.gif

Yes I got my SS Card a couple of weeks after I arrived here, (they recommend 2 weeks after you arrive to alllow time for processing your POE paperwork).

If you google getting married in IL it should tell you what you need to know about ID requirements etc.

Straight after the ceremony, (it was just us & the JP), he filled in the necessary bits at the bottom of the license and we took it from there to the County Clerks Office and they did their bit and then gave the whole thing back to us as our marriage cert. After that we went to the SS Office and changed my name on the SS Card, and that was it. kicking.gif

While it's similar in most states, some of them do vary a little so you do need to google it for your state or contact your local County Clerks Office as they're normally the office that issue them.

Then she says since I am getting benefits I have to notify the people at the front of the building we got married. headbonk.gif So we walk there, go through a security check, and get a number just to see a person to tell us to wait another bit. sad.gif Then after all of that, she says she can't do anything because my husband doesn't have a social security number, even though I told her we just applied for one. headbonk.gif

So we have to wait 2 weeks for the cards now..great.

So I am looking at these AOS papers and am trying the I-765 one first haha and am not sure what to put for questions 14 and 15 which ask manner of last entry and current immigration status. He's not a visitor or student. Should I just put K1 Visa holder? Bah! I hate more forms. These seem worse than the first set of forms. sad.gif But if anyone has any advice/input on that, it'd be greatly appreciated. biggrin.gif

If your SO entered on a K-1 Fiance Visa then that's the correct answer to put down for both questions 14 and 15.

Well I sent the AOS package off on Feb 23 and it was received by them on Feb 26. good.gif

I received NOA1 for EAD & AP on March 7 and NOA1 for I-485 & the Biometrics apt on March 9th....a nice birthday prezzie it was too. kicking.gif The AP's a biggie for me as my Dad is in good health, (touch wood), but he's still 78 and my 2nd Mum (my Aunt) is steady for now but terminal so I really want to be able to travel at the drop of a hat if I need to. Hopefully it won't take too long to be approved.

I have my biometrics apt on March 20th in Memphis. It's a 2hr drive but I've already google mapped it so I know where we're going.....lol star_smile.gif

Hopefully there will be no RFE's and it'll be transfered straight through to CA, I'm crossing my fingers on that one unsure.gif whistling.gif

Still things are moving along so I can't complain. tongue.gif

Thought i'd add a copy of my email to the folks back home smile.gif

The flight out from Auckland was held back for approx 2 hours, which meant we missed the connecting flight to Charlotte from LA. Luckily the airline decided to send us to the LAX Hilton for the 8 hours we had to wait for the next flight. They also gave us lunch and dinner vouchers, so we had the most expensive burger for lunch and the absolutely best steak dinner I've ever had in my life, for dinner.

Immigration at LAX was a breeze. I got into the same queue as my daughter, the one for visitors as the other line had a sign that said for US permanent residents and US passport holders only. I had read about horror stories but it was a breeze, the immigration guy at the window just asked me a couple of questions about how long I'd known Rob and when were we planning to get married, it was quick and painless but man he had no sense of humour at all.

Finally flew into Charlotte airport at 0600hrs Sunday morning, 9 hours late but at least we were finally there.

I really can't express how happy I was to see Rob, it was truly like I was finally home and could finally relax and rest. Since Kelly and I have arrived we have mainly been shopping and sleeping. Poor Rob was dragged from shop to shop as we looked for rings and dresses, finally have everything we need.

In the middle of it all Rob had a doctors appointment and then they made an appointment for him at the hospital to test his lung function. It was all good news, Rob can be very stubborn and for some reason I won't bore you with, he hadn't been back to his doctor since I went with him in April 2008. But we had a very frank talk with the doctor and the doctor agreed that as Rob's condition seems to be stable, & he can carry on a conversation without getting breathless, he agreed with Rob that there was no immediate need for him to have a lung transplant, which is why we were at the hospital for the lung function tests, the doctor wanted a base line to compare Rob's progress too. All in all I'm very happy about our visit to the doctor, while Rob cannot come off the o2, we can put off the transplant for the forseeable future and he put Rob's worries about the addiction to o2 to rest. The doctor says the addiction is physiological, not psychological and therefore when Rob no longer needed the o2 his body wouldn't crave it. We're still waiting on the results for the lung function tests but I'm very optimistic.

We're waiting on some things I ordered online to arrive and when they get here we'll head off to the court house and get hitched (hehe)

Rob is going to have to put some of his things in storage, because there is no way that I fit with all my stuff into his bedroom, so we're organising that over the next few days while we wait for our packages.

Tomorrow we're going to be shooting Rob's gun and his fathers shotguns, well Kelly will, I'll probably just watch.

Now a question for those already here, what's with the bread and can anyone recommend a brand that doesn't smell quite so bad?

yes, i feel your pain michelle - i had actually been warned about it, but still... i would KILL for some vogels or bergen or something! don't even bother with bread from any supermarket, you really have to go to a good bakery to get anything decent.

a friend of mine has promised to send over some cadbury drinking chocolate - hot chocolates here are totally inferior. don't be fooled by the cadbury caramel creme eggs: they're british cadbury so it tastes very different!

thanks kim - no, i appreciate you bringing that info to our attention, we literally had no idea that there was any doubt i could continue working to the expiration of my visa while in the midst of adjusting.

after much time spent sending messages, posting on forums, asking so-called 'experts' (gahhh i got a really snarky lady over on justanswers.com), reading up on the immigration laws, my fiance finally called USCIS today and got through. we'd left this as a last resort because everything we'd read had led us to believe they would be of little knowledgeable help. but he got through and spoke to a woman who knew what she was talking about. she informed him that i CAN continue to work while adjusting, but when he asked for evidence of this - e.g. the specific law that references this, because we want 'proof' so we can sleep at night - she was unable to provide any. she said that while USCIS can advise, it's up to lawyers to provide proper legal advice in these matters. so we'll probably still have a brief consultation with a lawyer.

now the problem is: finding a lawyer! i don't want to use some shady lawyer, but i haven't the faintest idea how to go about finding a reputable one. any tips??

why can't they JUST SAY: "if you are on a J-1 visa with no HRR you have to give up work till your EAD arrives" OR "if you are on a J-1 visa with no HRR you don't have to give up work till your visa expires (unless your EAD arrives before then)"

i know that the EAD is supposed to arrive within 90 days, and if it hasn't you can apply for an interim EAD, i think. but man... we really hadn't planned on me being unemployed during any of this. we'll have to rethink about when we should file. originally intended to do so immediately after getting married end of march. thanks so much, kim, for mentioning that - i don't know if i would have come across that info on my own, and i would have ended up working illegally!!

Been busy the last few days.
Genna got her Visa and she flies here on the 17th!

I am having trouble focusing on any new Immigration stuff at the moment.
I took a look at the AoS guides, and they seem really helpful, but I just couldn't take it all in now. Too excited, plus making wedding plans.

Is there anything major I need to do for immigration/AoS before the wedding? I would hate to miss some important step along the way.

No...but remember they won't send it out over a week-end. It will probably go out on the Monday..and depending where she it may take a day or two. I was in Auckland, so interview Monday, sent on Tuesday, arrived on Wednesday. Not long now good.gif

Genna was granted her Visa at her interview today!

A years journey at an end... I hardly know what to do, except be extremely happy of course.

She will re-enter the USA on March 17th, and we will be married on April 25th.


I realize now I know nothing of what I am to do for the next step... I only dreamed to the interview.
Is there a good resource here or elsewhere for AoS?
(I remember Russ of Kim&Russ saying in a post once he reached the US "I am so done with immigration right now." or some such. I remember reading that and wishing I was at that place and time with Genna. Now I know EXACTLY how he felt)

I just called Genna, and the paper I sent her does indeed have a raised Seal on it. Unfortunately the Judge "Stamped" his name on it rather than take the time to sign it, but I assume that will have to do.

None of the paperwork form the Divorce is actually titled DECREE. My lawyer consultant told me that the decree is the "Judgement." so this is what I sent to Genna. Is this correct???

Yes, she does need a pre-paid courier bag. Get a legal size one (big) Write down the number from it so you can track it.

My papers for my divorce didn't say DECREE anywhere. Mine said judgement on it. I was also divorced in 1970's and that one says certificate.



The one I sent to Genna says "Judgement" also. It has the Judges name "Stamp" on it, and the court certified stamps and signatures. It doesnt contain my Ex-Wifes or mine signatures.

I wrote to the Consulate last week to see if there was any last minute stuff... and they asked that Genna bring the "original Divorce Decree, not a copy"... it was a copy that I sent in wit hthe original K-1 application.
