I can't edit my post since I'm posting this from my phone. I'd just like to add that I am from NSW. I had my certificate sent back to me. I hope that there will be one way for doing this in the near future to cut down on the confusion. :)

Interesting. It's strange how there's no clear cut one way to do the Police Certificate. I had my interview April 1st and completed my police certificate in January.

For the record: What I did was have my fingerprints taken at my local police station then I took the prints and filled out for a name check on the AFP forms. I can't rememer much about it I don't think I ticked the name AND fingerprint box. But whatever they charged me in the end was fine. I just wanted it done. I think it may have ended up being cheaper in the longrun than taking a trip to the ACT like the officers at my local station suggested. I did totally confuse the hell out of them with all the forms though.

Er sounds as if the child is saying they are being harmed on visits to the grandparents, so why would they report themselves?

 

Also if there is any indication a child is being harmed then the father should report it. If there isn't anything happening then no harm no foul but if there is then you could be saving the child's life. These things escalate sometimes very quickly and you don't want to think what if later on.

Thanks for the replies. I do know that we need to sign up for a 'proper' plan but our research so far was suggesting that we couldn't do that until we were present in the US. My wife and kids are USCs so it seems like they should be able to sign up - my wife will phone as suggested. But how do I get coverage under an Obamacare plan when until I arrive I won't have anything apart from a visa in my passport? No SSN, no green card etc...

when a visa gets glued into the passport, study the line that contains the word 'endorsement' and learn what an I-551 document is. 

 

And yes, most CR-1/IR-1 visa holders are successful in getting a SSN 3 to 4 weeks after arriving in the USA, getting into a SSA office and applying for the SSN.

You have to be resident in the State to apply, you can do the preliminary investigation now, but until you take up residency then as I understand it you can not do anything else.

 

When you enter you will become a LPR and be eligible.

You are eligible to have your name changed in NSW if:

1. Your birth is registered in NSW or
2. You were born overseas and have been resident in NSW for three (3) consecutive years immediately prior to your application or
3. Your birth is not registered in NSW and a protection order has been made to protect you and/or your children from domestic violence.

(emphasis and numbers added)

So assuming you were born in NSW, you fit criteria one. It's an "OR" situation for 1 OR 2 OR 3 so... I'm confused why if you were born in NSW that you don't think you can change your name.

If you weren't born in NSW but were born in another state of Australia then you change it in that state. If you were naturalised in Australia (born in another country) it's a difference process.

I am a bit confused..

I am also getting an Australian Police certificate for my CR-1 visa, and contacted the NVC in May of this year to ask if I need fingerprint checks also and they said no.

According to the Australian Federal Police website:
Fingerprint checks

"Fingerprint checks may only be conducted where there is a legal or regulatory requirement for such a check to be conducted."

So, it appears that it is not a requirement to get fingerprint checks in addition to the name check?

Fingerprints are a requirements. I don't know who you spoke to but they're wrong. However if you don't want to trust us, feel free to just get the name one and see what happens.

Yep you need a police check with fingerprints. Which method depends on your state. click the link that KLS listed as it gives you the different state info

Wrong. Depends on their state (or whether they're applying from out of the country) and it's valid for 12 months for immigration. And from my understanding,Australian police certificate is a national police check.
Does it represent only for Victoria state or national? no matter before I lived in Sydney for a couple of months? Or I have to apply another pcc for NSW? :crying:

The one you get in Victoria will be a National Police Check. It doesn't matter which state you go through (you go through the one that you are currently living in). They all use the same database to run the check. You don't have to get one from NSW as well.

Just make sure you get the fingerprints and name check.

Some of the information on the Canberra US embassy website is out of date (at least it was last year for Victoria). Best thing is to go to you state's police force website and look for information on how to get a national police check (the one with the fingerprints).

Hey everyone, I just have another general inquiry about my situation.

 

I live in a very rural area with basically no work opportunity's and have been supported by my parents since I left school, volunteering at nearby farm. I have never officially received any income whatsoever and have never payed tax because of this. Will this be any detriment to my K1 Visa, in any stages whatsoever? My fiance lives in a very populated city in Kansas with lot's of retail work and I'd love to be able to get started there. I will obviously be doing everything I can to acquire a job before at least my interview stage of the visa, but this has been a big question on my mind, if you had needed to pay tax, or have had to have been working for a minimum period - if anyone could give me some insight to this I would really appreciate it..

You work history/tax history will not affect the process at all. There is absolutely no requirement for the beneficiary to have any kind of tax records, work history etc. All that matters is the petitioner's ability to sponsor you.

The guides on this website are excellent on how to get started.  If you still have questions after reading them, post away and we will do our best to help you.  But please read the guides first as most if not all of your questions will be answered.

 

There is no educational requirement for the visa.  The requirements, roughly stated, are:

 

1.  She makes enough money to support you, can show it on paper, and is willing to sign an agreement to support you.  It will be 6 months or so after your arrival before you can legally work.

 

2.  You are free of dangerous contagious diseases and drug use and have no criminal record.

 

3.  Both of you are free to marry (single, divorced, annulled, widowed, etc)

 

4.  She is a United States citizen.

 

Good luck to you.  It is a slow process but it works in the end.

Well for K-1 you need the full background/history with fingerprints, I assume it would be the same for most visa's. Don't know which state you're in but in SA there two different ones, you'll be wanting the more expensive one, it's about $150. Not sure about other states though.

I got a name check only which was accepted at my K1 interview.

 

BUT! I have noticed that CR1 applicants need to send their police certificate to the NVC (is this correct?) and that NVC only accept police certificates based on fingerprints. 

 

K1 seems to be different cos we take ours to the Sydney consulate itself.

 

Yes, CR1 applicants do send their police certificates to NVC. But a fingerrint check is still not required. I am a CR1 and got my Australian police certificate based only on name check. No issues.

I got a police certificate without fingerprints and it was accepted by NVC and embassy without any problems. I have not read anywhere that police certificate MUST be with a fingerprint check.

G'day KLS.

I am confused regarding police clearance. So the embassy website says go to WA police and get police clearance from them. I also sent an email to Sydney to check that and they told me to get one from Australian Federal Police, not WA police. They also said to refer to the embassy website, which tells me to contact the WA police.

Which authority did you get your clearance from?




This thread is over 2yrs old now. Honestly, I don't know what the requirements are now, they may or may not have changed. May be a better idea to post your question in the Aussie forum, as someone with more up-to-date info can probably help you better than me. Good luck!

Forget the AFP.

The one you are going to get is not just a state police check, it is a national one.

Here is the link on the Tasmania Police website that details their police checks.

From the looks of it - the second one listed here is the one you need - National Police Record and Fingerprint Check. Cost is $120 (which is consistent with what the Embassy website says).

I did CR-1, so my experience with F2A visas is limited, but imagine that the PCC requirements would be the same.

This link is to the US Embassy Canberra website and details the process for obtaining PCC for each state.

They are valid for 12mths.

OK - anybody else run into this with NVC?  I called tonight, expecting to get a "case complete", but the guy I talked to said we were getting a checklist for a Police Certificate.  We were expecting this - my partner is from Queensland, and the PCC gets sent directly to the Consulate.  BUT...I think NVC is VERY confused, as they are saying she needs TWO Police Certificates - one from Victoria and one from Queensland.  I think this is completely wrong, as the Australian PCC is a national one - not a state-by-state one.  You just have to apply through your state.

 

Has anyone run into this (IR-1/CR-1)???  How was it resolved?  I don't have the checklist yet - so I can't do anything yet.

  • I got married in California, registered first, so i have my marriage certificate, it has my new name on it.
  • Then i applied for AOS, with new name, as it shows on my marriage certificate.
  • and same time as AOS, i applied and got SSN, so it's also in my new name
  • later on i got called to do the AOS interview, got greencard in new name
I don't have CA driver's license yet. I do have a combined bank account with my husband in the new name, we got it after we got married and with SSN.

ETA i don't need that now since I got my green card, but yeah it has my new name, but passport has my old name, I've been told as long as I bring my marriage certificate, US custom shouldn't be a problem. My ticket this time is still in my old name. I just don't know if this time i can't change my Aus passport, for the next few years when I exit/enter US would they question me. and I wonder when my Aus passport naturally expires in 2015 if i CAN change my name.

BUT I'VE BEEN TOLD BY THE AUSTRALIAN PASSPORT SERVICE (when i called few days ago from Sydney), I NEED AN AUSTRALIAN OFFICIAL 'CHANGE OF NAME' CERTIFICATE TO CHANGE MY PASSPORT, NO MATTER WHERE I AM IN THE WORLD.

Most people in my situation will change their Aus passport during this trip, but I can't as I got a valid visa for another country in my passport that I need to use for this year.

As you can see from my timeline, i got married in the US, and got my husband's surname on my SSN and green card already.

Now i'm back in Sydney for the wedding, i'm thinking of getting a change of name certificate so i can change the name on my Aus passport later (within 12 months) in the US.

But the NSW BDM requires me to have 'living' in Aus for the last 3 years as one of the criteria, and I don't qualify, i was overseas working for part of 2009, 2010 and 2011.

so i'm writing a letter to go with my application form, see what they say. The good thing is if i got declined they will still refund me the $166.

Just to let you guys know, or if you know any way around it.

 Yeah I gradually realised I don't need to renew the passport before the I-751.

 

Green card is in my new name, all US documents are in my new name.

 

now the hard part is getting the CA marriage license apostilled..... notary at the bank doesn't seem to be sufficient it seems.

My Australian passport is still my maiden name, and it will expire in Jan next year. My 2 year green card expires on late Sept this year. 

Should I renew my passport before I file the i-751 or after? Does it matter?

 

What if I want to change my first name in the passport too? Even it is just removing a - or a space? I read it is too difficult as I wasn't born in Australia but maybe.

Just a question - how did you get your husband's name on your SSN and green card?

I have been wondering this, as we have our marriage certificate from Virginia, but all of my proof of identity (i.e. passport, bank cards, drivers licence etc.) are in my maiden name and obviously are foreign.

I don't want to end up with two identities - i.e. being known in the USA as my married name but in NZ as my maiden name!

Also ETA - can your green card have a different name from your passport then?

And now I am bothering about"living" because I worked in Vietnam and total was near 2 years.
It's temporary and for business only.
I never stayed there six month periods at one time.
