Your visa stamps, the photos of you two together are going to be the best proof of your relationship. The movie stubs do not have your names on them, the cc receipt doesn't have her name on it so there is no proof either of those was for you and her. The pictures will need to be printed.

The phone records are good, keep collecting those. The receipts of the birthday cards and letters may not do much good either because they could be for anyone. What you would want to do is keep actual cards after they are mailed and stamped and make sure both of your addresses are on them. You can start doing that now since you are living apart. Chat records I am not sure of however emails will count. These are all considered secondary forms of evidence and are good to have, but not as important as the photos.

I emailed and called. The email came back and said that the final decision rests with the interviewer and was really short and to the point. The lady on the phone kept saying don't worry the interviewer can extend it if he chooses to and if he doesn't then they would proceed accordingly. Ugh....I just feel sick. I will let you all know how it goes. I still plan to call the USCIS and see if there is anything they can do.

Thank you for that suggestion as well. I think I'm going to do that, I don't have high hopes they will allow it, but it can't hurt to try! I think I am also going to call as Sachinky mentioned. They are so hard to get through to though, I'm sure I'm going to be up till 4 am trying to reach them.

Thank you. I plan to email them a note stating why I can't make it to the interview and how I'm going to be fully available to take a phone call should they have any questions for me. I will include this in there, I think I will also send a handwritten note as well. Better safe than sorry. This just makes me nervous and upset.

Okay, the embassy received my fiancee's packet 3 on November 12. They didn't schedule his interview until Jan 28. Our I-129 expires on Jan 22. Since I have been reading this is a way for them to deny your package after having come so far, is there anything I can do to possibly get the I129F reaffirmed before they have the chance? Is there something I can do or say to let them know they had 2 months to schedule the interview and did not and keep them from denying us for this reason? I have time to try to get this done (I hope). Do you think it would do me any good to call USCIS and try to get a new letter with new dates on it?

And just fyi, we stayed ahead of them on everything. He had all his packet 3 stuff and mailed it all back the day after he received the packet. There was no wait on our part. The NVC did however keep our package a month and as usual never said why. As I'm sure you are all aware, this was completely beyond our power to do anything more. But I don't go down without a fight lol. I'm not giving up yet, I don't want to see this fail on a technicality.

You mean they are not open till Jan 12th? :o I know it is expensive, but it was worth it because it was so fast.

Anyway, my suggestion is to scan a copy and have him print it out in Pakistan and bring to the interview. Take it out ONLY if it is requested. If they want the original copy, then you can mail it later.

In India its not a problem even if you don't have vaccination records. When she goes for her medical they will take a blood test and will determine which vaccines are needed according to her age and the test result.

I just received my NOA2 approval via email the other day.

I have a few questions..

What is a "Notice of Intent to Marry"? I'm not sure if we filed that, we are bot Muslim and it was an arranged traditional marriage. My father in law took care of these things and I'm not sure if he did or if we will need this... Any Input? Thanks in advance.

My wife can not find her vaccination records, what does that mean and what vaccines will she need to have done and/or what can be done about that?

I have a question for you all, and that is K3 or CR1..

I know most say K3 is obsolete.

So, what can I expect the difference be between K3 and CR-1 wait time when it is going through the Chennai, India Embassy?
Is it only 3 - 4 weeks, or is it a matter of a couple months???

Your going for a K-1 Visa, it's different, NVC just assigns a case number and forwards to the appropriate embassy.

CR-1 Appointment Post gets processed at NVC...

The reason I ask is, my wife and I are getting ready for the next step, as we are almost at the AOS stage and I just paid the AOS Fee Bill.

Even though it says im going for K3 I think we are switching paths since we are seeing some good and fast movement on the CR-1 route.

Have her employer write a letter on company letter head and ofcourse signed by her boss. You have only two pictures? Make sure you have w-2 ( i send three years worth)

My fiance went through Delhi but i thought i will give you a suggestion. We used plastic folder with little tabs for each section. I labled them as Prof of relationship which included Chat logs, Emails and our trip stuff. I also put lable for his birth certificate, our Noa's, PCC, passport, application, telephone records, photos, affadavit of support, tax return, w-2 and copy of my U S citizenship. Hope this helps.

As Rohini said, getting a tourist visa from India can be really tricky. Especially since your sister is single. They will want her to show significant ties to India such as ownership of property, bank accounts, ties to a job, basically as many reasons as she can that she intends to come back to India. Even with all of these things it's definitely not gaurenteed, but the stronger the ties the more likely she is to be able to get a tourist visa.

USCIS has already denied so there is no waiting anymore on that regard............ I am just waiting on a few documents from my fiancee and then would be refiling for K-1. Couldn't get married during this recent trip (even thought I considered it) as I hadn't heard the final decision from USCIS and also there was this 30 day rule for marriage registeration............. any way now my only option is to file K-1 because I can't take off from work as I just returned from India.

The one thing I am struggling with is how much detail to include about my denied petition.......... the whole 221g submission my rebuttal etc.
Any thoughts on that?

Thanks a lot! I didn't think so either that CSC had re-affirmed any K-1 petitions (at least didn't see any on this site)...........I know Vermont has (k.loveh had her's re-affirmed not too long ago).
Marc Ellis suggested the same to me - to address anything and everything you can think of that CO might think of............... the reasoning being like you mention, not give CO any chance to come up with something to deny or delay your petition. That's what happened in my case. They basically, sat on my file for 4 months from the time all issues in 221g were addressed and submitted to them........ and then once the petition expired, they used that as the reason for denial (its a legal loop-hole they use to their advantage).

The other thing I am wondering is does it help to be there (as a petitioner) with your fiancee for the interview, and do they (CO) allow that?

Thanks for your help. I want to include the reason for not getting married because I had the opportunity to that during my recent visit (after my K-1) was sent back by Delhi CO. It was suggested by many at VJ that I wait for the final decision from from USCIS before getting married or refiling. So now that has happened.........and I am free to re-file a K-1.

I should be ok regarding the two-year visit requirement as I was in India just a couple weeks ago.

The other thing I am looking for is feed back to item 3 in my post (should I include the re-buttal). Any thoughts there?

After a grueling wait, California Service Center refuses to re-affirm the returned K-1 petition. The four-month validity of the I-129F (a legal loop-hole) is what the Delhi Consulate uses to deny the fiancée visa petitions. To add to that, California Service Center lacks the back-bone to challenge the CO’s decision and the saga goes on………….
Just wanted to put this information out there for those who may be under the false impression that returned K-1 petitions to California SC could actually be re-affirmed…………. not in my case……..I think the general consensus on VJ.com was also similar but I was hoping against hopes.

Now that I have vented my frustration, I need your help/input as I am re-filing for the K-1. I apologize for re-posting this (posed earlier on “US Embassy and Consulate Discussion forum”), but I am looking for any suggestions or comments please to make this fool-proof the second time around. What all should I keep in mind besides the following:

1. I do intend to Front-load the petition with all the details starting with my original petition up to the current status (K-1 denied by USCIS). I want to address all issues, including thoughts, perceptions, cultural issues etc. to dispel any doubts in the minds of CO's -- they do go by stereotypes and often do not always understand the cultural complexities in a county like India. Any concerns if I do that?
2. I have additional evidence - lots of pictures to address the initial deficiencies of my petition so that is a definite plus.
3. Should I try to explain (be proactive) as to why I didn't get married during my recent trip to India -- fact that I was still waiting for the final decision from USCIS and didn't want to rush into marriage in this trip? or should I not address it?
3. Should I include my response (rebuttal to the denial) with the petition? -- Its pretty pointed (against the consulate as I have let out my frustration to some extent but its all facts)?
4. I am still waiting for the response to my FOIA where I have asked for the details - exact reasons from the dept. of State/consulate's refusal to my K-1 petition. Should I include that as well?
5. Waiver since I am filing for a K-1 second time around (even though my petition is denied) – just to be on the safe side.
6. Should I request in my petition that my case be assigned to someone else other than the CO who had it the first time around – a long shot but if I was the chief CO, I would want someone else to look at it?
5. Anything else you can think of that I should address - I really want to make it as fool-proof as possible.

Do all that the above that has been suggested by others i.e. attempt to contact them via email, phone etc and request formally for an extention of the petition. This may help later on just in case they deny your visa for any other reason (such as not enough evidence to support a bonafide relationship and such other #######)............... then the petition is sent back to USCIS generally using this technicality (petition expired) as an excuse (legal loop-hole). So if you have made attempts to get your petition renewed, this just gives you more ammo to fight your case once its with USCIS. Lets hope it doesn't get to that.

As someone has already pointed out, technically if they have themselves scheduled your interview after the expiry date, then your petition should hopefully, be extended for another 4 months. Its all up to the CO who is looking at your case - if they are satisfied with the bonafied relationship part of it, then you should be ok.

Focus your energies on the "bonafied relationship" and prepare your fiancee for the interview........... don't worry too much about the petition expiry.

Yes, it was in Mumbai. They asked him what he planned to do when he got here, how soon we would get married & when & where, they asked several times if we were already married (probably because I lived in India from Oct, 2008 thru July), they asked about my work history. The interview was pretty simple.

Well... I had thought that if you have 3-5x the poverty level @ 125% in assets that was good enough. I have well over 5x plus I own my property and home outright, zero debt. And they still want me to get a co-sponsor. Just what I needed, more time tacked on to this case. If anyone's got any advice or pieces of wisdom I welcome them. unsure.gif

My fiance submitted his documents this week and he felt they were somewhat disorganized. He had to ask at least three times for them to include one of his documents in those that they collected. They also got confused about his BMB number because it was transfered from New Delhi, and misquoted his interview time. On the positive side, they did inform him that he needs to get his passport related PCC. It's good to know what to expect when you go so you can be sure that things get done. Good luck on your upcoming interview!

My fiance was just informed yesterday by email (also the day his interview letter is dated), that his interview will be on Dec. 9th. The soonest he could get a medical appoinment is Monday. This hardly gives him time to get the documents in before 7-10 days. If you don't count Thanksgiving and the weekend (working days) then Then Wednesday (tommorrow!) is day 10 and Monday is day 7.

Regardless of exactly "when" he should submit them it's a little close! So what do you do if you can't submit everything "in time?"

Getting a tourist visa can be tricky. When my finace tried, they refused to look at his documents at all. I have heard of other people being refused as well. Do some research and find out what the lucky ones did. Pray about it. Good luck.
