Asia: SouthMedical for interview
Hey,
Does any body from Hyderabad,India went to Vijaya Diagnostic center for their medical? If yes,how long they take to give medical report? Will the reports be given to us or forwarded directly to consulate, chennai.

I am in dilemma whether to get the medicals done in Vijaya diagnostic center, Hyderabad or Apollo hospital, chennai.

Please share your experiences.

I see that this varies by embassy/consulate.

Can anybody who went through this for the K-1 visa clarify. In fact it will be great if someone can post the contents of the first letter received from the US Embassy.

Trying to prepare ahead so that there are no delays on my part.

Thank You

It doesn't matter that your mother's maiden name hasn't been documented anywhere, you still have to put Radha instead of Rani for question 24.

I just checked my DS-230 form, it was question #17 in my form, may be the forms have changed now, but anyways I did put her maiden name.

A bit confused with Q no. 24 on DS230 form

my mother's full name < first last name > is " SAVITA RANI " and the same is written on my Passport and Birth certificate. This name was given to my mother after her marriage.

Before marriage her name was " RADHA " which is not documented anywhere and i don't have any document which shows her this name.

so now my question is which is correct from following options OR Please write the correct format.

1) Q 24. Mother's Family Name at Birth : RANI
First Name : SAVITA
Middle name :

2) Q 24. Mother's Family Name at Birth First Name Middle name
RADHA SAVITA RANI

3) Q 24. Mother's Family Name at Birth First Name Middle name
RADHA SAVITA

My wife is a USC and i am Indian citizen (residing in India)
She mailed the I130 upgrade application on 8th Dec 2009 which reached NVC on 10th Dec 2009 to upgrade it from spouse of LPR to Spouse of USC catagory as she turned USC this Dec.

It is going to be a month and till the time it is not upgraded to IR1 category.
When tried to contact NVC help line they say that the case is being reviewed, we will be updated once it is upgraded and they can't provide any time line.

Our I130 is already approved in July 2009 and got the NVC Case number at that time

Is NVC Usually takes this much of time to upgrade I130 ?

Thanx/Ajay

Asia: SouthReturned K-1 petition NOT re-affirmed by California SC
CSC and VSC have been re-affirming petitions this year, a lot.

I'm sorry yours wasn't one of those.

IMO, refile the K-1 again. If 2 years have lapsed, well, get back over there, as there is a 2 year 'visit' requirement.

Sorry - this is not evidence of bonafide relationship. That's fodder for other stuff - I-134.

OP -
WRITE UP A LETTER - tailor it as a 'evolution of relationship' letter.

But ..
NOT YOU - you don't do it.
SHE DOES IT.
and she submits it with the K-1 application AND on interview day.

If you're certain you sent ALL originals to NVC, you should be OK.

The backup plan is what - to have another set of originals for interview day? That is great backup plan, A-1.

Timing is sucking right now though - so scan/email to him.

If the originals are lost from NVC to USEM, then he'll get a blue slip on interview day, giving him time to provide them. I suggest that you wait for a blue slip about this, instead of rush rush rush to get that one document to him.

Good Luck !

Hi all,
I am a permanent resident and my husband is a citizen.I came to U.S. on a K1 visa. When we got married my sister tried to attend our wedding but she didnt get a visa.At that time i just send her an wedding invitation card and nothing else. Now m having a baby in three months time. This is the first baby in my family(my sister is not married).Well i would like my sister to be here with me during the delivery so that i can atleast share my baby s birth with someone from my family.
My question is....
  • what kinda paperwork should i fill out for her
  • Can my husband sponser my sister s stay in america.
  • Should my husband and i write a letter to the embassy explaining the situation. if yes,how should the letter be.

Please do let me know....thanks.
You will need her a letter inviting her to come along with I-134 and 2-3 years worth of tax-returns. Your sister will need to send copies of these to the embassy/consulate along with the VFS paperworks and moneys. After that, you will need to pray that she gets appointment in time (if she needs local-language interview--for English, somewhat speedier).

Asia: SouthWhat is a "Notice of Intent to Marry". and A vaccination question
Notice of Intent to Marry is for K1 (fiancee visa), not K3. You are already married smile.gif

If you cannot find the vaccination records, she will need to get them done again (well, those age and gender appropriate for her); it could cost quiyte a bit but should not add any time to the proccess if you start getting them soon. I am not familiar with India, but maybe your wife can check with the doctor who looked after her in childhood and/ or the local health department if they have a record?

Asia: SouthK3 or CR-1
Just a few reasons why to go with the CR-1. If you are eligible for a IR-1 then you would be nuts going with a K3!
The K3 has to adjust status which cost $1010 + $131 visas application fee.
Have to go thru the cost and hassles of getting a I-693 also.
K3 normally has to do biometrics and have a AOS interview. Time off from work cost the petitioner. PLUS the hassles of submitting the paperwork and going for the interview. Tain’t fun.. Especially if denied or questioned. Ever done a Stokes interview?
That’s the second interview if they are in doubt of your relationship.
Also a possibility of being deported. Yeah doesn’t happen much but it happens.
K3 has to wait about 90 days after they file to get EAD or GC so they can get SSN and be able to work.
CR-1 can work as soon as they get the GC and SS card in the mail. Normally with 6 weeks.
Can’t do a LOT of things without SSN. Like work or get a drivers license in some states.
Some K visas don’t get GC for a LONG time.
If petitioner goes belly up before you get GC you stand a chance of being deported.
If the petitioner loses his/her job after the interview you don’t have to worry about getting a co sponsor to adjust status!
CR-1 cost about $470
Get their GC and SS card in the mail within 6 weeks of arrival.
No biometrics , dealing with civil surgeons, AOS interviews, going to SSA for SS card.
I’m sure I’ve missed a few things.
Bottomline is anyone that goes with the K3 the way things are now are masochist!
Yeah I did but at that time K3s were a LOT faster. That’s not the case anymore.

Asia: SouthReturned K-1 petition NOT re-affirmed by California SC
Just for the record I don't think California has re affirmed any K1 that I remember. They constantly fall to the petition being expired. They will reexamine the CR/IR ones. That being said , you can refile. In fact you don't even have to wait until they kill the first to reapply accord to Mr Ellis. You need to address the fact that you are refiling a second petition just so they can't use that as a rejection reason. You should front load this, the basic thing is they have to find something not covered in the petition to reject it. Don't get too nasty about the consulate they will be reading it, however you should cover whatever they had issues with and anything you can think of that they might use to reject a second petition including why you didn't marry.

Asia: SouthVisa Approved pending getting a co-sponsor
There's something in there about not using your house if that's your primary residence. They are looking at assets that can be converted into liquid cash at a short notice. Plus, with the housing market tanking, prices of home properties have declined. And the thinking behind is quite reasonable -- I mean you aren't going to be able to sell your house off at a moment's notice to prevent your SO from becoming a burden on the state.

From what I understand, there must be $56,000 in a bank account in the USC's name for it to work. Simple enough if you got the cash.

Find a co-sponsor ASAP and send them the documents they want. Good luck.

What other questions was he asked, if you don't mind sharing? This was in Mumbai, right?

I'm not sure about this either. I jumped the gun and got my PCCs done in end-October. I was hoping for a quick NOA2--oh well. Hopefully, they won't expire before I send them to the NVC. This is what I understand: when the PCC is sent to the NVC, it must still be valid. But for embassy purposes, it is considered to be valid for 1 year. So say you send the PCC to NVC 4 months after you get it, but by the time it gets to the consulate in India, it might cross 6 months. The embassy still considers it valid for a year then.

Hello everybody,

Ok, so here is the latest about my running around for my 221g and any additional advice will be very much appreciated. On the 221g that my fiance recieved they asked for religious divorce decree. His interview was on December 7, 2009. My petition expires January 31, 2010 and we will be submitting the religious divorce decree next week. Do you think that is enough time for them to make a positive decision? We have already submitted the civil divorce decree months ago, but I guess there are certain requirements in India that we were not aware of. This whole process is such a nightmare. I have come so far, and the embassy has not been responding to my emails. I called them, but the only response I get is its pending. So, just really frustrated. wacko.gif Thanks again and any advice is much appreciated.

oh star (((Hugs)))......its gonna be ok......as far as their answer when u call.....i think is generic answer.... what i get when i email them is its pending in administrative processing and all im asking is are u gonna let it die and make us start all over again.......

as long as u get that document in that they are asking for im sure they will give him his visa........as far as is it enough time?
your getting it in before the petition expires......i think that is all they are waiting for....at least thats what it sounds like to me.......i mean remember Margaret and Zahid? they wanted new passport because of damage and after he turned it in it was like what two or three days until visa was stamped in his passport..........i really think that is gonna be the case with u as well.....stay strong and never give up!!!!!!

In India its not a problem even if you don't have vaccination records. When she goes for her medical they will take a blood test and will determine which vaccines are needed according to her age and the test result.

If you have everything ready, all the PCC, tax information, i-864 then its a matter of weeks only. It surely is better to go with CR-1 on long run. Indian consulates are good with giving interview dates. It will also depend upon when your case gets completed at NVC. Say your gets completed at around 18th of the Dec, then most probably you will get an interview date of February which will be assigned to you in January.
