My fiancee just finished his interview a little while ago. He went in and was interviewed by a male. The male never asked him for any evidence. He questioned him about why he would ever marry a woman who was divorced with three kids and wanted to know how his parents felt about it. Then he was belligerent because we met over yahoo, specifically wanting to know what we were doing on yahoo before we met. He continually insulted my fiancee then told him his visa was denied. My fiancee had to ask the consulate to stop speaking badly to him. Then he handed him a white slip that says the information provided was not conclusive.

He's on a train now so it's hard to discuss all of this with him and I don't have all the details. What should I do now? What happens next? What can I do?

My fiancee read me the piece of paper and it says something about stopping the petition and it is being sent back to the NVC. Anyone have any idea what all this means.

I am so sorry for your situation! I'm not trying to add to the heartbreak, but I just want to give you our experience. Just prior to us filing for the K-1 Tarun went to try to get a tourist visa to come over and meet my family in person. He went for the interview and they straight away denied him and told him that because he had the intention of immigrating they could not, by Consulate rules, give him a tourist visa, even though he had ties there and we were planning to go through the proper channels to bring him here. I'm afraid that because your visa was just denied they would be even less likely to give him one and it would be heartache for you guys all over again. These are just my opinions mixed with a little bit of experience, and I just wanted to put it out there even though I know things are tough for you right now and you so badly want to see him. Keep your chin up and keep fighting!

Thank you. That is helpful. His whole family is devastated and now he thinks we may lose parental support altogether. He's dramatic. I'm not sure how I'm going to manage going. I'm living with my disabled father to help take care of him and he is awaiting surgery to have a pacemaker put in to keep his heart beating (thankfully at that point he'll have a nurse and I can breathe), I am a single mom to 3 kids and I can't leave the kids with their father because he's legally psychotic. I can't go or take any time off of work before March because I'm under contract and any absence will automatically result in termination. I'm sure that's not enough to prove hardship considering how the consulates are. I'm working on going as soon after that as possible though. That's why I couldn't attend the interview either.

It is a hardship on me to just get up and go to India. If we get a second interview I will go no matter what, however my fiance wants to come and visit me in the mean time. He has a residence there, he would only be visiting here, he does not qualify for VWP.

How would you prove economic ties, social ties, and binding ties? He doesn't own anything of his own. As most Indians do, he still lives with his parents and still handles everything in cash. I read somewhere that he needed to have $50,000 USD in a bank account. That seems extreme. He's only 26, wouldn't it seem fishy for someone that age to have that much money in a bank account already?

How long does the process take to get a visitors visa?

Since you are going through CR-1, I assume you did send all the documents at NVC right? So NVC will forward those documents at Islamabad consulate.

What I am wondering is did you send NVC original PCC from SWAT or a photocopy of it? Do send your husband the original if you have it with you, if anything at the interview they will ask for the original and VISA will be on hold till the time he doesn't send the original.

I am not sure about Pakistan but in India consulate needs only 1 PCC and that is from the present address. I hope everything will turn out for you.



Yes I did send NVC the original, just I've heard stories where documents get lost. Inshaallah that is not the case with us !
Ya my husband already has it. That was how I had forgot to send it. I had scan it , and forgot it in the scanner , silly me. :bonk:

I have ran into a problem , and pray their is a simple solution that you guys can give me.
My husbands interview is Jan 7Th. I have sent all the documents to my husband, which he received just the other day. When going though them he notice I had not sent his police clearance from his home state Swat , but he does have his police clearance for where he is currently living in , Islamabad and has been living there for over the past 2 yrs. Do you guys think they will except a copy of his Swat clearance ? As there is no way if I snail mail it , it will arrive on time.

As most of you know Muhammad was approved. And was asked for his original police clearance form Swat , and of course he didn't have it and was giving the blue paper saying he has to submit his police clearance from Swat. So ... My question is , he was put on AP. And I'm wondering did AP start the day of the interview, or will it start from the day that he submits his police clearance.

The honeymoon.... did'nt have one... first my daughter got sick with a 104 fever. Then I got sick... so... she does have the prescriptions for me and my daughter... And I was there for only a month cause that's all i had for vacation from work. The honeymoon we decided to postpone and when she gets here we plan on going for the honeymoon.

The hotel from our wedding night was a gift from my brother in law, so the reservations are made by him and the statement shows him on it.

We never really chatted on the internet, we talk on the phone like day and night (thanks to Vonage and IndiaLD.com) so we have those records, emails, cards.

Thanks for the envelopes info. with stamps... that's a good idea that proves that the mail came from me!... Cool

2. Photos of us hanging out, family events, and her with my daughter, sanchak, mehndi.
3. Wedding photos/ and wedding album.
4. My AOS for her.
5. Notice of her as my life insurance beneficiary
6. Copy of health insurance card.
7. Phone records.
8. Email Inbox snapshots.

Anything else she should probably take?

I would'nt worry about taking on your spouse's last name, it's not a requirement, and there really is no culture in India implying the wife should or should'nt. My wife did'nt, I never asked her, nor did she tell me she wanted to but lol along many of our long talks she did say she wanted to so i said oh well... too late, we'll figure it out when she gets here.

I would suggest updating the biographic page, that can also be used as then evidence you to are truly together, I mean why would you go through the hassle. But, yes, your right, how long will it take, India is not really a straight forward country, and can take a long time. If you don't update the biographic page, just plan on having a good justification for it.

Hello everyone! I'm Josh, and I'm new to the forums.

I'm getting ready to submit for a K1 Visa for my Thai fiance...here's my situation

I'm getting officially divorced from my American wife on July 17th:) That same day, I will probably send off my petition to the Nebraska USCIS office. Will this alone have an affect on my approval?

Also, I'm only 23 (24 in Sep.)...will they view this as too young and deny me?

I'm on active duty in the US Navy...so I can provide plenty of proof that I'm financially stable to support her.

She is 22. She went to a University in Thailand for a little less than a year...then moved to Pattaya. She worked in a bar, so I'm worried she'll be labeled a prostitude immediately and get denied at the interview. This is why I want to use an attorney to help get through this.

Right now, my plan is to use an attorney for everything. www.mythaifiancee.com is the site I'm planning on getting the attorney from. He will do all the paperwork, get everything from her that he needs, coach her for the interview, etc. I've heard it's much better, and faster to have an attorney do this for you. The attorney is an American, with offices in Thailand and also here in the US.


I really appreciate all guidance with this...im keeping my fingers crossed.

I don't think it applies to the PIO either...it said just the straight tourist visa. I will also be applying for PIO in April when we have been married for the 1 year that's required.

Melody, I say if you have the means to go the interview than hands down you need to be there. I was there for Tarun's interview and can say without a doubt it helped us 100%! They interviewed me as well and I think that is the best bonafides of a relationship you can possibly give them. Delhi is such a hard Consulate that if you can swing it do it!

Wow your case sounds almost exactly like mine. However my fiance did not work at a bar. But I also had to finalize my divorce first before I could do the k1 visa. And I also used www.mythaifiancee.com Brian Wright seems to be a great guy in helping me with my K1. Hope everything goes as well for me as its seems to of went for you with your Thai girl....well take care!!!!!

Hi Raj,

Were you able to get appointments with a short notice? I am not sure how much time I would have after the interview letter arrives and it looks like we cannot schedule the appointment without the interview letter for medical exam.

Also how long did your parents take to get their PCC's? Did you apply for PCC's from Hyderabad?

My wife hasnt done but we are planning to use Hyderabad. Which part of AP are you from? We are planning to get it done in 1st or 2nd week of Feb . I have heard Vijaya diagnostics is a reputed one since it has been around for a while.

Why are you sending it to Nebraska ? the K-1 application goes to California for Nebraska residents and to other locations depending on where you live.

So but Nebraska will not help for the VISA part .. and will help later with the AOS process.

Read the Guide and also read the www.uscis.org (Government)

Did you look online at your local Indian Consulate? They will have the application online and other requirements. You could also make a phone call on Monday to ask directly.

What you really should do is apply for an Overseas Citizenship of India (OCI) card, then you can leave to India whenever you want and stay as long as you want, no visa required. :thumbs:

but applications for OCI are accepted from residents of the following States and Territories: New York, New Hampshire, New Jersey, Maine, Connecticut, Massachusetts, Ohio, Pennsylvania, Puerto Rico, Rhode Island, Vermont and the Virgin Islands. and i live in CA.
