Call the embassy--speak to them. See what they want. Or if there is any other way you can keep the case there. Email them/fax them. Request a second interview with your presence.

I received this email this morning from Travisa Outsourcing (the people that handle Indian tourist visas).

In December 2009, India introduced a new rule that prevents Tourist visa holders from re-visiting India within 2 months after last leaving. That rule has been updated recently to include the following:

All Tourist visa holders, including 6 Month visa holders, and Non US citizens holding a Tourist visa are impacted by the new rule.
Some exceptions can be made on a case by case basis as decided on by the local Consulates. Exception reasons include sick family members in India.

Why are you sending it to Nebraska ? the K-1 application goes to California for Nebraska residents and to other locations depending on where you live.

So but Nebraska will not help for the VISA part .. and will help later with the AOS process.

Read the Guide and also read the www.uscis.org (Government)

first thing in the morning, call your senators. they will need an authorization from you in order to proceed. i would advise to fax it to them immediately. once you have the fax confirmation, call and speak to their immigration liasons. explain to them what happened. how you tried to get the interview moved earlier. how they scheduled the interview date after the expiry. ask them to do everything in their power to get a second interview. explain to them that you will make a personal appearance to ease any concerns the embassy has in issuing your fiance the visa.

i do not think an appeal (EOIR-29) will be accepted right now. your immediate goal (by contacting the senators and embassy) is to see if they can keep the case in NWD. then see if you can get another interview. tell them you will be there for that interview. give them your contact information. do everything, and anything you can to get your case to remain open there. if it makes it back to the usa, then it could tack on at minimum 6 months. ours was returned on december 29. we got the notice from uscis on feb 4 and a notice of action from uscis in july. so you do not want it going back. k1s do not hold as much weight as a cr1 or k3, so chances of appealing are slim to none.

in the meantime, contact your senators, email the embassy, etc. when we did, the senators in my state did jack squat, but i hear there are some good senators out there. i hope yours are. email the embassy to see what is going on. you may get a generic answer. also try calling the embassy yourself. it is sometimes difficult to get through, but if you are persistant, you can talk to someone. i found it easiest to get a person on wednesdays. but i recommend calling every day. you can go to their website to get the phone numbers, and i think they have a specific time they answer calls. mondays were the hardest days to get through. it will keep ringing busy. i remember having two phones going at the same time, plus my then fiance's dialing in to get through. so yes, it will take persistance.

one thing to know about delhi, they do not give color pieces of paper in general. all seem to be white. if they said they are sending it back to uscis, yes, it is a denial, and not AR/AP. they will specifically tell you if your case is going through mandatory administrative processing, or that they need additional documents. it sounds like they did not believe in your relationship and chose not to extend the expiry. they worked dirty in having your interview scheduled after the expiration so they could use that lame excuse.
you are right, DO NOT GIVE UP. we didn't, and there was no way we were going to. since it looks like you filed in VSC, if it does make it back, i would advise you to wait to see if they revalidate. that will take some months. if it had been CSC, i would have said as soon as it makes it back to the USCIS, to get married, and prepare a stronger case (which is what we did). i am curious to know what they stamped in his passport :blink: that part has me bewildered. again, until he scans the paper in, we will have to wait to give you further advice. the pinned topic on MENA on returned petitions helped us out tremendously.

:wow: sorry about the situation. delhi is a tough consulate, but i have never heard of anyone getting denied on the spot there. when your fiance reaches home have him scan in the document and the page in his passport that got stamped and email it to you. until we know word for word, it is hard to advise what can be done. again, i am sorry :(

just read your post #3, when is the expiry date of your i129f? it sounds like they are choosing not to extend.

Frankly I think the lawyer is not needed for the K1. The process, however flawed, is pretty straight forward. Follow the guides on VJ and you should have no problem. Although you will have your divorce finalized on that date, will you have the divorce decree. You have to have that to send in a copy with the I-129F package to show that you are legally able to marry. You also will have to check to see if your state has a "cooling off" period before you can get married again.

And on another note, as a USC, Thank you for your service. From the bottom of my heart thank you.

Since you are going through CR-1, I assume you did send all the documents at NVC right? So NVC will forward those documents at Islamabad consulate.

What I am wondering is did you send NVC original PCC from SWAT or a photocopy of it? Do send your husband the original if you have it with you, if anything at the interview they will ask for the original and VISA will be on hold till the time he doesn't send the original.

I am not sure about Pakistan but in India consulate needs only 1 PCC and that is from the present address. I hope everything will turn out for you.

There is no requirement in taking your spouse's last name, however about the biographic page if your passport was issued before your marriage then its cool, but if your passport was issued after your marriage I would suggest to upgrade your biographic page.

Also it takes only a week or so time to have your spouse's name in your biographic page. I never took my husband's last name but I did have his name on my passport, never had to deal with any questions regarding taking his last name.

On a totally different subject, I still think its stupid and totally out of line how women from Gujurat are being made to take spouse's last name at Indian Passport office, officers flat out deny issuing passport if they don't take up their SO's last name.

It doesn't matter that your mother's maiden name hasn't been documented anywhere, you still have to put Radha instead of Rani for question 24.

I just checked my DS-230 form, it was question #17 in my form, may be the forms have changed now, but anyways I did put her maiden name.

I-751 is for removing condition, which you will have to file at 90 days mark before your 2 year GC expires. So you don't need it now, you have time for it, relax and enjoy your holidays for 2 weeks in India.

No, you don't need any visa, you are an Indian national. For how long you can stay, India won't stop you for however long you want to stay but since you are a Green Card holder, you might have problem entering US if you stay in India for more than 6 months.

Being a GC holder of US, you will have to satisfy the residency requirement of US govt.

Do check the consulate service menu and they do have OCI listed there.

You will have to have a good reason to expedite your interview date. Since you are CR-1 applicant, NVC will allot an interview date. I checked your timeline and according to it you have received your DS-230 instruction package on 3rd of Dec. Have you sent it out yet?

There really aren't many people who had their interview expedited, what you might be referring to are people who got their K-3 interview date and changed it to CR-1 interview.

But either way, you will need a good reason, something like medical emergency of sort to expedite and it will be done by NVC.

You mean they are not open till Jan 12th? ohmy.gif I know it is expensive, but it was worth it because it was so fast.

Anyway, my suggestion is to scan a copy and have him print it out in Pakistan and bring to the interview. Take it out ONLY if it is requested. If they want the original copy, then you can mail it later.

I don't understand how you have his certificate from India and he doesn't? Are you in USA? If so, you can send by FedEx it will arrive within 2-3 days for sure. First scan a copy to him immediately (so he can print it up there) then send on Saturday if possible. Even sending on Monday, he will have it by the 6th. However, often in interviews they do not ask for additional PCCs. Good luck! good.gif

Sorry, I read you post too quickly. However, I think you can show your Indian birth certificate (or other documents like 10th class, proving your birth and parentage) instead of passport. You might have to call up the Consolata or go in person with your birth certificate and other documents (surely, you have copies of your lost passport? You can use those) and ask them, maybe they will let you apply with no problems. Good luck! :thumbs:

Did you look online at your local Indian Consulate? They will have the application online and other requirements. You could also make a phone call on Monday to ask directly.

What you really should do is apply for an Overseas Citizenship of India (OCI) card, then you can leave to India whenever you want and stay as long as you want, no visa required. :thumbs:
