Based on your timeline, your interview date is on June 28. Remember you are in :no: India a little handshake :whistle: can go a long way for an experdite service.

Even here in the states If you need your passport quickly here you have to pay extra, the only thing it's all legit and
the govt get something from it for the urgency, other places it's not as uniform.

thank you :D he is doing fine. happy he is able to call india anytime he wishes. i have taken him to several places. he has been able to meet a lot of people. today, we are going to church, where he can meet a lot more :) he was able to get himself a cellphone and a connector for his laptop, so he is on cloud 9. sometimes it is still hard to believe we do not have to rely on technology as our means of communication. simply amazing!!

My day started kind of earlier than usual. About 6 am heard some noise in the front yard. Went out to check and it was the neighbor's badly neglected dog scratching the door and crying. Tried to take her back, she would not go. Gave her some food & water. She ate like she never gets food. Alwyas left in the backyard, unattended for days without food and water, Poor thing. We have reported the neglect before to the police & they checked on the dog and told us to call the animal shelter if she gets out again. The police can't do anything while she is in owners property and not being physically abused. Well, the shelter said they will come to check on the dog, they have a checklist to determine course of action. Then they will either talk to the owner to take better care of the dog or if its bad enough, they will just take her. I hope they can do sometihng. It says a lot when a dog does not want to go back to its home.

Daniel, Adi and I spent last whole week in San Antonio (Daniel's conference and we tagged along, hotel was free). The night we reached there, Adi started teething really bad with 3 new molars. Except for spending our evenings in the hotel pool, the 2 of us did nothing except try and soothe the poor baby. I am still recovering from that holiday(?). Good to be back home.

I can't remember exactly, but I believe it was given to me on the same day. I do remember coming in early in the morning to wait in line, and I think it was ready for me later that afternoon.

i filed I-129f (K3) and I-130 visa petition
approved both petition by uscis
I-129 f sent to the nvc, uscis hold i-130
nvc sent embassy i-129
visa denied after interview because bonafide relationship, I-129f
I-129f case sent back to the uscis
uscis sent letter for i-129f to us that petition expired after four month and embassey not revelited petittion.
but uscis sent i-130 back to BIA after they revoked my i-130.
BIA remand my case and sent back to USCIS to consider my case back.
but today embassy told me that uscis going to sent another NOIR letter insted of they send case to embassy

Department of state excepted that they (embassy ) did mistic on our case.and embassy try to bring my case back

my know about 2nd NOIR (leter of intend to revok ) is this ever happend with anyone

I'm sorry I'm not going to be of much help with this one.

I'm not very familiar with the Board of Immigration Appeals processes, this isn't something I have followed very much. I know of a couple of cases that have gone through the BIA, but their USCIS revocations weren't because of the inability to rebut the general "non bonafide relationship" reason, there were very specific ineligibilities under the INA which applied to those cases such as fraud and/or misrepresention.

The BIA 'may' have the authority to not agree with the revocation of the I-130 and have sent it back to the USCIS for re-adjudication, not sure about that. Did you respond to the original NOIR/NOID for the I-130 within the timeframe the USCIS asked for it? If so, in your mind did your rebuttal address the "non bonafide relationship" the NOIOR/NOID specified was the reson for the return? Did the USCIS provide a specific reason for the final decision to revoke the I-130?

I know one thing, If I received a 2nd NOIR/NOID that is another opportunity to address this petition return, I would take it. If "bonafide relationship" is the only reason given to you for all of this, then tell the story of your relationship from the beginning up to current date with proof of spending time together, plane ticket receipts, copies of passports, letters, photos, emails, phone records, affidavits from family and friends, co-mingled finances, etc.


I do think that you should seek legal advice on this one from an attorney experienced in this specific area of family immigration, as it does involve the Board of Immigration Appeals and a previously revoked petition. Once a petition is officially revoked there is a marker placed in the beneficiary immigration record, this may need to be addressed by legal counsel. Legal counsel can also assist you with the 2nd NOIR/NOID.

Everyone going through Mumbai Consulate, just a heads up, this is a very good and well-organized consulate.They are really not out there to get you,and if you have good evidence and are being honest ,it will all fall in place.

Moving on, my K-1 visa interview was scheduled for the 24th of May,2010 at 7:30am in Mumbai.I had purchased the VFS lounge option,so I reached the VFS office at around 6:40am.There were already quite some people ahead of me,but it was not as intimidating and I quietly got in line.
I had a prior experience with them and hence was aware that no matter how long the queue gets,the security guard will only ask people with the first interview slot to get inside the VFS building.
Anyway at around 6:50am the guard called out people with a 7:30am interview time to go inside the building and once inside we had to keep our appointment letter and the VFS lounge ticket ready for inspection.They keep a certain half of the VFS ticket with them and give you the other half.Then a lady security guard once again checked my bad and folder and the VFS ticket half and let me inside the lounge.We were inside there for hardly 10-12 minutes when the guard again called out the people with a 7:30 appointment to come out and board the bus waiting outside.So out we went and I jumped onto the first seat.I also found another girl who had her K-1 interview ,so we talked and exchanged all heavy visa jargon ladden conversations :whistle:
Once we reached the consulate, we by-passed the crowd standing outside and there was a lady who asked us all strictly to keep our passports inside our folders,as opposed to displaying them.Then inside there is a separate security queue for ladies and gentlemen.The lady officer checked my accordion folder and the plastic bag and after okaying me,she handed me a wooden token and let me go inside.Inside,immigrant and non-immigrant applicants form separate lines.
I was called by an Indian lady for finger-printing.Then once that was over ,she asked me to sit in the main hall.Again another guy asked immigrant Visa applicants to go to another tinier hall,just for us intending immigrants :huh:
And my name got called first,as soon as I actually squeezed my way to the end of a row of seats,so I had to squeeze myself out again.Went up to the counter no. announced and was greeted by an Indian lady.At first she was chatting up with her colleague in the side window,but then greeted me and said sorry about that.She asked me for the $131 draft and asked me just 2 questions:

Why are you not getting married in India?-I said that I really had no specific reason,it was just how we started the process when I had left the US,and we did not know of many visa categories back then.
On which visa did you go the US earlier?- I said F-1 and she confirmed whether that was where I met my fiance and I said yes.
Then she returned me my original documents(which I had submitted at the VFS office a few days back)

Then, Oh God,I waited for 4 hrs!!! Just sat there,saw the non-immigrant queue growing and growing and us just sitting there.Finally at 11:30am my name was called.
I was kinda excited and eagerly waiting for this moment. :yes:
My CO was a very good looking American woman.We greeted each other and she made me take the oath.
These are thes questions I could remember:

So,tell me something about yourself?
Tell me something about your summer internship Job description?
What was your fiance's job when you joined as an intern?
Once your internship got over,how often did you guys meet?
What did you guys do on weekends?
Where all have you guys gone together?
Did you parents approve of your living with him? :luv:
Where is he originally from?
Where is he staying currently?
Has he visited you in India?
She looked at some pictures and asked if those were his parents.

Umm,yeah,this much I can think of ! That's it.She then said "Okay Madam,your visa has been approved!! And you will be getting your pp soon."

I was just very happy,I enjoyed my interview.It felt more like a conversation with her.
I was not asked anything about our financial documents which I was stressing about.She might have surely gone over them before the interview,but she did not bring it up that day.
On my way out,I handed over the wooden token and was very terribly ambushed by the Mumbai heat,baah!
So yes,that is how I rolled! B-)

does anyone know what happens if you dont pay the courier fee prior to the interview. My husband has an interview date in Chennai for the 1st and completely overlooked paying the courier fee. Since its the weekend here we can't do anything about it prior to the interview. If anyone has experience in this situation, please let me know. thanks!!

Did he submit his documents at a vfs office?If yes,then am surprised they forgot,rather than your husband forgetting.
I am sorry I could not be of much help,but I would suggest carrying that amount with you,and once your interview is over,you could go back to vfs and submit it saying it was over-looked.May be,good luck :thumbs:

ok the wording is pretty much the same, except no periods were specified in my wife's passport office PCC from Bangalore. the exact wording is: "There is no adverse information against Shri/Smt/Kum your name here ****************************** W/o husband's (or wife's) name here **************************
holder of Indian passport # (passport no) issued on (issue date) at Bangalore which would render him/her ineligible for grant of travel facilities including visa for USA".

Same thing for the local police station PCC. couple of things - make sure your passport office PCC is within 6 months of your interview date. Also when applying for the passport office PCC, make sure you write "For USA visa" on the top of the PCC application. they held my wife's PCC b/c the idiots at the office didnt tell her to write those 3 words and when she went to the office, they yelled at her for not properly filling out the form. so make sure you do that. also you can track the PCC online (thru your passport #) AND make sure you make the PCC appt online on the bangalore passport office website and get the online token. it will save you a world of waiting time!

My fiance wore beige/khaki colored casual dress slacks, a Blue open collared dress shirt, a Brown belt with brass buckle and shoes to match and no tie.

He didn't want to be 'overly' dressed like he was at his first interview (he went all-out at that one), so opted for the more casual look this time.

Note: He said he didn't see any other men with dress ties on either.

What happened was that my wife had to get a new Aassport because she found out that there was an error in her father's name.
Did you add your spouses name to your Passport? There's a line all the way to the end page of the Indian Passport that reads: Spouse's name.
The first time my wife went to get the PCC, they asked why husband's name was not added. And that she needed to add my name to get the PCC. Second time she went, they said they needed the letter from NVC. Third time, they took it because the officer who refused the first 2 times was on vacation and it was a woman officer. But there were holidays around that time, so tehy delayed the process. Then my wife went again to find out the status and the application wasn't even registered in the system yet. That's how the government is in Gujarat. So She asked them to register everything right there and then and then they did her background check, and asked for witnesses for residance proof. And that's how it went.
So yes, my wife was able to get the PCC without NVC letter. But she only needed Passport/Regional PCC. She didn't have to get the District/Local PCC because her Passport was not more than 6 months old.
About completing the case, it depends on NVC. If they do say that it's ok to submit the PCC at the time of interview, ask them to send you an email or something in writing.

Yes, in Gujarat, they give you hard time if you don't have the letter from NVC. Like they did to my wife.
You can give it a try.
Show them your NOA1, copy of I-130 and G-325 for both, your original passport and copy of your spouse's passport, copy of marriage certificate, and a letter requesting PCC for immigration process.
Below is the link of a PDF file with the Checklist for the required documents that need to be submitted to NVC. It also includes Police Certificate info. You can print it and show it with the rest of the stuff.

NVC needs atleast one PCC to complete the file. You can always ask them if they will allow you to submit the PCC at the time of interview just becuase Gujarat Police services is giving you hard time.
In the end, when it comes to getting stuff done, you might have to spare some Rupees to get things done, if you know what I mean.

we are geeting ready for new noir, but we not recived noir letter yet we can get any time
me and my wife liveing toghter in india from last six month, we vist embassy toghter talked to head of embassy.and they agree with our true relationship.and embassy helping also
actuly when embassy asked my case from uscis. they sent letter to embassy that they going to send us noir letter. after that uscis will take desicion on my case.
i dont know wt they going to ask in 2nd noir. after bia returned case
i think we not abel to reply properly to uscis first time that is why they revoked . but when we reply bia all information they send case back to uscis.i just wan ask that is that any one ever gone thrugh this so he or she can help me

My wife had similar issues with the Ahmedabad Passport office. She had to visit them 3 times before they would accept all the necessary documents. The guy working there wanted her to apply for a brand new passport with my name as spouse added so we paid Rs. 2000 via the TATKAL method (expedited sservice). We received the new passport with passport police cert attacehd within 4 business days.
Necessary documents for us were:
-NVC checklist (any damn NVC checklist should work as long as it has the barcode and the applicants name on it, we used a false RFE for the DS-230 required)
-Original marriage certificate
-Indian passport photos 2-3
-local police cert issued form her district police off.
-marriage affidavit notarized (they gave her a blank affidavit to fill out on her second visit)

I believe that is all they required but it may help to keep your PAN card, drivers license, ration card, voters card, etc. with you.

The hardest part is the dam long wait in line at the passport office. Otherwise if you have all of these docs ready then they will take them and issue you a tracking number to check the status of your new passport. I was amazed at how she received her new passport.



I have used my name on the I130 forms as per my current passport, so i will not be able to change my passport like that due to the names used. Can you tell me how do you generate a false RFE ? How can i show them the NVC checklist ? Can u give a link or something for that.
Is there any way to get the passport clearance certificate without changing my passport ?

Just wondering if they will send interview appointment letter to USC spouse if we make USC as choice of agent..

Thanks for all the helpful comments. The Chennai consulate has been pretty helpful 2 hours after I sent the email requesting a new interview date they had emailed the new date which is on July 22 so a little less than a month later, which isn't bad. As far as the PCC is concerned we have tried the "expedited" service route and did get some action on the part of the government officers. Even with the extra money they said it would take at least 10+ days. We are now going to our local SP to give some incentive to them to hurry up the process. My wifes cousin works for the police and has friends at the SP office so hopefully that can get things rolling a little faster.

Also when applying for the passport office PCC, make sure you write "For USA visa" on the top of the PCC application. they held my wife's PCC b/c the idiots at the office didnt tell her to write those 3 words and when she went to the office, they yelled at her for not properly filling out the form. so make sure you do that. also you can track the PCC online (thru your passport #) AND make sure you make the PCC appt online on the bangalore passport office website and get the online token. it will save you a world of waiting time!

Hi,

I applied through the K1 visa and I needed to get PCC from both the passport office and the commisioners office in infantry road.. The certificate is linked to the period of stay. The PCC issues by Comissioners office for me says that

There is no adverse info against------ resident of ---- since --- to present holder of passport no---- dated--- valid till ---- issued at --- which would render him ineligible for the grant of travel facilities including visa for USA.

Now I'm not sure in your case u need to extend it to your entire stay in bangalore or restrict it to the last 2 years. Maybe the last 2 years is enough, I suggest you read through the packet 4 again carefully and then decide. If you have already received your case number in Chennai you can also call them and find out.

In case you decide to get it for all the places in bangalore, you might have to apply again for a new certificate paying Rs 200 again. you can talk to the person at the single window counter at Infantry road and decide. But do carry the documents needed to apply again and cause that might well be the case.

Anyone can tell me whats the wordings and format on PCC issued by bangalore police? I saw in chennai consulate website they need PCC for the entire duration of stay at any place. When i applied for PCC in bangalore, last week..I only mentioned current residence and that I have been staying at the place for 2 yrs. Any help will be much appreciated..
