Asia: SouthGoing to Pakistan for marriage!

Penguin I think your statement that "many Pakistani applicants get put in AP after interview" is a little off base. I think that most male Pakistani beneficiaries get put into AP not women.

See the post just prior to yours--beneficiary is Tariq (last-I-checked, male name) who is in Pakistan.

Oh there is no K3 now? Ok then I will do the other thing you mentioned. Where do I find the guides?

Penguin wasn't saying that K-3 is nonexistant, only that it is redundant--since you have to file the I-130 for it anyway, you might as well go "all-or-none" and file for CR-1.

(since the design behind K-3 is itself shambolic, Penguin has a good point--exactly why when alternatives finally became available****, I opted to do K-1 for Pras)

Followup; we finished the box on June 3 after my dad arrived here (he was sent here from CA by my sister so she and her family could go touring NYC, and will stay until 6/26). I tried that day to pick up another box--but there weren't any in stock.

When we returned from a retreat (6/4-6/6), I bought another box (10-count) on 6/8 which turned out not to be as nice as our first one (some of the fruits had soft or black spots which needed to be removed)--it would have been nice if the price had been reduced somewhat (say to $25.00) though admittedly it was a "not-happening".

For reference,

http://www.visajourn...-trip-to-india/

On May 29, we went to one of the desi grocers around DC--to buy some toor (last time at that store, we were able to get an 8-lb packet--but this time no packets over 4-lb), curry leaves and a box of "Marathon Brand" mangoes (not really that nice, product of Mexico), which runs about $9 there. On the counter, I noticed boxes of "Royal Mangoes" which were imported from India (which gave these a leg-up on the Marathon--we didn't yet know the price of it). When we asked, it was $35 for the box (3.5 kg/7.7 lb)--and we found out by further looking on the side the mangoes within to be...Banganapallis (with the fruit-count written on the side). Well, we took a 9-count box home with us--and have so far consumed 6! :D :)

Hi, I am in same situation.. But I am thinking why not I apply K1 for my wife? we are going to have nikkah because her family wont allow to have meetings or phone talk before marriage (traditions...)... Any suggestion?

You say your wife... are you legally married? If so, you cannot file a K1. Otherwise, K1 is certainly an option, but then she would need to come over here to the USA by herself and spend a day or two at least (as long as it takes to make wedding arrangements) with you without being married. If her parents are very strict, then that is not an op[tion and you would be better off getting married in Pakistan and then filing for a CR-1.

K3 is dead, you will be filing for the CR-1 spousal visa. It takes about 6-8 months from initial filing to visa interview, but many Pakistani applicants get put in AP (Administrative Processing) after the interview. Read the guides on this site (link above) for info on what to prepare.

Ok, noob question--As a CR-1 GC holder, I can still enter/exit India with just my Indian passport, yes? I'm beginning to get confused. I don't need a PIO/OCI until I apply for USC (if and when I do), correct?

Here's the relevant clause--

Those applying as spouses of persons of Indian origin should submit original Indian passport or PIO card (whichever is applicable) of the spouse and original marriage certificate; (To be eligible the marriage must have taken place more than a year before the date of application)

So from the sound of it, it's best to just have my husband, the USC, apply for a PIO. We'll be married one year this August and I think he'll be eligible for it then.

Thanks for this 'entry visa' tip--had no idea!

Asia: SouthJust an update

I can't afford to refile right now and getting to India is also going to pose a major challenge sine I'm dealing with my son's medical issues. I'm just missing too much work to save enough money to go and keep all the expenses paid here while I'm gone. I'm not quite sure how I could stay there the required 31 days to get married either because that would pretty much mean quitting my job. It's hard enough to get a week off much less 5 weeks (counting travel). Ugh...I'm still hoping that this will get reapproved and then I will do whatever it takes to be at that Embassy this time. And the lawyer is more about filing for consular misconduct because there isn't much else she can help us with.

Yes you can enter and exit India with your Indian passport as long as you are an Indian citizen. Do keep your GC handy while exiting India coz you will have to show that to the custom/border security guys.

Daniel is the USC and he has a 10 year valid tourist visa that he has used 2 times before to come see me in India. Does he need to get a different visa now? What kind of visa would our son need?

Parul you should look into OCI for Adi. As he qualifies for that being a child of Indian citizen. It is a bit expensive but in long run he can come and go out of India any time and stay for as long as he wants to without going to authorities every 6 months (as that's the requirement for PIO).

Asia: SouthDoes US spouse of Indian passport holder need visa?

Thanks for all your input. I have some follow-up questions:

1. I will be leaving in mid September and my husband will leave a month after. Since I will not be with him when he enters India, does that change anything?
2. Can my husband still apply for a tourist visa and enter India on that visa? He thinks that may be an easier route so I wanted to know if he is eligible for a tourist visa.
3. How much time does it take for the PIO card to come? What all forms, documents need to be submitted? I couldn't find too much info on the site.

Thank you guys...

1) Your husband can enter and leave India as he pleases, you don't have to be with him at Indian POE.

2) I am not sure about the recent rule changes, so may be he isn't allowed to apply for tourist visa as he is married to an Indian citizen. In 2008 my husband applied for entry visa and it took only 10 days time (including the time where he forgot to attach an utility bill). They were really good about it, they emailed my husband asking for the utility bill and all he had to do was send a scan copy of it.

3) About how much time it takes for PIO, here is the timing from New York Consulate General website. Just type in PIO on search bar at that site and you will get other informations too.

Here is the list of all the q&a about PIO from the same website. Now if you do plan about applying for it, make sure you apply with the right consulate general which comes under your jurisdiction.

Asia: SouthDoes US spouse of Indian passport holder need visa?

My husband who is a USC, and his parents and siblings (all USCs) are all going to India with me for a traditional wedding ceremony. I know that his family will need to get tourist visas for India, but just today I read the following:

Per requirements of the Indian Ministry of External Affairs, persons of Indian origin, his/her spouse and dependent children will be granted only an Entry visa and should not apply for a Tourist visa.

I received my green card but I still have my Indian passport and I'm a person of Indian origin, so will my husband not be required to apply for a tourist visa to visit India? If yes, how does that work for multiple visits?

Thanks in advance....

Not sure when you guys would be traveling but if you have enough time in hand before your travel dates, you should look into PIO (person of Indian origin). Being married to an Indian he is eligible for it. PIO is valid for 15 yeras.

Also once you get your US citizenship (if you ever plan for) look into OCI (overseas citizenship of India) when the time comes.

Best wishes (F)

Asia: SouthI-134 and I864

Hi All

I have two questions:

1)I m very confused right now. what visa require you to fill I-134 and I-864. can somebody please explain. what i know so far is that if you are applying for K-1 visa then you have to fill I-134 but i m not sure, and when do you use I-864.

2)I just graduated from college last year so i didn't work in 2009 and i was depended on my parents tax, and they didn't make enough money also, but now i have a job and making $40k/year. does anybody know if that will be ok.

Thanks for your help.

Since you are going for K-1 at consulate stage you will have to full up i-134. But once your spouse comes to US and you have to do the whole AOS process you will have to fill up i-864 at that point.

About your second question, I personally would suggest to get a joint sponsor just to be on the safe side. You haven't filled your taxes yet with the 40k/year income, you do have the proof that you are making it with your paychecks but still you haven't filled the taxes and with i-134 you have to show tax return papers. Just be prepared for joint sponsor, if not your parents may be someone else as long as the person is US citizen or a resident.

Best wishes.

Thanks for the update! My opinion is: you both need to get married and apply again, my guess it is useless to further pursue the old, rejected application. Either you go to India to get married or if he can get a visa to some neutral country (say, Singapore), you can marry there. You would need to go over the CR1 rules to see what is required regarding marriage certificates. Also, time-wise a new application would be faster than going on years like this, trying to fight a battle of higher govt forces, no matter how wrong they are!

It wouldn't be so bad living in India - I lived there for 21 years and we are planning on returning for good in a few years! I would take the simple life there any day, to the endless complications and expenses here.

Whatever you decide, know that you have many good thoughts and prayers supporting you! (F)

 I agree with ELW. It is useless to pursue K-1. Most likely after 4 month time period they are going to say the case has been expired.

And please don't give up. Me and hubby lived this distance for 4 long years. Without going into details, all I have to say is -- Nothing worth having comes easy.

I wish you all the courage you and your SO needs to fight this obstacle (F)

Greetings from the new Republic of Nepal!

I am sitting at a cybercafe in Boudha - so much to write about.... We did some trekking in the Annapurna area and it was the experience of our lives - planning on returning there next year for sure. I have been eating lots of Dal Bhat, yak cheese pizza and chili veg momos.yum.... I am returning to NYC in 2 weeks and trying hard not to think about it, just thinking this will be our last separation and the next time I fly back from KTM Govi will be sitting next to me... still no activity on our case and I am a little worried... sad.gif

The political situation is not good - Koirala refuses to leave his position as PM and the Maoists have pulled out of the new government.... Students are demanding a 50% discount in bus fares and since the transit companies don;t agree both sides are protesting and blocking the roads... So now we are stuck in Boudha but hopefully the situation will improve soon.

See you all in 2 weeks... Dolma

Very exciting PR!! I have had that feeling too (of witnessing history being made) each time I've gone to Nepal. It is a very exciting time to be there.

I second Eileen's wish for a peaceful first meeting of the CA. And a happy reunion with tapaaiko mutu! Looks like you're leaving in a week... lucky duck!

Please do send update(s) from Ktm if/when time allows... we'd love to hear how you're getting on and what the general mood is, too.

Best wishes for a safe journey...

Exactly 12 days from now I will be leaving... kicking.gif I already have most of my stuff packed. biggrin.gif I am just curious, when you have gone to Nepal how did you handle the H2O situation? I have drank bottled water in the past but I feel so guilty doing so - have also used purification tablets but they seem expensive. Govi's family has a water filter but I dunno if it gets all of the nasties. I came down with Giardia last year and don't want to repeat it... dead.gif There is a website by a doctor who has practiced in Nepal and specializes in high altitude medicine - rather than any fancy commercial filters he recommends using iodine - 10% solution, 4 drops per liter. For additional protection he says you can use coffee filters. Especially if we go to Manang/Mustang I want to keep waste to a minimum. The website is http://www.high-altitude-medicine.com.

And yes of course I will post updates as soon as I can - you might not hear from me for a few days though. wink.gif

According to http://www.ekantipur.com, the first meeting of the constituent assembly will be at 11:00 on May 28 - 3 days after I arrive. Like the first time when I arrived in Nepal(June '01) I will be witnessing history being made - I just hope it all goes peacefully.

First CA meet at 11 am, May 28

Kantipur Report

KATHMANDU, May 12 - Prime Minister Girija Prasad Koirala has called the first meeting of the recently elected constituent assembly (CA) on May 28.

Pm Koirala called the meeting as per act 69 of the interim constitution.

The meeting will begin at 11 am on the same day at Birendra International Convention Centre, New Bansehwar in the capital.

The date was finalised after consultations between the PM and the senior leaders of the parties elected in the CA.

The CA meeting has been able to garner widespread concern especially because it is expected to decide on the fate of the monarch.

All the parties elected to the CA have already reached an agreement to declare the country a federal democratic republic through the first CA meeting
