Asia: SouthUSC with 2 DWI's and mandatory jail time
Hi all, I posted this in general discussion but I guess this is a better forum for this.
I am 31 yrs old white male USC, I started talking to my (now) wife in nov 2010 and went to India last week (1st trip) for 6 days and we got married. She is divorced with a 5 year old daughter with sole custody and full rights. I also have 2 DWIs with mandatory jail time. 1st one 7 years ago and 2nd one 4 years ago. We are getting ready to file for CR1. I was warned to make a couple of trips before getting married but we did it anyway. Is it going to cause us any problem in the future? Also are my DWIs going to affect my eligibility to file for her and her daughter?
It was her parents idea for us to get married so soon because they did not want me seeing her without being married to her (not that we did not want to, we did and are happy). Can someone who has dealt with Consulates in India help me on this one please?

I appeared at interview on 8th December, 2010 and at that time my P.D was Current but in January 2011 it goes backward due to retrogression. I made contact with embassy and now they are saying that we will issue visa when P.D will be Current.....Plz help me regarding this problem ....wt should i do regarding this case.

I also appeared for my interview we have the same case due to retrogression my priority date moves back after I file my AOS under F3 category and the Immigration officer hand me a piece of paper saying;
CONTINUED FOR SERVICE ACTION:PLEASE INQUIRE AFTER 180 DAYS;
Your application for permanent residence is pending for the reason(s);According to this month's visa bulletin,a visa number is not currently available for your case.It is recommended that you call the State Department's visa bulletin telephone number.(###)###-####,or visit their website on a monthly basis to determine when visa number will be available to you.

To OP: one possible way around this is if your spouse becomes USC then a second I-130 can be filed as "immediate relative" (this is allowed) which will be faster.

(caution: that requires that spouse actually be eligible to apply)



IR/CR cases can also land into AP/AR...

seems like ur case was put in Administrative Processing at the time of interview...and then that retogrssion happened...

I've read a lot abt AP on VJ as well as other forums... even if AP ends u will only be issued a visa when PD becomes current...No one can do anything...U shud pray and wait..like the rest of us :(

Nevermind! I found me answer on the country reciprocity schedule for Pakistan - if anyone else has this query they can rest easy after looking at the source.

"Pakistani names are subject to a variety of combinations with no established surname rule. Individuals may change their names by simply announcing name changes in the newspaper. For older persons and those born in rural areas, frequently only the year of birth is available. It is not unheard-of for birth dates to be changed. The essential element of identity is generally the name of the father and, in the case of married woman, the name of the husband though adherence to standards of proof of identification for these passport entries can be lax."

If you still wish to be cautious, get a notarized affidavit by your parents stating the customs and why they changed the name within a month's time of one's birth. Also read on a different source (some VJ thread) how as long as name is changed before 16 years of age its never a bother.

We've just recently received our NOA2 from CSC - however today I found out me name's different on the birth certificate. Truth be told I learnt of this today, when I was prepping my documents for the interview; I'm based in Pakistan so in many instances its the custom here when the name on birth certificate is different from your original. Whenever someone's born mostly - for record they put in a name in the birth certificate document and hold an 'official christening' later where they sometimes change the name (without amending the birth certificate). In my case for example its Ray Adam Bowie on the birth document (Adam Bowie being dad's name), but on me passport and everywhere else (including the USCIS K1 petition) its Sam Ray.

So my question, has anyone gone through something similar in Pakistan and what have they done to rectify it? Would a notarized affidavit signed by me parents explaining 'why' they changed my name suffice in this case, or do I need to do something else?

on the other hand,, you can go to pak embassy/consulate, and change your nicop card and passport with her married name.. you would need your marriage certificate....

otherwise there are no issues...

Do you think that there could be a problem even when the embassy wrote in the letter to the Senator that we will schedulke another interview fro me when the petition reached New Delhi Embassy ?

We would like to Thank everyone who has been with us throughout our Journey and giving us valuable feedbacks and suggestions . Today we went for our second interview and the visa is approved . I should have the visa in a weeks time as told by the VO officer .

The formal request you made is enough - after all, even on the example form here on VJ, it is not really a form, just a request letter!

They usually grant the extension with no problem but because you had problems with the approval, never know if they will make an issue of it. Hope all will go well. You are doing all the right things! :innocent:

Sorry you are having troubles, but sounds like the process is on track to be reconsidered this time.:yes:

The only thing I know of to officially extend the validity of an application (though as you said, it is at the discretion of the consular officer to re-validate it, which usually happens) is to send in a formal request to the Consulate: please see the "Example Forms" on this site and under "K1 Visa Related Forms", click on the last one, "Request to Extend Approval of I-129F". we did sent a formal request to the embassy as well ... It was not in a format of a form though . Do you think that would be an issue ?
We thought that its ok to write them a letter requesting them to extend the petition formally .

Hi Everyone
I would like to thank everyone for being so helpful for all the inputs .
We have a new issue for which we are trying to get the answers , but nothing is getting clear , so here i m again .
I had my K1 Interview on the 16th May and the Visa got denied because the VO did not think that we had a genuine Relationship . I received the passport back without the Visa stamp after 9 days (25th May ), and the petition sent back to NVC.
My Fiancee had written to the Senator and there was a query sent to the New Delhi Embassy on the 26th May , now , on the 27th May, my fiancee got a call from the Senators office that they are recalling the petition back to the Embassy ,after the petition had been reviewed by a Supervisory Counselor Officer .
We are just told to wait and that once they receive the Petition back there would be a Re interview done at the Embassy .We believe that it will take close to 45-60 days before the petition gets back.
The issue is that the I129 F expires on the 16th of may and we wrote several emails to new Delhi Embassy , but no reply from them at all . We also wrote to VFS and just today after a week i received a reply saying
"Dear Applicant,
As per the U.S Embassy there is no provision of extending the expiry date. However, the consular officer has the discretion to re-validate fiancé petitions if they expire during processing."
now this is a very generic statement that we all are aware about i guess .So i m completely confused as to ,if at all i will have a 2nd interview as stated in the letter to the senator by the New Delhi Embassy ,even after the Petition Expires? what should be our next step ?

Hey I was just reading about your NICOP, I had the same situation. I went to New York to get my passport and NICOP. But my daughter couldn't get that because she is half white, hmmmm discrimination, I hate Pakistani policies. But if a Pakistani man will marry to a white girl. His kids are el legible. So Islam is color blind. Now next time when I will go Pakistan gonna try in a main office and if they said a same thing. I am going to ask them give me in writing. Gosh that is sucks.

Your wife can go with you to the interview all she will need is her American passport to show to security. I can't tell you how long it will take to finish with the NVC.

there are two types of shuttle services going to embassy
1) one is at early morning started at 7'O clock (this service is used by interview applicant's) & charged @ 500 Pakistani rupees
2) the other one is started at 10 am & used by every person which wana to go to embassy & charged @ 200 per person

when u reach there at shuttle service they check ur passport and interview letter and give u slip, which is checked in the bus.
ur mom dad and other persons allowed to go to embassy with applicant person (beneficiary) just by showing there Pakistani ID card

when u reach at embassy only "beneficiary" is allowed to enter into the embassy & US citizen only. ur relative must stay outside the embassy & the environment of consolor office is big lobby with dozen of chairs and mixed visa category persons sit there and at ur back side there is small windows number like 1,2,3,4,5,6 & 7.

ur named called u go there & in front of u there is mic & ur whole whole conversation is done there, just standing there and give answers to Consulor officer. & at the end of interview they tell u whether u qualify or not & that's it

My husband is US born (not of Pakistani origin)- Can he get NICOP based on marriage to me?
Our daughter is a US born citizen. Can she get NICOP based on being child of Pakistani parent? btw, I did not register her with the Consulate.

We plan on traveling to Pakistan in May for my brother's wedding and would like to know if we can get NICOP's or do we all need to get visas?

My wife came to the US in 2009 on Fiance visa. we got married and she got green card which now has new last name.
We are planning to travel to Pakistan in November:
Her green card is in new married name
Pakistan passport is in maiden name
NIOC is her maiden name
We intend to buy airline ticket via PIA in the passport name ( maiden)
I am concerned about traveling to Pakistan where she could have difficulty leaving Pakistan due to name difference?
I am wondering if anyone has had a problems traveling in/out of Pakistan when using the passport in maiden name?

I got dengue last year here in New Delhi. The only thing that help with the platelet count is papaya leaf juice. Take the huge leaves and juice them. It makes a bitter dark green liquid that tastes terrible. but it helps with the dengue for sure, especially since there are no medicines you can take for dengue, because pain killers lower your platelet counts.
It sucks, but after 7-8 days she should be up again. after 2-3 weeks she will get her strength back.

Hi all
I just received my NVC case number recently and am eagerly awaiting the next steps for my fiance in Pakistan!
I have heard all of these horror stories regarding the AP process Isl insists on using and it is generally causing me great unease as my fiance and me are first cousins once removed and whilst this is legal for marriage purposes in Pak and in NJ (where I live and plan to marry), I fear it may cause the close minded officials to put us in AP even though we have more than sufficient evidence of a bona-fide relationship.
Do you guys think boarding passes from my flight to get engaged, photos of the ceremonies, call logs from cell and landline phones, an extensive FB chat when we first met online, and photos and boarding passes from a trip this past month we both took to London, do these things qualify as evidence??

Hi,

We seriously need some help regarding immigration interview for CR-1 catagory.Here is the little back group, I will try to make it to the point.

My wife and I got married in June. Wedding in June was just with close family members. Only about 10-15 people. We got the marriage certificate (with June wedding date) and filed I-130. We DON'T have much pictures to show for this wedding and invitation card and marriage certificate shows that wedding was at my HOME. And invitation card also shows that wedding was in the "afternoon".

We did our grand wedding in January with about 500 people (friends/family) and we have awesome wedding album to prove that. Invitation card for this wedding says that wedding was "at night at party plot" and ofcourse pics shows everything.

Here are the possible interview questions we are not sure what to answer:
Any suggestions are welcome.

We have to tell them that we got married in JUNE. And since we don't have picture for JUNE wedding, we will show them November wedding.

1) Should we go ahead and tell them that we had two weddings?
2) Should we not tell them, unless we are asked specifically about that?
3) Do we have to give them wedding invitation card? If yes, only from JUNE wedding, or both JUNE and JANUARY wedding?

Please HELP.

Yours is a different situation then ours is so I'm not sure how to answer your questions about the , but if you go to the "Example Forms" link above and look at the I-864, your questions may be answered.

Example Forms

Tax transcripts are the best and enough to satisfy the requirement of tax forms, so don't worry about it. :no: If you have any doubt, doesn't hurt to have ready your 1040 and any supporting documentation you have.

Hello,
I am filling out I-864 for spouse and step daughter who are living abroad(I-130 petition filed seperately). Due to income guideline, my brother is co-sponsoring them. I am confused filling out part 3, question 8. As the petitioner, do I check the question 8 yes box on the I-864 for my spouse? If so, then on part 5, question 21-a, the answer is 1. Again question 21-c should also be 1. Am I not counting my wife twice or should I not answer part 3 at all? Also, do I answer question 21-d as 1 for my step daughter as I am supporting them oversease?
Also, I called the NVC, they could not help regarding this.
Second question is that, when asked, the NVC rep informed me that I don't have to send the W-2s, pay stubs, etc from my job, and, since I am self employed and have a buisness, I still don't need to send the 1099s because I am sending IRS Tax Transcripts. My friend disagrees. Please help as I am confused!!
