IR-1 / CR-1 Spouse Visa Process & Procedureshow to change my overseas address (outside the US)

Call. Speak to a tier 2.

Let me know how that goes, when i did it (to change my wife address to the UK) they said they couldn't do it, and to address this at NVC stage....

IR-1 / CR-1 Spouse Visa Process & ProceduresDo I need a police certificate for...?

The DS261 is an agent of choice form.  I think you mean the DS260, which is a visas application containing addresses at least back to age 16.  If by "they" you are referring to NVC, (not once did you refer to NVC before using the pronoun "they") then yes, the information the applicant enters into the DS260 does indicate which police reports will be needed.  VJ is not here to help NVC.  We're here to help the members involved in immigration processes.  Members do not obtain information about police reports from ANY government form used in the process.

Thanks we are over it now, just please curb your attitude/tone towards people if you can.... if you can't then thats to bad.

IR-1 / CR-1 Spouse Visa Process & ProceduresDo I need a police certificate for...?

I would say Thailand would be a toss up, yes you were not technically a resident, but you used it on your I-130 so they MAY want to see it, it does not appear that you need a resident ID to get a Thailand PCC.
"

Police Records

Available. Police certificates are obtainable from:

Section 3, Sub-Division 2. General Staff Division
Special Branch
Royal Thai Police Department
Rama I Road
Pathumwan, Bangkok 10330

Residents of Thailand requesting a Thai police certificate will need to present two recent photographs (2 inch x 2 inch), the original and a copy of his/her passport, identification card, household registration, name change certificate (if any), marriage and divorce certificate (if any). Thai males aged 17-45 must also present military record or proof of exemption from military service.

Non-residents should send their requests to the Royal Thai Police Department at the above address with the required documents and a fingerprint taken by a police authority at their place of residence.

Normal processing time is two to three weeks. There is no processing fee"

This is what i was also trying to say, if you told them you live there, they will probably ask for it as they have no idea you were a actually a "tourist". As i said before, and as there is not charge, why don't you go ahead and get one anyway? Incase they ask...

about the issue of 12 or 6 months it is pretty clear at the US state Dept, when it is needed.

IF you?

AND?

have been living in your country of nationality at their current residence for more than 6 months

you are 16 years old or older

lived in a different part of your country of nationality for more than 6 months

you were 16 years or older at that time

lived in a different country for more than 12 months

you were 16 years or older at that time

were arrested for any reason

you were any age at the time of the arrest

So less than 12 months, no need...... Thanks :)

IR-1 / CR-1 Spouse Visa Process & ProceduresDo I need a police certificate for...?

Wrong again.  This is what you wrote, among a number of other wrong things.  FYI, USCIS has nothing to do with police reports obtained by the applicant, and never deals with them in any way.

You wrote,  "My advice would be to get as many Police checks as corresponds to what your i130, and eventually the DS261, will state. If you get a checklist, at least you will have them."

Your I-130 and your DS261 never state anything about police checks or police reports.  NEVER.  Instructions about them come from the links I gave above.  So, no, they don't guess.  They read the actual instructions.

What "hurts" people here is not straight talk, but rather bad information that causes errors and delays.
.

OMG you are simply amazing, you have brightened up my day with your attitude!

How do you think the NVC know you need a police check huh? Yep, from the address you put in the DS261.... if you didn't put these address they don't know you need one..... Do you think they just guess? . if the OP in the main post has put she lived in Thailand for over 6/12 months, then YES she sill need a police check (which is what she was asking) as the NVC will see, oh this person lived in Thailand - the fact she is on a visitor visa means zip! So yes, there is a correlation between what you put on the forms and what the NVC will ask for - my word it is lie explaining to a child.

So from now on will you please just be polite to people on this forum, many members have complained about your attitude and what you post, all are trying to help. Yes all will not be right, but we can't all be as well educated at you now can we

IR-1 / CR-1 Spouse Visa Process & ProceduresPolice check for Greece? (split topic)

What is a DS261? On the I130 I put that I was living there, as I was, but still had home in UK paying council tax etc but was not there for longer than 12 months so don't think I need one, do you agree?

Once you get the the NVC you will need to do the i130 again lol (well it seems like it), its called the DS261 (or 260 i forget). Basically if under 12 months, don't worry.... but if you put on this form that you lived somewhere for over 12 months, they will ask for the PCC as they will assume you "lived" there

EastyoMaleUnited Kingdom2014-05-09 11:04:00
IR-1 / CR-1 Spouse Visa Process & ProceduresPolice check for Greece? (split topic)

I am now wondering whether I need a police check for Greece .
My husband worked there and I went to stay with him for around 8 1/2 months in Athens and then on another occasion I stayed in Thessaloniki in Greece for around 8 1/2 months. I was not on the rental agreement and I didn't work there, was literally on a long holiday. I also went home for approx 3 to 4 weeks in the middle of the stay for Christmas both times. We still had our home address in the UK and had other ties there
Any advice would be greatly appreciated

It depends on a few factors, firstly you need to see if one is required. Sub 12 months I think not (but check). If your main residence was still the UK, and your post/tax etc was still there, then no. However, if you put on the DS261 you "lived" in Greece, then they will assume you "lived" there, and if over their specified time frame, then yes, you will require one. I wouldn't even mention it in your address history for the NVC

Were you paying council/income tax in the UK? Officially under UK rules, you are still a resident if you have not completed one complete tax year outside the UK.... so i would say you were still residing (living) in the UK.

We just received our 3rd packet and it says we need to apply for the police records at the Greek embassy and they will not take the ones we have. Same goes for the country we are from.

Apparently now they are all sent directly to them.

Hey, did you get this sorted? I take it the embassy in Greece needed a letter from the embassy and also sent it directly?..... If so

a) what letter did you use

b) Was the UK visa unit ok with them sending it direct?

Thanks for your reply! Yeah I was thinking in might be in some mail room among hundreds of other packages...hopefully things will start moving soon!

Hi Doria,

I'm currently waiting for my I-130 to be approved and I was hoping I could ask you some questions please? Your case is quite similar to mine because of your location in the US :)

My local field office is Philadelphia like yours, so I was wondering if your I-130 was sent to the Philadelphia field office? Or did it remain at the NBC? Also, did you receive an MSC code for your NOA1?

If I can confirm what you say on your profile, your husband lives in Philadelphia and you live in Romania, and you were married in January in Romania?

We're the any special circumstances for your case that allowed you to ask for an expedite?

I am living in the UK, my husband is in York, PA and our local field office is Philly. I've been waiting over 3 months now for my NOA2 and I'm just trying to find some rhyme of reason for this whole process, it's so frustrating!

Anyway, thank you very much in advance, I really appreciate your help :)

IR-1 / CR-1 Spouse Visa Process & ProceduresCR1 London Visa Interview Earlier Reschedule?

As i myself am also going down the exact road you have , may i ask what paperwork you took to your interview please?  i just want to be sure i have all i need for January.

Thank you  and Congratulations. smile.png

Hi!

I took literally every single piece of paper I could think of, honestly the more you have the safer you will be, just take EBERYTHING!

Here is my interview review if that also helps you prepare =) Please dont hesiate to ask me any questions and super good luck! Oh and laso, i was never able to reschedule my interview =)

London CR1 interview

I left my friends flat at 7:00am after triple checking all my paperwork. I arrived at marble arch just before 7:30, and I picked up a chai latte and dropped off my cellphone and key fob at Goulds Pharmacy before waking to the embassy. I had assumed there would be a really long queue, but I just walked straight up to the desk and showed the woman my interview letter and I was directed to the security booth, where I out my bag through the scanner and was told to take a sip of my drink to prove it wasn't dangerous. I walked round the right had side of the building to a set of doors and walked up to a reception type desk where I handed over my interview letter again and the lady stuck a strip of stickers on it all with barcoded and the number I908. Now my interview was only at 9:00am, but I think that when you arrive at the embassy, irrespective of the time of your "actual" interview, you're given the next number along in your visa category and you essentially form a new queue with your assigned numbers. So if you want to get out of there early, get there early smile.gif And don't listened to the "don't arrive over an hour before your interview" because I did and no one seemed to care in the slightest!

Right back to the interview: you walk into a really long rectangular room with rows and rows of seats facing a bank of television screens up high on the opposite wall to where you came in. The left hand screen was black at the time but as soon a the interviews started at 8:00am it was turned on and flicked through the N(non immigrant) I(immigrant) visas and various other letters and numbers to indicate other visas (I also saw L & V). I have no idea how long it took for me to be called up finally, but I chatted to naive guy there for a tourist visa for probably an hour and a half before I was called up to window 14.

A really nice friendly American guy greeted me and took my fingerprints from both hands and had a look through all my paperwork. He took my passport and interview letter, made me sign the back of my photos I had brought (just incase, even though I sent some to the NVC too, good thing I did!!). He also asked when I wanted to fly, and even though I wanted to leave on the Monday or Tuesday the next week, I told him I wanted to leave on the weekend. I wold very strongly advise that even if you want to fly in a month, tell them you want to fly asap, or you get put on the bottom of the pile! My interview was Tuesday, my visa was issued 24 hours later and is available for pick up today(Friday) from my local depot. I have seen too many people waiting weeks for their passports and it really stresses them out, so unless you need to delay the return of your passport for as long as possible I would just say you are flying within a few days to get it back asap and take that stress off yourself! After he had asked me a few further questions about where I lived and had a look through everything, he handed back my interview letter and told me to go and sit down and listen out for my number again.

After chatting to more people (it's really good at cal ing you down!) I was called up again to window 16 this time and was greeted by a very stoned faced, brown haired American man called Michael. After checking my fingerprints to see if it was still me, and making me raise my right hand and swear the information in the documents before him and that I was about to give was correct, he asked me:

Where my husband and I met
How he proposed
What our degrees were
What Dan wants to do for a job
What first attracted me to my husband
Where we are going to live when I get there
How long it had been since I last saw him
What did we do for our first date

He hardly smiled at all though the interview and didn't do much to settle my nerves, unlike the man I had before who put me at ease! What was worse was that after asking me this question he just got up and walked away!! No "excuse me a moment" or "I'll be right back" he just buggered off down the row of desks behind him and went to talk to someone there. It really terrified me that I was about to be denied!! Thankfully when he came back he said "I'm going to approve your visa" to which I squealed yay!! He then told me about how I would get my passport back (courier) and that I shouldn't open the envelope that comes with my passport as that's only for the immigration officers at the POE. I also told him about my imminent travel plans to reiterate the need for a quick issuance before hugging my paperwork to my chest and dancing my way out of there!!! Needless to say a lot of skyping ensued between my husband, his parents, my parents, my friends and I!! We are all so thrilled :D

A quick summary of some pointers:
Take extra passport photos, it can't hurt
Get the early to get out early
Tell them you plan to travel within a few days to get your passport back ASAP and not stress about where it might be.

Good luck on your interview day :D

IR-1 / CR-1 Spouse Visa Process & ProceduresCR1 London Visa Interview Earlier Reschedule?

Hi everyone =)

Firstly, I have looked high and low on the forums and cant really find an answer to my question, so if anyone does find it please let me know, but I did also try to answer my question before I asked it =P

I have sent my AOS and IV packets to the NVC and I'm now waiting for a case complete. (And hopefully no RFE's!)

Once my interview is scheduled in London, I want to know how easy it is, and likely it is to get an earlier interview date, and how I would go about it? I was just having a look and I can get a 6 hour train to London for £60 leaving latest 6:00pm to be able to attend an interview the very next day.

I can also head to London asap to get my medical done so that can be done well before the interview.

Has anyone on here asked for an earlier interview date in London? Are they likely, or even possible? Would they give me one with 24 hours notice if I asked for it? I'm so desperate to move already, and I have everything ready to go so I can leave in a heartbeat! =)

Any information or advice would be much appreciated!

Thank you very much =)

K-1 Fiance(e) Visa Case Filing and Progress ReportsUrgente K-1 Visa WHICH one 1-134 or I-864

The Montreal consulate (the one I will have my interview at) site also says I-864 for the fiance visa, but I think I read somewhere on VJ that they list all the required documents for spouses and fiances on the same list. I am sure it wouldn't hurt to call and clarify, but unless I receive specific communication from the consulate or NVC to submit the i-864 form, I will submit the i-134 with supporting evidence.

Today we received the hardcopy of our NOA2 in the mail. Only took 4 days :) And on the form it says our file is being forwarded to the consulate listed (assuming it will go through NVC on its way). Is this the consulate I specified on the form? I found out later on that Ottawa (the consulate I specified before I realized Montreal does them) doesn't actually do these sorts of visas, but Montreal does. So I hope they forward it to Montreal and not Ottawa. You'd think they'd know.

This process is so strange and frustrating  - they really don't seem to be going in any sort of trackable order. Fingers crossed for all May filers who have yet to receive an RFE or approval <3

hMM, All it told me when I checked was: Your I-129f was approved in 87 days from your NOA1 date.

So how do I make it tell me an actual date like it did for you?  Also, do I count as a May or April filer?  I want to make sure I am in the right thread!

I am not sure if you count as a May or April filer. I guess it depends on the date USCIS received it? Like Nurseling said, the timeline is only for the approval of the petition, not the visa. It says what it does because you've already received your NOA2. It still is in progress for me - my petition has not yet been approved.

If you go to Immigration Timelines in the top menu, then under Timeline Functions, click View My Timeline (if not, you'll have to start one). And on your timeline page, scroll down past your timeline, and the last item in the table says: Processing Estimates / Stats. :)

How do you get where it says the dates of the timeline estimate?  I have a timeline also but never saw the date of when it thinks she'll get her visa, etc.

Also!!  Can someone tell me where to go to put my USCIS Receipt # and and back up x # to see how far they are before the NVC gets to mine?  I got NOA2 approval on July 29, and the hardcopy 4 days later on 8/2.  Do they always go in sequential # regarding the USCIS receipt #'s?  I called NVC today and they haven't got my packet yet, and was told that instead of 3 wks (I thought it was 2), now it's 8!! (GASP!)

I got my NOA1 around May 3 I believe so do I count as a May filer too?

Thank you for the tip :) Much appreciated!

USCIS has been having issues with their notification service. Some people who are signed up never get notified and their case status still shows as "Initial Review" after they get a physical NoA2 approval in the snail mail. So don't rely wholly on that case status and electronic notification! It's (unfortunately) rather unreliable.

My fiance and I are quite lucky, as we are only about a 6.5 hour drive from one another (he lives in New Hampshire and I live in Ottawa Canada), so we visit at least once a month. Regardless, this is still stressful because I feel like my life is split in two! I hope we all have a positive experience with our i-129F petitions. K-1 Fiance(e) Visa Process & ProceduresI-134 Affidavit of Support -- Am I able to show ability to support myself?
Hi! I'm new to these forums..

My fiance and I have some questions about financial evident of support. We are both working (and I am well-educated, plus have a decent employment history), and are wondering if I'm able to provide proof that I can support myself (as we prefer to keep our finances separate), and that I will have an adequate amount of savings to support myself prior to being able to work once I move to the US on the K-1 visa, and after we are married / I'm legally able to work. Is there an alternative to him having to show pay stubs or tax returns? Are bank deposits sufficient? Can I show he doesn't need to support me, and I can support myself? I'm just curious, and would appreciate any input / experiences with this.

Thanks :)

**Also: do they always request this I-134 form?

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsAug 2013 I-130 filers

I am inclined to support your forecast except that CIS is extremely unpredictable.

As you know, August has 14-20% less applications than May.

Now, If I were an efficient bureaucrat interested in making senior management decisions that make your (and my life) easier, I'd probably transfer this lower aggregate volume at a faster rate.

We are instead dealing with USCIS instead.

So, I anticipate slower (and lesser number of) transfers spread out past february.

To give you a concrete example, before August, they were transferring every third day.

Now they're transferring once a week.

At least thats what it looks like to me sad.png

I hope I'm wrong bro

You make good points, and i think that is the issue, it is just totally unpredictable. I mean, how can they approve so many July petitions and ignore so many others.

I think we may be screwed here, stuck between the July fast rate and the October "direct to service centre" petitions!

Nobody from August has their NOA2 IF you don't count the expedites

We just started transferring last week.

Indeed X means unknown.

Meaning we do not know which SC it went to - if it has been transferred.

We have not received any transfer notices to answer your last question.

Hope this helps.

I know you have JUST started transferring, i was asking about the "X's", which I know know what they mean.

Anyway, lets hope that they transfer all of August by the end of February. I think this is possible, and would mean that (if we go by the 60 days) we should see approvals starting, and hopefully ending, in April right?

I meant...when it asked if I wanted a call back I chose to stay on hold. obviously big mistake , now I have nothing.

I think I need to just stay off this site for a bit...and uscis site especially.  Everyone is right.  I don't have it in me right now. I can't handle this anymore.  Their ridiculous unprofessional unorganized chaos is going to break me.  I just can't do it. I totally congratulate everyone that got transferred today.  I wish everyone luck who hasn't been transferred.  I'll come back and check on everyone when I can stay calm.  I just can't now.  Good luck everyone.

I really hope you are ok, i know you will be!. What is your PD? They only just started today so it will take a week or two :) Don't worry, i am sure you will be just fine!

I did.....commented and voted both.  Went to the site about an hour or so ago.  It showed it rank 45 and only 3 comments below.  something about it being moved to off topic or something like that
