Hey everyone - are all your status on USCIS site still stuck in "initial review"?  My priority date is August 16th and I have not heard anything moving yet.  At what month should we contact our senators and congressmen on the matter to have them inquire on the status of our cases.

I will at 6 months, we have (to be fair) only been at 4.5 months so i am not going to jump up and down yet. However a letter with another en-mass complaint at this time may well work wonders to make sure it doesn't get any worse. preventative medicine is sometimes the best...... what we DONT want is USCIS getting worse or pushing our cases back to meet the 5 month target..... But also until they update the 8.7 month timeframe on their website they have all the right in the world to tell you they are within timeframe if you complain.

 

I know this is horrible, but ultimately does the average american care, no, does he want this to go faster, no.... so until this becomes a factor which effects votes, why do they need to sort it? piss off a few hundred thousand people per year, small fry.....

 

However, as I read currently JULY cases have all but been transferred (correct me anyone if i am wrong) that means that we should see a transfer by the end of January. If not i will call then a tier - 2. 


GUYS, I was told  September when I first filed,  then Tier 2 told me " you will get approved by Halloween" Then I was told 20 more days, then I was transferred and I am still waiting.... I was transferred on Nov 27th......   The congressman have no clue and really shouldn't hand out timeframes.  My best assumption is that they have a special email address or phone number they can call.  Nothing more. and then they get lied to just like we do... so really,  Don't read too much into it.  it is what it is, you can't expect anything unless you actually have your approval letter in your hand and THEN its another 8 weeks at the NVC level.     

 

Sorry, what did you file in September? approved by halloween a few months later or a year and a few months later?


I would love to be IN the US by mid August, so approved early August would be fantastic....! thats 12 months start to finish.....

Tier 1 and 2 are only call center employees. They are not the USCIS. They pretty much have the same information as whatyou can look up yourself on the USCIS website.  They can put a service request in or an expedite request but that is only if you get one that actually wants to to their job.  Many are nasty and rude.  Always get their employee ID number when you call. Ask them to repeat it if you miss it ! 

 

If you haven't been transferred yet, your file is just sitting . When you get transferred, it goes to another place to just sit.  Unless it is actually assigned to someone or you get an RFE, there really isn't much status.  Waiting sucks.  I have been waiting a few days shy of 9 months. I only found out last week that my file is assigned to someone.  The problem with that is, I  have no idea what " being assigned to an officer " actually means.  Does it mean my file is actually on someones desk OR am I just part of a list for one of the officers that he/she will eventually get to work on?  and how long has my file been  assigned??? 

 

I think August filers have a while to go. They still have many files from March and April that have been collecting dust.  TSC and NSC are working slower than Molasses or a dead snail. CSC was getting them approved but now some EINSTEIN decided to transfer I-129's ( work related) to the CSC for procesing .........so in my opinion, CSC will slow down too.     As my lawyer told me....  " just let them do their job, it will get done"   Not exactly the most comforting words.  

 

But surely that cannot slow things down again, especially after the long "family centred" letter they just posted and the May deadline to reduce the wait time to 5 months....Who is accountable for USCIS? Anyone? I think now overland park is on-line things will speed up. I have been advised March/April for my i130 approval based on a PD of 22nd August. However as they only update every 3-9 months thier times, it is all pie in the sky. The trouble is we all need them, we don't have a choice. And what is worse is that nothing can or will be done? Another mass letter of protest?

 

Im happy to do one again if it will help, especially as things seem to be going backwards! they made comitments, lets see if they follow them through!

As of today (Jan 4), they've transferred cases all the way upto July 20th (based on VJ and other sources like trackitt).

No, California has been the fastest by far up until now. They might slow down though, since there's been a work load from a different immigrant class there in the past few weeks. Nebraska is second fastest as far as I can tell (although I just got approved, and people who were transferred after me had already been approved, so there doesn't seem to be any rhyme or reason to it.) and Texas is dead last, and also throwing out a lot of bizarre RFE's.

I know as Jan 3 2014 they have transfer cases fromJuly 15 and maybe end of july so in like a few weeks august cases will be transfer...

 

However is this most cases or just a sprinkling of cases? Where did you get this info from?

Kayla is right. they are all over place to approving the cases.

I saw some cases which filled August and Sep already approved.

About Tranfer cases, they are on first week of July.

They will start August cases withing next 10 days.

 

So what is the score with a transfer? Do they have to look at it (supposedly) within a certian time frame? i have seen 60 days quoted here somewhere?

 

I really hope i get a transfer in the next 10 days lol :)

I don't follow the other months. I only follow March and April.   I was in Costa Rica when I received an email from my Senators office stating I was transferred to Texas.  I also received the 3 text messages regarding an update to my case.

 

I just found out on Monday through another inquiry that my case has been assigned to an officer.  Who knows when that happened and who knows how long an officer gets to hang on to them.  

 

Tier 2 are useless.  They only have access to a few more screens than tier 1.  I don't waste my time with them.  They only make me feel worse. They are RUDE and OBNOXIOUS

 

 

If you filed in Aug. I would start calling your Senators office in February.

 

Hey thanks. But hat do you say to a senators office? I guess you don't speak to the actual senator!. Can you only call when your i130 is out of their guideline times?

We've been seeing approvals from Jan-June, with several after that as well. (Some with Philippine beneficiaries, some not.) So basically, they're all over the place.  

 

 

Just crazy, it all adds to the nightmare that is USCIS..... at least if it was methodical it would take the edge off.... However at least they are moving again!

I will be as prepared as possible!! apart from the police certificate I think i have everything ready (our lawyer gave us plenty of info), so i am hoping for 3 months.....

How old can the police certificate be? 6 months? Is it worth me getting one in April/May to have it ready?

 

Kaylara, I know what you mean, and welcome to outsourcing.... I do agree that if we pay for it, we should get a better service. I could sort of undertstand if it was a free government run process, but this is a business. The US government should be kicking them!

 

I am lucky that my wife is with me in the UK, i count my blessings every day for that, but i just want to get on with my life and the "Promoting family harmony" or whatever ####### USCIS gives doesn't wash with me!

Although like you Jan 22 (the 5 month date) is what i think should be given. Its the NVC 4-5 months after that is going to be a pain, although i hear London is quite quick...

Look like they are almost transfer all cases dated before 10th June.

Hi Guys!

 

I am new to the forum and an Aug 2013 filer (22nd Aug, 2013), I am a Uk citizen and my wife is the US citizen. 

We both live n the UK, we couldn't do DCF as we moved from Hong Kong to York in September (so we didn't qualify) and posted through the Phoenix lock box.

As at the time of filing we didn't have a fixed UK address (only Hong kong but we were moving), our lawyer put my wife's US address as her moms (she still has all bank stuff going there).

 

Mind you when i called to update our addresses in the UK the tier 2 told me they couldn't do it?????

 

Anyway my question.......

 

I see that we are hopefully going to get transfers in January and should (hopefully) be approved by Feb/March. However I wanted to know if anyone had any experience

filing in the US (while living in the UK, or any abroad location) and having your visa sorted in the country where you live after the i130?

 

My lawyer says after the i130 they will transfer to London, but as this is not NVC i just wondered what the timeline would be for me under this process?

 

Hang in there everyone, I am sure we are all close and forums like this really help.

I'm seeing June and July filers getting approved from TSC. I've been trying to be positive, but COME ON!

 

Its just so crazy, July filers have been approved super rapid, CSC or TSC, both have been flying. Which proves TSC can do it!!

there is no flexibility, you must get a police clearance certificate from every country she has lived in for 6 months or more from the age of 16. Why is it impossible to get one? my husband didn't have any issues, it took 2 weeks to get it, and it wasn't difficult. He went and had his fingerprints taken, they did a short interview and returned 2 weeks later to pick it up.

I say not difficult because people have showed a few email discussions with an apartment locator and that was enough to show intent to re-establish domicile at a London interview. Just a plan to go back is allowed. Sometimes people aren't even asked in London.

 

Ok great, sounds like i shouldn't worry, especially with my list.

 

Is an agreement to stay with her parents ok/good, twinned with a conversation with a realtor? Or if we have a letter from her mother (who is also our second sponsor at the same address) enough.

 

My other question was if we hold alot of cash in the US ($85k cash and $250k in investments 401k etc) do we need a sponsor, plus surely this shows she "intends" to return to the US.... We didn't transfer anything to HK or the UK

She sounds fine. Domicile isn't that difficult at a London interview. It's not like you are building a case for the Supreme court. She has maintained her ties.

 

Everything but her house! So I think we will submit;

 

1) Last 3 years tax filed (W2)

2) Previous work contact to show she was paid in the US and was actually a US employee of a US based firm, who was temporally located in Hong Kong for 3 years (contract length)

3) Copy of her HK visa showing it was a temporary residence visa not permanent 

4) Copy of her auto insurance which was continuous while she was in HK and now in the UK (she still insured her car as she came back a lot)

5) Copy of her valid state drivers licence

6) Copy of her valid SSN

7) Title to her car showing she still owns it in the US

8) Copy of the last 12 months bank statements from our US bank (open and used for 14 years, and in both our names, although only mine for 1 year)

9) Copy of her credit card statement (last 12 months)

10) Copy of the last 3 years pay stubs (showing payment in the US while she was in HK)

11) Letter from the university showing she was a student in the UK (this is ok for the US for keeping domicile)

12) Letter from our solicitor showing my London flat was sold (we did this so that we/I had no more ties in the UK)

13) Email correspondance showing I have been interviewed for jobs in the US

14) Email from our movers with a quote for moving our goods to the US

15) Copy of e-mails between her and recruiters about prospective jobs and phone interviews scheduled

16) Rental agreement between us and her parents for the basement flat in their house

 

Do you think this is enough?

 

Also why do you say London is not difficult with proving domicile. The thing is, i don't think she actually broke domicile, but do we just write a general letter with the above info?

My wife, the US citizen, worked for an American firm for 6 years before being asked to manage their hong kong office. She lived in Hong Kong for 3.5 years and all this time was employed under a US contract, was paid in the US in USD and has been saving for her 401k etc. She still uses her US bank account and credit cards. Her contract in Hong Kong was a standard expat one, meaning it had an end date (thus was temporary).  She has also filed and paid taxes every year since she was 16 (including while she was in Hong Kong). The only thing she gave up was her home (as they provided one for her) and her car (as she didn't need it).

 

In September 2013 we came to the UK to study for a year (she has a tier 4 visa) before we return to the US to get jobs and start our lives.... (n.b: We don't have jobs yet, we will look when we get to the US and will be living with her mum)

 

While I realise we need a joint sponsor, I am concerned the visa unit in London may think she broke residency due to her being away from the US for 4.5 years, even thought she has maintained all the above (bank, credit card, driving licence, taxes etc).

 

Also just to clarify, she did not get any permanent residency status in Hong Kong, just a temporary work permit (1 x 12 and 1 x 24), so again i am not sure how they can define this as anything other than temporary..

 

What do you think, we should be ok?

 

Actually she still has the car registered in her own name at her mums address, and is still on the Auto insurance.

1. A copy should be fine.

2. It's a little more complicated than that. He's going to need to show he actually has a US domicile or has made a good faith effort to reestablish one, since he has been resident abroad for so long. This can be done in a variety of ways, like securing a place to live, a job offer, having a voting record, state driving licence etc. Take a look at the instruction PDF for the I-864 - it explains a bit about domicile requirements for sponsors. The stuff you listed may be enough already. So he should probably be listing his domicile address on that form as the US one.

Related to domicile: have US tax returns been filed for the years abroad?

London advised me they would not approve our petition with them until the one in the US was cancelled but I went ahead an mailed London a copy of our notarized letter requesting to have our US petition cancelled and London approved ours a few days later! So in short I think they may tell you that they have to see it cancelled but in reality I think they are just looking for your intent to cancel it. 

 

As far as I'm aware our petition is still live in the US despite my letter requesting it be cancelled having arrived over a month ago. 

 

Hey, thanks for that. One question, what do you mean by "notarized"? Did you just sign the letter yourself or actually get someone to notarize it for you like a lawyer?

 

I was just going to send a copy of the letter, signed by me to be true, and a copy of the proof of postage, to the embassy with my application?

thanks for the suggestion on sending the copy of the NOA1 sent it and a letter today, over night was £49 so we opted with the £6 option of having it arrive within 5 days.

 

Hi Mayb, Can i ask (as i am about to do the same), how long after you sent the letter to cancel the i130 did London accept and process the i130?

 

Does London just need to send the letter or do they need to "see something on the system"? I was just wondering as it could take USCIS a while to cancel and for London to see it!

Hello

We were approved for Visas at the London Consulate (DCF) but still have to send in translations of foreign police certificates. They insisted we still needed to send in official translations of the two documents for our records, even though the clerk told us he recognized they were 'all clear.' This was an oversight by me, I know, but now I am at a loss as to how to get them translated. I have queried for the service online and have gotten quoted 103-150 pounds (for two certificates) based on the number of words to translate. This seems really high. Has anyone else had to have documents translate? Is it necessary to have the whole thing done or just part of it?

Hi,  you had to apply for police certificates from non Uk countries then i assume? If so did you need a letter from the embassy to get them? also did they send them direct to the embassy?

You do not need to change a beneficiary's address. You do need to keep an updated petitioner's address or have it sent to an address in the USA that you trust.

 

 

Yes, but you cannot seem to change the petitioners address to an address outside the US either.....

Let me know how that goes, when i did it (to change my wife address to the UK) they said they couldn't do it, and to address this at NVC stage....
