Whats your PD?

I hear it takes 2 months just to get your number form the NVC, so i will start getting my stuff ready after transfer (depending where i get)

I see from the July forum that they are up to the 30th now, strangely apart from the people from early mid july that didn't get a transfer. Why do you think they missed some?

Do u guys think my k-3 may slow down my process ? I don't see why it would because they aren't conjoined yet so idk I'm worried

I dont see why not... I don't know much about the K3, my lawyer told me it was not available so I didn't persue it.

I will be mega happy when August transfers start...

That "blip" in the middle was the i-129F transfer for H1-B workers.

Thankfully that workload transfer wasn't permanent - it was a fraction of the grand total of i-129F petitions.

I am 100% confident we're gonna hit august before the week ends

Cool, well i hope your right, and i hope i get CSC!

psshhhhhh...

not really..

we'll have the first august approval on Thursday (or earlier)

You think... I would love to be proved wrong, but i think we will have to wait a week or two....

Assuming we take the current upper bound successful date of 07/29 as the start date, we've got the 30th and the 31st left.

We should see our first August approvals day-after.

I still think it will be a few weeks before August transfers start

MY PD is August 12th,2013.
I requested for expedite my  case on Nov 29th, 2013.
It's been 45 days now.
I called them to get an answer but they told me to wait 6 months for the decision.
I involve my congressman in this issue.
They told my congressman that they are checking my background. n update me soon.

So they r telling two different things to me and my congressman.

6 months from when you called in November or recently? When did they tell you this?

6 months seems to be the standard BS answer!

The first one of six months was october 16 when we first spoke six months which is april and teh second april everything seems to be april that is why i feel that april is when we will be approved even when i speak to uscis they pretty much estimated april late august -april is 8 months so 8 months

See thats strange that USCIS gave you an estimate, most people on here don't get one, they just get the usual "we are at Feb xx sir' #######, however i also got an estimate. Mine was end of March, but still i got an estimate. However the tier 2 i spoke to was mega nice and very helpful.

EastyoMaleUnited Kingdom2014-01-13 14:29:00
IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsAug 2013 I-130 filers

Good Afternoon,

My name is Festa Berisha- Mati I am 24 years old, I am a United  States Citizen who has lived in the  in the Bronx since 1992. I am originally from a small town of??. My family moved here in order to give us a better education and opportunities. After the war my parents made it a priority to go back home often in order to keep our culture alive within our daily lives.  After the war I went several times and fell in love with my child hood family friend and now husband Noli Mati. Noli has had a rough childhood his mother had died a week after he was born and his father passed a few years ago in Florida after a rough struggle of Lou Gehrig's disease. Noli has most of his family in Florida he is the only person left on his father?s side in Kosovo. He currently lives with his uncle, uncles wife there four kids , grandma  and invalid aunt in a one bedroom apartment in Gjakova.   Noli was sadly not eligible to enter the states at the time of his father?s illness/death. At the time I was a college student and was working part time and simply was unable to go back home. I kept in contact with him often. After I graduated ????????..and found a full time job at Jacobi ????????.. I decided I was stable enough to go back him and reconnect with Noli. When I went back home we instantly became inseparable and on August 17, 2013 we decided to get married. Even though we had a small ceremony with our close friends and family we were ecstatic and very happy. I wanted to make sure I could get him to states as soon as possible in order for us to begin our lives together.  When I came back to the United States on August 23, 2013 I immediately put in his paper work in on August 29, 2013. I sent out the I-130 along with all proper documentation.  I have heard several scenarios of how these cases take a long time and are aware of processing times however my fear is that the paper work will take much longer than expected and I will not be able to take time off to go back in addition to spending a lot more money which can be used to support us until he is able to find a job and is situated in the States. I would appreciate it if there is any way you and your team can help me in my situation. I just want to start my life with my husband and have him see the light at the end of the tunnel through these very difficult times he has encountered.

They replied after they called

Thank you for emailing me. I am truly honored to represent the people of the Bronx and Queens in Congress, and I appreciate knowing your thoughts on the issues confronting our nation.

In the coming weeks, you will receive a more detailed response from me specifically addressing the matters raised in your email. I do, however, appreciate your patience in the meantime, as I receive a large number of letters, phone calls and emails on a variety of issues every day. For this reason, I also only respond to the correspondence I receive from residents of the 14th District of New York. If you are not a constituent, I encourage you to contact the Member of Congress who represents your area.

Again, thank you for writing. Please feel free to visit my Web site at http://crowley.house.gov - where you can also sign up to receive my e-newsletters, which provide updates on my work on behalf of the people of New York.

They asked me to send a copy of my noa1, photo ID And fill out a form they emailed to me

Greetings,

Thank you for contacting Congressman Joseph Crowley?s Office with your immigration concern. Please see below for the response received to the inquiry made on your behalf to the National Benefit Center:

A review of our systems shows that Case MSC1391?.., Form I-130 filed by Festa Berisha Mati  on behalf of Noli Mati was received in our office on 08/29/2013 and is currently pending.  The estimated processing time for I-130 petitions is an additional six months from today?s date.  These delays are due to workload factors not related to your constituent?s case.  If your constituent does not receive a decision or other notice of action from USCIS by that date, please don?t hesitate to contact us again.

I will continue to follow-up on this matter in 6 months and notify you on any information pertaining to this matter received. If you have any questions or require additional information, please contact me at Congressman Crowley?s Bronx District Office at (718) 931-1400.

Sincerely,

My response a month later

Good Afternoon,

How are you? We spoke several weeks ago about my husband?s pending I -130 and you informed me about the inquiry which stated that its going to take an additional six months. I wanted to ask is there any way you can find out if a K-3 visa is obsolete I had sent one in as well on September 19, 2013 I-129 MSC13918?.. At the time when we spoke I had done research of the K-3 and it was mostly referred to as being obsolete so I did not pursue asking any further questions of it. Now that the National Benefits Center has declared longer i-130 approval times I am curious to know will my k-3 visa be processed quicker. I am planning a trip to visit my husband in January and it has become very difficult for me to take the time off from work and after January I plan on pursuing my Master?s degree so I will not be able to go during the semester this is why I wanted to ask you to find a definite answer. I am so sorry for contacting you once again I understand how busy you must be but a trip back home is costly and I feel puts my job at risk. If you please can make an addition inquiry of what the current state of my i-130 and i-129 I would really appreciate it.

Regards,
Festa Berisha Mati

Attached I sent everything she asked for originally and then a noa2 for my i-129f

Her response years later

Greetings,

Please see below for the response received regarding your I-129F petition, according to the National Benefits Center:

Case MSC13918?..6, Form I-129F filed by Festa Berisha Mati on behalf of Noli Mati was received in our office on 09/11/2013 and will be adjudicated along with the I-130.

I hope you find this information accurate and beneficial. I will continue to follow-up your petition April 2014. Please keep in mind, you may be contacted by the USCIS before this date. If that?s the case, please proceed with following their instructions.

Happy Holidays

They are stupido lol

i HOPE THIS VERYYYY PERSONAL INFORMATION HELPS YALL LOL

That's what USCIS told me.

6 more months? When did they say that? What is your PD? they can/should raise a request if you fall outside their advertised processing times

Can you post, without your details, a copy of the letter you sent? I think we will send one asap anyway. I guess we would send to the congressman in Iowa (where she "lives"). How do you send them a letter btw? sounds strange but i didn't think you could just write to them directly?

Ok so nine months from August is May ok guys if that is the case we need to make peace with that May isn?t too far away I am not happy about this either I swear the last thing I want to waste money going back and forth and not being with him permanently but as of right now if nine months it is than fine but if May comes and we still have nothing what then? Anything before May would make me ecstatic however these games they play with our heads is exhausting. About a week and a half ago we thought by now at least half of August  filers would be transferred and the reason why we are all upset is because we got our hopes up. I want to take action but with that said let?s put it out there and note that we shouldn?t get our hopes up until august filers are transferred and even than to skeptical look at July not all of them have been transferred.  Come the second week of April if we are not approved I am writing my congressmen yet again. But as of right now nothing is happening???..and your right my husband compares others situations with ours. Back home a phone call can easily clear up messes like this and its hard to explain to them that in this great old nation we don?t work so simply.

When did you write to your congressman? What did he say?

Plenty of things have moved, there is no denying that. The problem is though, why are they approving July filers when there are still April, May and June filers waiting to see approvals?

They are trying to improve their processing times. It worries me that they are approving July when there are still so many waiting from previous months.

Once they get their numbers to where they want them to be, they will stop approving July and got back to the front of the line. What does that say for Aug filers?

Exactly, its called a number fudge...... and it will make them look good, but screw us.... its the only way to explain so many July approvals while so many may/june are still pending. However, if they are at the end of April, and from what i see thats about right bar a few, its (only) 4 months until our month, and will July well underway perhaps this wont make to much of a difference... .anyway you slice it, its 9 months i bet, no more... but no less..

EastyoMaleUnited Kingdom2014-01-13 12:31:00
IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsAug 2013 I-130 filers

I have participated in the last 2 letters that were sent. The first got a resppnse. Date of filling was changed from October 2012 to 12 Feb 2013 and they gave a 7.5 (??) month processing time and a letter stating their goal of reaching the 5 month processing time by May 2014.

Next update, processing date was change to 13 Feb 2013 and processing time to 8.4 months. A joke and an insult to all filers!

Honestly, even with another letter, nothing will be achieved. Im sorry if I sound bitter, but I am, because no matter what was tried by members here on VJ, technically it didn't work.

That doesnt mean that if another letter is sent out i won't participate. I just won't expect anything to come of it. And here i thought Greek bureaucracy was bad!!!!

We could always try? Just to "remind" them that we are watching........ but lets see what they say this week (hopefully). To be honest if it is past mid April I will be surprised!

We are definetely stuck in a backroom, but not in Alaska.. the bottomless black pit our files have been thrown down in, is Overland Park in Kansas or maybe even Lee's Summit.

Little trolls are still working their way down to where the Aug files have landed and then they need to work their way up with them. I think they need a month for our files to see the light of day again!!!!

I agree, we are all just hitting 5 months, so with a few delays (christmas, new year, i129F etc) i would say early Feb for a transfer or action....

Do you guys want to write a letter or something if we dont see anything happen soon? Like we should see what happens after the next updated date if miracles dont happen maybe we should take action again? Did u see that thread about the petition that has been pending since january 2013 ? thats crazy ....

Im up for that, but as you said, lets see the new updates. I would be surprised if we had to wait more than 9 months. But that is a long time, almost twice the "target".

It is painfully obvious they are doing June/July to fudge the figures though, which does not bode well for us!

You mean... they started adjudicating ??

Na ah

They send out receipt notices because they are a satellite office of NBC (to do the clerical work pre-transfer).
Thats all they are.

They were supposed to have trained adjudicators or something by sep of last year.

No go.

Crazy! I wonder the backlash if they miss the may 5 months?

Also it is very obvious that they are on July to bring the average time down, that's why you are seeing so much
movement for July. This means they need to then go back, do the others, then start August.

So we will suffer I think

They were supposed to hire more people since april 2013 to staff Division 8 at Overland Park, that was supposed to be operational at the end of Sep 2013. That didn't happen.. and it isnt likely to happen..

Im leaving in a week and a half to visit my husband in the US for 12 days. I will probably come back and still be waiting to see a transfer!!

How do we know Overland Park is not running? I thought they started, slowly, but started?

EastyoMaleUnited Kingdom2014-01-11 14:21:00
IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsAug 2013 I-130 filers

USCIS updated their processing times for i130-U.S. citizen filing for a spouse, parent, or child under 21

Texas Service Center- May 2, 2013

California Service Center- June 2, 2013

Nebraska Service Center- April 5, 2013

Vermont Service Center- April 5, 2013

National Benefit Center-  April 5, 2013..

At least we are seeing a) some good movement, well on TSC and CSC, and b) a realistic perhaps honest? update!

This should mean (remember that July/August has a lower number of petitions) that;

TSC is at late June early July

CSC late July early August

The rest - late may early June

Of course, there are always some that are missed, but we have to work with the info we are given

Did USCIS slow down transfers last month when they did an update? As someone has used their shared computer to do this today, I hope it doesn't stop the transfers!

that means there will be a bombard of transfers and approvals for the next few days yay!

Why do you think that? I hope you are right!

I have filed through immigration attorney (filed on 8/12, transferred to TSC on 2/7 still waiting for approval). Can I still follow-up with NVC for a case number ?

er... no. You need an approved i130 and for USCIS to send this to the NVC, currently to the NVC, you don't even exist

I`m like that too... ,I try to keep myself busy with eating clean working out and reading books since i do not have a job,I managed to lose 70 pounds ,at first i just wanted to lose the first 20 pounds i gained in the US lol ,but it kept me a bit busy so i kept on going .

I`m so very happy my Husband will come visit me in 3 days only for a week but better than nothing,he will come just in time, this past week i sleep very little and my hair is falling and i keep checking for updates all the time and i have this thing where no piece of paper is safe from me lol i keep making these paper worms/Snack thingies ...no idea why, even in days i know nothing will happen i keep checking ...

My Husband cannot handle this very well he gets very upset that`s why i took over checking VJ,Just last night i was looking for the Average time from NVC to interview date for Morocco, and found out it was 4-5 month and when i told him he got very upset and angry,we both thought this entire thing would take 7 month ow naive of us sad.png

He has far more things to keep him busy his Thesis, work, Reviewing books and articles plus our two dogs ,oh how i miss my dogs ! 8 months last time i saw them,i do see them in Skype everynight but i miss them like anything, and in those couple of month in the US i made many friends,Jamie`s family did not want me to go ,and when we explained why i could not stay they just could not understand it...but anyways ,yes keep yourself busy with other things .

Going to go do some shopping for my Love ! that should keep me busy for today lol

Izzy.

Hey, keep your head up, it will all be over soon and you will be with him!

Also, how did you check the average times from NOA2 to interview for your embassy?

I can relate to that completely.  I grew up with a father who was in the military for 22 years and was gone constantly.  My mother would not see my dad for a year or more at a time and its true what you say.......no internet, cell phones, etc.  All they had was an occasional expensive long distance phone calls, lots of letters, some photographs, and if we were really lucky and dad was in the USA he might get a weekend or 30 day leave to come home.

My parents loved each other very much and stuck it out together through all the separations and hardships. Often times we lived near bases were my mom had no family close by and never knew if my dad was going to come back home in a body bag.  They died 3 years apart.  My mother was heartbroken when my father died and felt she belong in the grave beside him.  Though cancer is what took both my parents lives I really believe my mother's heartbreak contributed to her death.  If they were still alive they would be have celebrated their 50th wedding anniversary.

We are really lucky to have internet these days to at least see our love ones daily in most cases but still the separation is hard.  Some days we can be positive but there are times it takes a toll on our emotions.  I guess the point I am trying to get at is that if the relationship is strong and the love is there we can all make it through this time of waiting.

I sincerely hope and wish for many, many transfers and approvals today for all who are still waiting.........remember to check your status late in the evening.  I got my transfer late in the day and approval even later in the night.  Hang in there everyone!!!!

Well said all. I think these USCIS games make it worse, especially when we see people approved/transferred ahead of us...

It is silent as it is currently 5.25am pacific time, and yesterday was a holiday. Hopefully they will do some transfers today, however these show late in the day/over night.

Dont worry, there will be transfers this week at some point...
