Why did they put the kibosh on transfers ? This is all proving kaylaras theory about fake 6-month processing time. Such bullshit


 

 

Its the only real explanation, it fudges times, but screws them as they will just get a load of service requests...

Brill - thank you for this! Lawyer hasn't emailed back yet, and the wife has sent another email in asking for a call between 8 and 10 our time tonight. We shall see where it leads! 

 

Our lawyer is the exact same, takes AGES to get a reply. To be fair the website gives you loads of detail on how to do it, it seems really easy! most don't use a lawyer so we will send one anyway as we don't have to withdraw and see if it gets accepted. I see someone on VJ got their visa in 3 months through DCF, although a few take longer.... guess you have to be flexible and have all the docs ready

We've been here for seven years with me on a ILR, so number one isn't a worry. wink.png

 

Just shot them an email now. In the past, we've had to chase them like hounds for a reply, but I might be making an overseas phone call tomorrow if I don't hear back. I'll let you know as soon as I do! 

 

Hi TJsMomSarah, I got an email back from the embassy today, i asked about filing a petition and the risks of withdraw of my previous one, he said...

 

You can submit the I-130 FIRST with a copy of the cover letter and then I can send you an email to confirm that we would accept it before you would need to send the letter to withdraw.

 

SO basically, send another petition with a copy of your withdrawl,  BUT DONT SENT IT, then if he emails to say he will accept it bingo your good...

They usually reply same or next day

Before I sent my I-130 petition off to USCIS,  my sister-in-law gave me an attorney's number to call and talk to that she recommended.   He told me the reality is at least 1 year and if your spouse is from an Islamic country be prepared to wait for 2 years.

 

Wow really? When did they say that? about 4-5 months ago i130 in 1 year was probably true..... (not sure about the islamic part), i would be suprised if it took that long now as June/July filers are getting approved.

Or, conversely, they could just process a whole bunch of newer applications very quickly and bring that average processing time way down without actually touching the bulk of the backlog.  
 
Because the key word there is "average" processing time. 
 
It blows, but we suspect that they're going to do this, or have been working on doing it already. Hence the crazily out of order processing. 




Oh for sure that is what they are doing! I think it's letter time!

Thing is, surely they are making a rod for their own back? If they bring down processing times, surely
this just opens up a load of service requests and letters from congressmen? Sure this would make them
look worse.....

However I can't think of any other reason to why they are approving July and leaving April/May/June? Unless they are going to finish April/May/June across TSC & NSC in 60 days and just threw a few through CSC mega quickly?
It doesn't explain the transfers through.

I would love to know where they really are.... From what I read, Texas = May CSC = June (plus the strange July approvals) and Nebraska = April....

Well, supposedly transfers happen at 6 months.
So you and I are well within that stipulation.
 
 
Given USCIS' goal of reducing the backlog by May to 5 months - faster transfers (which we did see for july) - give us all the more reason to think it WONT BE 9 MONTHS FOR THE WHOLE SHEBANG.  That is what we expect for April.

For me, this forum gives me more comfort than vexation - mostly because you know what to expect - and to make some noise if this agency does not keep up to its goals.

How did you know transfers are 6 months? I thought most of July was 5 ish?
Regardless, it will be early feb when the transfers start, and I agree with you, they must be
approving us by April if they have a hope in hell of reaching 5 months by May!

According to my lawyer friends, USCIS is supposedly the worst of all government agencies (true story).
 
Just to give you a comparison, compared to the UKBA, it is 100 times worse. For real. 




To be fair I found UKBA to be ok, not great, but ok. It just seems no one is responsible for their performance!!

I'm wondering if this forum is also making me more anxious about my i130, I'm only 4.7 months in and all this talk of
Transfers gets us all excited.

My lawyer told me 9 months, which is just sooooo poor!!

From everything I've checked out today, we check all the boxes for a DCF. I'm US citizen, she's UK citizen, we married in the USA 7 years ago. I moved over to the UK a month after that on a spousal visa. Been living here, gainfully employed, have a 3yo son (dual citizen). No police issues, no health issues, no previously denied visas (she had a student visa for a year, ended when course did), enough money to support ourselves. 
 
The DCF looks pretty straightforward as well. We certainly won't be laying down any more cash to get the lawyers to sort it out if that's the route we take. 



Exactly! Still speak to your lawyer though, the rub is you need to withdraw your previous petition (after 5 months!) so
You take a risk, but you can mail USCIS London and ask them to confirm.

I'm not sure how bad withdrawing an i130 then refilling is?

Wife called the attorneys. She asked to speak with our lawyer directly, he wasn't available. (No surprise.) Asked to speak with our case manager. She was there, but didn't want to talk to us as the lawyer was going to respond to our email directly. 

 

I don't want to read too much into this, but it's giving off the impression that things aren't as straightforward as a "We did it because of X." reason if the case worker is passing the buck back to the lawyer. 

 

Im not sure on your background, so i cant judge your case, but i don't see why you cant DCF, as long as you meet the criteria....

 

.... From what i see, many people don't use lawyers for DCF in London.....

Not that i see, i think we are still waiting for a few July....


 

Bear in mind that data was from the end of October, when they hadn't really ramped up the transfers. March transfers started in earnest around the third week of October, so we should have a very different chart for the November update.

 

 

Ah, good point, when do they get updated? same as the main "goal"

We won't do anything rash quite yet. We've asked the lawyers to explain why they didn't do a DCF and went with a US Service Center. Unless they've got some crazy good reason, and the PD date doesn't move much, we'll pull it. I think in this current path we're looking at more than 'weeks to a few months' for the approval. 

 

If you look on the US London consulate site, there is a 3 week wait for i130 processing.... but yes, the entire timeline is also better

True, but it all depends on what USCIS post as their "update". I don't think we will see any improvements, and i bet the PD date is only a few weeks after Feb 13th...

 

Some with the transfers, they do some and we all go YAY, and say we are next, but we just don't know ,thats the killer!

I get the same response time from my lawyers, funnily enough, if you email the department
in London, you get a response in around 2-3 hours! And they are mega helpful!

It's just having the balls to cancel a petition 5 months in to the process.... We can't file here until March, so that will
be 7 months in, which is even more risk...

Also you don't wait for the NVC, people on this forum often get visa's
in 3 to 4 months from the start to finish!

This is the trouble, 

 

1) The US citizen needs to be granted entry to remain and have been in the UK for 6 months.

 

and 2.. perhaps the most annoying...

 

2) You have to FIRST CANCEL your i130 you currently have, BEFORE they accept your petition in the UK, so there is risk...

 

But let me know what your lawyers say!

Yes, both in the UK. Not sure why not - we're using lawyers based in California and they've handled it all for us. 

 

DCF in London takes around 1 month for i130 approval, and NO NVC!

That's bit weird. We've used our UK address as the primary one. I think they did ask for my last US-based address, but not as the one that they advise to change if you move. :-/

 

So you are both in the UK? How come you didn't go DCF through London?

Question, when i called to change my spouses address from the US to the UK a tier 2 told me they could not do this as it is a foreign address. However how can this be right, we both live in the UK and didn't put our UK address as we were in transit from Hong Kong and didn't have it sorted, so i used my parents and she used hr parents in the US.

 

Form what i hear its better if we both live outside of the US, so why cant they change her address. They tell me it is only "revenant" or "applicable" at the NVC stage... How can this be true?

At this point, I would just be glad to see July transfer closed AND all of july filers transferred.

I get more pissed about sasuhol and stvmjames not getting transferred, than I am happy about the rest moving faster than expected. 

 

Between when July filers that were transferred and now, they have ignored at least 200 expected transfers

 

Exactly, i am just not sure what they are doing? It can only be that they are taking batches to reduce the "average time" for processing. Which is just plain wrong! I cant understand why else they would do this!

For those who have already wrote to their senators / congressmen, did you talk to your lawyers before sending it off, or did you just do it on your own? 

 

I'm going to start drafting a letter for mine, to send next month if no joy in the next four weeks. Just unsure if to 'run' it by the lawyers first. 

 

Also - can someone point me to a list of docs they will want so I can include it in the original letter?

On the July forum, at least 4 or 5 today have posted they have transfers. Ok so its a small sample, but at least USCIS is doing some!

Emails, faxes, and phone calls. I think that we'll need to organize it over in the I130 Green Card Petitioners Committee thread. I think we also need to update our blog to show what we've done, what the response was, and all relevant information. (This way we can point people to it if they are interested in finding out more information and want to help.)  As the new numbers should be coming out this week, I think that we should wait until that information is published, and then respond accordingly.

 

Kaylara, how long do you think your next stage is going to take you? did you get an indications from anyone?

I did not use a lawyer I dont think I need one ....but i asked around everyone said lawyers included it wouldnt hurt but wont necessarily do much

Every application is unique.

 

There are times when background check and clerical paperwork for certain individuals might be delayed for one or many of the following reasons

 - background search 

 - country of origin 

 - aliases

 

They are like sharks - they find something about you or your application that doesn't add up - they'll hold up the rest of the process.

 

And not tell you what's wrong. 

 

 

 

Or they're bureaucrats and in a mad rush to make themselves look good, they ignored some people and left their files unattended in a backroom in Lee's Summit or OPark

 

 

I heard that, but i am talking about simple transfers, surely they do not know any issues at this stage?....

 

..... i also heard they can be quite "funny" with checks depending on country, i was told as i was from a "low risk" country i would not raise "additional flags", whatever that means....

I hear it takes 2 months just to get your number form the NVC, so i will start getting my stuff ready after transfer (depending where i get)

 

 

I see from the July forum that they are up to the 30th now, strangely apart from the people from early mid july that didn't get a transfer. Why do you think they missed some?
